Actually it's a legitimate legal and constitutional issue to resolved. It revolves around what the subject to the jurisdiction thereof clause of the 14th amendment means. The only case law has resolved:
1. Members of Foreign missions are not subject to US jurisdiction, children born in the US to members of a foreign are not citizens.
2. American citizens where ever they are in the world. Children born to at least one American citizen is a natural born American citizen (This is why whether Obama was born in Kenya or Hawaii it didn't make a difference, he was a natural born citizen of the United States.)
3. Children born to permanent legal residence of the United States are natural born American citizens.
For all other cases the status is an open question. An argument can be made that people in the US on tourist, student, or H1 visas are temporary and not completely subject to the jurisdiction of the United States and of course illegal aliens have no status at all.
