The complaint does not arise in connection with the operation of any U.S. government intelligence activity, and the alleged misconduct does not involve any member of the intelligence community. Rather, the complaint arises out of a confidential diplomatic communication between the President and a foreign leader that the intelligence-community complainant received secondhand.So, sure... it makes sense that a whistle blowing complaint is derived from within the organization that you work for. That is what makes it a whistle blowing complaint. You are complaining about something within your own company or organization. You are also complaining about something that you have first hand knowledge of and can prove.
The alleged misconduct is not an “urgent concern” within the meaning of the statute because it does not concern “the funding, administration, or operation of an intelligence activity” under the authority of the DNI. Id. § 3033(k)(5)(G)(i). That phrase includes matters relating to intelligence activities subject to the DNI’s supervision, but it does not include allegations of wrongdoing arising outside of any intelligence activity or outside the intelligence community itself.In other words, you are not a whistle blower if you are complaining about something that happened outside of your organization. Then you are simply a complainer (especially if you have no real proof). In the case of reporting something that you believe might be a crime, well the idea then (as most school children would understand) is to go the authorities.
Accordingly, should the DNI or the ICIG receive a credible complaint of alleged criminal conduct that does not involve an “urgent concern,” the appropriate action is to refer the matter to the Department of Justice, rather than to report to the intelligence committees under section 3033(k)(5).So, there was never any solid legal grounds for the IG to even report the matter as an urgent concern or go to the DNI with a complaint under the pretense that if involved the statute 3033. The IG is either incompetent, partisan, or was rolling over due to some political pressure from the rest of the partisans in the intelligence community.
The problem is that everyone with an IQ over room temperature understands that what the President did would not be seen by the Department of Justice as anything close to criminal. There isn't a criminal case to be made without a vivid imagination and a huge suspension of disbelief.

A former Defense Intelligence Agency officer who spied for China worked secretly as a Beijing agent for five years and revealed in an intercepted phone call he was motivated in part by hatred for President Trump.
Ron Rockwell Hansen, a DIA operations officer until 2006, was arrested June 5 and pleaded guilty on Friday in Utah to attempting to sell national defense secrets to China. He faces 15 years in prison under a plea deal. Sentencing is set for Sept. 24.
Court documents in the case reveal Hansen was motivated by both money and an affinity for China. In seeking to recruit a DIA coworker as a fellow Chinese spy, he voiced fears that Trump would start a war and said that was a reason to cooperate secretly with several Chinese intelligence agencies or branches in providing information and trying to penetrate U.S. defense and intelligence agencies to obtain secrets.
Hansen admitted in the plea agreement he met frequently with Chinese intelligence agents beginning in early 2014.
"During those meetings, the agents described to me the type of information that would interest Chinese
Intelligence," Hansen stated in the pleading. "During the course of my relationship with Chinese intelligence, I
received hundreds of thousands of dollars in compensation for information I provided them, including information I gathered at various industry conferences."

The meeting will take place on the condition that acting Director of National Intelligence Joseph Maguire approves appropriate security clearances for the individual's legal counsel so that they can accompany their client, the correspondence showed.
House Intelligence Committee Chairman Rep. Adam Schiff wrote a letter to Maguire making the request Wednesday after the whistleblower's lawyers agreed to meet with lawmakers if that condition is met and requested assistance in expediting approval from the acting DNI.
CNN reported Tuesday that the whistleblower's legal counsel "wrote to the Acting Director of National Intelligence to request specific guidance as to the appropriate security practices to permit a meeting, if needed, with the Members of the Intelligence Oversight Committees."

A White House official on Wednesday accidentally sent talking points for allies defending the president to Democratic officials, then tried to “recall” the memo.
In the email, the White House laid out guidance for how supporters should publicly discuss President Trump’s July phone call with Volodymyr Zelensky, the president of Ukraine. An allegation that Mr. Trump tried to use that conversation for political gain contributed to the decision by House Democrats to announce a formal impeachment inquiry on Tuesday.
But the White House list of concise points and counterpoints was also sent to the offices of Speaker Nancy Pelosi and other Democratic lawmakers.

The email, sent by Tori Q. Symonds, a White House communications staff member, argued that there were “myths” being spread by Democrats about the phone call, which had “triggered a media frenzy of false accusations.”
It portrays the conversation between the two leaders as “entirely proper” and the handling of a related whistle-blower complaint about the call as being “absolutely by the book.” The email also made reference to the “Deep State,” a phrase that has fueled conspiracy theories of government bureaucrats working to undermine President Trump. Sharing such messaging guidance with allies is common among both parties in Washington.

Shortly after the memo went out, a follow-up message from Ms. Symonds’s account stated that she would “like to recall” the previous email. Such messages are often sent by Microsoft Outlook when an individual who uses the program seeks to revoke an email from a recipient who is not an Outlook user.
The misfire came as the White House scrambled to coordinate responses to Democrats who the day before had announced a formal impeachment inquiry. Democratic Party leaders have accused the president of betraying his oath of office in seeking Mr. Zelensky’s help in targeting former Vice President Joseph R. Biden Jr., a leading contender for the Democratic presidential nomination.
On Wednesday, the White House released a reconstructed transcript of the call between the two men and invited a dozen or so top Republican lawmakers, including Representatives Kevin McCarthy, Steve Scalise and Liz Cheney, to review the document in advance and pose questions, officials familiar with the meeting said. At one point, Mr. Trump dialed into the meeting from the United Nations.
“The House Democrats have been careening from impeachment theory to impeachment theory, they’ve careened from target to target,” Ms. Cheney said on Wednesday. She accused Ms. Pelosi of “trying to weaken the president, trying to weaken his hand as he’s dealing with crucial issues of national security.”
