When asked if they think the Senate should confirm a Supreme Court Justice replacement nominated by President Trump now or by whoever wins the presidential election: 48% said they should vote to confirm now and 46% said they should wait till after the January inauguration. Eighty-eight percent (88%) of Republicans said they should vote now to confirm Trump’s nominee, and 82% of Democrats said they should wait till after the January inauguration. Independents were split: 45% said they should vote now to confirm Trump’s nominee, with 44% favoring to wait for the winner of the November election.
This is coming from a pollster that has a more realistic viewpoint of a Presidential election result, rather than the over the top media polling showing Joe Biden with double digit leads. Emerson has seen this race toggle between about a two point Biden lead and a six point Biden lead... which probably is fairly realistic at this point. So I would tend to believe this poll over any media based push poll that came out a day or two after the death.
We also had a poll that came out three days before Ginsburg passed that showed even a greater percentage of Americans felt that a USSC justice should be replaced by the sitting President (even close to an election). This is also not unlike 2016, when a majority of Americans disagreed with McConnell decision to not put the Merrick Garland nomination up for a vote.
Moreover, once you attach a name to the nomination, it no longer just becomes an "open seat" but also starts to represent the actual life of an American citizen caught on the political cross hairs of an angry minority Party. To some degree, the American public "will" take into consideration the qualification and (yes the feelings) of the nominee. If that nominee seems to have a valid claim for being on the high court, then should politics put a stop to someone's career advancement? We would never worry about who is President or when the next election is, when deciding who gets promoted to the CEO of some major corporation? Why does a Supreme Court candidate have to deal with that?
This was exactly some of the arguments that made people feel a little bad for Merrick Garland back in 2016. He seemed well respected and qualified for the position, and many felt like he was a victim of the political fall out. In fact, the general argument for not sitting Merrick Garland is exactly the same for not sitting Amy Barrett, which is that they are nothing like the person they are replacing (and that the person who was being replaced would have preferred someone different).
Many of us made the argument in 2016 that to a large degree the public had provided the Senate Majority to the Republicans and therefore McConnell had some justification for doing what he was doing. After all it was President Obama himself who was fond of telling Republicans who didn't get their way that "elections have consequences". Well one of Obama's biggest legacies was squandering a 60-40 Senate majority for Democrats and turning it into a Republican majority. The various elections that put McConnel in charge offered the consequences of no vote for Garland in 2016 and a likely vote for the likely nominee Barret in 2020.
Nobody really believes that if the situation was reversed that Democrats wouldn't have done the exact same thing in both 2016 and 2020.

Totally true.
Roe v. Wade was the defining moment. The decision was bad logically, bad law, and bad politics.
Kanvanaugh told Collins it was "settled law."
Excuse me, speaking to Feinstein, he called it "settled precedent."
In response to questions about his stance on abortion from Sen. Dianne Feinstein, Judge Brett Kavanaugh, President Trump’s Supreme Court nominee, called Roe v. Wade — the 1973 Supreme Court decision that legalized abortion nationwide — “settled Supreme Court precedent” that has been “reaffirmed many times” over the years.
Wednesday was the second day of Kavanaugh’s confirmation hearing, and the senators' opening questions revolved around three issues: Kavanaugh’s beliefs regarding the extent of presidential power, gun control, and abortion.
Is Roe v. Wade “settled law,” Feinstein asked Kavanaugh, “or can it be overturned?”
“It is settled as precedent under the Supreme Court,” Kavanaugh responded. “One of the important things to keep in mind about Roe v. Wade is it has been reaffirmed many times over the years, as you know.”
After this response, Feinstein asked about Kavanaugh’s personal beliefs on “a woman’s right to choose.” He responded that “as a judge” he would respect the “important precedent” of Roe v. Wade and its reaffirmations.
The most important case reaffirming Roe, Kavanaugh said, was the 1992 case Planned Parenthood vs. Casey, which restated that the right to an abortion was protected by the Constitution and said that states could not place an “undue burden” on women’s access to abortion. What constitutes an “undue burden” has since been the subject of many different court cases over state laws restricting abortion.

Democrats Will Shift Focus In Supreme Court Fight
Washington Post: “Several of their recent confirmation battles, as well as their strategy during the impeachment trial of President Trump, focused on complaints about how the Senate GOP majority steamrolled the minority party’s rights. This process-centric approach produced polling that the public backed the Democratic position, but they lost the bigger battles and the issue often faded from relevance.
“Instead, in sync with Joe Biden’s presidential campaign, Democrats want to replicate their successful 2017 fight to preserve the Affordable Care Act, which peeled off enough GOP senators to defeat Trump’s bid to repeal the health law. They remain skeptical of defeating this particular nominee...but Democrats believe this policy-focused message could propel them to big wins in the November elections.”

Amy Coney Barrett Deserves to Be on the Supreme Court
By Noah Feldman
I disagree with Trump's judicial nominee on almost everything. But I still think she's brilliant.
Like many other liberals, I’m devastated by Justice Ruth Bader Ginsburg’s death, which opened the way for President Donald Trump to nominate a third Supreme Court justice in his first term. And I’m revolted by the hypocrisy of Senate Majority Leader Mitch McConnell’s willingness to confirm Trump’s nominee after refusing to even allow a vote on Judge Merrick Garland.
Yet these political judgments need to be distinguished from a separate question: what to think about Judge Amy Coney Barrett, whom Trump has told associates he plans to nominate. And here I want to be extremely clear. Regardless of what you or I may think of the circumstances of this nomination, Barrett is highly qualified to serve on the Supreme Court.
...
We have a Supreme Court nominee who is a brilliant lawyer, a genuine and good person — and someone who holds views about how to interpret the law that I think are wrong and, in certain respects, misguided. I hope the senators at her hearing treat her with respect.
And when she is confirmed, I am going to accept it as the consequence of the constitutional rules we have and the choices we collectively and individually have made. And I’m going to be confident that Barrett is going to be a good justice, maybe even a great one — even if I disagree with her all the way.

What will the final electoral vote be?
Biden 353 (where it is right now with no toss ups) is surely too high, as the race will tighten in the final days, so where do you put Biden's victory amount when it eventually does come?
You are always proud of how right you say you have been in the past, so where do you predict the electoral vote numbers will finally stand?

“As black Christians we will not stand by in silence as our sister in the faith is persecuted for the ‘political crime’ of her beliefs,” said the letter, which was signed by numerous clergy members, scholars, and religious leaders.

A 15-year-old girl who has lived in the U.S. with her family since she was an infant is now alone in government custody and facing deportation after she was arrested by Customs and Border Protection (CBP) officials at a Texas hospital.
The teenager, who was born in Mexico and does not have legal status, went to a hospital in Edinburg, Texas, with her aunt last week after experiencing gallbladder-related pain, her attorney, Sarah Valdes, told CBS News. She was then referred to undergo surgery in another hospital in San Antonio. But the girl and her aunt, who is also undocumented, did not have proper documents to travel through a CBP checkpoint on the way to San Antonio. CBP operates dozens of highway checkpoints in the interior of the country near the borders with Mexico and Canada. At these checkpoints, designed to curtail human and drug smuggling, agents can ask travelers for their immigration status.
CBP told CBS News that it learned of the family's status and sent Border Patrol agents to the Edinburg hospital to provide documents the child could use to travel through the checkpoint and to "process her and her aunt consistent with their immigration status."

The best economy in history?
Economic growth
Trump says he had the “greatest economy in history” during the GOP convention, a claim fact-checkers quickly marked as false. A look at economic growth shows why.
The economy grew just shy of 1 percent in Obama’s first term when the Great Recession took its toll. Growth improved to 2.3 percent in Obama’s second term. Under Trump, the economy is on track to average slightly above zero in his first term because of the sharp losses from the pandemic.
Permanent job losses are growing in the coronavirus recession
Excluding 2020, growth in Trump’s initial three years in office was 2.5 percent — barely above Obama and well below the growth under the Clinton, Reagan and Johnson administrations.
What the fuck .

There is an unrelenting myth that if we raise the minimum wage it will cause the inflation rate to rise. This is pure bullshit and needs to be debunked. To keep this from not getting too long, this will mostly focus on 1980’s-present.
The theory is that if the minimum wage rises, it will cause inflation. It says that corporations will raise prices in order to recuperate their profits that were lost from the increase of the cost of production, in this case, the increase of the minimum wage. Because employers will have to spend more money on their employees, they will just increase the prices to make it up. It makes sense in theory but that’s not how it works in reality.
In 1980 the minimum wage was increased; it went from $2.90 to $3.10. From 1979 to 1980, before the increase, inflation rose 2%, from 11% to 13%. After it was increased, 1980–1981, the inflation rate decreased from 13% to 10%.
In 1981 the minimum wage was increased to $3.35. We know that in 1980–1981, the inflation rate went down by 3% to 10%. After they increased the minimum wage again the next year, between 1981–1982, the inflation rate went down more, from 10% to 6%.
The next time the minimum wage rose was in 1990 and 1991. In 1989, the inflation rate was 4.8%, and rose to 5.4% in 1990. From 1990 to 1991, the minimum wage went up from $3.35 to $3.80 but the inflation rate decreased by 1.2% to 4.2%. The next year, in 1991, the minimum wage rose to $4.25 and again, the inflation rate did not increase. It went down to 3.0% in 1992.
So now you have several minimum wage increases in a row that did not cause the inflation rate to increase over the course of an entire decade. None of the minimum wage increases —in 1980, 1981, 1990, and 1991 — resulted in an increase of the yearly inflation rate. In fact, every single time there was a minimum wage increase, there was actually a correlation (I’m not saying a causation) with a decrease in the annual inflation rate.
The next two times the minimum wage was increased, was in 1996 and 1997. Between 1995–1996, the inflation rate rose to by 0.2% to 3.0%. After the first minimum wage increase to $4.75, inflation, yet again decreased. It went down 0.7% to 2.3%. In 1997, the minimum wage rose again to $5.15 and the inflation rate… decreased! Oh who could’ve seen that coming! The inflation rate went down from by 0.6% from 2.3% in 1997 to 1.6% in 1998.
Now you have the last three minimum wage increases; 2007, 2008 & 2009. In 2006, the inflation rate was 3.2%. Between 2007 and 2008 when the minimum wage was raised to $5.85, the inflation rate went up from 2.8% to 3.8%. But once it was raised to $6.55 in 2008, the inflation rate decreased by 4.2%. And for the last minimum wage hike to $7.25, inflation rose 2%. For only two times in recent history since the 1980’s has the inflation rising corresponded with a minimum wage increase. It is important to remember, however, that during this time we had a global food crisis and the financial crisis; inflation was going to rise regardless of whether or not the minimum wage had been increased. So even though the minimum wage increase corresponded with an inflation increase twice, it does not mean that raising the minimum wage triggered an automatic inflation increase.

Trump Threatens Integrity of the Election
Dan Balz: “Each week has brought evidence of the damage President Trump has done during his nearly four years in office. According to his own words, he is not finished. This past week brought a renewed warning of a harm he could yet inflict on the integrity of elections.”
“The president did more than simply refuse to pledge that he would facilitate a peaceful transfer of power if he loses to former vice president Joe Biden, though that in itself was a step no previous president has taken. In doing so, he escalated his ongoing attack on mail-in ballots, seeding the ground to contest the election as rigged or fraudulent if he is not the winner and to propel the country into chaos.”
“Perhaps what Trump said merely reflected the mind-set of a president who knows he is running behind in his bid for a second term, one more rhetorical flailing to somehow throw the opposition off balance and to distract from the real reasons for Biden’s lead in the polls. But this close to the election, anything Trump does to question the validity of the count should be regarded as serious and treated as such.”

There is an unrelenting myth that if we raise the minimum wage it will cause the inflation rate to rise.
It is also a myth that the minimum wage is the most common wage, it is not. It is only given to high school students' first job, retirees and unskilled workers.
Truly skilled workers (90% of the workforce) make far above minimum wage.
The dirty little secret is that unions negotiated contracts that indexes wages to the minimum wage do when it goes up, the contract wages go up/

Trump's work for Black community 'unparalleled to any other president' of past 50 years: Dem lawmaker
Vernon Jones calls on president to declare Black Lives Matter a terror organization
President Trump's commitment to the African-American community is "unparalleled to any other president, Democrat or Republican, in the past 50 years," Georgia Democratic lawmaker Vernon Jones told "Special Report" Friday.
"Four years ago he [Trump] talked about what he wanted to do for the Black community and he brought about results," Jones told host Bret Baier. "Opportunity zone districts, support of historically Black colleges, and prison reform with the First Step Act."
"President Obama and Vice President Joe Biden did not have a plan for African-Americans," Jones said later. "President Obama meant a lot to Black people but he didn't do anything for Black people. And certainly Joe Biden followed suit. But this president is back again, laying out his future [plans] on how he is going to assist to lift the Black community out of dark conditions such as school choice.
The president's so-called "Platinum Plan" calls for a nearly $500 billion increase in Black communities' access to economic capital. It also designates the Ku Klux Klan and Antifa as terrorist organizations.
How They’re Preparing for the Debates

“Trump has decided to skip any formal preparation. And while Biden’s team believes the significance of the debate may be exaggerated, the Democratic nominee has been aggressively preparing to take on the president.
“Biden’s campaign has been holding mock debate sessions featuring Bob Bauer, a senior Biden adviser and former White House general counsel, playing the role of Trump… Bauer has not actually donned a Trump costume in line with Trump stand-ins from previous years, but he is representing his style and expected strategy.”

Politico:
“The two sides have decided to forego the traditional pre-debate handshake in light of the virus, according to a person with direct knowledge of the negotiations. They also won’t do an elbow-bump, a coronavirus-era handshake substitute which both campaigns saw as awkward.
“Neither Trump nor Biden nor the debate moderator, Fox News host Chris Wallace, will wear masks.
“And unlike past presidential debates, there will be a limited audience of only 75 to 80 people, all of whom will be tested prior to attending the debate.”

“THIS IS REALLY SIMPLE, AMERICA”:
HOW DEMOCRATS PLAN TO MAKE TRUMP’S SCOTUS PICK RADIOACTIVE
With few tools to block Trump’s SCOTUS pick, Democrats are focused on making the stakes clear to voters—
including how a conservative court could decimate the ACA:
“Don’t use the word jurisprudence. Don’t talk about precedent. No one gives a sh**. People care about their health care.”
Six weeks out from the election, the death of Supreme Court Justice Ruth Bader Ginsburg sent the Democratic apparatus into a tailspin....[and] the reality is that congressional Democrats have little to no recourse when it comes to blocking a Donald Trump pick.
Senate Majority Leader Mitch McConnell already appears to have shored up enough Republican votes to muscle a nomination through the Senate. Senate Judiciary Committee Chairman Lindsey Graham is reportedly setting an aggressive schedule, with a vote coming as soon as the end of October.
“For people who hated Trump on the right but still turned out for him in 2016, this was always the carrot,” said a Democratic congressional staffer. “He’ll have nominated a third of the sitting justices on the Supreme Court in his first term, which is pretty remarkable.”
Tactically speaking, Democrats have a few “arrows in [their] quiver,” to borrow Speaker Nancy Pelosi’s characterization; in an interview over the weekend, Pelosi signaled that she isn’t ruling anything out. But according to sources I spoke with, the appetite to pursue such extreme options as shutting down the government or impeaching Attorney General William Barr, or even Trump again, is slim, even on the progressive end of the spectrum.
During a call with reporters on Wednesday, cochair of the Congressional Progressive Caucus Pramila Jayapal said the House Judiciary Committee, on which she sits, has “not initiated any of those processes,” and that when Pelosi discusses Democrats’ so-called quiver, “that doesn’t mean you use every arrow.”
In the Senate, where Republicans hold the majority, Democrats’ options boil down to delay tactics. For instance, given the rules around unanimous consent, an individual senator could, as a senior progressive congressional staffer put it, “grind things to a halt.” (Senator Rand Paul is a frequent practitioner of these kinds of dilatory tactics.) But, as this person added, “The question ultimately is about political will.”
Democrats also have the option to boycott the hearing on Trump’s nominee, but Democrats on the Senate Judiciary Committee have already ruled out the idea, and with good reason. By not showing up to ask questions in the hearing, Democrats would only speed up the process. They would also be ceding all ground to Republicans in terms of shaping public perception of the hearing and nominee. And Joe Biden’s running mate, Senator Kamala Harris, would be robbed of the spotlight in the arena where she first rose to national prominence.
Without any actionable battle plan, Democrats are focused on winning the messaging fight. Polling from CNN suggests they have a head start, with nearly six in 10 Americans indicating that they think the winner of November’s election should fill the open Supreme Court seat.
In the days since Ginsburg passed, Democrats have zeroed in on a Supreme Court case over the Affordable Care Act, slated for mid-November, to make their argument.
“This is at once really complicated and really simple. And it’s really simple because we took back the house in ’18 by talking about health care and talking about nothing other than health care,” a Democratic Senate aide told me.
“This is really simple, America. The ACA is about to go away because of this. Don’t use the word jurisprudence. Don’t talk about precedent. No one gives a shit. People care about their health care.”
The key will be not to get cornered into talking about issues like axing the Senate filibuster or packing the Supreme Court—two things predicated on a Biden victory and retaking the Senate majority anyway, and even then the vote count would be questionable. On a Wednesday call with reporters, Congressman Mark Pocan dismissed these discussions, saying that there are “a few too many hypotheticals in there for me to give you an answer.”
Instead, they’re staying strictly on message, with the goal of raising the political cost for Senate Republicans.
“Right now, we’re gonna do our very best to focus on explaining why it doesn’t make sense to rush a Supreme Court nominee through and what the consequences of that are,” he said.
That messaging may not satisfy those on the left who are urging drastic action to forestall a Trump pick. But from a strategic standpoint, keeping the drama to a minimum would keep the focus on COVID-19 and the tanking economy, two factors that are likely to weigh heavily with most voters.
Well, Ch, that works both ways. Does anyone "really" believe that the GOP, if they had been treated as the Dems have now been treated, would not take advantage of a new Senate majority to PACK THE COURT?

Over three linked tweets, Trump wrote: "I was never a big fan of John McCain, disagreed with him on many things including ridiculous endless wars and the lack of success he had in dealing with the VA and our great Vets, but the lowering of our Nations American Flags, and the first class funeral he was given by our Country, had to be approved by me, as President, & I did so without hesitation or complaint. Quite the contrary, I felt it was well deserved. I even sent Air Force One to bring his body, in casket, from Arizona to Washington. It was my honor to do so. Also, I never called John a loser and swear on whatever, or whoever, I was asked to swear on, that I never called our great fallen soldiers anything other than HEROES. This is more made up Fake News given by disgusting & jealous failures in a disgraceful attempt to influence the 2020 Election!"
Here, we’ll focus on Trump’s assertion that he "never called (McCain) a loser."
The reality is that Trump did say that about McCain in a widely noted public event in 2015.
The event in question was a family leadership summit in Ames, Iowa, on July 18, 2015. Here’s the full video, with the remarks in question coming at about the 5:10 mark.
After Trump recalled McCain saying something that Trump considered an insult to him and his supporters, "I said, 'Somebody should run against McCain,' who has been, in my opinion, not so hot. And I supported him for president! I raised a million dollars for him. That's a lot of money! I supported him. He lost. He let us down. But he lost. So I never liked him much after that, because I don't like losers."
Amid audience laughter, the moderator, Republican pollster Frank Luntz, then interjected, "But he's a war hero!"
Trump responded, "He’s not a war hero. He’s a war hero because he was captured. I like people that weren’t captured."
Later that day, Trump retweeted, with seeming approval, a web post headlined "Donald Trump: John McCain Is ‘A Loser,’" that recapped his exchange at the summit.
Neither the White House nor Trump’s campaign responded to an inquiry for this article.
Our ruling: Trump tweeted, "I never called John (McCain) a loser."
That’s false. He called McCain a loser at a televised event in 2015 and then, later that day, tweeted out a web post recapping the event.
We rate the statement Pants on Fire!

Not only that, but when Trump said,"I was never a big fan of John McCain, disagreed with him on many things including ridiculous endless wars and the lack of success he had in dealing with the VA and our great Vets, but the lowering of our Nations American Flags, and the first class funeral he was given by our Country, had to be approved by me, as President, & I did so without hesitation or complaint. Quite the contrary, I felt it was well deserved."
THAT TOO IS A LIE.
The Atlantic reported Thursday that when Sen. John McCain died in 2018, Trump told his staff that "we're not going to support that loser's funeral" and was furious when the flags were lowered to honor the senator for his public and military service.
Trump denied the report, claiming that he approved the lowering of the flags and funeral services for McCain "without hesitation or complaint."
Former chief of staff at the Department of Homeland Security Miles Taylor responded to the president's tweets, writing in his own post "that is not true."
He said President Trump tried to rescind flag half-staff orders following the death of Sen. John McCain (R-Ariz.).
The New York Times interviewed Taylor on Friday, who said he was on a counterterrorism trip in Australia at the time when he received calls from White House officials questioning the half-staff order for McCain.
"I get someone from the White House, a senior person there, who calls and says, 'What is going on with the flags? The president is upset, this has gone out too soon and he doesn't want it to happen.'"
WHAT A LYING LIAR TRUMP IS.
At the White House, almost every person is white and no masks. An impeached and minority popular vote President, should not be able nominate a justice to the Supreme Court of the United States.
Election Day is just weeks away, and millions of Americans are already voting because the stakes in this election could not be higher. They feel the urgency of this choice – an urgency made all the more acute by what’s at stake at the U.S. Supreme Court.
They are voting because their health care hangs in the balance. They are voting because they worry about losing their right to vote or being expelled from the only country they have ever known. They are voting right now because they fear losing their collective bargaining rights. They are voting to demand that equal justice be guaranteed for all. They are voting because they don’t want Roe v. Wade, which has been the law of the land for nearly half a century, to be overturned.
President Trump has been trying to throw out the Affordable Care Act for four years. Republicans have been trying to end it for a decade. Twice, the U.S. Supreme Court upheld the law as constitutional.
But even now, in the midst of a global health pandemic, the Trump Administration is asking the U.S. Supreme Court to overturn the entire law, including its protections for people with pre-existing conditions. If President Trump has his way, complications from COVID-19, like lung scarring and heart damage, could become the next deniable pre-existing condition.
Today, President Trump has nominated Judge Amy Coney Barrett as the successor to Justice Ginsburg’s seat. She has a written track record of disagreeing with the U.S. Supreme Court’s decision upholding the Affordable Care Act. She critiqued Chief Justice John Roberts’ majority opinion upholding the law in 2012.
The American people know the U.S. Supreme Court decisions affect their everyday lives. The United States Constitution was designed to give the voters one chance to have their voice heard on who serves on the Court. That moment is now and their voice should be heard. The Senate should not act on this vacancy until after the American people select their next president and the next Congress.
Thanks to President @realDonaldTrump strong women like Judge Amy Coney Barrett are shattering the glass ceiling - not Hillary Clinton - and liberals are completely losing their minds!

Let's see if they are smart. Early indications are not encouraging.
If the Republicans were smart, they'd let the next President determine who is nominated, as most Americans want.
Early indications are that they are not smart.

Barrett on the Chief Justice Roberts approval of the ACA. She should not be appointed to the Supreme Court!
Chief Justice Roberts pushed the Affordable Care Act beyond its plausible meaning to save the statute. He construed the penalty imposed on those without health insurance as a tax, which permitted him to sustain the statute as a valid exercise of the taxing power; had he treated the payment as the statute did—as a penalty—he would have had to invalidate the statute as lying beyond Congress’s commerce power. Barnett vehemently objects to the idea that a commitment to judicial restraint— understood as deference to democratic majorities—can justify a judicial refusal to interpret the law as written.
She went on to write:
Barnett is surely right that deference to a democratic majority should not supersede a judge’s duty to apply clear text… If the majority did not enact a ‘tax,’ interpreting the statute to impose a tax lacks democratic legitimacy.”
In other words, Barrett disagreed with Chief Justice Roberts’ opinion that the ACA penalty was a “tax” and believed as such, it would invalidate the statute as being beyond Congress’ authority.
Trump had 3 and a half years to get rid of the ACA, so now he's using his authority to overturn the ACA

The simple fact is that the Obama administration is compelling religious people and institutions who are employers to purchase a health-insurance contract that provides abortion-inducing drugs, contraception and sterilization. This is a grave violation of religious freedom and cannot stand. It is an insult to the intelligence of Catholics, Protestants, Eastern Orthodox Christians, Jews, Muslims and other people of faith and conscience to imagine that they will accept an assault on their religious liberty if only it is covered up by a cheap accounting trick.”
The statement she signed concluded:
Finally, it bears noting that by sustaining the original narrow exemptions for churches, auxiliaries and religious orders, the administration has effectively admitted that the new policy (like the old one) amounts to a grave infringement on religious liberty. The administration still fails to understand that institutions that employ and serve others of different or no faith are still engaged in a religious mission and, as such, enjoy the protections of the First Amendment.”

In other words, Barrett disagreed with Chief Justice Roberts’ opinion that the ACA penalty was a “tax” and believed as such
Not just Barrett, nearly every legal scholar of the textualist school was aghast at Robert's construction as a tax. It was clearly a penalty.
Even Gorshech objected and he had a similarly unique and (dangerous) construction on the word sex. By the words changing of the meaning over the years you can actually change the statue.
The will lead to an Orwellian situation where all you have to do the change the law is change the meaning of a word.
Birth control pills would be banned, because they prevent fertilizing eggs.
I'm old enough to remember the discussion of birth control pills.
I suspect that if a case came to the Supreme Court, Birth control pills would be banned, because they prevent sperm from fertilizing eggs.
Birth control will not be ban but nobody should be forced to pay for someone else's lifestyle choices.
And if a group "like little sister's of the poor" has a well founded religious objection then they should pay for birth control at all.
And nobody should have to pay for somebody else's abortion. That's like reimbursing Murder, Inc with taxpayer money.

PORTLAND, Ore. — Members of the right-wing Proud Boys and their supporters rallied in a Portland park on Saturday as leftist activists launched their own counter-rallies, raising the temperature of a city already on edge as officials pleaded for the ralliers to refrain from violence.
Gov. Kate Brown had declared a state of emergency in advance of the arrival of the Proud Boys, an all-male group whose members — many of whom support President Trump — often engage in provocations, threats or fighting with opponents at their events.
But as thousands gathered at three locations in the city — kept apart by a major law enforcement presence — the rallies unfolded during the afternoon with only a handful of confrontations and arrests.
Downtown Portland has been rocked by protests this summer, first over the police killings of Black people, and later over the Trump administration’s move to send federal agents to the city in an attempt to quell the demonstrations.

Rioting Radicals Will Have Free Reign if Biden Gets Elected
If you are tired of seeing radical leftists riot in the streets, just wait until they run our federal government with the help of Joe Biden.
The Democrat Party and the liberal media want us to believe that Biden would tame the violent progressives who have been ransacking and pillaging our cities if he gets elected president this November. This appealing promise, however, is nothing but a deadly trap designed to deceive the American people into voting against our own best interests.
Despite his desperate, superficial pivot to the center in recent weeks, Biden always has been and always will be a key ally of the radical left. In fact, the Democrat nominee is the radicals’ only hope of taking control of the presidency in this election and ensuring that their unhinged slogans and demands are translated into public policy.

Telling the Truth About Slavery Is Not ‘Indoctrination’
It's disheartening to see the "Pro-life" response to Justice Ruth Bader Ginsburg's death. It's clear the folks who think RBG was a vehement "baby killer" have never heard the name Susan Struck.
In the '60s & '70s, before Roe v. Wade, abortion was not only legal on US military bases, it was actively ENCOURAGED and basically mandated.
Yes, really.
Captain Susan Struck was a combat nurse in Vietnam. When she got pregnant in 1970, the Air Force starkly gave her two choices. Get an abortion or be discharged. Struck wanted to keep her baby. So she was kicked out of the service.
When she got back to the US, Struck sued the US Government for putting women in such a horrible position that they had to choose between either not being able to serve their country or getting an abortion that they didn't want.
Do you know which ACLU lawyer took her case and got the military to change their policy?
RUTH BADER GINSBURG.
Ginsburg approached this case with the same tenacity she would later use to help Congress draft the Pregnancy Discrimination Act of 1978. In the dark days after Roe in 1973, it was perfectly legal for employers in many states to put women in the same situation that Struck was put in - "deal with your pregnancy" or suffer the consequences of a lost job.
Ginsburg fought for the rights of women to choose life. She also fought for the rights of women to be able to work without discrimination, purchase homes, have bank accounts, and a myriad of other things that make it easier for women in desperate situations to choose life in the first place.
Life is never as black & white or simple as it looks through a myopic lens. It's never either/or. There are always "ands” and "buts" to everything.
So before you paint Justice Ginsburg as some satanic villain, at least acknowledge the many abortions that likely DIDN'T happen because of her tireless advocacy for women and families.
#RBG
So before you paint Justice Ginsburg as some satanic villain, at least acknowledge the many abortions that likely DIDN'T happen because of her tireless advocacy for women and families.

My own commentary. Not a copy paste from another website.
Dems have themselves to blame for the Coney Barrett nomination. After three years of nonstop investigations of Trump, he's not inclined to do them any favors. The other finalist, Lagoa, is a bilingual Cuban american who received 80 votes in her confirmation to get current court of appeals post. That's about as good as anyone gets. Trump could've put her up instead. Why didn't he? Because dems Washington impeached him and tried to remove him. So Barretts nomination is big middle finger right back to the hateful democrats.
And guess what? Justice Beyer in 83. Trump could get a 4th pick if we wins reelection.
And RBG should've retired during Obama's 8 years.
Most people support the ACA and pre existing conditions
I don't know anybody who support pre-existing conditions and would rather they go away.
If your talking for support for coverage of pre-existing conditions, then nobody is talking about removing the requirement. Equating the ACA with that coverage is disingenuous hyperbole. If the ACA was declared unconstitutional tomorrow, coverage for pre-existing condition would survive.
And polling suggests that women are giving trump the middle finger as the GOP drags womens rights back to the middle ages and existing conditions are your problem......assholes....

After two political conventions, the continuing spread of the novel coronavirus, economic dislocation, more racial upheaval and a coming battle over a Supreme Court vacancy, the race for the White House remains stable, with former vice president Joe Biden holding a steady advantage over President Trump, according to a Washington Post-ABC News poll.
Biden and vice-presidential nominee Sen. Kamala D. Harris (Calif.) lead Trump and Vice President Pence by 53 percent to 43 percent among registered voters, statistically unchanged from the 12-point margin in a poll taken in August just before Democrats and Republicans held their conventions. Biden and Harris also have a 10-point advantage among likely voters, 54 percent to 44 percent.
Biden’s lead narrows to six points among likely voters (49 percent to 43 percent) and among registered voters (47 percent to 41 percent) when Libertarian Party nominee Jo Jorgensen and Green Party nominee Howie Hawkins are included as response options in the survey.
Biden maintains national lead among registered voters
A sizable gender gap continues to fuel Biden’s lead, with women making the difference in the current state of the race. Trump has a lead of 55 percent to 42 percent among male likely voters, but Biden has an even larger 65 percent to 34 percent advantage among female likely voters. Trump’s lead among men is about the same as his margin over Hillary Clinton in 2016, but Biden’s lead among women is more than twice as large as Clinton’s was then.

BTW.....balls....no one is complaining about a vaccine as you describe....again you are just full of shit!!!!!!

Curious how democrats complain about the number of virus cases while also complaining about attempts to find a vaccine. It's almost as if they'll criticize whatever Trump does.
to dems everything is political.
Even God.
Good news is cases don't really mean much with the greatly increased testing numbers, the false positives and problems found with pcr sensitivity, and a "weakening" virus that has a substantially lower hospitalization rate.
But fear mongering will continue until at least the election... Must be very depressing being a democrat
Why do polls clearly show that Democrats and most other Americans do not trust Trump to tell the truth about either the virus or a vaccine?
DON'T PANIC!
Still unchanged.

Biden issues warning on Trump's Supreme Court pick
Yahoo News Sep 27th 2020 4:58AM
Joe Biden warned Saturday that Amy Coney Barrett, President Trump’s nominee to fill Ruth Bader Ginsburg’s Supreme Court seat, would help dismantle the Affordable Care Act if she is confirmed by the Senate.
In a statement issued as Trump was introducing Barrett in a ceremony in the White House Rose Garden, Biden noted that she had taken aim at the health care law put in place when he was vice president.
“She has a written track record of disagreeing with the U.S. Supreme Court’s decision upholding the Affordable Care Act,” Biden said in his statement. “She critiqued Chief Justice John Roberts’ majority opinion upholding the law in 2012.”
In 2017, Barrett wrote a review of a book by libertarian law professor Randy Barnett in which she criticized the court’s justification for upholding the legality of the Affordable Care Act, or ACA.
“Chief Justice Roberts pushed the Affordable Care Act beyond its plausible meaning to save the statute,” Barrett wrote.
Biden’s running mate, Sen. Kamala Harris, D-Calif., issued her own statement in which she also framed Barrett’s nomination in terms of the impact it could have on the ACA.
“From day one, President Trump made clear that he had a litmus test for Supreme Court Justices — destroy the Affordable Care Act’s protections for people with preexisting conditions and overturn our right to make our own health care decisions,” Harris said in her statement.
On Thursday, Trump held an event in Charlotte, N.C., where he signed an executive order that he said would improve health care in the U.S. and protect people with preexisting conditions from being denied insurance coverage.
“The historic action I’m taking today includes the first-ever executive order to affirm it is the official policy of the United States government to protect patients with preexisting conditions,” he said.
Those protections were put in place by the ACA under President Barack Obama. The Trump administration, along with a number of Republican-led states, is seeking to overturn the ACA in a case that will go before the Supreme Court shortly after it convenes for a new term in early October. Trump’s statement of “official policy” did not specify a mechanism for keeping preexisting coverage in place, or how it would be paid for.
Biden pointed out that ending coverage for preexisting conditions could make it difficult or impossible for patients recovering from COVID-19 to get health insurance.
“President Trump has been trying to throw out the Affordable Care Act for four years. Republicans have been trying to end it for a decade,” Biden said in his statement, adding, “But even now, in the midst of a global health pandemic, the Trump Administration is asking the U.S. Supreme Court to overturn the entire law, including its protections for people with pre-existing conditions. If President Trump has his way, complications from COVID-19, like lung scarring and heart damage, could become the next deniable pre-existing condition.”
While Democrats appear to lack the votes to block Barrett’s nomination, Harris, who sits on the Senate Judiciary Committee and will question the nominee during her confirmation hearings, made clear that she would do her best to derail the nomination.
“As a U.S. Senator and member of the Judiciary Committee, I have a duty to ensure that a Supreme Court nominee will uphold the law and has a demonstrated commitment to equal justice,” Harris said, adding, “I will continue to fight on behalf of the people and strongly oppose the president’s nomination.”
Senate Minority Leader Chuck Schumer, D-N.Y., issued his own statement vowing to “strongly oppose this nomination,” citing the threat to the ACA and other issues that might come before the court: “a woman’s right to choose, workers’ rights, voting rights, civil rights, LGBTQ rights, environmental protections and more.”
That's the party line, but even Fox news poll shows the President is in danger of a landslide loss

Former Pennsylvania Gov. Tom Ridge announced in an op-ed Sunday that he would be voting for Joe Biden.
Why it matters: Ridge, who was also the first secretary of homeland security under George W. Bush, joins other prominent Republicans who have publicly said they will either not vote for Trump's re-election this November or will back Biden.
Not voting for Trump:
Sen. Mitt Romney (Utah): The party's 2012 presidential nominee said in February that he will not support Trump shortly after he voted to convict the president on one count in his impeachment trial.
John Bolton: Trump's former national security adviser said he will not vote for Biden or Trump and hopes that history remembers Trump "as a one-term president."
Jeff Flake: The Arizona Senator said he will not vote for Trump, but added that he's never voted for a Democrat for president, per The Washington Post.
William H. McRaven: McRaven, who led the raid that killed Osama bin Laden, has publicly criticized the president. He told The New York Times, "This fall, it's time for a new leadership in this country — Republican, Democrat or independent."
Voting for Biden:
Colin Powell: The former secretary of state under George W. Bush and retired four-star general said that he will support Biden because he believes that Trump has "drifted away" from the Constitution.
Carly Fiorina: The 2016 presidential candidate said she will support Biden because she believes he is "a person of humility and empathy and character," per The Atlantic.
John Kasich: The former Ohio governor and 2016 presidential candidate is not only endorsing Biden, but also speaking at the DNC to support the former vice president.
Rick Snyder: The former Michigan governor said he will vote for Biden because "Trump lacks a moral compass" and "ignores the truth."
Miles Taylor: The former Department of Homeland Security chief of staff officially endorsed Biden saying, "Even though I'm not a Democrat, even though I disagree on key issues, I'm confident that Joe Biden will protect the country."
Tom Ridge: The former Pennsylvania governor said he would be voting for Biden, writing in the Philadelphia Inquirer, "I believe the responsible vote is for Joe Biden...It’s time to put country over party. It’s time to dismiss Donald Trump."
Cindy McCain: The widow of the late Sen. John McCain (Ariz.) lent her voice to a video about her husband's friendship with Biden that aired during the Democratic National Convention and formally endorsed the former vice president in September, calling him the "candidate in this race who stands up for our values as a nation."
On the fence:
Sen. Lisa Murkowski (Alaska): Murkowski, one of Trump's consistent foils in the Senate, said that she was "struggling" to support the president's re-election after James Mattis, the former defense secretary, issued a public rebuke.
Undecided publicly, but skeptical, via a New York Times report:
George W. Bush: The former president has reportedly decided not to support Trump's re-election, though he's made no public statements to that end.
Jeb Bush: The former Florida governor and 2016 presidential candidate is so far reportedly undecided.
Worth noting: While former top military leaders like Mattis and John Kelly are technically non-partisan, they both served in Trump's administration and have publicly expressed skepticism about the president's standing ahead of the 2020 election.
Mattis said Trump made a "mockery of our Constitution" and called him "the first president in my lifetime who does not try to unite the American people" after the president's response to mass protests in the wake of George Floyd's killing.
Kelly, Trump's former chief of staff and homeland security secretary, said he agreed with Mattis' comments.

HEADING INTO THE DEBATE, TRUMP IS SCARED TO DEATH HE WILL DO BADLY
REPORTED TODAY:
Trump Lowers Debate Bar for Biden
“President Trump has framed the first general election debate as a test for his opponent, former Vice President Joe Biden,” the New York Times reports.
“Yet he has simultaneously set the bar so low for so long that many of his supporters — having watched unflattering, often manipulated clips of Mr. Biden in Trump campaign advertisements or on Fox News — are now expecting the president to mop the floor with an incoherent opponent in something resembling a W.W.E. match.
“Democrats — and even some Republicans — believe that is not likely to happen.”
REPORTED YESTERDAY
Trump Confounds Aides In Run Up to Debate
ABC News:
“With days to go the debate, Trump has carried out conflicting and confounding strategies both repeatedly targeting Biden’s mental acuity, claiming at a recent rally he doesn’t know he’s alive, while also making passing attempts to boost the former vice president as a seasoned debater who could outshine him.”
“At a campaign rally Saturday night in Pennsylvania, the president both attacked Biden as ‘dumb’ before immediately lauding him as an experienced debater.”
Said Trump: “He’s a dumb guy. Always known as a dumb guy. But we look forward to seeing him in the debate. He’s got a lot more experience. He’s got 47 years. I’ve got 3 1/2 years. So we’ll see. But he’s got 47 years of experience.”
HE'S BEEN SCARED FOR A LONG, LONG TIME:
Trump Spent Year Building Legal Network
Politico:
“A year before President Trump alarmed Americans with talk of disputing elections last week, his team started building a massive legal network to do just that,” Politico reports.
“Dozens of lawyers from three major law firms have been hired. Thousands of volunteer attorneys and poll watchers across the country have been recruited. Republicans are preparing pre-written legal pleadings that can be hurried to the courthouse the day after the election, as wrangling begins over close results and a crush of mail-in ballots. Attorneys from non-battleground states, including California, New York and Illinois, are being dispatched to more competitive areas and trained on local election laws.”

The FBI’s Bad Intelligence
The bureau relied on a suspected Russian agent for its 2016 wiretaps
It was worse than we thought. We’re referring to the FBI’s 2016 investigation into the Trump campaign and Russia, as new documents this week reveal.
Senate Judiciary Chairman Lindsey Graham on Thursday released newly declassified FBI documents that contain this stunner: The bureau relied on a suspected Russian agent for the information it used to obtain a secret surveillance warrant against former Trump adviser Carter Page.
Four years into accusations about Russia-Trump collusion, we finally learn that Russia’s main conduit for disinformation may have been America’s FBI. Vladimir Putin must be howling with laughter.
***
Department of Justice Inspector General Michael Horowitz last year revealed that former spook Christopher Steele relied on one primary “subsource” for most of his accusations against the Trump campaign. This subsource was later identified as Ukrainian-born Igor Danchenko, who worked as a research analyst from 2005 to 2010 at the Brookings Institution in Washington. The latest disclosures show that Mr. Danchenko was the subject of an FBI counterintelligence investigation from 2009 to 2011, based on concerns he was a Russian agent and “a threat to national security.”
According to the documents, Mr. Danchenko attempted to recruit two individuals connected to “an influential foreign policy advisor in the Obama administration.” He said that if they “did get a job in the government and had access to classified information,” he had a way for them “to make a little extra money.”
Further FBI investigation found Mr. Danchenko was an associate of two other “FBI counterintelligence subjects.” He also had contact with “the Russian Embassy and known Russian intelligence officers,” and the FBI went so far as to apply for a warrant to surveil Mr. Danchenko. The investigation ended because he left the country in September 2010, though the FBI said “consideration would be given to re-opening the investigation” if he returned. A lawyer for Mr. Danchenko in July said his client “is a highly respected senior research analyst” who wasn’t responsible for writing or editing the Steele dossier.
Here’s the kicker: The FBI identified Mr. Danchenko as Mr. Steele’s source in December 2016, when senior bureau officials also became aware of the prior FBI investigation. The FBI’s realization that it was being fed potential Russian disinformation should have put an immediate halt to the Page probe, if not the entire collusion investigation.
it just gets worse:
