Very little chance of a conviction here folks...

Missouri couple charged with two felonies

“The government chooses to persecute us for doing no more than exercising our right to defend ourselves, our home, our property and our family and now we’re getting drug here time after time after time and for what?”

There are politically motivated prosecutions, and then there are politically motivated prosecutions. The first rule of a prosecution is that you only prosecute cases that you believe you have a good chance to win. Prosecutions are not designed to "make a point" or otherwise used for any other reason than to put someone in jail.

This couple does not belong behind bars. They technically did everything that the law states they are allowed to do. The only way you can convict them of this particular crime is to demand that the State understands the motivation of the couple better than the couple does. The high burden of proof in this case is to prove (beyond reasonable doubt) that the couple's "intention" was not protecting their property, but rather to harass and cause "fear" in the minds of the protesters.

But in reality, this appears to be a matter of semantics and an attempt at turning the table and making the intruders the victim (which seems to be the point of liberal law enforcement lately). If you are allowed (as you are in Missouri) to own guns and to use them to protect yourself and your home, the question that is begged by these charges is how to do that without "striking fear" in the minds of the person(s) you believe are attempting to cause harm to you.

In other words, the prosecution (as a matter of logic) is stating that you can only wield your weapon with the intent to shoot someone in self defense. But if you were to pull a gun on a burglar and demand that he leave, then you would be in violation of the law in the same manner that the McCloskey couple is being charged with. The reason being is that you are using the gun "illegally" to strike fear in the minds of he burglar. The fact that this is part of the point of owning a gun to protect yourself seems to be missed by the prosecution.

So making it illegal to use your gun to scare someone off, only leaves the alternative to shoot that person instead.  Is that really what the prosecution is attempting to

Moreover, this slippery slope could be applied to other similar situations. Perhaps putting up a sign that warns a potential burglar that you have a security system might cause similar fear of retribution if they attempted to burglarize your home. Same might be said for a beware of dog sign. A potential criminal might be fearful of being bitten or otherwise attacked by a dog, putting the homeowner in jeopardy of being charged with unlawful use of having a dog.

The reality here is that there is no way that you will convince 12 jurors that the McCloskey couple did not feel threatened or that the weapons were not being wielded in self defense (as in stay away from our property). People do not have the "right" to break into anyone else's property and they certainly have to right to so do without "fear". If this is what law and order will be like under liberal rule, then it will drive people away from the Democratic Party in waves.

Trump’s Corrupt Schemes Keep Blowing Up
12:42 pm

Greg Sargent:
“When you step back and survey the last two years of U.S. politics, one of the biggest story lines that comes into view is this:

"One after another, a whole string of deeply corrupt schemes that President Trump has hatched to smooth his reelection hopes have crashed and burned.

“In all these cases,
Trump has either blown up the schemes himself
or compounded the damage they did to him when they self-destructed.

"In some cases he did both.

“Meanwhile, Trump has also managed to wreck numerous opportunities that he could have easily turned to his political advantage if he had reacted to them in a non-depraved manner.

"Instead, he sought to pervert or corrupt them in ways that ended up backfiring.”

GOP Donors Ditching Trump In Effort to Save the Senate
9:57 am
Daily Beast:
“Increasingly convinced that President Trump’s election chances are grim, top Republican donors, lobbyists, and operatives are directing their attention to the Senate in hopes of keeping a majority in the chamber and, with it, a check on a future President Joe Biden.

“Top GOP money men said that efforts to shift resources to Republicans running for the Senate have been happening for weeks, as Trump’s chances have not improved—indeed, worsened—and as the party’s candidates have been dramatically outraised.”

Said one GOP operative:
“There is no discussion among donors about giving money to the president. The discussion among donors, bundlers and check writers is about the Senate seats.”

Pollster Who Shows Trump Ahead Nationally Says Florida Is Almost Out of Reach for Biden – Trump is Doing Great

We learned in 2016 and before (see Ann Coulter’s book Slander) that the Democrats use polls to manipulate elections. We now know they lie and spy and create scandals in efforts to gain power. Over the weekend one pollster, who’s apparently not part of the Democrat media complex, released numbers showing President Trump is ahead of Joe Biden nationally and in almost every category.
This poll appears to best reflect reality as we have measured attendance of supporters at events since Labor day for both parties and see with our own eyes that President Trump is filling up events around the country while Biden doesn’t even fill up the circle markers at his events wherever he goes.

Below are some notes from the Democracy Institute on the results of their analysis:

A Democracy Institute poll over the weekend showed Trump winning nationally and in the Electoral College. Patrick Basham of the Democracy Institute was interviewed about the results of his poll. The poll showed Trump winning nationally and in the Electoral College.

There was no more fitting place to talk about the cost of division than in Gettysburg. On that sacred ground, Abraham Lincoln reimagined America itself. He spoke of the price of division and the meaning of sacrifice.

Lincoln believed in the rescue, the redemption, and the rededication of the Union — all this in a time not just of ferocious division, but also widespread death, structural inequality, and fear of the future. And he taught us this: A house divided could not stand. That is a great and timeless truth.

Today, once again, we are a house divided. But that, my friends, can no longer be. We are facing too many crises. We have too much work to do. We have too bright a future to leave it shipwrecked on the shoals of anger and hate and division. I believe in this moment, we must come together as a nation once more.

That puts an end to 401k ownership

the hard left has had it's eye on our savings for quite some time now. the mount everest of cash is irresistible to the marxists in the bernie/aoc crowd.

0linsky had his eye on this back in 2013:

THE OBAMA Administration's new budget will cap retirement savings for the nation's super-rich, but it's possible that it could affect even smaller-scale savers.

According to advance reports, the administration's budget due out on Wednesday will propose a cap limiting the amount of annual return a retirement account can create to $205,000. If that proposal were enacted today, that would mean retirement accounts would be limited to $3 million in assets. The White House estimates that caps on the tax-preferred accounts would generate $9 billion over 10 years.

"Under current rules, some wealthy individuals are able to accumulate many millions of dollars in these accounts, substantially more than is needed to fund reasonable levels of retirement saving," the White House told Politico last week.

Biden retirement proposal would upend traditional 401(k) plans

Ben Harris, a Biden adviser who served as the nominee's chief economist during his vice presidency, emphasized the equalization feature at a policy roundtable Aug. 18 during the Democratic National Convention. “This is a big part of the plan which hasn’t got a lot of attention,” Harris said.

Under current law, there will be some $3 trillion in tax benefits distributed to those saving for retirement over the next 10 years, Harris said. But those tax breaks are spread “incredibly unequally” with low-income earners getting very little, he said.

Nate Silver

President Trump was already in a deep electoral hole following the first debate, but one remaining bright spot for him was the economy. So calling on Republican leaders to end talks with Democrats on another stimulus package — as Trump did on Tuesday — would seem like a bad move for the president, and, in fact, it did send the stock market tumbling.

True, U.S. GDP fell at an annualized rate of 31.7 percent in the second quarter, the largest ever quarterly decline. But Trump’s approval ratings on the economy had remained relatively solid despite this: 51 percent of voters approve of his economic handling and 47 percent disapprove of it, according to the Real Clear Politics average. The economy has also been one of the few issues on which polls regularly find that voters prefer Trump to Joe Biden.

How to explain this seeming disconnect? Well, Trump can actually make some decent arguments to voters about the economy that are grounded in the data. For instance, the economy was pretty good during his first three years in office. And the rebound has been pretty swift. The Atlanta Federal Reserve’s “nowcast” estimates that GDP grew by a 35.3 percent annualized rate in the third quarter, which ended on Sept. 30. That still leaves the economy in worse shape than before the pandemic,This might seem counterintuitive since 35.3 percent is larger than 31.7 percent, but the 31.7 is taken from a lower baseline. Say, for example, that I have $100 and lose 20 percent of my money; now I have $80. Then, I increase my money by 20 percent. Instead of getting all the way back to $100, though, I take 120% of $80, which works out to $96.

" style="box-sizing: border-box; text-rendering: optimizelegibility; margin: 0px; padding: 0px; border: 0px; font: inherit; vertical-align: baseline; color: rgb(0, 143, 213); text-decoration: none; position: relative;">1 but not that much worse.

Trump had also been able to patch a lot of holes in the economy with the series of stimulus packages passed by Congress earlier this year, which injected trillions of dollars into the economy in the form of direct cash payments, expanded unemployment benefits and protections for businesses. Indeed, one of the economic indicators that has historically been among the most reliable predictors of the election — disposable income — sharply increased amid the pandemic because of the stimulus benefits, although it has since fallen as those benefits have lapsed:

GOP Plunged Into Crisis
7:39 pm
“Vulnerable Republicans are beginning to distance themselves from President Trump’s dismissive response to the coronavirus pandemic and his dramatic termination of negotiations with congressional Democrats over federal economic relief, with the latest cracks carrying enormous implications for Trump and the party with just four weeks until Election Day,” the Washington Post reports.

“Facing a political reckoning as Trump’s support plummets and a possible blue tsunami looms, it is now conservatives and Trump allies who are showing flashes of discomfort with the president, straining to stay in the good graces of his core voters without being wholly defined by an erratic incumbent.”

Republicans Urge Trump to Restart Relief Talks
7:21 pm

“President Trump is taking a huge political gamble with his decision to end coronavirus relief talks weeks before the election. But Republicans don’t want him to call it quits just yet,” Politico reports.

“Several frustrated GOP lawmakers — who are facing major political headwinds as they fight to hang on to their Senate majority — are urging Trump to come back to the negotiating table, as millions of Americans are out of work, airlines are on the verge of massive layoffs and the Federal Reserve chairman recently warned of dire economic consequences if Congress doesn’t act.”

“Some Republicans even fear that Trump’s Tuesday order to halt the talks will not only mean months of delay for suffering families and businesses, but it will also ensure that the GOP takes the political hit for it — even though a deal was unlikely to come together before the election, and despite their belief that Speaker Nancy Pelosi is to blame.”

Wednesday night’s vice presidential debate came to a close with a lot less heavy breathing and yelling than last week’s presidential showdown. But Mike Pence does retain the sociopathic-seeming ability to just lie through his teeth about virtually anything and everything, and Sen. Kamala Harris had to do a lot of history lessoning and in-debate fact-checking.

But at one point, when Mike Pence was condescendingly attempting to say that Joe Biden and Kamala Harris were disrespectful to law enforcement by supporting the concept of racial justice and equality, a new star was born. What we can only speculate was a common housefly landed on Pence’s head and sat there in the spotlight for a full two minutes. It was hard not to quickly realize that the Fly had truly overshadowed the pile he was sitting on.

WASHINGTON (AP) — The second debate between President Donald Trump and Democratic nominee Joe Biden will take place virtually amid the fallout from the president's diagnosis of COVID-19, the debate commission announced Thursday.

The nonpartisan Commission on Presidential Debates cited a need "to protect the health and safety of all involved with the second presidential debate.” The candidates will “participate from separate remote locations” while the participants and moderator remain in Miami, it said.

The announcement comes a week before Biden and Trump were scheduled to face off in Miami.

Trump was diagnosed with the coronavirus a week ago and but in a Tuesday tweet said he looked forward to debating Biden on stage in Miami, “It will be great!” he tweeted.

Biden, for his part, said he and Trump “shouldn’t have a debate” as long as the president remains COVID positive.

Biden told reporters in Pennsylvania that he was “looking forward to being able to debate him” but said “we’re going to have to follow very strict guidelines.”

Trump fell ill with the virus last Thursday, just 48 hours after debating Biden in person for the first time in Cleveland. While the two candidates remained a dozen feet apart during the debate, Trump's infection sparked health concerns for Biden and sent him to undergo multiple COVID-19 tests before returning to the campaign trail.

President Trump won the first debate despite a terrible and biased moderator in Chris Wallace, and everybody knows it. For the swamp creatures at the Presidential Debate Commission to now rush to Joe Biden’s defense by unilaterally canceling an in-person debate is pathetic. That’s not what debates are about or how they’re done.

Here are the facts: President Trump will have posted multiple negative tests prior to the debate, so there is no need for this unilateral declaration. The safety of all involved can easily be achieved without canceling a chance for voters to see both candidates go head to head. A Failed Experiment
The lockdowns must end.

Lockdowns are typically portrayed as prudent precautions against Covid-19, but they are surely the most risky experiment ever conducted on the public. From the start, researchers have warned that lockdowns could prove far deadlier than the coronavirus. People who lose their jobs or businesses are more prone to fatal drug overdoses and suicide, and evidence already exists that many more will die from cancer, heart disease, pneumonia, and tuberculosis and other diseases because the lockdown prevented their ailments from being diagnosed early and treated properly.
Yet politicians and public-health officials conducting this unprecedented experiment have paid little attention to these risks. In their initial rush to lock down society, they insisted that there was no time for such analysis—and besides, these were just temporary measures to “flatten the curve” so as not to overwhelm hospitals. But since that danger passed, the lockdown enforcers have found one reason after another to persevere with closures, bans, quarantines, curfews, and other mandates. Anthony Fauci, the White House advisor, recently said that even if a vaccine arrives soon, he does not expect a return to normality before late next year.
He and politicians like New York governor Andrew Cuomo and British prime minister Boris Johnson profess to be following “the science,” but no ethical scientist would conduct such a risky experiment without carefully considering the dangers and monitoring the results. After doing so, a group of leading researchers this week called for an end to the experiment. In a joint statement, the Great Barrington Declaration, they predicted that continued lockdowns will lead to “excess mortality in years to come” and warned of “irreparable damage, with the underprivileged disproportionately harmed.”
While the economic and social costs have been enormous, it’s not clear that the lockdowns have brought significant health benefits beyond what was achieved by people’s voluntary social distancing and other actions. Some researchers have credited lockdowns with slowing the pandemic, but they’ve relied on mathematical models with assumptions about people’s behavior and the virus’s tendency to spread—the kinds of models and assumptions that previously produced wild overestimates of how many people would die during the pandemic. Other researchers have sought more direct evidence, looking at mortality patterns. They have detected little impact.
In a comparison of 50 countries, a team led by Rabail Chaudhry of the University of Toronto found that Covid was deadlier in places with older populations and higher rates of obesity, but the mortality rate was no lower in countries that closed their borders or enforced full lockdowns. After analyzing 23 countries and 25 U.S. states with widely varying policies, Andrew Atkeson of UCLA and fellow economists found that the mortality trend was similar everywhere once the disease took hold: the number of daily deaths rose rapidly for 20 to 30 days, and then fell rapidly.

Trump's squad

The Civil war was stopped by the FBI

Federal prosecutors on Thursday announced the arrest of six men who allegedly plotted to violently overthrow the government and kidnap Michigan Gov. Gretchen Whitmer.

The half a dozen men were arrested Wednesday night after the FBI and Michigan State Police reportedly spent hours raiding a Hartland, Michigan, home. As part of the alleged plot, the group reached out to members of a Michigan militia for help, according to a federal affidavit filed Thursday.

“Several members talked about murdering ‘tyrants’ or ‘taking’ a sitting governor,” an FBI agent wrote in the affidavit, as first reported by The Detroit News. “The group decided they needed to increase their numbers and encouraged each other to talk to their neighbors and spread their message.”

The individuals named in the complaint include Adam Fox, Barry Croft, Ty Garbin, Kaleb Franks, Daniel Harris, and Brandon Caserta. News of the thwarted plot comes amid an ongoing investigation into the death of a Detroit man who was killed during a FBI shootout.

The affidavit states that during the investigation, the FBI became aware that several men, including Croft and Fox, were discussing “the violent overthrow of certain government and law-enforcement components.” During these discussions, the two agreed to “unite others in their cause and take violent action against multiple state governments that they believe are violating the U.S. Constitution.”

Along with 13 other people, investigators state that Crox and Fox gathered in Dublin, Ohio, to discuss their scheme, talking about “creating a society that followed the U.S. Bill of Rights and where they could be self-sufficient.” The affidavit states that during this meeting, the group bounced around several different ways to achieve their goals—some peaceful, others violent.

At one point, several members brought up state authorities they believed were violating the Constitution, including the “government of Michigan and Governor Gretchen Whitmer.” As part of their efforts to overthrow these governments, Fox allegedly reached out to a Michigan based militia group that was already being monitored by the FBI and local authorities. According to the affidavit, the militia group had previously attempted to obtain “the addresses of local law-enforcement officers.”

Their plot finally came to the attention of law enforcement when a member of the group became concerned that they planned to “target and kill police officers” and reached out to federal authorities, ultimately agreeing to become an informant. That informant confirmed that militia groups periodically met for field training exercises in a remote property in Michigan.

During one June 14 training, which included firearm and tactical drills, Fox was allegedly introduced to one of the militia’s founders over the phone, the affidavit states. That introduction led to various meetings with militia-group members throughout the month of June, including one “at a Second Amendment rally at the State Capitol” in Lansing.

“In an effort to recruit more members for the operation, Fox told Garbin and [the informant] he planned to attack the Capitol and asked them to combine forces,” the affidavit states.

Pelosi Rules Out Airlines-Only Relief Plan
12:25 pm
New York Times reports that:
Speaker Nancy Pelosi said she would not agree to stand-alone aid package for airlines unless the Trump administration committed to a broader pandemic relief plan to help struggling Americans, declaring that “there is no stand-alone bill without a bigger bill.

“Her comments cast doubt on the prospects for a compromise just hours after President Trump had given an upbeat assessment, saying in an interview that he had reconsidered his decision to pull the plug on bipartisan negotiations on a stimulus plan until after the election.”

WASHINGTON (AP) — In an extraordinary step, the Washington, D.C., Department of Health has released an open letter appealing to all White House staff and anyone who attended a Sept. 26 event in the Rose Garden to seek medical advice and take a COVID-19 test.

The letter indicates a lack of confidence in the White House medical team’s own contact tracing efforts regarding an ongoing virus outbreak that has infected President Donald Trump, multiple senior staff members and two U.S. senators, among others.

It’s Going to Get Uglier for Republicans
3:11 pm
Stuart Stevens:
“About a year ago, I finished a pretty bleak book about the GOP, but it turns out I was too optimistic. Even after the party’s turn away from time-honored Republican principles, I couldn’t have imagined a party that would abandon any pretense of standing for conservative values, decency or common sense. Having spent four years defending their guy at every turn, they’re stuck. In for a penny, in for a pound: Republicans can’t tell the truth about Trump anymore. Even if they wanted to.

“Many GOP candidates know they face near-impossible odds this year.
Across the nation, every morning there are campaign team calls on which political professionals try to think of ways their bosses might escape impending electoral doom. I’ve been on calls like this more times than I’d care to remember, and I know they will take on an increasingly desperate tone as reality sinks in. In a week or two, it’ll be all gallows humor from here on out as they mask the pain.”

Coldheartedtruth Teller said...

What to believe anymore? All sides make it difficult to know

JOHN ROLFE | TAKING IT PERSONALLY | 7 hours ago

It says a lot — none of it good — about what has become of truth in this country when many people doubt that President Trump became ill with COVID-19. They say he’s faking it to look like a superhero, or dodging the next debate, or taking attention off his taxes and mishandling of the pandemic, or setting the stage for a treatment that will benefit him financially, or trying to make us think the virus doesn’t really affect anyone.

America has been turned into a bizarre carnival not-so-funhouse loaded with smoke and mirrors where honesty is on life support and it seems plausible that chicanery lurks everywhere at every turn.

Trump and his allies have done their part with his more than 20,000 false or misleading statements (some glaringly obvious) that have been fact-checked since he took office; their constant charges of “fake news” directed at media that report critical or unflattering stories; their disparagement of respected experts and data that present uncomfortable information; their promotion of “alternative facts;” and their paranoia that brands seasoned government employees as members of an insidious Deep State plotting to destroy the United States.

Chickens on strike? Cats let mice go? End Times conspiracies all around us

Conspiracy theories: Shared reality needed before common problems can be solved

It’s not all Trump’s fault. Partisan media presents only each side’s version of events or downplays and even ignores stories. The internet has given crackpots like Alex Jones a platform to compete with reputable news sources and now even the wildest conspiracy theories and unproven charges — such as massive, organized, nationwide voter fraud — consume the political spectrum. The “Trump isn’t really sick” chatter shows that even the middle is buying into this madness.

I suspect most of us feel we have no choice but to believe what we want to believe whether we have proof or not.

“The acceptance of conspiracy theories is just one station in the slaughterhouse of truth that is the Trump presidency,” former GOP strategist Stuart Stevens, who worked for the presidential campaigns of Bob Dole, George W. Bush and Mitt Romney, writes in “It Was All a Lie: How the Republican Party became Donald Trump.”

In his book, Stevens laments how the party he’s served since 1978 has made conspiracy theories a prominent pillar of conservatism and is counting on Americans to accept whatever it says even when it insults their intelligence.

“That seems like a bad bet for a political party,” Stevens writes, “but one on which truth-shredding, anti-fact Republicans are betting the future of a sane, respected, center-right political party in America.”
