The incompetence and disaster that is Illinois (197 Covid deaths reported yesterday alone)

Now that Governor Pritzker has pretty much shut down the states (no indoor service at bars or restaurants, mandatory quarantines, mask mandates,  no public meetings of any kind over 25 guests or 25% capacity, limited personal social gathering of no more than six guests or 10 guests in an outdoor setting)... amazingly (or not so much) things continue to get worse. 

Oh in what can only be described as rich hypocrisy and irony, the Governor is requiring 14 day quarantines from people arriving from "other states"... as if it's the fault of "other states" that Illinois is looking like they are going to be Florida or Arizona on steroids as it pertains to Covid cases and deaths. Of course the states left out of their quarantine list are liberal states like California and New York (where yesterday alone they accounted for nearly 13,000 new cases). But you have to quarantine for 14 days if you come from Alaska (which reported less than 100 new cases and 1 new death yesterday putting them at 98 deaths since the whole thing started).

Think about that for a second... the state that just broke the single day record for most cases and reported nearly 200 deaths in a single day is suggesting that the real danger lies with a state that has 6.5 times less deaths per million than Illinois. But they have no issues with the state that more than doubles their own death per million statistic? 

The only real question here is whether or not this incompetence resides solely at the leadership level or if the people of Illinois are to blame as well?

“In every one of those states, we have more than enough illegal ballots already documented to overturn the result in that state,” Giuliani said, erroneously claiming that the mail vote was invalid because Republicans hadn’t been allowed to observe the count.

“They didn’t allow Republicans in those key places to observe the mail vote. That makes the mail vote completely invalid,” he told anchor Maria Bartiromo.

The story has been debunked by the AP and the New York times .

The Dominion software was used in only two of the five counties that had problems in Michigan and Georgia, and in every instance there was a detailed explanation for what had happened. In all of the cases, software did not affect the vote counts.

In the two Michigan counties that had mistakes, the inaccuracies were because of human errors, not software problems, according to the Michigan Department of State, county officials and election-security experts. Only one of the two Michigan counties used Dominion software.

Issues in three Georgia counties had other explanations. In one county, an apparent problem with Dominion software delayed officials’ reporting of the vote tallies, but did not affect the actual vote count. In two other counties, a separate company’s software slowed poll workers’ ability to check-in voters.

The United States surpassed 11 million coronavirus cases Sunday, less than a week after it reached 10 million, according to the Johns Hopkins University Coronavirus Resource Center.

The U.S. leads the world in both cases and in deaths, with 246,006 fatalities, according to the data.

Saturday marked the eleventh consecutive day with over 100,000 COVID-19 cases recorded, health data showed. In the last week, the U.S. has reported a new weekly record of cases, with 989,825.

The Joint Chiefs of Staff Chairman Mark Milley said the U.S. military did not take an oath to “an individual,” but the Constitution, as President Donald Trump continued his reshuffle of the Pentagon in the wake of sacking Defense Secretary Mark Esper.

Speaking at Fort Belvoir in Virginia on Veterans Day, the top general reiterated that servicemembers did not take an oath to any individual person, religion, country or tribe as he opened the new National Museum of the United States Army.

Delivering his remarks on Wednesday, Milley said: “We are unique among armies, we are unique among militaries. We do not take an oath to a king or queen, or tyrant or dictator, we do not take an oath to an individual. No, we do not take an oath to a country, a tribe or a religion.


“We take an oath to the Constitution, and every soldier that is represented in this museum—every sailor, airman, marine, coastguard—each of us protects and defends that document, regardless of personal price.”

Milley has long respected and spoken about the military’s oath to the Constitution over any one individual or entity, but repeated his position as the Pentagon saw several members of its leadership team depart this week.

Defense Secretary Mark Esper was the first to be fired by Trump on Monday after it was reported that he had prepared a resignation letter in the wake of the commander-in-chief’s election defeat.

National Counterterrorism Center Director Christopher Miller was appointed as acting defense secretary in Esper’s stead, with Trump announcing the shakeup on Twitter and promising that Miller would do a “GREAT job” at the helm of the Pentagon.

A further three Defense Department exits were announced by the Pentagon in a Tuesday press release. Dr. James Anderson, acting under secretary of defense for policy, the Under Secretary of Defense for Intelligence and Security Mr. Joseph Kernan, and Esper’s Chief of Staff Jen Stewart were all said to have handed in their resignations in the wake of Esper’s sacking.

“I want to thank Dr. Anderson, Admiral Kernan and Jen Stewart for their service to the nation and the Department,” Acting Defense Secretary Miller said in a statement. “Over their careers each has contributed greatly to the national defense and the future of the Department of Defense. We wish them the best in their next endeavors.”

The Intercept also reported on Wednesday that Mark Tomb, the deputy chief of staff to the undersecretary of defense, had also been removed from the department as part of the administration’s shakeup.

It is unclear why President Trump has chosen to reshuffle the top of the Pentagon with weeks left in his presidency, but there have been speculative reports that the appointment of loyalists could be part of an attempt to bring more U.S. troops home from service in the Middle East.

President Trump’s campaign on Sunday scrapped a major part of its federal lawsuit challenging the election results in Pennsylvania.

Trump’s attorneys filed a revised version of the lawsuit, removing allegations that election officials violated the Trump campaign’s constitutional rights by limiting the ability of their observers to watch votes being counted.
Trump and Rudolph W. Giuliani, his personal attorney, have said repeatedly that more than 600,000 votes in Philadelphia and Pittsburgh should be invalidated because of this issue.


Trump’s pared-down lawsuit now focuses on allegations that Republicans were illegally disadvantaged because some Democratic-leaning counties allowed voters to fix errors on their mail ballots. Counties have said this affected only a small number of votes.

Cliff Levine, an attorney representing the Democratic Party in the case, said on Sunday evening that Trump’s move meant his lawsuit could not possibly change the result.

“Now you’re only talking about a handful of ballots,” said Levine. “They would have absolutely no impact on the total count or on Joe Biden’s win over Donald Trump.”
Kathy Boockvar, Pennsylvania’s Democratic secretary of state, submitted a court filing in response to the Trump campaign’s actions reiterating her request for the judge to dismiss the lawsuit.

The shift comes amid a string of losses in the Trump campaign’s post-election legal effort, which claimed without evidence that voter fraud, irregularities and rule-breaking led to President-elect Joe Biden’s victory. Taken together, the flurry of post-election litigation has affirmed the integrity of the election: many of the complaints have been tossed, and not a single vote has been invalidated.

Employers should anticipate major changes to national labor policy when President-elect Joe Biden assumes the Oval Office. Changes will likely seek to increase union membership by facilitating organizing, shortening election periods and reducing the bargaining period for the first collective bargaining agreement. The Biden administration will seek to effectuate these policy changes using a combination of legislation and revisiting Trump-era National Labor Relations Board (NLRB) decisions.

In February 2020, the House of Representatives passed the Protecting the Right to Organize Act of 2019 (PRO Act), one of the most significant pieces of labor legislation since the Taft-Hartley Amendments of 1947. The PRO Act did not pass the Republican-controlled Senate.

Among other things, the PRO Act would ease employee classification, facilitate faster organizations, and shorten representative elections by codifying several Obama-era decisions and rule-makings. Most significantly, the PRO Act would substantially alter the test for determining whether an independent contractor is really an employee by codifying the “ABC” test used by the California Department of Labor. Under the “ABC” test, to prove that a worker is an independent contractor rather than an employee, the employer must demonstrate that:

the employer does not control or direct the performance of the work both under the terms of the employment contract and in practice.
the work performed is outside the usual course of business for the employer.
the worker ordinarily performs the same work as part of an independently established trade, occupation or business.
Because the “ABC” test requires an employer to meet all three prongs before classifying workers as independent contractors, its application tends to favor the classification of individuals as employees. This is important because, under the National Labor Relations Act (NLRA), only employees have the right to organize.

Even if the Democrats are unable to regain control of the Senate in January, it is likely that a newly-appointed Biden NLRB would revisit a number of Trump NLRB decisions, particularly those that overturned Obama-era determinations.

First, a Biden NLRB would likely reinstate Specialty Healthcare, 357 NLRB 934 (2011), which the Trump NLRB overruled in 2017. In Specialty Healthcare, the Obama NLRB endorsed the concept of “micro-units” when evaluating potential bargaining units. Under the “micro-unit” standard, the NLRB presumes that a bargaining unit is appropriate when it is composed of employees that perform the same job at the same facility regardless of whether other employees share a community of interest with that unit. This means that organizing efforts can target a smaller group of employees to organize, allowing the Union to gain a “toe-hold” in an employer’s operation from which it can expand its representation.

Second, a Biden NLRB would likely also reinstate Purple Communications, 361 NLRB 1050 (2014), which the Trump NLRB overturned in 2019. In Purple Communications, the Obama NLRB determined that employees had a NLRA-protected right to use their work email accounts for organizing purposes even if the employer prohibited non-work related use of work emails accounts. Reinstating this decision would be a boon for organizers looking to use employer provided email accounts as a way to organize — and it would require employers to review their handbooks to make sure their email use rules do not run afoul of NLRB law.

Finally, a Biden NLRB would likely return to the joint-employer test articulated in the Obama-era decision Browning-Ferris Industries, 362 NLRB 1599 (2015). In that decision, the NLRB expanded the joint-employer standard by holding that an employer’s status as a joint-employer hinges on the employer’s reserved right to control employees as well as its indirect control over employees. The Browning-Ferris decision relaxed the previous joint-employer standard, which required a demonstration that the putative joint-employer actually exercise direct control over the employees in question. By relaxing the joint-employer standard, employees may assert their right to bargain with both their direct employer and the company that contracted their services. Browning-Ferris has the potential to lead to increased bargaining across a variety of industries, particularly those industries that rely on a franchise model.

In sum, major changes to labor policy do not hinge solely on the Democrats winning both January run-off elections in Georgia. Regardless of the outcome of the Senate run-off elections, the composition of the NLRB will change under the Biden administration, likely resulting in a return to Obama-era precedent in key areas, including unit composition, joint-employer status and the rules around organizing activity.

After years of blanket opposition to Trump, we are being told that Joe Biden has a national "mandate."

He does not. G-d willing, Washington is headed for more "gridlock" -- a completely healthy, organic reflection of the geographical, ideological and theological differences of real people in contemporary America. Congress makes laws, and right now, that institution is narrowly divided and unlikely to be able to come together on any of the big-ticket items Biden promised. This is why federalism exists.

Unity is found in comity with your neighbors, in your churches and schools, in your everyday interactions with your community. Politics is not a place for unity. It is a place for airing grievances. And we've got plenty.
