“Under the current circumstances, we do not intend to participate in your Wednesday hearing,” White House Counsel Pat Cipollone wrote in a letter to Judiciary Committee Chairman Jerrold Nadler (D-N.Y.), adding that “an invitation to an academic discussion with law professors does not begin to provide the president with any semblance of a fair process."
Nadler has yet to identify any witnesses, but Rep. Doug Collins, the top Republican on the committee, has requested that the witness panel include an equal number of Democratic- and GOP-selected scholars.
This is a failure of the Judiciary Committee to be able to talk to fact witnesses, to be able to talk to the people that have actually been a part of this, and actually have the president viably participate in his own defense — which he’s not had the opportunity to do now,” the Georgia Republican said on “Fox News Sunday."
“It is too late to cure the profound procedural deficiencies that have tainted this entire inquiry,” Cipollone wrote Sunday, adding: “We cannot fairly be expected to participate in a hearing while the witnesses are yet to be named and while it remains unclear whether the Judiciary Committee will afford the president a fair process through additional hearings.”
So basically, the idea here is for the Democrats to provide a whole slew of law professors who will testify to their personal foregone conclusion that the President committed impeachable offenses. They will allow the GOP to call ONE witness in response, and would not be allowing the President to call ANY witnesses. The GOP will be allowed to cross examine the Democratic witnesses, but all their questions must be pre-approved by the Democrats.
They have not determined what sort of questions that the President and his team could ask (if any), nor have they provided any sort of witness list for anyone to see. They simply are playing a public political tactic where they pretend to "invite" the President to take part, without actually allowing him to actually take part.
This is nothing more than a last ditch desperate hail Mary attempt to gain some traction. At the very least, they are addressing the actual problem point of their futile argument. Which, of course, that the President's phone call was perfectly "legal" under the current Congressional laws regarding foreign financial aide.
But they actually "failed" for the most part to "prove" their allegations. Only 39% of Independents and 15% of Republicans believe that the President purposely withheld military aid in a firm connection to investigating the Bidens (that is according to the most recent YouGov poll). Many still remain "uncertain" in spite of all the witnesses testimony and wall to wall media coverage.
Either way, about the same percentage of Independents (38%) and Republicans (14%) believe that these are impeachable offenses even if they are proven. The problem is that I am not sure that this is really "up for grabs" and I doubt very seriously that a slew of anti-Trump law professors will be any more able to convince many (if any) people, than the droves of media legal experts that have already stepped up on this one.
