President-elect Joe Biden said another 250,000 Americans could die of coronavirus between now and January, a higher forecast than previously given by health officials as the country faces rises in new infections and hospitalizations.
“We’re likely to lose another 250,000 people dead between now and January,” Biden said.

In 1814, John Adams wrote a letter to Virginia Delegate John Taylor reminding that “Democracy never lasts long. It soon wastes, exhausts and murders itself. There never was a Democracy yet, that did not commit suicide.”
Texas was never going to win its recent lawsuit against Georgia, Michigan, Pennsylvania and Wisconsin, but if it had, it certainly would have fulfilled Adams’ dark prophesy. The lawsuit, filed by a Texas Attorney General under criminal investigation, read more like an effort to curry favor with the President than a serious legal document. On a personal level, his logic was sound: when pardons are being handed out to corrupt cronies, corrupt people figure out how to become a crony, fast.
Far more alarming was the decision of eighteen other Republican state attorneys general—most of whom presumably do not need a pardon from the outgoing president—to support Texas’ effort to disenfranchise millions of American voters and overthrow the results of a democratically held election.
They were joined by more than half of the Republican members of the House of Representatives—126 in all—all signing onto the proposition that four states’ elections should be entirely discarded. Strikingly, several of the signatures on that brief were from Members seeking to disenfranchise their own voters and cast their own elections into doubt.
The Supreme Court rejected Texas’ anti-democratic effort unanimously, with seven justices saying that Texas did not have a legal right to proceed and the other two saying that they wouldn’t block the election even if the case did proceed.
Our institutions held—this time.
But the broad support among Republicans for the previously unthinkable—a demand that the judiciary deliver Trump the presidency against the overwhelming will of the American people—signals a worrying and serious erosion of our democratic values within the Republican Party.
This time, there were several reasons that the attempted coup failed and John Adams’ prediction did not come to pass. There is no guarantee that we will be so lucky next time.
First and most obvious, Joe Biden and Kamala Harris won a landslide election garnering more than 300 electoral votes and a lead of more than seven million votes nationwide. There was no single contested state whose results decided the outcome.
Second, the states attacked by Trump’s lawsuits included states with mixed partisan governments–Georgia has a Republican Governor and legislature, while Michigan, Pennsylvania and Wisconsin all have Democratic governors and Republican legislatures.
Third, Democrats control the U.S. House, and the Senate is narrowly divided. Thus, any ultimate decision to tamper with democracy would face a skeptical Congress.
Finally, the legal claims being advanced were outlandish, unsupported in law or fact, and poorly lawyered. By the time the U.S. Supreme Court received Texas’ case, similar claims had been rejected by courts around the country, and the lawyers advancing them had become the subject of national ridicule.
But what if it were closer, the legal claims and team more polished and the Congress unified in support of that candidate?
Donald Trump came to prominence in Republican politics by promoting birtherism—the racist lie that Barack Obama was not born in the United States. Even as clear evidence proved that it was not true, Trump did not retreat. Instead, he expanded the lie to make it even more outrageous and conspiratorial.
Trumpism has morphed from a racist attack on the first Black president into an all-out assault on the very idea of democratic elections. In this sphere, Trumpism’s defining feature is a belief that every electoral outcome that does not favor Trump and his allies must be fraudulent. Its logic is tautological—if Trump did not win there must have been fraud. If there was fraud, Trump did not win. Nothing more is required.
One might think that the simple end of this problem is for Donald Trump to simply leave the White House on the morning of January 20th as a disgraced one-term president. The Republican Party’s reaction to the Texas case suggests this will not be the case.
John Taylor, to whom Adams was writing, was also skeptical of virtue as the foundation for democratic government. “The more a nation depends for its liberty on the qualities of individuals, the less likely it is to retain it. By expecting public good from private virtue, we expose ourselves to public evils from private vices.”
Trumpism has taught us that, for our democracy to survive, we cannot allow ourselves to be exposed to public evils from private vices. This means hardening our institutions of democracy and making them more explicit. This will need to take many forms, but we must start with those that force our nation’s leaders to do better.
First, every election-related lawsuit should have to explicitly state in the caption of the complaint whether the plaintiff is claiming fraud. Claims of fraud must be held to the highest pleading standard—providing the details of who, what, when and how much. If plaintiffs do not claim fraud, they need to say so. When a lawsuit claiming fraud is dismissed, judges should be required to make a specific finding that the claim of fraud was denied.
Second, state bar associations should promulgate specific rules of ethical conduct aimed at anti-democratic efforts. Just as attorneys owe an obligation to the court, they should owe obligations to democracy and democratic institutions. Lawyers should not be allowed to recklessly shout fraud in the parking lot but quietly disclaim it in the courtroom.
Finally, the House and Senate must strengthen their internal rules to prevent Members from undermining democracy. Candidates who, through public statements or court filings, cast doubt on an election that they won should not be seated without formal inquiry into the validity of the election credentials. Members should also be cautioned from making statements, outside of official channels, casting doubt on the validity of an election other than one for a seat in their own chamber.
These suggestions are not the complete solution for what we have witnessed, but they are a start. We cannot ignore the challenges our democracy faces. We must not wait to act until it is too late.
The courts have saved the country for now.
We have to be vigilant

A top Trump appointee repeatedly urged top health officials to adopt a "herd immunity" approach to Covid-19 and allow millions of Americans to be infected by the virus, according to internal emails obtained by a House watchdog and shared with POLITICO.
“There is no other way, we need to establish herd, and it only comes about allowing the non-high risk groups expose themselves to the virus. PERIOD," then-science adviser Paul Alexander wrote on July 4 to his boss, Health and Human Services assistant secretary for public affairs Michael Caputo, and six other senior officials.
"Infants, kids, teens, young people, young adults, middle aged with no conditions etc. have zero to little risk….so we use them to develop herd…we want them infected…" Alexander added.
"[I]t may be that it will be best if we open up and flood the zone and let the kids and young folk get infected" in order to get "natural immunity…natural exposure," Alexander wrote on July 24 to Food and Drug Administration Commissioner Stephen Hahn, Caputo and eight other senior officials. Caputo subsequently asked Alexander to research the idea, according to emails obtained by the House Oversight Committee's select subcommittee on coronavirus.
Alexander also argued that colleges should stay open to allow Covid-19 infections to spread, lamenting in a July 27 email to Centers for Disease Control and Prevention Director Robert Redfield that “we essentially took off the battlefield the most potent weapon we had...younger healthy people, children, teens, young people who we needed to fastly [sic] infect themselves, spread it around, develop immunity, and help stop the spread.”
Rep. Jim Clyburn (D-S.C.), who chairs the coronavirus subcommittee, said in a statement that the documents "show a pernicious pattern of political interference by Administration officials."
"As the virus spread through the country, these officials callously wrote, 'who cares' and 'we want them infected,'" Clyburn added. "They privately admitted they ‘always knew’ the President’s policies would cause a ‘rise’ in cases, and they plotted to blame the spread of the virus on career scientists."
Clyburn said that the documents — which the Trump administration only released to his subcommittee after the election, more than two months after his probe began — underscore why HHS must cooperate with his investigation and that CDC Director Redfield must appear for an interview about an email that he allegedly told staff to delete. Otherwise, "I will be forced to start issuing subpoenas," Clyburn said.
The email cache provided a real-time look at the administration’s deliberations as the Covid-19 crisis first began to rebound during the summer.
"So the bottom line is if it is more infectiouness [sic] now, the issue is who cares?" Alexander wrote in a July 3 email to the health department's top communications officials. "If it is causing more cases in young, my word is who cares…as long as we make sensible decisions, and protect the elderely [sic] and nursing homes, we must go on with life….who cares if we test more and get more positive tests."

There Isn’t a Coronavirus ‘Second Wave’

In recent days, the media has taken to sounding the alarm bells over a “second wave” of coronavirus infections. Such panic is overblown. Thanks to the leadership of President Trump and the courage and compassion of the American people, our public health system is far stronger than it was four months ago, and we are winning the fight against the invisible enemy.
While talk of an increase in cases dominates cable news coverage, more than half of states are actually seeing cases decline or remain stable. Every state, territory and major metropolitan area, with the exception of three, have positive test rates under 10%. And in the six states that have reached more than 1,000 new cases a day, increased testing has allowed public health officials to identify most of the outbreaks in particular settings—prisons, nursing homes and meatpacking facilities—and contain them.
Lost in the coverage is the fact that today less than 6% of Americans tested each week are found to have the virus. Cases have stabilized over the past two weeks, with the daily average case rate across the U.S. dropping to 20,000—down from 30,000 in April and 25,000 in May. And in the past five days, deaths are down to fewer than 750 a day, a dramatic decline from 2,500 a day a few weeks ago—and a far cry from the 5,000 a day that some were predicting.
The truth is that we’ve made great progress over the past four months, and it’s a testament to the leadership of President Trump. When the president asked me to chair the White House Coronavirus Task Force at the end of February, he directed us to pursue not only a whole-of-government approach but a whole-of-America approach. The president brought together major commercial labs to expand our testing capacity, manufacturers to produce much-needed medical equipment, and major pharmaceutical companies to begin research on new medicines and vaccines. He rallied the American people to embrace social-distancing guidelines. And the progress we’ve made is remarkable.
We’ve expanded testing across the board. At the end of February, between Centers for Disease Control and Prevention labs and state public health facilities, the U.S. had performed only about 8,000 coronavirus tests. As of this week, we are performing roughly 500,000 tests a day, and more than 23 million tests have been performed in total.
We’ve also vastly expanded our supplies of crucial medical equipment. In March, there were genuine fears that hospitals in our hot spots would run out of personal protective equipment like N95 masks, gloves or, even worse, ventilators for patients battling respiratory failure. The Strategic National Stockpile hadn’t been refilled since the H1N1 influenza outbreak in 2009, and it had only 10,000 ventilators on hand.
Since then, we’ve increased the supply of personal protective equipment by the billions. Our administration launched Project Air Bridge—a partnership between the federal government and private companies—that, as of June 12, had conducted more than 200 flights from overseas to deliver more than 143 million N95 masks, 598 million surgical and procedural masks, 20 million eye and face shields, 265 million gowns and coveralls, and 14 billion gloves. In addition, we’ve worked with the private sector to ramp up ventilator production. Today, we have more than 30,000 ventilators in the Strategic National Stockpile, and we’re well on our way to building 100,000 ventilators in 100 days. No American who required a ventilator was ever denied one.
We’ve also made great progress on developing therapeutics and a vaccine. Last month, the pharmaceutical company Gilead Sciences announced it would donate about 940,000 vials of its new drug remdesivir to treat more than 120,000 patients in the U.S. Under Operation Warp Speed, the federal government is already funding research into multiple vaccine candidates, and we are well on our way to having a viable vaccine by the fall.
But our greatest strength is the resilience of the American people. From the outset of this pandemic, the American people have stepped up and made great personal sacrifices to protect the health and safety of our nation. And it’s because of their embrace of social-distancing guidelines that all 50 states have begun to reopen in a safe and responsible manner.
The media has tried to scare the American people every step of the way, and these grim predictions of a second wave are no different. The truth is, whatever the media says, our whole-of-America approach has been a success. We’ve slowed the spread, we’ve cared for the most vulnerable, we’ve saved lives, and we’ve created a solid foundation for whatever challenges we may face in the future. That’s a cause for celebration, not the media’s fear mongering.

Finally, significant fraud has been identified in the 2020 election. It is being perpetrated by Sen. Ron Johnson, Republican of Wisconsin.
President Trump lost the election. He lost the recounts. He lost the vote certifications, by Republican and Democratic officials alike. He lost 59 of 60 court cases. He lost the electoral college vote. His own attorney general said “we have not seen fraud on a scale that could have effected a different outcome.”
But Johnson forges ahead with his fraudulent attempt to undermine the election — and the credibility of elections in the United States generally.
Though passively admitting “the conclusion has collectively been reached” that any fraud was too small to reverse President-elect Joe Biden’s win, Johnson then spent nearly four hours in a hearing Wednesday trying to suggest otherwise.

“There was fraud in this election,” Johnson said. “I don’t have any doubt about that.” He went on at length about alleged “irregularities,” including “violations of election laws,” “fraudulent votes and ballot stuffing,” and “corruption of voting machines and software.” He insisted that “many of these irregularities raise legitimate concerns.”
Johnson, you may recall, used his chairmanship of the Senate Homeland Security Committee last month to promote the long-discredited quackery that hydroxychloroquine cures the coronavirus. He used Wednesday’s hearing, mercifully his last as chairman, to mention “the Russian collusion hoax,” “censorship” of conservatives, “financial entanglements of the Biden family,” Hillary Clinton and the Steele dossier.

In one of its closing acts, the Trump administration this week finalized two new rules rolling back water efficiency standards on showerheads and laundry machines.
It's the latest move in line with the president's yearlong crusade against what he deems as insufficient water pressure in household appliances and bathroom fixtures.
The new showerhead rule, which the Energy Department announced on Tuesday, allows for each showerhead in a fixture to reach the two-and-a-half gallon-per-minute maximum water flow rate mandated by Congress, which set those standards nearly 30 years ago. Previously, a showerhead fixture could only use two-and-a-half gallons per minute regardless of how many showerheads were on it, with the total usage collected cumulatively.
In its second rule, the department also created new product classes for washers and dryers with shorter cycle times. That followed the agency's October announcement of a new rule allowing for a new class of dishwashers with shorter cycle times and different efficiency standards.

The fall surge of coronavirus infections and deaths related to COVID-19 has hit hardest in rural areas across the country that had largely been spared the worst of the initial waves in April and June as health care systems in smaller communities struggle to keep up with so much sickness.
A new analysis conducted by the Pew Research Center finds that rural areas that are sparsely populated now account for about twice the number of coronavirus-related deaths as the most densely populated cities.
An average of three people are dying each day in congressional districts where fewer than 5 percent of residents live in dense concentrations. Districts where more than 40 percent of residents live in urban or dense suburban neighborhoods are suffering an average of 1.5 deaths each day.
That figure is a stark reversal from the first wave of infections, when big cities like New York, Boston, New Orleans and Detroit suffered the brunt of the disease. Between March and May, congressional districts where more than 90 percent of residents lived in urban or dense suburban neighborhoods lost an average of 5.7 people each day, while the most rural districts suffered 1.1 deaths on an average day.
Both the number of deaths and the number of cases is rising fastest in areas President Trump won in 2020 and Republican congressional candidates carried in 2018. That may be a function of geography - Republicans perform better in rural areas, while Democrats do better in urban cores. It may also indicate that those living in rural areas are less likely to abide by recommendations from health experts to avoid social gatherings. OF COURSE IT DOES!
"We have people that are less likely to take precautions, and [we] have a lot of pandemic fatigue going on," said Amesh Adalja, a senior scholar at the Johns Hopkins Center for Health Security. "A lot of people have given up."
The diffusion, from an urban core rippling out to suburbs, exurbs and then rural areas, is not unexpected. It mirrors familiar patterns that epidemiologists see with seasonal influenza, which might be introduced into and spread rapidly through cities especially with a hub airport and then filter more slowly through less densely populated communities.
The fall surge has infected far more people than the two zeniths prior, and no state has been able to escape record levels of illness and death. More than 1 percent of Americans tested positive for the coronavirus in November alone, according to William Frey, a demographer at the Brookings Institution's Metropolitan Policy Program - a figure more than twice as high as any prior month.
"The early perception that COVID-19 was only impacting places 'somewhere else' - and that adopting measures such as wearing masks, observing social distancing, and eschewing large gatherings need not be followed - is no longer credible," Frey wrote.

Epidemiologists and public health experts worry about a surge of cases in rural communities, where health systems are smaller and more likely to be teetering on the brink of financial disaster. In earlier waves that were more concentrated, hospital staff could deploy to the hardest-hit epicenters across the country; now, as the virus spreads uncontrolled everywhere, health care workers are becoming an increasingly scarce commodity.
"You can always create extra beds. We have step-down units, we have post-op recovery units, we have actual surgical suites that can be turned into ICU beds," said George Rutherford, an epidemiologist at the University of California-San Francisco. "What we don't have is the staff."
Many smaller facilities are shipping the most severe coronavirus cases to larger medical centers in nearby urban areas - but even those medical centers are beginning to fill.
"You're going to see [rural hospitals] be the canary in the coal mine," Adalja said. "Many of these bigger hospital systems are being much more rigorous about who they accept for a transfer."
More than 109,000 people in America are currently hospitalized with the coronavirus, according to the Covid Tracking Project, a group of independent researches. That number has doubled since Election Day.
Frey's analysis shows the highest per capita case counts happening in non-metropolitan areas, where nearly 18 in every 1,000 people were infected in the month of November. The per capita infection rate in urban cores stood a little below 12 per 1,000.
Infection rates are the most substantial in rural counties where a higher percentage of residents are minorities, and where more than a quarter of residents live in poverty. In both cases, those counties recorded new per capita case counts far higher than the national average, Frey said.
In the 54 counties where more than 80 percent of residents are Black, Hispanic, Asian American or Native American, infection rates are almost three times higher than the national average. In 226 counties where more than a quarter of residents live below the poverty line, concentrated in nonmetropolitan areas in states like Kentucky, Mississippi, Louisiana, Georgia and Texas, infection rates have been higher than the national average since May.

Why would you want to continue to live in a country that you do not believe is great, and a country that you believe does not have free and fair elections?
Whenever your attorneys appear in court, and are asked if there was Fraud committed in the election, they always refuse to take the opportunity to say that there was. Rudy Giuliani was pointedly asked by a Federal Judge if he was claiming Voter Fraud in the election, and Rudy said "This Lawsuit is not about Voter Fraud". Why do your attorneys always refuse to say there was Voter Fraud in the election while they are in court, but are quick to claim there was when speaking to the Media? Could it be that they know they will lose their license to practice Law if they knowingly lie to a Judge in court?
Now that you have lost the election you will lose the protection your office provided you against prosecution. This explains why you refuse to accept the fact that you lost.
