Election updates day 5

The day after the USSC orders Pennsylvania to separate tens of thousands of ballots, the networks call Pennsylvania for Biden

I guess the USSC has no business following through with any of that legal nonsense, now that the media has declared a winner! 

You know polling is bad when "exit polls" are wrong?

According to the exit polling from NBC news (as calculated by their partisan breakdown results) Joe Biden apparently beat Donald Trump by over 6%. This is down from the 10% they provided just before the election, but still is looking at approximately doubling the actual Biden lead.  

NBC exist polling showed a 37% DEM, 35% GOP, 28% IND, as their breakdown... which is unusual for the smaller percentage of Independents, but not terribly surprising as a higher partisan turnout looks to be what drove the huge number of voters. 

But the exit polling (based on simple math using those partisan breakdowns) shows Joe Biden at 52.1% (his actual is 50.5% right now) and Donald Trump at 45.9% (his actual is 47.7% right now). From what I can muster, exit polling is still overstating Biden support from Independents by approximately 11%. 

While I understand clinging to a narrative running up into an election, the idea that you continue such a narrative "after" the election seems a little unnerving. You would think that NBC has someone with the math skills to realize that their own exit polling is actually wrong.

Election shenanigans - GOP election poll watchers kicked out of Michigan polling stations: 

So what many poll challengers were actually seeing was that when the ballots were scanned and it did not match a voter in the electronic poll book, and it did not match a voter in the supplemental paper poll book, which was provided due to Michigan’s law that allows for same-day registration, they were still allowing those ballots to go through and be counted.  When challenges were issued for these ballots, the ballot counters were either ignoring the poll-watchers (who are allowed to legally challenge) or kicking them out for being disruptive.  

In other news, a whistleblower has exposed a "directive" to separate ballots that had late post office dates stamped  from others that were disqualified for other reasons, so that they could later be hand stamped over the stamp with a valid date and counted. 

Now there is little reason to believe that these things are not being done. Nearly everyone accepts that not everything in elections are on the up and up. That being said, I would still doubt that all of this leads to the sort of fraud that actually turns that state. Biden is up by about 150,000 in Michigan. If it was 1500 or even 15,000... then we might have an issue. 

But either way, if this can be proven (apparently some of this is on video or in writing) then these poll workers who are breaking election laws should be prosecuted to the full extent of the law.  

Total Vote Count:  

  • Biden: 74,549,065
  • Trump: 70,347,223
  • Jorgesen: 1,725,476 
Who would have thought that Trump would garner 70 million votes and still be looking at a loss? He is now over 7 million more votes, with a larger percentage of his own 

Lack of Green Party Biggest overlooked issue of the election: Many states went out of their way and successfully prevented the Green Party from having a place on their ballots this year. Approximately 20 states (many of them battleground states with Democrats in charge locally) did not include  the Green Party. In many cases these came down to legal court rulings and technicalities. So instead of Libertarian and Green Party voters sort of cancelling each other out, there were tens of thousand of Libertarian voters that may have cost Trump the wins in several states. 77K in Pennsylvania, 61K in Georgia, 47K in Arizona, and 30K in Wisconsin, all enough to flip those states to Trump.

I recall thinking at the time that it would take a very close election for this to have any particular meaning. But this is exactly the sort of close election where it matters... and quite frankly Jo Jorgensen receiving about 1.7 million votes overall was not surprising. What is surprising is that it was nearly double the amount of every other third Party Candidate combined, largely because the Green Party was shut out of many important states.  

And here we all thought Democrats were the inclusive bunch who wanted everyone to have a fair vote and to vote for who they want. Turns out that they are just as pragmatic as anyone else and blocked the Green Party from even being on the ballot... solely to help their own Party. Mover, had there been the sort of "ranked" voting method that Democrats support, then Trump probably also is now winning in these four states and would be the likely winner at this point. This is something to chew on

USSC orders Pennsylvania to separate late arriving ballots: Now keep in mind that the USSC sort of "punted" on their original decision regarding these late arriving ballots in Pennsylvania with a 4-4 tie. Pennsylvania law requires ballots to be there by day of election. The extension was not an act of legislation (as required constitutionally to change election laws) but rather an executive order from the Governor. 

Now this might mean something important or it might not. These ballots were already ordered to remain separate, but many counties (primarily blue counties) refused to comply with the order. But the fact that the USSC is offering that they should be separated means it is not a moot legal issue. Apparently there is a feeling that this might come back around and get a full nine vote decision.

Pennsylvania likely to go to recount: Why this USSC decision might look large is that Pennsylvania might be headed for what would be a long and drawn out recount. That provides a lot of time for legal maneuvering and legal challenges. 

Arizona Update: Donald Trump has closed the gap down to under 30,000 ballots with thousands of ballots left to count. On the surface, it looks like an uphill climb as Trump's margins have fallen below where they need to be to catch up. That being said,  most outlets are still suggesting that Arizona is too close to call.

Donald Trump is a sadist. In 2016, after winning his party’s presidential nomination, he bragged for months about all the Republican candidates he had beaten. As president-elect, he toured the country, boasting about the emotional pain he had inflicted on Democrats and others who had stood in his way. Throughout his presidency, he gloated that just by occupying the White House, he was infuriating his critics. And this year on the campaign trail, he reveled in recounting the anguish of his opponents on election night 2016.

Now Trump’s reign of cruelty is ending where it began: in defeat, disbelief, and agony. But this time, the agony is his.

Every president-elect before Trump made at least a token effort to unite the country. The victor would reach out to heal the wounds of those who had lost. But Trump never tried. In December 2016, he went on a bizarre victory tour, staging rallies to celebrate his defeat of the 54 percent of Americans who had voted against him. He savaged Hillary Clinton and her supporters, calling the election a “slaughter.” He recalled every detail of election night, especially the TV reporters who, in Trump’s retelling, were “devastated” and “throwing up.”

As president, Trump constantly pitted red America against blue America. He scorned “Democrat-run” cities and states, targeting them for tax increases as he cut taxes for his wealthy supporters. He treated his impeachment not as a rebuke but as a triumph over his enemies. He tried to expunge, out of pure spite, every program and policy enacted by President Barack Obama. As COVID-19 killed tens of thousands of Americans, Trump blamed Democratic governors and threatened to withhold aid from them. He gloated that he was sitting in the White House, and his enemies weren’t.

In this year’s campaign, Trump tried to humiliate his opponents once more. He called former Vice President Joe Biden a “dummy” and a “corpse.” In front of white crowds, he mocked Obama’s middle name (“Hussein”) and the first name of Sen. Kamala Harris “If you don’t pronounce her name exactly right, she gets very angry”). He told audiences how much he enjoyed watching the National Guard invade cities after George Floyd’s death (“That was a beautiful sight … They walked down that street with pepper spray and tear gas, and it was pow, pow”) and how disappointed he was when these invasions were averted. He threatened to punish states whose governors displeased him. He demanded that the Department of Justice prosecute his political enemies. He said Clinton, Biden, and other Democrats should be “locked up.”

But Trump’s favorite riff was reliving the night of the 2016 election. It was “the greatest night in the history of television,” he told a crowd in Wisconsin three weeks ago. “We had so much fun, the tears that were flowing … Remember the tears?” On Oct. 25, at a rally in New Hampshire, he claimed that as one state after another fell into his column that night—Georgia, Michigan, Pennsylvania—TV reporters had wept on air. “They’re crying, they crying,” he exulted, recalling the scene. “It was beautiful … You saw these very unbiased anchors with the tears coming down.” In every retelling, Trump boasted that his tally that night, 306 electoral votes, had traumatized the opposition. “We’re going to have an even more amazing evening” on Nov. 3, he promised.

For a few hours on Tuesday night, it looked that way. Then states began to count the millions of ballots mailed in by people who’d had enough of Trump. By Wednesday morning, he was in shock. “They are finding Biden votes all over the place,” he protested. First he issued a preposterous monarchic decree that “we have claimed” Michigan, Georgia, and Pennsylvania. Then he demanded that election workers “STOP THE COUNT!” On Thursday, he went to the White House podium and ranted, “I won Pennsylvania by a lot … In Georgia, I won by a lot … We were way up in Michigan, won the state.” By Friday, he was pleading, “I had such a big lead in all of these states late into election night, only to see the leads miraculously disappear … Perhaps these leads will return as our legal proceedings move forward!”


What we’re watching now, as the ballots pile up against Trump, and as he vows to fight on in the courts, is the slow-motion humiliation of an empty demagogue. The man who mocked Sen. John McCain’s heroism and called former Sen. Jeff Flake “stupid” is trailing in their state, Arizona, thanks to 100,000 Republicans who, at the urging of Flake and of McCain’s widow, voted for Biden. And the rebuke is personal: Republicans held the Senate and won lots of races down the ballot, often beating the president’s margins. Now, as his party slinks away from him, Trump faces the prospect of surrendering the White House to the man he belittled, in every speech, as “the worst candidate in the history of presidential politics.” It’s such a shame.

Trump, however, has signaled that he is not likely to concede defeat quickly. In a Wednesday tweet, the president declared without evidence that he had won in Pennsylvania, Georgia and North Carolina.

“We have claimed, for Electoral Vote purposes, the Commonwealth of Pennsylvania (which won’t allow legal observers) the State of Georgia, and the State of North Carolina, each one of which has a BIG Trump lead,” Trump wrote in tweets that were quickly flagged on Twitter as containing disputed or misleading election information. “Additionally, we hereby claim the State of Michigan if, in fact, there was a large number of secretly dumped ballots as has been widely reported!”

Hours earlier, the Trump campaign announced it would seek a recount in Wisconsin, another state the AP said Biden had won.

We all know why Joe Biden is rushing to falsely pose as the winner, and why his media allies are trying so hard to help him: they don’t want the truth to be exposed. The simple fact is this election is far from over. Joe Biden has not been certified as the winner of any states, let alone any of the highly contested states headed for mandatory recounts, or states where our campaign has valid and legitimate legal challenges that could determine the ultimate victor. In Pennsylvania, for example, our legal observers were not permitted meaningful access to watch the counting process. Legal votes decide who is president, not the news media.

Beginning Monday, our campaign will start prosecuting our case in court to ensure election laws are fully upheld and the rightful winner is seated. The American People are entitled to an honest election: that means counting all legal ballots, and not counting any illegal ballots. This is the only way to ensure the public has full confidence in our election. It remains shocking that the Biden campaign refuses to agree with this basic principle and wants ballots counted even if they are fraudulent, manufactured, or cast by ineligible or deceased voters. Only a party engaged in wrongdoing would unlawfully keep observers out of the count room – and then fight in court to block their access.

So what is Biden hiding? I will not rest until the American People have the honest vote count they deserve and that Democracy demands.

The earlier comment about poll watchers being expelled were people who broke into the facility. The state government has placed observers from both parties are monitoring the facility. They usually verify signatures. If they can't verify them they are rejected.

Many leaders have been battered by four years of the convention-smashing President Donald Trump, and see in Biden a counterpart who will try and return America onto a path of multilateralism and international cooperation.

Canadian Prime Minister Justin Trudeau, who had a fraught relationship with Trump, was among the first world leaders to issue a statement congratulating Biden and his running mate, Kamala Harris.

"Our two countries are close friends, partners, and allies. We share a relationship that's unique on the world stage," Trudeau wrote soon after news emerged that the former vice president had won the pivotal state of Pennsylvania, according to NBC News projections. "I'm really looking forward to working together and building on that with you both."

Paris Mayor Anne Hidalgo was less diplomatic.

"Welcome back America!" she wrote on Twitter. "Congratulations to Joe Biden and Kamala Harris for their election!"

Messages from foreign leadersand officials are common when a new U.S. president is elected. Less common, however, is the number this time around who have been referencing the previous administration — perhaps tacitly signposting their relief that it's over — when delivering their congratulations.

There were many mentions of the challenges the new White House faced.

Sweden's Prime Minister Stefan Löfven congratulated Biden and mentioned the need for "multilateralism" — something the Trump administration has explicitly shunned.

New Zealand's Prime Minster Jacinda Ardern — lauded for her response to the coronavirus pandemic and the March, 2019, Christchurch mosque attacks that killed 51 — celebrated Biden's victory before saying there were "so many issues facing the international community."

French President Emmanuel Macron also noted the international challenges piling up on the president-elect's desk.

The rush of congratulations from many Europeans made sense given Biden's long track record as a supporter of strong trans-Atlantic ties.

"Biden will be more diplomatic toward allies across the board but particularly toward Europeans," Hans Kundnani, a senior research fellow at the U.K.-based think tank Chatham House focusing on Europe and trans-Atlantic relations, said before the election. "Europeans will be extremely relieved."

German Chancellor Angela Merkel, who Trump has publicly criticized, also congratulated Biden on his win, while the country's Foreign Minister Heiko Maas welcomed the "clear figures" that propelled Biden to victory.

Relations with the European Union, NATO and, in particular, Germany were strained under Trump.

While the U.K.'s Boris Johnson also quickly issued a congratulatory message, referring to the U.S. as Britain's "most important ally," the Conservative prime minister's message was not as fulsome as that of some of his counterparts.

Biden has spoken against Britain's exit from Europe, a cause championed by Johnson, and in December referred to the British leader as the "physical and emotional clone" of Trump, according to The Hill.

Elsewhere, not everyone may be overjoyed at the prospect of a Biden presidency.

A sense of unease is likely coursing through parts of the Middle East, where Trump's White House has had especially close relationships with the leaders of longtime U.S. partners Saudi Arabia, the United Arab Emirates, Israel and Egypt.

"They are going to try to coexist with Biden and make the best of a bad situation from their point of view," Fawaz Gerges, a professor of international relations at the London School of Economics, told NBC News. "They put most of their eggs in Trump's basket — he's been good to them."

Elsewhere, Russian President Vladimir Putin has said Moscow will work with any U.S. leader, but Biden's win will be a net negative for Russia, Moscow-based political analyst Vladimir Frolov said before the election.

Biden called Russia the biggest threat to U.S. national security last month — an assessment the Kremlin said encouraged hatred of Russia.

"Moscow is paying close attention to this and does not like what it sees," Frolov said.

President-elect Joe Biden on Saturday delivered his first televised remarks since he was declared winner in his race against President Donald Trump. Touching on themes of unity, hope, and healing, Biden said he has a mandate to reach across the aisle and “marshal the forces” of decency and science to tackle some of the country’s largest issues, including systemic racism, the pandemic, and climate change.

We have a new president. After all that we have seen and endured, amidst pain and outrage, loss and danger, we now will enter a new chapter in our national story.

The nature of our electoral system had a nation, and the world, waiting anxiously on the vote in a handful of states, nevermind that the general will of the American people has delivered a much more overwhelming verdict. There will be a lot more to say in the days, weeks, and months ahead. Longtime GOP pollster and political strategist Frank Luntz told CNBC on Tuesday he will be closely watching the results in North Carolina, Florida and Ohio, describing the trio of states as key bellwethers in determining the election outcome between President Donald Trump and Democratic nominee Joe Biden.

“If Donald Trump wins all three of them, he’s going to be in this,” Luntz said on “Squawk Box,” as Americans who haven’t already voted go to the polls on Election Day. “If Biden wins even one of those three, it’s Biden’s presidency,” Luntz added.
