There has been long time dispute between original intent and the living document arguement.
The entire point of the courts is to be a check on legislative and executive power. There is literally no point in even having any sort of Federal Court system if all they do is "reaffirm" what legislators determine to be what the public "wants".
If someone could explain to me what a "living document" is, if not an excuse to ignore what Judges and Justices are sworn to uphold, because some Judges and Justices see themselves (and their own opinions) to be above the law and constitution... then I would be happy to listen.
But no Judge or Justice is going to just "overturn" ACA because they don't believe it's a good law. Some might ignore constitutional issues because they personally "like" the law and uphold it for personal reasons. But it will not happen the other way around.
The only challenge right now to ACA is in regards to the individual mandate, which was eventually declared unconstitutional at least to some degree. The argument that the entire law is unconstitutional because it was build on that mandate is a hard stretch. You won't get Roberts, it's very unlikely you get Gorsuch. It might be a bad and stupid law that cannot be politically justified without the mandate (and it certainly has increased our cost of healthcare insurance because of it). But being stupid or bad, doesn't make it unconstitutional.

A federal investigation meant to target Obama administration officials for “unmasking” the names of individuals in classified intelligence reports ended recently without finding any wrongdoing that the Trump administration could use as political ammunition, The Washington Post reported Tuesday.
Attorney General William Barr appointed Texas U.S. Attorney John Bash in May to look into the unmasking requests from late 2016 and early 2017, which involved intercepted conversations between Michael Flynn — President Donald Trump’s former national security adviser — and Russia’s ambassador to the U.S. during the 2016 election.
The “unmasking” of names in classified documents is a common, legal practice that allows government officials with proper security clearance to better understand what they’re reading, the Post noted. During the Flynn unmasking, the list of Obama officials involved included Vice President Joe Biden, FBI Director James Comey and director of national intelligence James Clapper.
But Trump has attacked the practice as a conspiracy to undermine his administration.

Well now, that's news to me. I cannot remember a single time in my life when I ever said to myself, I have an important choice to make. I have got to decide if I am going to be attracted to boys or to girls.
I never had that "choice" to make. (Maybe some do, but I didn't.)
From an early age, at least as early as the third grade, I was especially attracted to a female, to a girl in the second grade, even though I didn't want to admit it to anyone. (I thought it was sissy or something to be ashamed of).

SACRAMENTO, Calif. (AP) — Grasping for a comeback, President Donald Trump and his Republican allies are intensifying their focus not on Democratic nominee Joe Biden, but on his running mate, Sen. Kamala Harris — arguing without evidence that it’s Harris, the first Black woman on a major party ticket, who would really be in charge if Democrats win the White House.
The effort is laced with sexist and racist undertones, and one that is aimed at winning back Republicans and independents who are comfortable with Biden’s more moderate record, but may associate Harris with Democrats’ left flank, despite her own more centrist positions on some major issues.
During the past week, Trump told Sean Hannity of Fox News that Harris would assume the presidency within “three months” of Biden's inauguration. OUT AND OUT LIE
During a conversation with Rush imbaugh, he warned that House Speaker Nancy Pelosi would “replace” Biden with Harris. And the president called her a “monster” during an interview with Maria Bartiromo of Fox Business.
Trump's focus on Harris is building as he tries to regain an advantage against Biden, who is leading most national and battleground state polls three weeks before the election. Trump has long sowed doubt about Biden's fitness for the job, but is especially eager to shift attention after contracting the novel coronavirus and confronting his own health scare.
At his first campaign rally since being hospitalized for the virus, Trump told a Florida crowd on Monday that Biden has “a lot of bad days coming."
Former House Speaker Newt Gingrich, a Trump ally, is pushing the president to make Harris a campaign centerpiece.
“If voters understand the totality of her radicalism, they would conclude that she would be a very high-risk person to put in the White House,” Gingrich said.
He went on to call Biden “docile" and Harris “aggressive."
The sexism and racism associated with such language, including Trump’s reference to Harris as a “monster,” are aimed at Trump’s most loyal supporters.

“It is really an effort to say to their base, ‘Look, we don’t want a Black woman to be president,'" said Rep. Marcia Fudge, D-Ohio, a former chair of the Congressional Black Caucus. "'We don’t want this Black person to take over in case something happens to Joe Biden.’”
Fudge said efforts to brand Harris as radical don’t align with her record, particularly on law enforcement. Harris and Fudge are both former prosecutors.
Republicans “consistently talk about law and order to the only person in this race that has a law-and-order background,” Fudge said.
Still, there are some signs that Trump's message is resonating with his RACIST, SEXIST base.
“I’m scared that if Harris gets in, it will be a Harris administration ’cause old Joe’s got some issues," said Bob Stanley, a retired orthopedic physician assistant who lives in Johnstown, Pennsylvania, and said he will be voting again for Trump.
Joshua Dyck, an associate professor of political science at the University of Massachusetts, Lowell, said the focus on Harris is a sign that Trump's attacks on Biden aren't working.
“This is a desire not to run against Joe Biden, to run against anybody but Joe Biden,” he said.
There’s little evidence that Trump’s strategy will change minds. While vice presidential picks generate buzz, they rarely sway voters, said Dyck, who also runs the UMass-Lowell’s Center for Public Opinion.
One exception may be 2008, when Republican John McCain chose little-known Alaska Gov. Sarah Palin as his running mate. McCain was 72. A New York Times/CBS News poll taken just before the election found 59% of voters said Palin was not prepared to be president. DUH!!!
A vice presidential nominee’s ability to step in as commander in chief has long been a prime qualification for a running mate. Either the 77-year-old Biden or the 74-year-old Trump would become the oldest president ever inaugurated.
Biden last released medical records in December 2019, during the Democratic primary. Biden’s doctor called him “healthy, vigorous” and fit to execute the duties of the presidency. He takes a statin medication for cholesterol and has a “persistent” atrial fibrillation, a type of irregular heart beat. He takes a blood thinner to prevent risks like blood clots or stroke.
A Pew Research Center poll released in August found that among Biden supporters, 31% called his age or health a concern in an open-ended question. Just 1% of Trump's supporters said the same about the president, though the survey was taken before Trump contracted the coronavirus.
Harris and Vice President Mike Pence deflected in last week's debate when asked if they had conversations with Biden and Trump, respectively, about procedures in the event of presidential disability.
Harris did not address the question directly or speak to Biden’s health at all, instead pivoting to their shared values and her own political background, an implicit nod to her fitness for the top job if need be.
“I serve on the Senate Intelligence Committee, where I’ve been in regular receipt of classified information about threats to our nation and hot spots around the world. I’ve traveled the world. I’ve met with our soldiers,” she said.
It was a rare moment of Harris talking about herself. As typical for running mates, she regularly pivots to Biden's record in a clear demonstration that he is the one running to lead the nation.
Biden and Harris can best respond to the attacks by focusing on their agenda and policies, said Democratic Rep. Barbara Lee of California. Other allies can denounce Trump's comments, as the women of the Congressional Black Caucus recently did.
“There are those in the country who need to raise their voices and say this is un-American," Lee said. “We cannot tolerate this in a multiracial country."

The central tension in Barrett’s hearing, as it has been for other Trump nominees, is whether her attempt to remain an impartial judge means she can’t comment on common-sense legal matters.
Democrats, knowing that, still asked her questions about the president potentially abusing his power. And they got answers like this:
Leahy: Does the president have a right to pardon himself for a crime? We saw this after President Nixon’s impeachment.
Barrett: So far as I know, that question has not been litigated or arisen.
They also asked: Can the president legally delay an election? On Tuesday, she wouldn’t clearly say. Is voter intimidation illegal? She didn’t clearly say. Are absentee ballots an essential way for Americans to vote in a pandemic? “That’s a matter of policy on which I can’t express a view,” she replied.
On Tuesday, Barrett said she would be nobody’s “pawn” on the Supreme Court when she was questioned about whether she’d weigh in on decisions over the presidential election. But it’s potentially troubling for vulnerable Senate Republicans trying to distance themselves from Trump that Barrett hasn’t been able to do that, either.

The most Pravda-like thing is that the immediate pushback by Biden's many allies in Big Media and Big Tech serve as confirmation of the story and how damaging it is to the Biden campaign. If it weren't true, they'd just say that, rather than censor its distribution.
And the campaign wouldn't say the meeting wasn't on his official schedule, they would deny it outright. Did anyone ask if Joe ever had meetings not on his official schedule ? Or release his personal schedule ???

Trump’s declining poll numbers against Joe Biden could be complicating efforts of Republicans trying to keep control of the Senate.
President Donald Trump’s once-tight grip on Republican lawmakers is showing signs of slipping as he falls further behind Democrat Joe Biden, making the GOP path to keeping control of the Senate increasingly fraught.
Republicans continue to line up behind Trump where their core interests coincide, such as solidifying a conservative majority on the Supreme Court by quickly confirming Judge Amy Coney Barrett. GOP candidates also are eager to tout tax cuts and deregulation under the president, longtime campaign themes that pre-date Trump.
But the president’s handling of the coronavirus pandemic and his attempt to force through a stimulus deal with Democrats are exposing fractures at a time when Republicans are facing grim Election Day prospects in three weeks.
Every recent national poll shows Trump trailing well behind Biden in the presidential race -- 10 percentage points in the RealClear Politics average. Republicans have little chance of gaining on Democrats in the House, and may end up losing more seats. The party is at serious risk of losing its 53-47 Senate majority.

Direct, public criticism of Trump is still rare. GOP candidates need his fervently loyal base in an election where Democratic voters are motivated. Yet if they don’t try to create some distance with the White House they fully tie their fates to Trump.
“I think most Senate Republicans will privately acknowledge what everyone else seems to know: the president’s not going to win reelection and they are going to be dealing with a President Biden,” said former Arizona Republican Senator Jeff Flake, who retired in 2018 after Trump loyalists turned on him for criticizing the president. “He’s put some of my former colleagues in an untenable position.”
Trump’s erratic moves on the stimulus in particular have flummoxed Republicans, who were already divided among themselves over how big a package they’d agree to with House Speaker Nancy Pelosi and Democrats.
First he ordered an end to negotiations until after the elections, which endangered Republican Senator Susan Collins quickly labeled a “huge mistake.” Days later, Trump was pounding the table for a major deal.
But when Treasury Secretary Steven Mnuchin and White House Chief of Staff Mark Meadows drew up a $1.8 trillion administration proposal for talks with Pelosi, many Senate Republicans balked.
Trump undercut GOP lawmakers again on Tuesday a short time after Senate Majority Leader Mitch McConnell announced plans for a vote on a narrow piece of stimulus legislation, with a tweet.
McConnell’s decision to bring a vote on a smaller, Republican-only stimulus bill is a measure of defiance after Trump’s repeated urging for a massive pre-election stimulus, though he blames Pelosi for the failure to reach a deal.
Many GOP lawmakers are keenly aware that Trump could pull the rug out from under them at any moment. They also are concerned he could be even more unpredictable on stimulus negotiations as the election draws nearer, according to a person familiar with conversations among lawmakers and their aides.
White House spokeswoman Sarah Matthews said Trump “remains focused on saving the jobs of airline workers and providing relief to Americans unemployed through no fault of their own.” Matthews said Pelosi and Democrats were blocking action on pandemic relief “because of an upcoming election.”
One Republican who has consistently criticized Trump, Senator Mitt Romney, has a solid constituency in his home state of Utah that has made him largely immune to Trump’s wrath. He was the only Republican to vote to convict Trump on an impeachment charge and on Tuesday he ripped into the president’s political rhetoric, as well as the statements from some Democrats.
Some senators are shifting their campaign pitches to position themselves as a brake on Biden and the Democratic agenda. North Carolina Senator Thom Tillis, who is trailing Democrat at Cal Cunningham, told Politico last week that a Republican Senate was “the best check on a Biden presidency.”
Texas Senator John Cornyn, facing an increasingly competitive race against Democrat M.J. Hegar, said Wednesday on Fox News that he wants Trump to win so that the GOP can continue filling federal courts. But he acknowledged he is “very concerned” about Trump’s poll numbers and said Republicans “need the Senate as a firewall” against the Democrats.
A GOP strategist who has been consulting with Senate campaigns said Republicans have been carefully laying the groundwork to restrain a Biden administration on federal spending and the budget deficit by talking up concerns about the price tag for another round of virus relief. The thinking, the strategist said, is that it would be very hard politically to agree on spending trillions more now and then in January suddenly embrace fiscal restraint.
Some of Trump’s worst marks in polls come when voters are asked to assess his handling of the spread of the coronavirus, which has infected almost 8 million people in the U.S., including the president and some of his top advisers.
McConnell said last week he has been avoiding the White House for two months because proper protocols -- social distancing and masks -- weren’t being followed. Although he avoided mentioning Trump, McConnell said anyone not following health guidelines is now “paying the price.”
Even Trump’s staunchest supporters avoid directly tying themselves to the president. Embattled Arizona Senator Martha McSally refused to say in a recent debate whether she was “proud” of her support for Trump. She instead said was proud of delivering tax cuts. Senator David Perdue, asked about Trump’s low approval ratings, said “What I talk about is this: results,” citing economic growth pre-pandemic.
Kevin Madden, a Republican strategist and former aide to Romney and ex-House Speaker John Boehner, said it is now too late for Republicans to make a firm public break with Trump.
“Many Republican senators have built political profiles in the last few years as political allies of the president,” he said. “If there is anybody who’s going to survive and find those ticket-splitters, they will have started that process a long time ago and not now.”
