It’s all over but the shouting, and perhaps one last bit of red tape. Within the last hour, the DC Circuit Court of Appeals issued a writ of mandamus ordering Judge Emmet Sullivan to dismiss the charges against Michael Flynn. The vote broke 2-1 on the order, which might have come as a surprise after the arguments two weeks ago in court over the Department of Justice motion to dismiss.
I have to admit that like most everyone else, I was a bit surprised by the ruling. Not because I ever thought that Sullivan would be able to prosecute Flynn on his own, but that it appeared that the Appeals court was not really wanting to rule one way or the other, when technically Sullivan hadn't issued his own ruling.
Of course, that sort of just prolongs the issue. If the appeals court ultimately agreed with the Flynn/DOJ argument that the decision to drop the charges was outside the authority and jurisdiction of the Judge, then why wait until you got the ruling from Sullivan. I believe ultimately this is what eventually happened and why the ruling was made.
The dissent is interesting in that it challenges the Appeals court's authority to issue the ruling, stating that it had never made such an order before. Of course, there had never been a district judge who decided to hold another trial in lieu of the first one being dismissed.
At the end of the day, judges and justices are already wanting to be legislators. We don't need them to be prosecutors as well.

PROVIDENCE, R.I. (WPRI) — Gov. Gina Raimondo signed an executive order Monday afternoon to remove the phrase “Providence Plantations” from all gubernatorial orders and citations, executive agency websites, official correspondence and state employee pay stubs.
“Our work to dismantle systemic racism in Rhode Island did not start today and it will not end today, but we can rise together and make meaningful progress toward racial equity now,” Raimondo said.
The state’s official name, “The State of Rhode Island and Providence Plantations,” was established when it declared statehood in 1790. There’s been a renewed push by lawmakers and activists to remove the phrase from the state’s legal name, which they argue evokes the legacy of slavery.
“Rhode Island was founded on the principles of acceptance and tolerance, and our state’s name, and actions, should reflect those values,” Raimondo said. “The steps I am announcing today are just the beginning, and I am fully committed to continuing to work alongside the community in stamping out individual and institutional racism in our state.”
Changing the state’s full name, however, would require a constitutional amendment. Raimondo said she’s supportive of lawmakers’ efforts to ensure a referendum goes before voters in November.

Joe Concha, a media reporter for The Hill, told Steve Doocy on “Fox & Friends” that Biden does not appear to be up to the task of holding the kind of press conference President Trump routinely holds.
“A lot of Democrats will tell you, at least privately, that he does not have the mental acuity that he even had a couple of years ago and this is a candidate that simply would not able to withstand the type of press conferences that the current president has, as far as them going on for an hour, an hour and a half, taking questions with multiple outlets with no ground rules attached,” Concha said.
Biden hasn’t held a press conference in nearly three months. The Democratic nominee instead occasionally sits for interviews with left-leaning news organizations, often setting ground rules first.
“It’s a lot easier … to have, say, a handpicked interview, where you have ground rules for interviews, with certain outlets that may be friendly to your candidate, as opposed to having a press conference, which Mr. Biden has not done for 80 days,” Concha said.
Biden’s campaign on Monday made a show of announcing that Biden is prepared to appear with Trump for a series of presidential debates, which don’t begin until Sept. 29. In a letter to the Commission on Presidential Debates, Biden campaign manager Jen O’Malley Dillon said he’s ready.
“While I know no formal debate invitation will be issued to Joe Biden or Donald Trump until after the Party Conventions and the CPD’s invitation process, I wanted to set forth our views on how the Commission should proceed with planning for the fall debates,” Dillon wrote, according to Fox News.
Trump campaign chairman Brad Parscale and Trump attorney Rudy Giuliani, meanwhile, are pushing for the commission to set up more debates that start earlier, Fox reported.
Last week, Zogby International conducted a survey of 1,007 “likely voters” in which 55% said they think the former vice president, 77, “is in the early stages of dementia.”
“Overall, subgroups who normally approve of Trump’s job as president, were the most likely to believe Biden could be suffering from dementia,” the poll found. “Thus, majorities of Republicans (77% more likely/23% less likely) and Independents (56% more likely/44% less likely) thought Joe Biden had early-onset dementia; while nearly a third of Democrats (32% more likely/68% less likely) thought this was the case.”
Trump has blasted Biden – who he calls “Sleepy Joe” – over his repeated verbal stumbles and memory lapses, calling him an old man who should be put in a retirement home.
“They are going to put him in a home and other people are going to be running the country,” Trump said in early March during a rally in Charlotte, North Carolina. “Sleepy Joe,” Trump added, “he doesn’t even know where he is or what he’s doing or what office he’s running for. Honestly, I don’t think he knows what office he’s running for.”

Strzok's notes just came out (Friday?) and also raise the continuing question of why these exculpatory findings keep dripping out. They were supposed to be turned over years ago. It also raises questions of Strzok's previous testimony. And Biden.

GOP governors have faced enormous media pressure to lock down their states in solidarity with Democrats, and some now are getting browbeaten to shut down again amid coronavirus flare-ups. So it’s worth pointing out that states that didn’t lock down this spring kept the virus under control and experienced fewer deaths than most that did.
A new analysis by The Sentinel, a Kansas nonprofit, compares the 42 states that shut down most of their economies with the eight that did not. The latter group includes mostly rural states with some small metropolitan areas: North and South Dakota, Nebraska, Iowa, Arkansas, Oklahoma, Wyoming and Utah. Private employment on average fell by 7.8% between May 2019 and May 2020 in these states while plunging 13.2% in the others.
Rural state economies generally rely more on “essential” services like agriculture and food production, and some industries like energy and hospitality would have shed jobs regardless of the lockdowns. Still, private job losses were higher in states that locked down like Colorado (9.5%) compared to economically similar ones that didn’t like Utah (4.6%).
Yet per-capita Covid fatalities in states that stayed open were on average about 75% lower than those that locked down. One reason is that deaths in most states, regardless of whether they locked down, have been concentrated in nursing home facilities and minority communities that have higher rates of underlying health conditions and multigenerational housing.
This is a main reason hospitalizations and deaths continued to surge in states like New York, New Jersey, Illinois and Massachusetts long after lockdowns took effect. About half of deaths in New Jersey and Illinois have been in nursing homes, and most others have been in dense low-income minority neighborhoods where social distancing is difficult.
Deploying more tests and protective equipment can help shield these vulnerable communities, and citizens can do their part by donning face masks in public indoor locations like supermarkets. But governors don’t need to intubate their economies to save lives.
