Polling suggest public largely split on replacing Ginsburg before the election

In the latest Emerson College/NewsNation national poll of likely voters: 
  When asked if they think the Senate should confirm a Supreme Court Justice replacement nominated by President Trump now or by whoever wins the presidential election: 48% said they should vote to confirm now and 46% said they should wait till after the January inauguration. Eighty-eight percent (88%) of Republicans said they should vote now to confirm Trump’s nominee, and 82% of Democrats said they should wait till after the January inauguration. Independents were split: 45% said they should vote now to confirm Trump’s nominee, with 44% favoring to wait for the winner of the November election.

This is coming from a pollster that has a more realistic viewpoint of a Presidential election result, rather than the over the top media polling showing Joe Biden with double digit leads. Emerson has seen this race toggle between about a two point Biden lead and a six point Biden lead... which probably is fairly realistic at this point. So I would tend to believe this poll over any media based push poll that came out a day or two after the death.

We also had a poll that came out three days before Ginsburg passed that showed even a greater percentage of Americans felt that a USSC justice should be replaced by the sitting President (even close to an election). This is also not unlike 2016, when a majority of Americans disagreed with McConnell decision to not put the Merrick Garland nomination up for a vote.

Moreover, once you attach a name to the nomination, it no longer just becomes an "open seat" but also starts to represent the actual life of an American citizen caught on the political cross hairs of an angry minority Party. To some degree, the American public "will" take into consideration the qualification and (yes the feelings) of the nominee. If that nominee seems to have a valid claim for being on the high court, then should politics put a stop to someone's career advancement? We would never worry about who is President or when the next election is, when deciding who gets promoted to the CEO of some major corporation? Why does a Supreme Court candidate have to deal with that?

This was exactly some of the arguments that made people feel a little bad for Merrick Garland back in 2016. He seemed well respected and qualified for the position, and many felt like he was a victim of the political fall out. In fact, the general argument for not sitting Merrick Garland is exactly the same for not sitting Amy Barrett, which is that they are nothing like the person they are replacing (and that the person who was being replaced would have preferred someone different).

Many of us made the argument in 2016 that to a large degree the public had provided the Senate Majority to the Republicans and therefore McConnell had some justification for doing what he was doing. After all it was President Obama himself who was fond of telling Republicans who didn't get their way that "elections have consequences". Well one of Obama's biggest legacies was squandering a 60-40 Senate majority for Democrats and turning it into a Republican majority. The various elections that put McConnel in charge offered the consequences of no vote for Garland in 2016 and a likely vote for the likely nominee Barret in 2020. 

Nobody really believes that if the situation was reversed that Democrats wouldn't have done the exact same thing in both 2016 and 2020.

Is Roe v. Wade “settled law,” Feinstein asked Kavanaugh, “or can it be overturned?”

“It is settled as precedent under the Supreme Court,” Kavanaugh responded. “One of the important things to keep in mind about Roe v. Wade is it has been reaffirmed many times over the years, as you know.”

After this response, Feinstein asked about Kavanaugh’s personal beliefs on “a woman’s right to choose.” He responded that “as a judge” he would respect the “important precedent” of Roe v. Wade and its reaffirmations.

The most important case reaffirming Roe, Kavanaugh said, was the 1992 case Planned Parenthood vs. Casey, which restated that the right to an abortion was protected by the Constitution and said that states could not place an “undue burden” on women’s access to abortion. What constitutes an “undue burden” has since been the subject of many different court cases over state laws restricting abortion.

Like many other liberals, I’m devastated by Justice Ruth Bader Ginsburg’s death, which opened the way for President Donald Trump to nominate a third Supreme Court justice in his first term. And I’m revolted by the hypocrisy of Senate Majority Leader Mitch McConnell’s willingness to confirm Trump’s nominee after refusing to even allow a vote on Judge Merrick Garland.

Yet these political judgments need to be distinguished from a separate question: what to think about Judge Amy Coney Barrett, whom Trump has told associates he plans to nominate. And here I want to be extremely clear. Regardless of what you or I may think of the circumstances of this nomination, Barrett is highly qualified to serve on the Supreme Court.

We have a Supreme Court nominee who is a brilliant lawyer, a genuine and good person — and someone who holds views about how to interpret the law that I think are wrong and, in certain respects, misguided. I hope the senators at her hearing treat her with respect.

And when she is confirmed, I am going to accept it as the consequence of the constitutional rules we have and the choices we collectively and individually have made. And I’m going to be confident that Barrett is going to be a good justice, maybe even a great one — even if I disagree with her all the way.

The teenager, who was born in Mexico and does not have legal status, went to a hospital in Edinburg, Texas, with her aunt last week after experiencing gallbladder-related pain, her attorney, Sarah Valdes, told CBS News. She was then referred to undergo surgery in another hospital in San Antonio. But the girl and her aunt, who is also undocumented, did not have proper documents to travel through a CBP checkpoint on the way to San Antonio. CBP operates dozens of highway checkpoints in the interior of the country near the borders with Mexico and Canada. At these checkpoints, designed to curtail human and drug smuggling, agents can ask travelers for their immigration status.

CBP told CBS News that it learned of the family's status and sent Border Patrol agents to the Edinburg hospital to provide documents the child could use to travel through the checkpoint and to "process her and her aunt consistent with their immigration status."

There is an unrelenting myth that if we raise the minimum wage it will cause the inflation rate to rise. This is pure bullshit and needs to be debunked. To keep this from not getting too long, this will mostly focus on 1980’s-present.
The theory is that if the minimum wage rises, it will cause inflation. It says that corporations will raise prices in order to recuperate their profits that were lost from the increase of the cost of production, in this case, the increase of the minimum wage. Because employers will have to spend more money on their employees, they will just increase the prices to make it up. It makes sense in theory but that’s not how it works in reality.
In 1980 the minimum wage was increased; it went from $2.90 to $3.10. From 1979 to 1980, before the increase, inflation rose 2%, from 11% to 13%. After it was increased, 1980–1981, the inflation rate decreased from 13% to 10%.
In 1981 the minimum wage was increased to $3.35. We know that in 1980–1981, the inflation rate went down by 3% to 10%. After they increased the minimum wage again the next year, between 1981–1982, the inflation rate went down more, from 10% to 6%.
The next time the minimum wage rose was in 1990 and 1991. In 1989, the inflation rate was 4.8%, and rose to 5.4% in 1990. From 1990 to 1991, the minimum wage went up from $3.35 to $3.80 but the inflation rate decreased by 1.2% to 4.2%. The next year, in 1991, the minimum wage rose to $4.25 and again, the inflation rate did not increase. It went down to 3.0% in 1992.
So now you have several minimum wage increases in a row that did not cause the inflation rate to increase over the course of an entire decade. None of the minimum wage increases —in 1980, 1981, 1990, and 1991 — resulted in an increase of the yearly inflation rate. In fact, every single time there was a minimum wage increase, there was actually a correlation (I’m not saying a causation) with a decrease in the annual inflation rate.
The next two times the minimum wage was increased, was in 1996 and 1997. Between 1995–1996, the inflation rate rose to by 0.2% to 3.0%. After the first minimum wage increase to $4.75, inflation, yet again decreased. It went down 0.7% to 2.3%. In 1997, the minimum wage rose again to $5.15 and the inflation rate… decreased! Oh who could’ve seen that coming! The inflation rate went down from by 0.6% from 2.3% in 1997 to 1.6% in 1998.
Now you have the last three minimum wage increases; 2007, 2008 & 2009. In 2006, the inflation rate was 3.2%. Between 2007 and 2008 when the minimum wage was raised to $5.85, the inflation rate went up from 2.8% to 3.8%. But once it was raised to $6.55 in 2008, the inflation rate decreased by 4.2%. And for the last minimum wage hike to $7.25, inflation rose 2%. For only two times in recent history since the 1980’s has the inflation rising corresponded with a minimum wage increase. It is important to remember, however, that during this time we had a global food crisis and the financial crisis; inflation was going to rise regardless of whether or not the minimum wage had been increased. So even though the minimum wage increase corresponded with an inflation increase twice, it does not mean that raising the minimum wage triggered an automatic inflation increase.

Truly skilled workers (90% of the workforce) make far above minimum wage.

The dirty little secret is that unions negotiated contracts that indexes wages to the minimum wage do when it goes up, the contract wages go up/

This, high taxes, and extreme regulations, the hallmark of Democrat policies are the primary reason our manufacturing base was hollowed out and move to China.

No only did this lead to a shortage of high paying manufacturing jobs, it also left us strategically vulnerable.

As China's threat to cut off our supply of drugs over COVID-19 proved beyond any doubt.

With few tools to block Trump’s SCOTUS pick, Democrats are focused on making the stakes clear to voters—
including how a conservative court could decimate the ACA:

“Don’t use the word jurisprudence. Don’t talk about precedent. No one gives a sh**. People care about their health care.”

Six weeks out from the election, the death of Supreme Court Justice Ruth Bader Ginsburg sent the Democratic apparatus into a tailspin....[and] the reality is that congressional Democrats have little to no recourse when it comes to blocking a Donald Trump pick.

Senate Majority Leader Mitch McConnell already appears to have shored up enough Republican votes to muscle a nomination through the Senate. Senate Judiciary Committee Chairman Lindsey Graham is reportedly setting an aggressive schedule, with a vote coming as soon as the end of October.

“For people who hated Trump on the right but still turned out for him in 2016, this was always the carrot,” said a Democratic congressional staffer. “He’ll have nominated a third of the sitting justices on the Supreme Court in his first term, which is pretty remarkable.”

Tactically speaking, Democrats have a few “arrows in [their] quiver,” to borrow Speaker Nancy Pelosi’s characterization; in an interview over the weekend, Pelosi signaled that she isn’t ruling anything out. But according to sources I spoke with, the appetite to pursue such extreme options as shutting down the government or impeaching Attorney General William Barr, or even Trump again, is slim, even on the progressive end of the spectrum.

During a call with reporters on Wednesday, cochair of the Congressional Progressive Caucus Pramila Jayapal said the House Judiciary Committee, on which she sits, has “not initiated any of those processes,” and that when Pelosi discusses Democrats’ so-called quiver, “that doesn’t mean you use every arrow.”

In the Senate, where Republicans hold the majority, Democrats’ options boil down to delay tactics. For instance, given the rules around unanimous consent, an individual senator could, as a senior progressive congressional staffer put it, “grind things to a halt.” (Senator Rand Paul is a frequent practitioner of these kinds of dilatory tactics.) But, as this person added, “The question ultimately is about political will.”

Democrats also have the option to boycott the hearing on Trump’s nominee, but Democrats on the Senate Judiciary Committee have already ruled out the idea, and with good reason. By not showing up to ask questions in the hearing, Democrats would only speed up the process. They would also be ceding all ground to Republicans in terms of shaping public perception of the hearing and nominee. And Joe Biden’s running mate, Senator Kamala Harris, would be robbed of the spotlight in the arena where she first rose to national prominence.

On a Wednesday call with reporters, Congressman Mark Pocan dismissed these discussions, saying that there are “a few too many hypotheticals in there for me to give you an answer.”
Instead, they’re staying strictly on message, with the goal of raising the political cost for Senate Republicans.

“Right now, we’re gonna do our very best to focus on explaining why it doesn’t make sense to rush a Supreme Court nominee through and what the consequences of that are,” he said.

That messaging may not satisfy those on the left who are urging drastic action to forestall a Trump pick. But from a strategic standpoint, keeping the drama to a minimum would keep the focus on COVID-19 and the tanking economy, two factors that are likely to weigh heavily with most voters.

He construed the penalty imposed on those without health insurance as a tax, which permitted him to sustain the statute as a valid exercise of the taxing power; had he treated the payment as the statute did—as a penalty—he would have had to invalidate the statute as lying beyond Congress’s commerce power. Barnett vehemently objects to the idea that a commitment to judicial restraint— understood as deference to democratic majorities—can justify a judicial refusal to interpret the law as written.

She went on to write:

Barnett is surely right that deference to a democratic majority should not supersede a judge’s duty to apply clear text… If the majority did not enact a ‘tax,’ interpreting the statute to impose a tax lacks democratic legitimacy.”


In other words, Barrett disagreed with Chief Justice Roberts’ opinion that the ACA penalty was a “tax” and believed as such, it would invalidate the statute as being beyond Congress’ authority.

Not just Barrett, nearly every legal scholar of the textualist school was aghast at Robert's construction as a tax. It was clearly a penalty.

Even Gorshech objected and he had a similarly unique and (dangerous) construction on the word sex. By the words changing of the meaning over the years you can actually change the statue.

Gov. Kate Brown had declared a state of emergency in advance of the arrival of the Proud Boys, an all-male group whose members — many of whom support President Trump — often engage in provocations, threats or fighting with opponents at their events.

But as thousands gathered at three locations in the city — kept apart by a major law enforcement presence — the rallies unfolded during the afternoon with only a handful of confrontations and arrests.

Downtown Portland has been rocked by protests this summer, first over the police killings of Black people, and later over the Trump administration’s move to send federal agents to the city in an attempt to quell the demonstrations.

1. Her opinion is very much in the mainstream, The Obama administration was compelling the little sister's of the poor to subsidized birth control and abortifacients using a "cheap accounting trick" as a fig leaf. And while most people favor birth control that don't favor compelling religious organizations to subsidized birth control against their principles.

It's disheartening to see the "Pro-life" response to Justice Ruth Bader Ginsburg's death. It's clear the folks who think RBG was a vehement "baby killer" have never heard the name Susan Struck.

In the '60s & '70s, before Roe v. Wade, abortion was not only legal on US military bases, it was actively ENCOURAGED and basically mandated.

Yes, really.

Captain Susan Struck was a combat nurse in Vietnam. When she got pregnant in 1970, the Air Force starkly gave her two choices. Get an abortion or be discharged. Struck wanted to keep her baby. So she was kicked out of the service.

When she got back to the US, Struck sued the US Government for putting women in such a horrible position that they had to choose between either not being able to serve their country or getting an abortion that they didn't want.

Do you know which ACLU lawyer took her case and got the military to change their policy?

RUTH BADER GINSBURG.

Ginsburg approached this case with the same tenacity she would later use to help Congress draft the Pregnancy Discrimination Act of 1978. In the dark days after Roe in 1973, it was perfectly legal for employers in many states to put women in the same situation that Struck was put in - "deal with your pregnancy" or suffer the consequences of a lost job.

Ginsburg fought for the rights of women to choose life. She also fought for the rights of women to be able to work without discrimination, purchase homes, have bank accounts, and a myriad of other things that make it easier for women in desperate situations to choose life in the first place.

Life is never as black & white or simple as it looks through a myopic lens. It's never either/or. There are always "ands” and "buts" to everything.

So before you paint Justice Ginsburg as some satanic villain, at least acknowledge the many abortions that likely DIDN'T happen because of her tireless advocacy for women and families.

Dems have themselves to blame for the Coney Barrett nomination. After three years of nonstop investigations of Trump, he's not inclined to do them any favors. The other finalist, Lagoa, is a bilingual Cuban american who received 80 votes in her confirmation to get current court of appeals post. That's about as good as anyone gets. Trump could've put her up instead. Why didn't he? Because dems Washington impeached him and tried to remove him. So Barretts nomination is big middle finger right back to the hateful democrats.

And guess what? Justice Beyer in 83. Trump could get a 4th pick if we wins reelection.

And RBG should've retired during Obama's 8 years.

I don't know anybody who support pre-existing conditions and would rather they go away.

If your talking for support for coverage of pre-existing conditions, then nobody is talking about removing the requirement. Equating the ACA with that coverage is disingenuous hyperbole. If the ACA was declared unconstitutional tomorrow, coverage for pre-existing condition would survive.

Harris (Calif.) lead Trump and Vice President Pence by 53 percent to 43 percent among registered voters, statistically unchanged from the 12-point margin in a poll taken in August just before Democrats and Republicans held their conventions. Biden and Harris also have a 10-point advantage among likely voters, 54 percent to 44 percent.
Biden’s lead narrows to six points among likely voters (49 percent to 43 percent) and among registered voters (47 percent to 41 percent) when Libertarian Party nominee Jo Jorgensen and Green Party nominee Howie Hawkins are included as response options in the survey.

A sizable gender gap continues to fuel Biden’s lead, with women making the difference in the current state of the race. Joe Biden warned Saturday that Amy Coney Barrett, President Trump’s nominee to fill Ruth Bader Ginsburg’s Supreme Court seat, would help dismantle the Affordable Care Act if she is confirmed by the Senate.

In a statement issued as Trump was introducing Barrett in a ceremony in the White House Rose Garden, Biden noted that she had taken aim at the health care law put in place when he was vice president.

“She has a written track record of disagreeing with the U.S. Supreme Court’s decision upholding the Affordable Care Act,” Biden said in his statement. “She critiqued Chief Justice John Roberts’ majority opinion upholding the law in 2012.”

In 2017, Barrett wrote a review of a book by libertarian law professor Randy Barnett in which she criticized the court’s justification for upholding the legality of the Affordable Care Act, or ACA.

“Chief Justice Roberts pushed the Affordable Care Act beyond its plausible meaning to save the statute,” Barrett wrote.

Biden’s running mate, Sen. Kamala Harris, D-Calif., issued her own statement in which she also framed Barrett’s nomination in terms of the impact it could have on the ACA.

“From day one, President Trump made clear that he had a litmus test for Supreme Court Justices — destroy the Affordable Care Act’s protections for people with preexisting conditions and overturn our right to make our own health care decisions,” Harris said in her statement.

On Thursday, Trump held an event in Charlotte, N.C., where he signed an executive order that he said would improve health care in the U.S. and protect people with preexisting conditions from being denied insurance coverage.

“The historic action I’m taking today includes the first-ever executive order to affirm it is the official policy of the United States government to protect patients with preexisting conditions,” he said.

Those protections were put in place by the ACA under President Barack Obama. The Trump administration, along with a number of Republican-led states, is seeking to overturn the ACA in a case that will go before the Supreme Court shortly after it convenes for a new term in early October. Trump’s statement of “official policy” did not specify a mechanism for keeping preexisting coverage in place, or how it would be paid for.

Biden pointed out that ending coverage for preexisting conditions could make it difficult or impossible for patients recovering from COVID-19 to get health insurance.

If President Trump has his way, complications from COVID-19, like lung scarring and heart damage, could become the next deniable pre-existing condition.”

“As a U.S. Senator and member of the Judiciary Committee, I have a duty to ensure that a Supreme Court nominee will uphold the law and has a demonstrated commitment to equal justice,” Harris said, adding, “I will continue to fight on behalf of the people and strongly oppose the president’s nomination.”

Senate Minority Leader Chuck Schumer, D-N.Y., issued his own statement vowing to “strongly oppose this nomination,” citing the threat to the ACA and other issues that might come before the court: “a woman’s right to choose, workers’ rights, voting rights, civil rights, LGBTQ rights, environmental protections and more.”

Worth noting: While former top military leaders like Mattis and John Kelly are technically non-partisan, they both served in Trump's administration and have publicly expressed skepticism about the president's standing ahead of the 2020 election.

Mattis said Trump made a "mockery of our Constitution" and called him "the first president in my lifetime who does not try to unite the American people" after the president's response to mass protests in the wake of George Floyd's killing.

The bureau relied on a suspected Russian agent for its 2016 wiretaps


It was worse than we thought. We’re referring to the FBI’s 2016 investigation into the Trump campaign and Russia, as new documents this week reveal.

Senate Judiciary Chairman Lindsey Graham on Thursday released newly declassified FBI documents that contain this stunner: The bureau relied on a suspected Russian agent for the information it used to obtain a secret surveillance warrant against former Trump adviser Carter Page.

Four years into accusations about Russia-Trump collusion, we finally learn that Russia’s main conduit for disinformation may have been America’s FBI. Vladimir Putin must be howling with laughter.

Department of Justice Inspector General Michael Horowitz last year revealed that former spook Christopher Steele relied on one primary “subsource” for most of his accusations against the Trump campaign. This subsource was later identified as Ukrainian-born Igor Danchenko
, who worked as a research analyst from 2005 to 2010 at the Brookings Institution in Washington. The latest disclosures show that Mr. Danchenko was the subject of an FBI counterintelligence investigation from 2009 to 2011, based on concerns he was a Russian agent and “a threat to national security.”

According to the documents, Mr. Danchenko attempted to recruit two individuals connected to “an influential foreign policy advisor in the Obama administration.” He said that if they “did get a job in the government and had access to classified information,” he had a way for them “to make a little extra money.”

Further FBI investigation found Mr. Danchenko was an associate of two other “FBI counterintelligence subjects.” He also had contact with “the Russian Embassy and known Russian intelligence officers,” and the FBI went so far as to apply for a warrant to surveil Mr. Danchenko. The investigation ended because he left the country in September 2010, though the FBI said “consideration would be given to re-opening the investigation” if he returned. A lawyer for Mr. Danchenko in July said his client “is a highly respected senior research analyst” who wasn’t responsible for writing or editing the Steele dossier.

Here’s the kicker: The FBI identified Mr. Danchenko as Mr. Steele’s source in December 2016, when senior bureau officials also became aware of the prior FBI investigation. The FBI’s realization that it was being fed potential Russian disinformation should have put an immediate halt to the Page probe, if not the entire collusion investigation.
