Fauci repeats the obvious - Liberals rage on!

Put extra funds into making in-person voting safer 
“What about voting? So many people are concerned. We are in an election year. Some people are going to be heading to the polls in the next few weeks, can people go out and vote in person given there is so much concern about the vote?” ABC News’ Deborah Roberts asked Fauci during a recent interview. 
“I think if carefully done according to the guidelines, there’s new reason I can see that not being the case. For example, when you look at going to a grocery stores now in regions and counties and cities that are doing it correctly, they have x’s every six or more feet and it says don’t leave this spot until the person in front of you left their spot, and you an do that. If you go and wear a mask, if you observe the physical distancing and don’t have a crowded situation, there’s no reason why you shouldn’t be able to do that,” Fauci said. “There’s no reason we shouldn’t be able to vote in person.”

There is zero medical reason for us to have to vote "mail in" this election. If Fauci (who is as careful as a priest in a brothel) says it can be done, then it can be done. Perhaps we open up a few more polling stations, perhaps we expand hours, but from what we have seen during the primary season is that states that are not already prepared to vote by mail or having issues just deciding to do so in 2020.

As has been pointed out, California and New York just did their primaries by mail in voting and there was an approximate error rate of around 20% combined (meaning 20% of the ballots were tossed on technicalities), and New York took literally weeks to count everything. 

Now I am going to go ahead and disagree with Trump when he states that Democrats want mail-in voting as a means to steal an election through fraud. Not that I don't believe that fraud will occur and that Democrats are always helped by such fraud. Rather I think Democrats inherently understand that there are going to be more liberals than conservative who decide to "stay home" and "stay safe" rather than risk voting in person.

This is especially exasperated by the already low enthusiasm of the overall Biden support. People are already lukewarm about voting for Biden. Not risking a brush with a bunch of voters at a polling station might be all it takes for many of those unenthused to decide to stay home. However, many of them might be willing to fill something out and stick it in the mail.

Lastly, the entire concept of both legal and illegal vote harvesting is not going to be a thing in 2020. Certainly nobody is being let into nursing homes over the next few weeks in order to "assist" the elderly in filling out election ballots. This whole harvesting thing has been a huge part of the Democratic get out the vote drive, which of course is already suffering because of Covid. Currently Republicans have been outpacing Democrats in registering new voters, which is highly unusual for any election.

Without the means to badger people on the street, go door to door to assist with ballots, and using nursing homes and senior living communities as a means to fill out extra ballots, Democrats are already at a disadvantage over normal elections. If they have to deal with the reality that their voters are simply more cautious and timid about Covid, and may be less willing to stand in line than conservatives, well that is just rubbing salt in the wound.

In the modern world, it is going to be very difficult to commit fraud voting.

But you know that in mostly Republican states have made it very difficult to vote. They have closed hundreds of polling sites, in minority districts.

My deepest fear is that the President and Willam Barr will file complaints about the results of the election, and lead to chaos from both sides.

One other point is that you support original intent philosophy. The USPS is in the Constitution!

So we need to let every qualified voter in vote safely.

Really? We had a mayor removed from office after being convicted of absentee ballot fraud. We had a congressional race overturned by the state election board due to election fraud. There were over 1200 "proven" cases of voter fraud... a large percentage including mail in or absentee ballot frauds.

That was just in 2018.

If widespread use of mail ballots truly did engender fraud, one would expect that the instance of such kinds of fraud would be lower in the 16 states that strictly regulated absentee balloting as opposed to the 28 states, which allowed anyone to vote absentee ("no excuse" absentee voting states) or the five states that automatically mailed ballots to all voters for them to mail back or drop off ("vote-by-mail" states).



Instead, the opposite is true. An examination of the Heritage Foundation database for the period 2000-2020 shows that reported instances of such fraud per capita are actually higher in "strict" states than either "no excuse" states or complete "vote by mail" states.

For these types of fraud, within the 29 "no-excuse" absentee states, there was one reported fraud case for every 2.4 million persons. This compared favorably to one such case for every 1.6 million persons in "vote by mail" states, and even more favorably than the strict states, with one fraud case for every 740,000 persons. Although mail ballot fraud was by no means frequent in any of the states, it was actually more common in the states that took the stricter, more Trump-favored approach.

It is true that pure vote-by-mail states had a slightly higher rate than no-excuse states, potentially aiding the argument that more mail ballots leads to more fraud. But the vote-by-mail rate was only 1.5 times that of the no-excuse rate, while the strict states' rate was twice that of vote-by-mail, and over three times that of no-excuse states. This doesn't seem consistent with the notion that liberalizing mail voting increases fraud.



The 2000-2020 period was chosen to address the risk that the database was more "spotty" the further back in time one went. But the same relationship among the three types of states holds true when you go all the way back to 1979, the database's earliest reported instance of fraud.

Obviously, this doesn't prove causation. It doesn't seem plausible that restricting access to absentee ballots increases mail ballot fraud. But the data, taken from a leader in the "mail balloting leads to fraud" camp, certainly seems to undercut the assertion that increasing access to mail ballots will significantly increase the rate of voter fraud.

This should not be surprising. States have long experience with checking the provenance of absentee ballots. They check to make sure that the voters sending in the ballot are properly registered, for one thing. And they compare the signature on the absentee ballot with the voter signature on file, for another.

Nor is it the case that there is no time to switch to mail balloting for the November election. About nine states have already done so this year, with more likely on the way. Ohio even switched to mail voting for its presidential primary in the past month, with only a few weeks' lead time.

There are many good reasons to move to mail balloting in this pandemic year. There don't seem to be any good reasons not to. And vote fraud certainly isn't one of them.

So we are in the midst, once again, of that quadrennial dance with democracy. Although this one seems less like a dance, and more like... well, frankly, I am sorry to disappoint, but I don't think I can summon a metaphor for what we are seeing that would accurately capture the danger, the farce, the corruption, and perhaps, if we allow ourselves to dream, the hope of emerging into a better future.

I want nothing more than to be covering a normal political season. I wish the candidates were on the trail debating policy. I wish we were talking about the bus trips, the bunting, and kissing babies. Instead, we are hunkered down, stalked by a deadly pandemic, with the very future of our democracy and the health of ourselves and our planet at stake. And we see a president, losing, desperately grasping to power, a power he uses to torpedo our institutions and tear apart the delicate fabric of our people. We the People? Who are we? Where are we going? How expansive or narrowly will we define our nation and the progress forward?

We are about to tumble into the conventions. I am old enough to remember when these things mattered, when smoke-filled rooms of party elders - always men - horse traded and put the chips on the table while the nation awaited the outcomes. I remember the tumult, the drama, and the disappointments. We thought at the time that this is what American democracy was, but our focus in the moment was bound to be too narrow. America has been, is, and will always be, a nation of change. In recent cycles, these conventions would rightfully be called infomercials. They were scripted affairs, but they still brought a twinge of excitement and joy to my heart as I walked the hallways and stepped onto the convention floor. Seeing Americans gather from all over the country to commit themselves to the purpose of politics can be inspiring.

Yet over the years, I also have seen the limits of these power summits laid bare. I have become more aware of the voices not being heard, the poor, the marginalized, the ones that don't get invited or can't afford to join the party. I have seen the political parties drift into distinct corners in their vision for what this nation can be. And that brings us to where we are now. We see the Democrats reach to the past and the future in their ticket. We see the Republicans become fully the Party of Trump.

I would like to simply say that this is the choice before us. This is what is going to be on the ballot. But the ballots themselves are in question. We have talked about the norms of our democracy a lot over the past three-plus years. And those norms are rooted, at their very base, in a fair and free election. Yet here we are...
I don't long for the past, as much as I yearn for the future. I recognize that America, while baptized in the language of justice, has in reality seen a lot of injustice. I believe in the journey we have taken. I believe most of my fellow Americans agree that we must be on a path to greater inclusion and empathy. And in the end, I still believe in this country and what it can be.

I had hoped to attend the political conventions in person this year. Some people have streaks of going to the Super Bowl, or the Rose Parade, or opening night at the Met. For me, I had a streak of conventions, stretching back unbroken on both the Republican and Democratic side to 1960. Considering this year's conventions will be virtual, I'm giving myself a special dispensation. Maybe 2024? I plan to still be here. And I believe America, a better, healthier, more just and equitable America, will be as well.

Many states have moved toward voting by mail for the 2020 elections due to pandemic concerns, leaving only seven states lacking this option for all voters. Members of Congress have called for national legislation for a vote-by-mail option for federal elections this year, which would cover the remaining states. President Trump and some other Republicans have resisted, arguing that mail voting risks election fraud. There’s little empirical evidence to back up this fraud claim, but there have been enough instances of absentee ballot fraud over the years to make it worth a look.

Evidence for the pro-vote-by-mail side may come from an unlikely source: A database of fraud cases maintained by a conservative think tank that raises alarms over voter fraud and is decidedly not in the pro-mail ballot camp. Its data suggests that mail ballot related fraud is actually more common in states that restrict absentee voting than in other states.

The Heritage Foundation is an established conservative think tank. It has long raised the alarm about the perceived dangers of voter fraud, most notably as a justification for strict voter photo identification laws for in-person voting. But they have also spoken out against mail-in voting, suggesting, among several complaints, that it raises an unacceptable risk of fraud.

The photo ID arguments lack merit. They have been shown to disenfranchise large numbers of people. And the only kind of voter fraud that it could prevent – in-person “voter impersonation” fraud, in which one voter shows up at the polls claiming to be a different person – is so rare as to be virtually nonexistent.

But not so with absentee ballot fraud. Although voter fraud of any kind is rare, absentee ballot fraud is the most common type. A high-profile instance in North Carolina last year involved “ballot harvesting,” in which unscrupulous operatives collected absentee ballots and filled them out themselves. A similar case occurred the year before in a small town in Mississippi. Well-publicized cases of such fraud have also been reported in Texas over the years.

These cases are certainly the exception and not the rule. A comprehensive study of election fraud cases by Arizona State University’s News21 journalism project found only 491 cases of absentee ballot fraud out of literally billions of votes cast in U.S. elections since 2000.

But, rare or not, if we were to move to vote-by-mail, would that significantly increase the risk of voter fraud?

Probably not, according to the Heritage Foundation’s data. The think tank compiles a database of reported instances of voter fraud or election fraud. It lists 1,277 “proven instances of voter fraud” in the 50 states over decades, dating back to 1979. The database caveats that it does not purport to be an “exhaustive or comprehensive list.” But given its repeatedly expressed concerns about voter fraud in general and mail ballot fraud in particular, it seems unlikely it would leave out many reported instances of that kind of fraud.

The database includes many categories of the types of voter fraud involved: Registration fraud, voter impersonation fraud, illegal “assistance” at the polls, etc. But only some are relevant to the specific concerns about mailed ballots: “Fraudulent use of absentee ballots” and “vote buying.”

The fraud is not committed in the act of accepting them. The fraud is in the act of filling them out and submitting them in the expectation they will be counted.

In other words, if you filled out and mailed a dead guys ballot, the police and the FBI would still show up at your door and arrest you for fraud even though the ballot was never counted.

The rejection itself in fact would have lead to the investigation to arrest you.

The Rasmussen Reports daily Presidential Tracking Poll for Friday shows that 47% of Likely U.S. Voters approve of President Trump’s job performance. Fifty-two percent (52%) disapprove.

Birthright citizenship has been a subject of debate from the time that the 14th Amendment was adopted. There are arguments on both sides of the currently accepted broad interpretation of the language. Many of our closest allies reject the concept of birthright citizenship.

However, the case law is strongly supports Harris. In 1898, in United States v. Wong Kim Ark,the court found that the child of Chinese immigrants was still a citizen under the 14th Amendment because he was born on U.S. territory. His parents were here legally as permanent residents. Moreover, the language of the 14th Amendment does not clearly support the exclusions raised by Eastman. It states “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.”

Most reading that language have concluded that it allows for birthright citizenship for anyone “born … in the United States.” The 14th Amendment starts and ends as a model of clarity, stating that “all persons born or naturalized in the United States” are “citizens of the United States and of the state wherein they reside.” But between those two phrases, Congress inserted the words “and subject to the jurisdiction thereof.” Those six words have perplexed scholars for 150 years. The dominant view of law professors is the line as a whole guarantees that anyone born within the United States becomes an American citizen. But some believe that the caveat means you must be here in a legal status, that if you are not a American citizen, then you are a legal resident.


He does not address Elk v. Wilkins. And the perplexing clause "and subject to rhe jurisdiction thereof" has not been completely resolved.

When I was born, I as an American citizen was immediately subject to all our laws (including the draft which was then full in effect).
