Ninth Circuit Court rules for Trump again!
On Monday, the Ninth Circuit Court of Appeals handed the Trump administration a victory, ruling 2-1 that a preliminary injunction barring implementation of decisions to terminate Temporary Protected Status (TPS) designations of Sudan, Nicaragua, Haiti, and El Salvador would be vacated.
It's not quite a conservative court, but the chances of finding at least two reasonable judges for these reviews is at least within the realm of possibilities today. The entire court is no longer loaded with liberal justices making up laws from the bench.
Now if Trump could just replace enough of the other knucklehead district judges who go around making things up on the fly to pander to political influences, we might actually solve this whole California / Hawaii system of silly justice problem.

Dallas News] WASHINGTON — In an anxious fundraising appeal sent of late on behalf of his reelection campaign, Texas Sen. John Cornyn rang the alarm bell that Republicans are in "grave danger" of losing control of the Senate, and with it, "our ability to confirm conservative judges."
President Donald Trump keeps raising the issue, this week releasing a list of potential future Supreme Court picks that included Texas Sen. Ted Cruz. Vice President Mike Pence has likewise made the case to conservatives that four more years means "more judges."
But the reality — in Texas, at least — is that there are currently no federal judgeships to be filled.
Candidate Trump raised the specter that the election of Democrat Hillary Clinton to the White House would tilt the court’s make-up for a generation. He took the unconventional step at the time of releasing a list of judges from which he would nominate to the high court.
For many Republicans wary of Trump, either due to policy or personality, the prospect of stocking the federal judiciary with conservative judges was the "main justification for holding their nose and voting for Trump" four years ago, Steinhauser [Austin-based GOP consultant] said. "I heard that again and again," he said.
What’s undeniable is that Trump came into office with an unusual number of court vacancies to fill and a plan to reshape the judiciary long-term.
Take Texas, where 24 new Trump-appointed judges mean the federal courts are operating at full strength for the first time in years.
In the state’s four district courts, Trump nominees make up a plurality, meaning that more of his judges sit on the bench than any other president’s. The same is true for the 5th Circuit Court of Appeals, which covers Texas and two other states at a step below the Supreme Court.
Republicans also nominated younger judges. The average age of the Trump appointees in the Texas courts, for instance, is 51 years old, with the youngest judge being only 40. That means some of those judges could conceivably sit on the bench for the next four decades.
"Mark my words, President Trump’s impact on our federal judiciary will be his greatest and most long lasting legacy," Cornyn said in a video for the recent GOP convention, adding that he was proud to help confirm 200 "highly respected constitutional conservative judges."
"Over the next four years, America’s president will choose hundreds of federal judges, and, in all likelihood, one, two, three, and even four Supreme Court justices," Trump said, adding the the nation’s "founding principles" are at stake.
Vacancies are indeed inevitable, and not just on the Supreme Court. Nearly two dozen judges on Texas' district courts and the 5th Circuit are of retirement age. Those potential openings are a way to touch on all manner of consequential issues that help fire up base voters.
"It boils down to who’s better at messaging — the Republicans, absolutely," Lisa Blue Baron, a Dallas attorney and major Democratic donor, said with some exasperation.

“A Republican member of the Wisconsin Elections Commission advised a Green Party representative about who to hire as an attorney after its presidential nominee was denied ballot access in the key battleground state,” the AP reports.
“The elections commission deadlocked 3-3 Aug. 20 on whether to put Green Party presidential candidate Howie Hawkins on the ballot.
"All three Republicans were in favor, while all three Democrats were against.

Testing people for the virus, and tracing those they may have infected, is how countries in Europe and Asia have gained control over their outbreaks, saved lives, and successfully reopened businesses and schools. But in the U.S., Trump claimed, falsely, that “anybody that wants a test can get a test.” That was untrue in March and remained untrue through the summer. Trump opposed $25 billion for increased testing and tracing that was in a pandemic relief bill as late as July. These lapses accelerated the spread of disease through the country—particularly in highly vulnerable communities that include people of color, where deaths climbed disproportionately to those in the rest of the population.

It wasn't just a testing problem: if almost everyone in the U.S. wore masks in public, it could save about 66,000 lives by the beginning of December, according to projections from the University of Washington School of Medicine. Such a strategy would hurt no one. It would close no business. It would cost next to nothing. But Trump and his vice president flouted local mask rules, making it a point not to wear masks themselves in public appearances. Trump has openly supported people who ignored governors in Michigan and California and elsewhere as they tried to impose social distancing and restrict public activities to control the virus. He encouraged governors in Florida, Arizona and Texas who resisted these public health measures, saying in April—again, falsely—that “the worst days of the pandemic are behind us” and ignoring infectious disease experts who warned at the time of a dangerous rebound if safety measures were loosened.

The states that followed Trump's misguidance posted new daily highs and higher percentages of positive tests than those that did not. By early July several hospitals in Texas were full of COVID-19 patients. States had to close up again, at tremendous economic cost. About 31 percent of workers were laid off a second time, following the giant wave of unemployment—more than 30 million people and countless shuttered businesses—that had already decimated the country. At every stage, Trump has rejected the unmistakable lesson that controlling the disease, not downplaying it, is the path to economic reopening and recovery.
Trump repeatedly lied to the public about the deadly threat of the disease, saying it was not a serious concern and “this is like a flu” when he knew it was more lethal and highly transmissible, according to his taped statements to journalist Bob Woodward. His lies encouraged people to engage in risky behavior, spreading the virus further, and have driven wedges between Americans who take the threat seriously and those who believe Trump's falsehoods. The White House even produced a memo attacking the expertise of the nation's leading infectious disease physician, Anthony Fauci, in a despicable attempt to sow further distrust.

LOUISVILLE, Ky. (AP) — Louisville Mayor Greg Fischer says the city has agreed to a settlement with the family of Breonna Taylor that includes a $12 million payment and police reforms after the Black woman was fatally shot by police who burst into her apartment at night.
Taylor’s death sparked months of protests in Louisville and calls nationwide for the officers to be criminally charged. The state’s attorney general is investigating police actions in the March 13 fatal shooting.
