Was this a "legitimate" election? (Part II)

After announcing that they had stopped counting in Wisconsin, Michigan, Pennsylvania, and Georgia, and after poll watchers, the media, and other onlookers were sent home... several counties in all four states apparently went back to counting. 

When we woke up the next morning and checked the counts:

  • Biden had gained about 110,000 votes in Wisconsin and pulled ahead
  • Biden had gained over 300,000 votes in Michigan and had pulled ahead
  • Biden had gained several hundred thousand votes in Pennsylvania
  • The NYT Georgia needle went from Trump up by 4% to Biden up by 0.1%

    Again... this all happened after officials in all these states determined that they were halting their counting until morning, and by most accounts this massive overnight counting was done without poll watchers present. This massive overnight counting included pretty much all of the talked about irregularities that nobody has ever really explained. 

    Oh, and to say that it's unusual for the NYT to have their needle off by over four points is an understatement. The needle is determined by the known number of votes left in the various areas of the State and how they believe those demographics will be counted. The NYT needles have been incredibly accurate for the past few elections. 

    In this case, Florida ended up 3.3% for Trump, when the needle had it at 3.2%. While North Carolina ended at 1.4% for Trump, which was exactly where the needle had it. 

    Only Georgia was off (massively) and the miss was the equivalent of about 220,00 votes. This isn't a matter of incorrectly figuring who was voting for who. This was a matter of approximately 220,000 ballots (in Biden's favor) that didn't appear to exist at 1:00 AM EST (when I last captured the needle). Again, no explanation for this was ever presented by NYT or anyone else. Seems everyone is vigilantly incurious about these things. 

    Does any of this "prove" fraud or voter tampering? I suppose that's a matter of opinion. 

    But it certainly proves that there were election officials willing to basically mislead and manipulate poll watchers and other onlookers into going home in order for them to continue their counting without them there. If there is an "honest" reason to do so, I cannot think of it. The fact that so many unusual things seem to happen in the middle of the night when no-one was paying attention feeds into the concept that fraud or tampering took place. 

    Everyone (Republican, Democrat, Independent) should be suspicious of the motivations for this and call on this type of partisan behavior to stop. We are partisan enough as a country, but that should end when it comes to counting votes. If we remain partisan while counting votes, then the way around that is to eliminate both Parties from the process (other than as onlookers) and require all counties in all states to be counted by independent accounting firms agreed upon by everyone in advance.

    And U.S. Rep. Louie Gohmert, R-Tyler, who appeared in Philadelphia on Friday, raised the possibility, without presenting any evidence, of “manufactured” votes and said “the election is in the process of being stolen.”

    The claims from Cruz and Cloud about election watchers are not true. In a court hearing Thursday, a lawyer for Trump acknowledged that the team’s observers were being allowed in the room, according to WHYY in Philadelphia. When the judge asked if Trump observers were allowed in the room, a Trump attorney answered, “There's a non-zero number of people in the room.”

    The judge in the case, a Republican appointee, dismissed a lawsuit seeking an end to the count after urging both sides to come to an agreement on how many observers from each party could be in the room where the ballots were being counted.

    The counting has been done in the presence of election watchers representing both parties. But Trump has continued to claim, with no evidence, that he is being cheated. Texas politicians and conservative figures have spread falsehoods that have further sowed confusion about those claims.

    The vote counting in Philadelphia is taking place at its sprawling convention center. Philadelphia magazine reported that early in the count, observers had to watch the proceedings from distances ranging from approximately 15-105 feet away — making the ability to see the count difficult, according to a Republican observer’s testimony. Most notably, one observer was photographed watching the counting with the aid of binoculars. City officials argued that counters needed space to maintain social distancing, security and privacy protections while handling ballots.

    Scott, each state count the vote per county. The lower population rural counties favored Trump.

    The higher population counties take much longer to count millions of ballots. In every state, the Secretary of state has stated that the count was correctly calculated. And they complied with the rules, including observers from both parties.

    This was the cleanest and most secure in history.

    Baloney. Let’s look at the facts and debunk their myths once and for all.

    They claim millions of Americans are voting twice, using multiple registrations in different districts.  

    So how often does double voting really occur? An analysis of the 2012 presidential election found that out of 129 million votes cast, 0.02 percent—that’s two one hundredths of one percent—were double votes—which were likely the result of measurement error. This is a far cry from Donald Trump’s claims that millions of people were registered in two different states in the 2016 presidential election.

    Trump and his enablers claim non-citizens are voting in droves. Trump himself said that thousands of undocumented immigrants voted in 2016.

    Another lie. According to the non-partisan Brennan Center for Justice, of 23.5 million votes cast in districts with high populations of non-citizens only 30—I repeat, thirty—possible incidents of improper non-citizen voting were referred for further investigation.

    They claim voter impersonation is rampant at the polls.

    False. A 12-year study of election data found only 10 cases of voter impersonation out of 146 million registered voters. Ten. 

    So if voter fraud really isn’t a problem, why do Trump, Republicans in Congress, and their allies at Fox News keep perpetuating this myth? For one simple reason: To enact restrictive voting laws intended to keep voters from the polls.

    The nation's leading GOP election attorney throws cold water on election fraud claims

    Republican election attorney Benjamin Ginsberg spent his career helping Republican candidates get elected. As part of those efforts, he was on the lookout for voter fraud. As he details in a Washington Post op-ed, such fraud is very hard to find.

    The truth is that after decades of looking for illegal voting, there's no proof of widespread fraud. At most, there are isolated incidents — by both Democrats and Republicans. Elections are not rigged. Absentee ballots use the same process as mail-in ballots — different states use different labels for the same process.

    The Trump 2016 campaign, of which I was not a part, could produce no hard evidence of systemic fraud. Trump established a Presidential Advisory Commission on Election Integrity in 2017 to expose all the fraud he maintains permeates our elections. He named the most vociferous hunters of Democratic election fraud to run the commission. It disbanded without finding anything.

    The Heritage Foundation Election Fraud Database has compiled every instance of any kind of voter fraud it could find since 1982. It contains 1,296 incidents, a minuscule percentage of the votes cast. A study of results in three states where all voters are mailed actual ballots, a practice at the apex of the president's outrage, found just 372 possible cases of illegal voting of 14.6 million cast in the 2016 and 2018 general elections — 0.0025 percent.

    If anything, Ginsberg goes easy on those who make broad election fraud allegations.

    When Kris Kobach was Kansas Secretary of State, he pushed election law reforms premised on the need to root out election fraud and, in particular, prevent voting by non-citizens.  When these restrictions were challenged in court, his case crumbled.  Given the opportunity to present evidence and expert testimony, Kobach was unable to substantiate his fears of stolen elections. Kobach was eventually held in contempt and sanctioned by the court.

    The evidence of widespread election fraud is woefully thin. When it happens, it may affect local races (where the total vote counts are much smaller). It is impossible to prove election fraud is not happening, as it is impossible to prove a negative. (To those convinced we have a problem, the lack of evidence only shows that those stealing elections are even more devious than we thought!) While election administration in parts of the country may be rickety and inefficient, there is no reason to think national elections are compromised, let alone that the Presidential race could be stolen.

    That said, when efforts to subvert election laws are uncovered, they should be prosecuted aggressively. Election law violations should be taken seriously. With that in mind, here's more from Ginsberg's op-ed:

    ATLANTA — President Trump’s attempt to undo the election results was undercut twice by fellow Republicans on Friday, as Georgia became the first contested state to certify Joseph R. Biden Jr.’s victory and Michigan lawmakers — after meeting with the president — said they would not intervene in their state’s election certification process.

    After steady complaints by Mr. Trump about the Georgia vote count and a methodical hand recount, Georgia’s secretary of state, Brad Raffensperger, bluntly declared on Friday, “I live by the motto that numbers don’t lie,” and made official the final tally showing Mr. Biden had defeated Mr. Trump by 12,670 votes, out of roughly five million cast. Gov. Brian Kemp, also a Republican, tersely stated that he would sign the certification.

    Hours later, a delegation of seven Michigan Republicans, who had met with Mr. Trump at the White House at his request, said they had no information “that would change the outcome of the election in Michigan.” Mr. Biden beat Mr. Trump in the state by nearly three percentage points.

    “We will follow the law and follow the normal process regarding Michigan’s electors, just as we have said throughout this election,” the state’s top two Republican leaders said in a statement issued by the State Legislature.

    Under the bill, an Equity Commission would study the legacy of discrimination at the USDA and suggest reforms that could reach the farmer-elected county committees that help guide operations at local USDA offices. An independent board would hear appeals of civil rights complaints decided by USDA officials.

    “The Justice for Black Farmers Act is the most ambitious legislative proposal ever developed to address historic and ongoing discrimination against Black farmers,” said John Boyd, president of the National Black Farmers Association, and Scott Faber of the Environmental Working Group, two of the six dozen local and national groups that endorsed the bill. “Black farmers have been systemically denied access to land, subsidies, loans, and other critical tools through government and private discrimination, and the institutional racism that has driven Black land loss is being reinforced through the USDA’s broken policies.”
