USSC to hear Trump cases on Tax Returns and Financial records...

Supreme Court to decide whether Trump’s tax returns must be released to House
The Supreme Court said Friday it will hear President Trump’s appeal and decide whether the Constitution shields his tax returns and business records from being released to House Democrats and New York prosecutors. The court’s action sets the stage for a politically-charged decision next year, just as Trump campaigns for reelection.
If the justices uphold the congressional subpoenas, Trump’s tax returns and other financial records could be turned over by the summer. However, if the high court rules for Trump, he could continue his reelection campaign without having to disclose private financial details that most other presidential aspirants have, including the amount and sources of his income, taxes he has paid and business dealings of the Trump Organization.

This is bad news for Democrats (and others) who were hoping to force the President to hand over his tax returns and other financial records. The problem here is that much of this is a fishing exhibition. In most cases there isn't anything "specific" that anyone appears to be looking for. But rather they just want to have a look see to make determination if there is something there that could be considered embarrassing or a political liability. (If Trump was actually breaking the law, the IRS, the SEC, or many other organizations would have likely uncovered it by now).

This most certainly puts a hold on things till at least this summer, and possibly longer. Oh, and there is likely a better than average chance that the USSC will side with the President here.

I will say that the New York Prosecutor portion of this case comes as somewhat of a surprise. Not because I have any sort of expertise on this subject, but rather because some of the more neutral legal pundits that I follow believed that New York would likely avoid this going to the USSC as they are arguing that this is a "State" rather than "Federal" issue. But I suppose there is always an argument that if a State has laws in place that would be considered unconstitutional at a Federal level, then those laws would be unconstitutional in general.

Either way, the entire concept of Trump's financial records being released is now on hold. Or at least until some Obama District Judge ignores the USSC and demands that they be turned over in spite of the USSC stay.

(AP) — The Supreme Court said Friday it will hear President Donald Trump's pleas to keep his tax, bank and financial records private, a major confrontation between the president and Congress that also could affect the 2020 presidential campaign.

Arguments will take place in late March, and the justices are poised to issue decisions in June as Trump is campaigning for a second term. Rulings against the president could result in the quick release of personal financial information that Trump has sought strenuously to keep private. The court also will decide whether the Manhattan district attorney can obtain eight years of Trump's tax returns as part of an ongoing criminal investigation.

The subpoenas are separate from the ongoing impeachment proceedings against Trump, headed for a vote in the full House next week. Indeed, it's almost certain the court won't hear the cases until after a Senate trial over whether to remove Trump has ended.

Trump sued to prevent banks and accounting firms from complying with subpoenas for his records from three committees of the House of Representatives and Manhattan District Attorney Cyrus Vance Jr.

In three separate cases, he has so far lost at every step, but the records have not been turned over pending a final court ruling. Now it will be up to a court that includes two Trump appointees, Justices Neil Gorsuch and Brett Kavanaugh, to decide in a case with significant implications reagrding a president's power to refuse a formal request from Congress.

Trump attorney Jay Sekulow released a statement saying: “We are pleased that the Supreme Court granted review of the President’s three pending cases. These cases raise significant constitutional issues. We look forward to presenting our written and oral arguments.“

In two earlier cases over presidential power, the justices acted unanimously in requiring President Richard Nixon to turn over White House tapes to the Watergate special prosecutor and in allowing a sexual harassment lawsuit against President Bill Clinton to go forward. In those cases, three Nixon appointees and two Clinton appointees, respectively, voted against the president who chose them for the high court.


Personally I don't think that this will go well for the President. Ptecidnt suggests that the President will not win this decision.

Last week, the impeachment of President Donald Trump was still largely an exercise in sober testimony contrasted with partisan theatrics whose terms had yet to be defined precisely. The Los Angeles Times Editorial Board, which had previously expressed support for an inquiry but not yet articles of impeachment, abandoned its judicious position of “wait and see” and declared it was persuaded enough by the evidence to support making Trump the third president in history to be impeached by the House.

Finally, we continue to believe that the House should consider an article of impeachment addressing the actions Trump took to thwart or hobble special counsel Robert S. Mueller III’s investigation. Mueller did not conclude that Trump committed obstruction of justice, but neither did he exonerate the president. Atty. Gen. William Barr and then-Deputy Atty. Gen. Rod Rosenstein subsequently concluded that the evidence developed by Mueller was “not sufficient to establish that the president committed an obstruction-of-justice offense.” But in deciding whether Trump’s attempted interference amounted to an impeachable offense, Congress could well come to a different conclusion. And the allegation that Trump obstructed justice in the Mueller investigation involves the same sort of disrespect for legal norms as his defiant actions toward Congress’ inquiry into the Ukraine matter.

Trump’s defenders argue that the evidence against him on Ukraine is incomplete and thus inconclusive. They’re correct that some potentially important witnesses — including acting Chief of Staff Mick Mulvaney, who reportedly put the hold on the Ukrainian aid, and former national security advisor John Bolton, who reportedly objected to the efforts to persuade Ukraine to conduct the investigations — haven’t testified. But that is because Trump has objected to such testimony. Delaying impeachment because of no-show witnesses would reward Trump’s obstructionism.

Besides, as the president himself tweeted on Thursday: “If you are going to impeach me, do it now, fast, so we can have a fair trial in the Senate, and so that our country can get back to business.”

Holding the president accountable for gross abuse of power is the business of Congress. The House should get on with that business by writing articles of impeachment that make it clear to the Senate — and the American people — why the extraordinary remedy of impeachment is necessary. And Republicans who complain that the process is partisan could easily rectify that situation by abandoning their lockstep loyalty to Trump and looking at the facts.

FBI agents who investigated the Trump campaign’s possible ties to Russia did not know at the time that dossier author Christopher Steele was working for a Russian oligarch.

FBI and Justice Department officials told the DOJ inspector general that the information was significant to Crossfire Hurricane, the name of the Trump-Russia probe.

Steele worked for lawyers for Oleg Deripaska, a billionaire aluminum magnate.
Stuart Evans, a DOJ attorney, told the IG that government officials would have “wanted to dive into” the Steele-Deripaska links had they known about it during the investigation.

The FBI’s Crossfire Hurricane team turned over every rock to find out whether members of the Trump campaign were working with Russians in 2016, but failed to discover that Christopher Steele, the FBI’s primary source for claims of a Trump-Russia conspiracy, was himself working for a Russian oligarch, according to the Justice Department inspector general’s report.

The cost of imports from China fell again and they've declined 1.7% in the past year. These price changes don't reflect U.S. tariffs that are applied at ports of entry.

The small decline indicates Chinese suppliers haven't cut prices very much in response to U.S. sanctions.
