Washington — President Trump is expected to nominate Judge Amy Coney Barrett to replace the late Justice Ruth Bader Ginsburg on the U.S. Supreme Court, CBS News has confirmed, according to multiple sources involved in or familiar with the selection process.
It's possible Mr. Trump could change his mind, but at this point, Barrett is expected to be announced as the president's choice Saturday afternoon at the White House.
She has been a leading candidate and was a finalist to be Mr. Trump's second Supreme Court pick. Barrett met with the president at the White House on Monday.

I spent over 300 mornings in the Oval Office briefing the president and his senior staff. I had the privilege to manage, edit and deliver the president’s Daily Brief a summary of the most timely and critical intelligence threats to the U.S. from 2010 to 2014.

Attorney General Bill Barr “personally briefed” President Donald Trump about the already controversial Department of Justice (DOJ) investigation into a handful of previously discarded military mail-in ballots that were recovered in Pennsylvania, an official from the DOJ told ABC News Friday.
Trump and White House Press Secretary Kayleigh McEnany amplified those claims. Meanwhile, the U.S. Attorney’s Office overseeing the investigation released a public statement on the investigation that required almost immediate revision due to factual errors.
According to the ABC report, the personal briefing with Barr took place just prior to Trump going on air for an interview with Fox News Radio where he erroneously touted the investigation as vindicating his false claims about mail-in voting being easily susceptible to widespread fraud.
“These ballots are a horror show,” Trump said during the interview Thursday. “They found six ballots in an office yesterday in a garbage can. They were Trump ballots — eight ballots in an office yesterday in — but in a certain state and they were — they had Trump written on it, and they were thrown in a garbage can.”
During Thursday’s White House press briefing, McEnany also insinuated that the DOJ investigation substantiated Trump’s claims that Democrats were trying to steal the election.
“I can confirm for you that Trump ballots, ballots for the president were found in Pennsylvania,” McEnany said. “I believe you should be getting more information on that shortly. Here in the last 24 hours, they were found cast aside.”
According to the report, Barr was made aware of the investigation in Luzerne County after the U.S. Attorney’s Office for the Middle District of Pennsylvania “sought guidance” from Main Justice on what steps to take going forward.
The eventual response was severely bungled. In a pair of statements that were resoundingly criticized by election law experts as “wildly improper,” the U.S. Attorney’s Office initially declared that all nine of the recovered ballots “were cast for presidential candidate Donald Trump.”
Matt Wolking, the deputy director of communications and rapid response with the Trump campaign, widely circulated the announcement, writing in a now-deleted tweet that “100% of [the ballots] were cast for President Trump” and adding that “Democrats are trying to steal the election.”
Rudy Giuliani’s initial tweet on the matter is still up as of Friday afternoon. The tweet says all discarded ballots were in favor of Trump.

I foresee no role for the U.S. armed forces in this process.”

Weiser said it was important that officials provide detailed information about any voting issues that arise, which happen every election cycle. For instance, officials with the U.S. Postal Service said this week they are investigating a report that an unknown number of ballots were among other mail found in a ditch near a highway intersection in Wisconsin, another presidential battleground state.
Officials have so far released little information in that case, including whether the ballots were blank and on their way to voters or if they had been completed and were being returned to the local election office.
Experts say the lack of information in these cases opens the door to speculation and conspiracy theories.
By Friday, more details had emerged in the Pennsylvania case. Federal officials were considering whether a recently hired, temporary election worker may have mishandled the ballots. Aside from the unknowns about the investigation itself, questions persist over how the Justice Department handled the matter.

Rep. Al Green (D-Texas), who pushed for Trump’s impeachment back in 2017, told The Hill that, in light of the president’s most recent remarks, he was concerned about “unrest that can spiral out of control in this country.”
Green added: “A peaceful transfer of power is not a conservative position, not a liberal position — it is an American tradition. There are some traditions that ought to withstand the test of time. We should not try to erode that tradition, and the president’s words are eroding that tradition.”
Advertisement Carlos Curbelo, a Republican who represented Florida’s 26th Congressional District from 2015 until 2019, suggested that those who did not take Trump’s threats seriously were making a mistake.
“I always take people who are in power seriously,” Curbelo said. “He certainly has the power to create a very chaotic situation in regards to the election results, and everyone should take him seriously.”
Some prominent commentators put the situation in even more strident terms.
New York Times columnist Thomas Friedman told CNN’s Anderson Cooper on Thursday that he had started his career covering the Lebanese civil war and added, “I’m terrified to find myself ending my career as a journalist covering America’s potential second civil war in its history.”
Friedman also described Trump’s recent comments as a “six-alarm fire.”
Trump has been beating the drum about what he characterizes as the dangers of mail-in voting for months, despite the lack of credible evidence that postal votes are any more susceptible to fraud than voting in person.
He also equivocated during the 2016 campaign about whether he would accept the election result if he lost to his Democratic opponent, Hillary Clinton.
The current furor was sparked when Trump was asked during an appearance in the White House briefing room Wednesday whether he would commit to a peaceful transition of power and replied, “We’re going to have to see what happens.”
Asked about those comments the following day, the president said: “We want to make sure the election is honest, and I’m not sure it can be.”
Most experts believe the likelihood of Trump actually seeking to remain in power if he were to clearly lose to former Vice President Joe Biden is remote.
There is no obvious legal mechanism by which he could do such a thing, and the Constitution provides that the election’s winner will be sworn in as president on Jan. 20 next year. Any attempt to defy that process — itself an unlikely prospect — would mean Trump risking his ejection from the White House, perhaps at the hands of the Secret Service.
A Wall Street Journal editorial on Friday called the idea of Trump remaining in power in such circumstances “preposterous.”
A more plausible scenario, in the eyes of many, is Trump casting doubt on the election results and stoking resentment among his supporters with claims that victory is being stolen from him. Statements like those could pitch the nation into serious strife, even assuming Trump accedes to handing over power come Jan. 20.
In the unlikely event that no winner of the election were to be certified by Jan. 20, the presidency would pass to the Speaker of the House — which will continue to be Nancy Pelosi (D-Calif.) barring a seismic upset in November.
Biden has sought to calm nerves about what will happen in the wake of the election. The Democratic nominee told MSNBC’s Stephanie Ruhle in an interview conducted Friday, “I’m confident that [after] all of the irresponsible, outrageous attacks on voting, we’ll have an election in this country as we always have had. And he’ll leave.”
But Biden added: “What I am concerned about is whether he generates some kind of response in a way that unsettles the society or causes some kind of violence.”
Trump’s remarks were transgressive enough to earn implicit rebukes from some members of his own party. Senate Majority Leader Mitch McConnell (R-Ky.) insisted that, come Inauguration Day, “there will be an orderly transition just as there has been every four years since 1792.”
“The president says crazy stuff,” Sen. Ben Sasse (R-Neb.) told reporters. “We’ve always had a peaceful transition of power. It’s not going to change.”
The electoral implications of Trump’s remarks may turn out to be slight, given how energized Democratic voters are about defeating him, and how fervently his base supports him.
But Curbelo, the former Florida congressman, suggested the controversy could backfire with some voters in the Sunshine State, the biggest and most crucial battleground.
In an apparent reference to immigrant communities from nations such as Cuba, Nicaragua and Venezuela, Curbelo said, “There are communities in South Florida where there are a lot of families who fled countries where democratic institutions were weakened or destroyed. This could really push those voters who may not be enthusiastic about Biden. They may be wary about socialism from the left but this will make them wary of authoritarianism from the right.”
Whether Trump’s comments have that effect on the election, though, they clearly mark another voyage into uncharted waters for the nation at large.

“Vice President Biden was jokingly encouraging the audience to clap for an airwoman on the stage, and a number of service members can be seen laughing and smiling at the comment. Seconds before, he praised them for 'the incredible sacrifices [they] make for our country,’” Biden campaign spokesperson Andrew Bates told The Daily Beast exclusively in a statement.
“He thanked them for their patriotism and courage throughout, and closed his remarks by saying, 'you’re the finest generation of warriors the world has ever, ever known'—receiving an enthusiastic ovation,” Bates said.
Biden made the utterance during a speech in Abu Dhabi on March 7, 2016 while he was serving under former President Barack Obama. He said: “I’ve been in and out of the Balkans 25 times; in and out of Iraq 26 times; in and out of Afghanistan about 10 or 12 times. And I have one regret every time I’m with you all—and I mean this sincerely—is the folks back home can't see you; can't see you in place. Don't get to fly on the mission with you. Don't understand—they appreciate, but they don't fully understand the incredible sacrifices you make for our country,” according to the official transcript, which was archived in the White House’s Office of the Vice President.

I spent over 300 mornings in the Oval Office briefing the president and his senior staff. I had the privilege to manage, edit and deliver the president’s Daily Brief a summary of the most timely and critical intelligence threats to the U.S. from 2010 to 2014.
As a Deputy on the National Security Council, I spent over 1,000 hours in the White House Situation Room providing the intelligence assessments which informed critical U.S. national security policy decisions — including the raid that rendered justice for the victims of 9/11.
Since I have been eligible to vote, I have never registered with a political party. I remain an independent with a history of voting for candidates I believe in — I focused on their policy and not their party. Before this election, I have never spoken out for or against a candidate for any office.
But I can be silent no longer.
In the summer of 1976, I was 14 years old and new to Colorado, my father took command of the Western Region’s National Guard. I enrolled in the brand-new Smoky Hill High School on what was then the far eastern boundary of Aurora. As a military brat, I was accustomed to moving around and not putting down roots — but as readers will know well, Colorado has a way of pulling on your heart and it became home. It remains so as my family spends as much time as possible in our Dillon residence.
Upon graduating from Cornell University, I joined the intelligence community as an analyst during President Ronald Reagan’s increasing investments in defense — a buildup that culminated in the collapse of the Soviet Union by the end of the decade. In my nearly four decades of service, I had the privilege of serving under six presidents — four Republican and two Democrat. The constant across all of those administrations was the oath I took to “protect and defend” the Constitution against “all enemies — foreign and domestic.”
I know what it takes to succeed at the highest levels of our government — intellectual curiosity, the strength of moral purpose and a commitment to selfless service. Broadly speaking, I can personally attest that Americans were very well served by those they elected to fill critical national security positions.
There is one important exception to that statement — our current president.
I have briefed him up close — and I have seen and felt the effect of his faults on our nation’s security. Out of respect for the confidential nature of Oval Office conversations, I will not provide details. Suffice to say that the person you see presiding over COVID-19 press conferences is the same one in the privacy of his office. He has little patience for facts or data that do not comport with his personal world view. Thus, the conversations are erratic and less than fully thoughtful.
While it is natural for there to be tension between the intelligence community and senior policymakers, President Donald Trump’s decision to rely upon the word of dictators like Vladimir Putin is an unprecedented betrayal of his oath to the Constitution. Our current president bases his decisions on his instincts, and his instincts are based upon a personal value proposition — what’s in it for me?
As a Commander in Chief, President Trump comes up tragically short. He fails to protect our soldiers when bounties are placed on their heads by his friend Vladimir. And not only does he not respect their service, but President Trump also belittles combat heroes who were taken as prisoners of war.
As a nation, we were fortunate that a true crisis did not occur during his first three years in office.
Then 2020 happened. This has been an unprecedented year for which many of us were not prepared. In moments of crisis, the American people demand — and deserve — a leader who will put the country first. Full stop. Because the reality and the science of COVID-19 conflicted with his personal views, President Trump knowingly downplayed the pandemic.

Attorney General Bill Barr “personally briefed” President Donald Trump about the already controversial Department of Justice (DOJ) investigation into a handful of previously discarded military mail-in ballots that were recovered in Pennsylvania, an official from the DOJ told ABC News Friday.
Trump and White House Press Secretary Kayleigh McEnany amplified those claims. Meanwhile, the U.S. Attorney’s Office overseeing the investigation released a public statement on the investigation that required almost immediate revision due to factual errors.
According to the ABC report, the personal briefing with Barr took place just prior to Trump going on air for an interview with Fox News Radio where he erroneously touted the investigation as vindicating his false claims about mail-in voting being easily susceptible to widespread fraud.
“These ballots are a horror show,” Trump said during the interview Thursday. “They found six ballots in an office yesterday in a garbage can. They were Trump ballots — eight ballots in an office yesterday in — but in a certain state and they were — they had Trump written on it, and they were thrown in a garbage can.”
During Thursday’s White House press briefing, McEnany also insinuated that the DOJ investigation substantiated Trump’s claims that Democrats were trying to steal the election.
“I can confirm for you that Trump ballots, ballots for the president were found in Pennsylvania,” McEnany said. “I believe you should be getting more information on that shortly. Here in the last 24 hours, they were found cast aside.”
According to the report, Barr was made aware of the investigation in Luzerne County after the U.S. Attorney’s Office for the Middle District of Pennsylvania “sought guidance” from Main Justice on what steps to take going forward.
The eventual response was severely bungled. In a pair of statements that were resoundingly criticized by election law experts as “wildly improper,” the U.S. Attorney’s Office initially declared that all nine of the recovered ballots “were cast for presidential candidate Donald Trump.”
Matt Wolking, the deputy director of communications and rapid response with the Trump campaign, widely circulated the announcement, writing in a now-deleted tweet that “100% of [the ballots] were cast for President Trump” and adding that “Democrats are trying to steal the election.”
Rudy Giuliani’s initial tweet on the matter is still up as of Friday afternoon. The tweet says all discarded ballots were in favor of Trump.

Thursday’s kerfuffle and accompanying internet outrage over a handful of ballots is likely a taste of what’s to come in the month left before the presidential election, which is being held amid a global pandemic that has triggered a wave of absentee ballot requests as Trump continues to launch unsubstantiated attacks on mail voting.
It was Trump, after being briefed on the case by Attorney General William Barr, who first revealed publicly that the discarded ballots had been cast for him. He did so in an interview earlier Thursday with Fox News Radio in which he used the investigation to further sow doubt about mail-in voting. The radio interview was hours before the U.S. attorney's office in Pennsylvania issued its news release about the probe to reporters.
“If past is prologue, we will see more,” said Wendy Weiser, an elections expert and director of the democracy program at the Brennan Center for Justice. “We are in an unprecedented situation where a sitting president of the United States and a candidate for reelection is and has long been actively seeking to undermine the election and discredit it.”
Weiser said it was important that officials provide detailed information about any voting issues that arise, which happen every election cycle. For instance, officials with the U.S. Postal Service said this week they are investigating a report that an unknown number of ballots were among other mail found in a ditch near a highway intersection in Wisconsin, another presidential battleground state.
Officials have so far released little information in that case, including whether the ballots were blank and on their way to voters or if they had been completed and were being returned to the local election office.
Experts say the lack of information in these cases opens the door to speculation and conspiracy theories.
By Friday, more details had emerged in the Pennsylvania case. Federal officials were considering whether a recently hired, temporary election worker may have mishandled the ballots. Aside from the unknowns about the investigation itself, questions persist over how the Justice Department handled the matter.
The first word of a federal investigation into unspecified “issues with a small number of mail-in ballots” came in a statement Tuesday by the local district attorney in Luzerne County. There was no mention of Trump, and there was little attention to the case beyond local news reports .

Lindsey Graham apparently needs money for his Senate reelection campaign. And so the South Carolina Republican has taken his appeal for funds to an unusual venue: cable news.
Specifically, Fox News. In a pair of interviews on the network on Thursday, Graham pleaded with Fox viewers for campaign cash, in an emotional appeal almost as weepy as Jerry Lewis in one of the later hours of his old charity telethons.
“I’m getting overwhelmed,” he told prime-time host Sean Hannity. Then, he turned to Hannity’s viewers, adding: “Help me. They’re killing me moneywise. Help me. You did last week. Help me again.”

With 44 days until the U.S. presidential election, it may seem to many as if the death of Supreme Court Justice Ruth Bader Ginsburg has Justice Ruth Bader Ginsburg has dramatically changed the political calculus—shifting the national conversation away from President Trump’s performance in office and refocusing voters on the battle over who, ultimately, gets to select Justice Ginsburg’s replacement. But a wealth of new polling data suggests that the fundamentals of this election are not likely to change—and particularly telling are a trio of Gallup survey questions that, taken together, have a strong track record for predicting past races in which sitting presidents vie for a second term.
The three key metrics—gauging presidential approval, U.S. satisfaction, and economic confidence—which were in the field from Aug. 31 to Sept. 13, suggest that President Trump has a very difficult road ahead to win reelection, no matter what happens with respect to the vacancy on the Supreme Court. “With those three measures,” says Jeffrey Jones, a senior editor and researcher at Gallup, “you can get a good sense of the lay of the land. Together, they usually offer a good way to figure out if an incumbent is going to win or lose.”
In the latest Gallup survey, 42% of Americans say they approve of the President’s performance in office and just 14% of Americans say they’re satisfied with the way things are going in the country. The firm assesses economic confidence by way of an index that combines two related measures—how Americans rate current economic conditions today

The nation is also contending with the long-term impact of extreme polarization, and with the inevitable tensions stoked by an election that is little more than five weeks away.
Rep. Al Green (D-Texas), who pushed for Trump’s impeachment back in 2017, told The Hill that, in light of the president’s most recent remarks, he was concerned about “unrest that can spiral out of control in this country.”
Green added: “A peaceful transfer of power is not a conservative position, not a liberal position — it is an American tradition. There are some traditions that ought to withstand the test of time. We should not try to erode that tradition, and the president’s words are eroding that tradition.”

Carlos Curbelo, a Republican who represented Florida’s 26th Congressional District from 2015 until 2019, suggested that those who did not take Trump’s threats seriously were making a mistake.
“I always take people who are in power seriously,” Curbelo said. “He certainly has the power to create a very chaotic situation in regards to the election results, and everyone should take him seriously.”
Some prominent commentators put the situation in even more strident terms.
New York Times columnist Thomas Friedman told CNN’s Anderson Cooper on Thursday that he had started his career covering the Lebanese civil war and added, “I’m terrified to find myself ending my career as a journalist covering America’s potential second civil war in its history.”
Friedman also described Trump’s recent comments as a “six-alarm fire.”
Trump has been beating the drum about what he characterizes as the dangers of mail-in voting for months, despite the lack of credible evidence that postal votes are any more susceptible to fraud than voting in person.
He also equivocated during the 2016 campaign about whether he would accept the election result if he lost to his Democratic opponent, Hillary Clinton.
The current furor was sparked when Trump was asked during an appearance in the White House briefing room Wednesday whether he would commit to a peaceful transition of power and replied, “We’re going to have to see what happens.”
Asked about those comments the following day, the president said: “We want to make sure the election is honest, and I’m not sure it can be.”
Most experts believe the likelihood of Trump actually seeking to remain in power if he were to clearly lose to former Vice President Joe Biden is remote.
There is no obvious legal mechanism by which he could do such a thing, and the Constitution provides that the election’s winner will be sworn in as president on Jan. 20 next year. Any attempt to defy that process — itself an unlikely prospect — would mean Trump risking his ejection from the White House, perhaps at the hands of the Secret Service.
Trump is right. If democrats given us a rigged election, we are not obligated to quietly accept it.

A more plausible scenario, in the eyes of many, is Trump casting doubt on the election results and stoking resentment among his supporters with claims that victory is being stolen from him. Trump’s remarks were transgressive enough to earn implicit rebukes from some members of his own party. Senate Majority Leader Mitch McConnell (R-Ky.) insisted that, come Inauguration Day, “there will be an orderly transition just as there has been every four years since 1792.”
“The president says crazy stuff,” Sen. Ben Sasse (R-Neb.) told reporters. “We’ve always had a peaceful transition of power. It’s not going to change.”
The electoral implications of Trump’s remarks may turn out to be slight, given how energized Democratic voters are about defeating him, and how fervently his base supports him.
But Curbelo, the former Florida congressman, suggested the controversy could backfire with some voters in the Sunshine State, the biggest and most crucial battleground.
In an apparent reference to immigrant communities from nations such as Cuba, Nicaragua and Venezuela, Curbelo said, “There are communities in South Florida where there are a lot of families who fled countries where democratic institutions were weakened or destroyed. This could really push those voters who may not be enthusiastic about Biden. They may be wary about socialism from the left but this will make them wary of authoritarianism from the right.”
Whether Trump’s comments have that effect on the election, though, they clearly mark another voyage into uncharted waters for the nation at large.

When I last spoke with my brother on that Sunday prior to him being intubated, he pleaded with me to let people know “Covid isn’t a joke. It’s not a hoax.” He implored me in broken, struggling breaths to “do something about it and make them see it’s real, and it hurts so bad.” I took the photo below on the day he was intubated. Heavily draped in PPE, I’m sure the hospital knew the severity of his condition and the bleak outlook. A five minute visit, but it was enough to resonate with me a lifetime. We must see the reality of Covid. We must not forget that the health department statistics or the national statistics aren’t just numbers; they are people like my brother. I hope that in some small way telling his story -my family’s story and our loss- honors his plea.
This virus is a public concern that has no preference to political parties. My community is known to come together during times of crisis. We are in a crisis as a community and as a nation. We need to be cognizant that our actions may unwittingly affect others. My brother now joins the staggering list of over 200,000 Covid deaths in the US. Jesse was an average guy, a military veteran, a husband, father, brother, son, uncle, and friend. He wasn’t just some abstract statistic. He was somebody, not just “virtually a nobody.”
Our fibers may tell different stories, but we are all part of the same tapestry. Covid is real. Covid kills, and dead is forever.
Please care about one another. Our very lives depend on each other to play a role in containing and eliminating this virus.

Democratic presidential nominee Joe Biden’s campaign has confirmed the accuracy of a recently resurfaced video showing him jokingly calling military troops “stupid bastards” and “a dull bunch” during a trip overseas, but said that they were made in jest as a way to garner greater applause for a female service member’s commitment to the country.
“Vice President Biden was jokingly encouraging the audience to clap for an airwoman on the stage, and a number of service members can be seen laughing and smiling at the comment. Seconds before, he praised them for 'the incredible sacrifices [they] make for our country,’” Biden campaign spokesperson Andrew Bates told The Daily Beast exclusively in a statement.
“He thanked them for their patriotism and courage throughout, and closed his remarks by saying, 'you’re the finest generation of warriors the world has ever, ever known'—receiving an enthusiastic ovation,” Bates said.
Biden made the utterance during a speech in Abu Dhabi on March 7, 2016 while he was serving under former President Barack Obama. He said: “I’ve been in and out of the Balkans 25 times; in and out of Iraq 26 times; in and out of Afghanistan about 10 or 12 times. And I have one regret every time I’m with you all—and I mean this sincerely—is the folks back home can't see you; can't see you in place. Don't get to fly on the mission with you. Don't understand—they appreciate, but they don't fully understand the incredible sacrifices you make for our country,” according to the official transcript, which was archived in the White House’s Office of the Vice President.
