One officer was indicted for wanton endangerment, for firing his gun into a neighboring apartment.
This is really quite simple and could apply to many different police complaints we have seen recently. In the late 1990's there was a case that went all the way to the USSC called County of Sacramento v. Lewis. In this situation there was a high speed chase involving a motorcycle and a police cruiser. The motorcycle eventually lost control, a passenger (not wanted by the police) was thrown into the path of the police car, and she was struck and killed.
The family of the victim sued the police department, claiming that they were negligent and responsible for the death. The argument (which we are hearing a lot of today) was that while the police may have acted within the proper police guidelines provided, that their decision making was flawed and that better judgement suggested that pursuing the motorcyclist was dangerous and should have not been attempted.
In a 9-0 decision written by Ruth Ginsburg, it was determined that there was no basis for a lawsuit against the police involved. The court ruled that unless there was proof of improper police actions or a malicious intent, that suing law enforcement officers for what would amount to a lack of prudent judgement would be opening a whole can of worms that our justice system could not undertake.
Obviously if you cannot "sue" over what might be argued a lack of good judgement, then you certainly cannot file criminal charges since it's much easier to prove a civil case than a criminal case.
For those who are not privy to the actual facts of the Breonna Taylor case, this was a situation where the police entered an apartment with a late night no-knock warrant. Taylor and her boyfriend refused to open the door and the police broke in. Taylor's boyfriend opened fire on the police officers (claiming self defense) and they shot back. Taylor was killed in the crossfire. The argument on behalf of the Taylor family was that there was a no-knock warrant that was dangerous, unwarranted, and that it should not have been attempted. Of course the police never actually served a no-knock warrant. Even neighbors testified to hearing them identify themselves.
If this sounds dangerously close to the logic from the Lewis case, it's because it is. If you don't like that case, then you can blame RBG for her majority ruling. But I doubt seriously whether you can get the courts to turn this one around any time soon.
This particular case could apply to any number of recent situations.- Derek Chauven was following proper police procedure and there is no evidence (at least that we know of) of any malicious intent in that situation. Clearly it could be argued that it was not "necessary" to hold Floyd down for 9 minutes, but it was also not against procedure, much less against the law.
- The shooting of Jacob Blake was very likely well inside the boundaries of proper police procedure and there is also no evidence (at least that we know of) of any malicious intent. While one could argue that the police had other options, that is irrelevant without improper procedure or malicious intent.
- Same would hold true in the Rashard Brooks Wendy's Parking lot shooting. Again, it can be argued that it would have been prudent to allow him to simply escape. The actions of shooting him (especially considering he stole a weapon and shot it back at the officer) appears within the boundaries of procedure and there is no evidence of malicious intent.
Yet, all of these police officers are being charged with crimes, when legal precedent probably dictates that no crime was actually committed. Time will tell if any of these prosecutions are successful. But if they are, look for an appeal and look for the Lewis case to be brought up.

Fauci shuts down false claims about coronavirus, herd immunity

Sen. Rand Paul (R-Ky.) received a sharp education lesson on virus immunity and prevention from Dr. Anthony Fauci during a Senate hearing on Wednesday when the Kentucky physician attempted to attribute New York’s dramatic reduction in COVID-19 cases to herd immunity instead of people following safety protocols.
During a heated back and forth, Paul, who has opposed mask mandates, criticized Fauci’s past praise of New York and its Democratic governor’s handling of the pandemic.
“New York had the highest death rate in the world,” Paul said. “How can we possibly be jumping up and down and saying, oh Gov. [Andrew] Cuomo did a great job? He had the worst death rate in the world.”
Fauci, the nation’s top infectious disease expert, responded with a fact check.
“No, you misconstrued that, senator, and you’ve done that repetitively in the past,” Fauci fired back. “They got hit very badly. They made some mistakes. Right now ... the things that are going on in New York to get their test positivity 1 percent or less is because they are looking at the guidelines that we have put together from the [coronavirus] task force.”
Those safety guidelines include mask-wearing, social distancing, avoiding crowds, washing hands and participating in public gatherings that are outdoors instead of indoors whenever possible.
“Or they’ve developed enough community immunity that they’re no longer having the pandemic because they have enough immunity in New York City to actually stop,” Paul interrupted.
“I challenge that,” Fauci responded, before repeating the latest data presented by the Centers for Disease Control and Prevention. The CDC’s director, Robert Redfield, was also testifying at the hearing.
“This happens with Sen. Rand all the time. You are not listening to what the director of the CDC said. That in New York it’s about 22%,” he said of the positivity rate. “If you believe that 22% is herd immunity, I believe you’re alone in that.”
To establish herd immunity, a large percentage of a community would have to contract the virus, or a similar one, and produce antibodies to it. Every disease’s threshold for herd immunity is different. In the case of the measles virus, which is one of the most contagious infectious diseases, it’s estimated that 94% of the population would have to be immune to it to achieve herd immunity, according to the Mayo Clinic.
“Experts estimate that in the U.S., 70% of the population — more than 200 million people — would have to recover from COVID-19 to halt the epidemic,” the Mayo Clinic’s website states.
Another report published in the medical journal JAMA in May estimates that to achieve herd immunity for COVID-19, between 55% and 82% of the population would have to have developed antibodies to the virus.
Sen. Paul went on to suggest that there may be people out there, about one-third of the population, that have “pre-existing immunity” to COVID-19. This idea is based on these people having what are called cross-reactive antibodies after successfully fighting similar viruses.
Fauci shot that suggestion down too.
“I’d like to talk to you about that also because there was a study that recently came out that pre-existing immunity to coronaviruses that are common cold do not cross-react with the COVID-19,” he said.
Sweden has beaten coronavirus by refusing to shut the country down and achieving herd immunity, according to an expert.
The Scandinavian nation was the only country in Europe not to introduce strict lockdown measures at the start of the pandemic.
But scientists believe that this may have helped it avoid a second wave of Covid-19 as it continues to record its lowest number of cases since March - with just 28 infections per 100,000 people.
This figure is less than half of the UK's own infection rate of 69 per 100,000 people.

Millions of families are impacted by the opioid crisis. It’s ravaging communities coast to coast, from New Hampshire to California. The challenge of substance use disorders is not limited to opioids. Millions of individuals are affected by misuse of other substances such as alcohol or methamphetamine. Latest estimates indicate that, in 2018, almost 68,000 Americans died from a drug overdose – almost 47,000 of which involved an opioid. And, the impacts of this crisis reverberate in our classrooms and neighborhoods, in small towns and big cities.
Biden will tackle this crisis by making sure people have access to high quality health care – including substance use disorder treatment and mental health services. That’s what Obamacare did by designating substance use disorder treatment and mental health services as essential benefits that insurers must cover, and by expanding Medicaid, the nation’s largest payer for mental health services which also plays an increasingly growing role as a payer for substance use disorder services.
But President Trump wants to repeal Obamacare, including its Medicaid expansion. Repeal would be disastrous for communities and families combating the opioid crisis. It is not realistic to think that grant money will fill the hole that eliminating Obamacare and its Medicaid expansion would create.
Step one of Biden’s plan to tackle the opioid epidemic and substance use disorders is to defeat Trump and then protect and build on Obamacare. And, Biden will pursue a comprehensive, public health approach to deal with opioid and other substance use disorders. His plan will:
Hold accountable big pharmaceutical companies, executives, and others responsible for their role in triggering the opioid crisis.
Make effective prevention, treatment, and recovery services available to all, including through a $125 billion federal investment.
Stop overprescribing while improving access to effective and needed pain management.
Reform the criminal justice system so that no one is incarcerated for drug use alone.
Stem the flow of illicit drugs, like fentanyl and heroin, into the United States – especially from China and Mexico.

Breonna Taylor was a beloved daughter, member of her community, and an essential worker who served as an E.M.T. as COVID-19 began to spread. But she died, shot in her own home by the police. In the wake of her tragic death, we mourn with her mother, family, and community and ask ourselves whether justice could be equally applied in America.
I know for so many people today’s decision does not answer that call. A federal investigation remains ongoing, but we do not need to wait for the final judgment of that investigation to do more to deliver justice for Breonna. We know what is necessary. We need to start by addressing the use of excessive force, banning chokeholds, and overhauling no-knock warrants. I know people are frustrated and they have a right to peacefully protest, but violence is never acceptable. And we can express pain, grief, anger, and disappointment at the way things are, but remain focused on rebuilding trust in our communities and delivering change that can be.
We must continue to speak Breonna Taylor’s name, support her family still in grieving, and never give up on ensuring the full promise of America for every American.

About 200 cars took part in the convoy that passed through Elon, North Carolina, on Saturday, the Elon News Network reported.
Members of a neo-Confederate organisation called Alamance County Taking Back Alamance County (ACTBAC) were said to have set-up the pro-Trump parade.
Founded by Gary Williamson, ACTBAC has been designated as a neo-Confederate group by the Southern Poverty Law Center, Elon News reported.
Megan Squire, an academic and researcher on right-wing extremism, videoed the procession as it passed through the campus at Elon University.

RAPID CITY, S.D. (KOTA) - Active COVID-19 cases and hospitalizations both increased Wednesday in South Dakota as the Department of Health confirmed an additional 445 cases.
This is a new record as 445 is the highest amount of new cases confirmed by the state in a day since Aug. 29.
The state has had a total of 19,634 cases COVID-19 cases since the first case was detected in the state back in March. Officials say 3,108 of those cases are active, which is an increase of 291 from Tuesday, which is also the highest amount of active cases South Dakota has had since Sept. 5 with 3,057 active cases.
The state’s death total from the disease remained at 202.

Current hospitalizations increased by 14 to 192. Eight percent of the state’s hospital beds are occupied by COVID-19 patients, according to the Department of Health. 41% of hospital beds are still available.

Mr. Trump’s vulnerability even in conservative-leaning states underscores just how precarious his political position is, less than six weeks before Election Day. While he and Mr. Biden are competing aggressively for traditional swing states like Wisconsin, Pennsylvania and Florida, the poll suggests that Mr. Biden has assembled a coalition formidable enough to jeopardize Mr. Trump even in historically Republican parts of the South and Midwest.

Two men were arraigned in Albany on Wednesday in connection to violent riots in the city.
District Attorney David Soares announced that 39-year-old Dwight Parker of Troy was arraigned on the following felony charges:
(1) Count of Attempted Aggravated Assault on a Police Officer as a Crime of Terrorism
(1) Count of Attempted Aggravated Assault on a Police Officer
(1) Count of Attempted Assault in the First Degree
(1) Count of Arson in the Third Degree
(1) Count of Riot in the First Degree
(1) Count of Criminal Mischief in the Second Degree
The indictment alleges that on May 30th, Parker threw a Molotov cocktail at four police officers on horseback during a riot in the area of South Pearl and Arch Streets.
It also alleges that Parker and 25-year-old Ah-Juan Boyd of Albany set fire to a tractor trailer in the area of South Pearl and Westerlo Streets on the same evening.
Parker pleaded not guilty to the charges and remains in custody.
Ah-Juan Boyd was also indicted for attempting to set fire to an Albany police vehicle on June 1st in the area of First Street and Henry Johnson Boulevard.
Boyd pleaded not guilty to arson, attempted arson and criminal mischief charges and remains released on his own recognizance, as the charges are not considered qualifying offenses under current bail statutes.
Two other co-defendants, Imari Allen and Shalene Allen were previously arrested and charged with Riot in the First Degree. Their cases remain open and pending.

Another 870,000 Americans filed for first-time unemployment benefits last week, unexpectedly rising slightly from the prior week to reaffirm a slowdown in the U.S. economic recovery.
Initial jobless claims, week ended Sept. 19: 870,000 vs. 840,000 expected, and 866,000 during the prior week
Continuing claims, week ended Sept. 12: 12.580 million vs. 12.275 million expected, and 12.747 million during the prior week
At 870,000, Thursday’s figure represented the fourth consecutive week that new jobless claims came in below the psychologically important 1 million level, but was still high on a historical basis. Nevertheless, the labor market has made strides in recovering from the pandemic-era spike high of nearly 7 million weekly new claims seen in late March.
“While jobless claims under a million for four straight weeks could be considered a positive, we’re staring down a pretty stagnant labor market,” Mike Loewengart, managing director of investment strategy for E-Trade Financial Corporation, said in an email Thursday. “This has been a slow roll to recovery and with no signs of additional stimulus from Washington, jobless Americans will likely continue to exist in limbo. Further, a shaky labor market translates into a skittish consumer, and in the face of a pandemic that seemingly won’t go away without a vaccine, the outlook for the economy certainly comes into question.”
On an unadjusted basis, initial jobless claims rose by a greater margin, or about 28,500, from the previous week to about 824,500. The seasonally adjusted level of new claims rose by 4,000 week on week
