Destined to fail lawsuit attracts more states...

 Seventeen states are now part of the lawsuit originally filed by Texas



Make no mistake, the changes of this lawsuit succeeding is about the same as our favorite senile nursing home resident's chances of "actually" objectively winning a statistical or legal debate with anyone at anytime. Which is to say that the chances are "slim to none" and reports are that "slim was seen a while back leaving the building".

That doesn't mean that technically the case doesn't have legal merit. After all, nothing the lawsuit states can really be argued. These states "did" in fact change their election laws by executive decree in a manner that was not consistent with the laws that their legislature put forward. By all constitutional accounts, this is a clear violation. Black and white. 

But the time to litigate these changes was "before" the election and the feckless Justice Roberts cast the deciding vote (4-4) in many of these cases that allowed these changes to take place. It would be one thing had the courts ruled against these states and they went ahead with their proposed changes anyways. But that is not what happened.

As it were, the states did in fact run their elections in a manner that might be unconstitutional (and probably would have been ruled so if we had a full court back when this was all being litigated). But the fact that the USSC already ruled sort of trumps the underlying concept that those 4-4 rulings were probably wrong. 

At this point the elections were held and those citizens voted within the guidelines (right or wrong) that were supposed to follow. You cannot punish voters or states for following the court rulings in these situations, which is what this lawsuit aims to do.

Paxton, a Republican who remains under indictment for state felony securities fraud charges, is asking the high court for permission to sue the four states to block their certification of Biden’s wins in them.

Paxton argues that a block is warranted because of supposedly improper changes to voting procedures there in the past year, purportedly different treatment of voters in Democratic-heavy areas, and voting “irregularities.”

The four swing-state defendants are set to file their replies in opposition to Paxton’s requests of the court by 3 p.m. on Thursday.

The effort comes as all states have certified their individual presidential election results, which show that Biden easily won the national popular vote.

Biden is projected to win the Electoral College when it meets Monday with 36 more votes than the 270-vote minimum needed to clinch the White House.

Michigan Attorney General Dana Nessel on Tuesday said Paxton’s filing “is a publicity stunt, not a serious legal pleading.”

“The erosion of confidence in our democratic system isn’t attributable to the good people of Michigan, Wisconsin, Georgia or Pennsylvania but rather to partisan officials, like Mr. Paxton, who place loyalty to a person over loyalty to their country,” Nessel said in a statement.

“The Michigan issues raised in this complaint have already been thoroughly litigated and roundly rejected in both state and federal courts – by judges appointed from both political parties. Mr. Paxton’s actions are beneath the dignity of the office of Attorney General and the people of the great state of Texas.”

Trump has refused to concede the election to Biden, claiming without evidence that he was the victim of widespread ballot fraud.

Trump and his campaign, as well as their political allies, have repeatedly failed in their legal attempts to invalidate votes for Biden.

The Supreme Court on Tuesday declined to hear a separate bid from Trump-allied Republicans challenging Biden’s win in Pennsylvania.

Election law experts saw that apparently unanimous rejection as a signal that the remaining efforts to overturn Biden’s win were all but doomed at the Supreme Court.

But the GOP plaintiffs in that case plan to petition the high court for a formal appeal, The Hill reported Wednesday.

The president and his lawyer, Rudy Giuliani, recently have pushed for legislatures in battleground states whose popular elections were won by Biden to overrule their citizens, and to appoint a slate of electors for Trump to the Electoral College.

Basically they don't have standing to discredit the popular vote in the four states they are trying to overturn.

We are a federal nation and each state has the right to conduct their elections.

The use of executive decrees or executive orders, is an issue we may agree.

We haven't declared war since 1942. Executive power troubled the founding fathers. The King of England and his authority troubled them. That's why the executive branch is the weakest branch.

The Congress can tax and determine how it is spent. Trump took money from the defense department to pay for the wall.

He's not the first person to do that.

He's a conservative, but he swore to protect and defend the Constitution of the United states. I don't agree with original intent. Decisions made hundreds of years ago were based upon various beliefs that science and racial views that have changed.

The national debt increased by $7 trillion, or 37 percent. In Trump’s last year, the trade deficit was on track to exceed $600 billion, the largest gap since 2008. Federal law provides a procedure under which, on January 6, Congress will convene to count the electoral votes. If Texas’s elected representatives, or those of any other state, object to the counting any state’s electoral votes, Congress will hear, debate, and vote on those objections at that point — mindful of what such disputes may portend for comity between the states. There is, however, no way the Supreme Court is going to entertain Texas’s lawsuit. There is also no way, I suspect, that Paxton doesn’t know that.

I had the unfortunate opportunity to view what appeared to be a screen shot of a website post that Trumpers are using as evidence of voter fraud. Some Chinese guy who "swears to God" he saw illegal ballots being printed in China and SAW them packed into a shipment of prescription drugs to be smuggled into Canada then across the border to be distributed to Democratic voters in the states where Trump lost. The screen shot included photos of stacks of paper (you couldn't see what, if anything, was written on them) in what looked like a warehouse. He swears to God it's all true and there was a bunch of writing within the paragraphs in Chinese (guess that made it authentic). I not sure how Democrats used these "ballots" to commit fraud and didn't really get an answer when I asked the person posting this info why they didn't just send a bogus ballot as a pdf email attachment to be printed in the U.S. or even why Democrats needed the Chinese at all since there are so many software programs that can be use to duplicate or edit a real ballot, or how these fake ballots would pass the voter ID and registration test for each state but....they believe what they want to believe and they SWEAR TO GOD it's true and this evidence will be presented to the US Supreme Court and Donald Trump will be president forever and ever. Amen.

PRESIDENT TRUMP’S lying about the election has become dangerous — and not just in the sense that it damages democratic norms. It also increasingly threatens to spur physical violence against Americans who have done their duty to oversee a free and fair vote.
Officials in Arizona, Colorado, Georgia, Kentucky, Minnesota, Vermont and Wisconsin have reported receiving threats or harassment. The Arizona Republican Party asked its Twitter followers Tuesday if they were willing to give their lives to overturn the election and “die for something.”
Armed “protesters” menaced Michigan Secretary of State Jocelyn Benson (D) and her family in their home over the weekend. “Someone’s going to get killed,” said Gabriel Sterling, a senior Georgia election official, as he detailed last week the death threats he and others have received. Yet, Mr. Trump continues to pour gasoline on the fire, tweeting Wednesday that “We will soon be learning about the word ‘courage’, and saving our Country.” Kim Ward, the majority leader of the Pennsylvania state Senate, told the New York Times that if she refused to cooperate with efforts to challenge the election result, “I’d get my house bombed tonight.”

President Donald Trump calls it "the big one," but the Texas lawsuit seeking to invalidate President-elect Joe Biden's election victory at the Supreme Court has several problems that doom it, according to experts on election law.

To cite a glaring one, the lawsuit, which Texas Attorney General Ken Paxton filed Monday, calls on the court to delay the electoral vote in the four targeted states, Georgia, Michigan, Pennsylvania and Wisconsin, to allow investigations of voting issues to continue. That would be unconstitutional, said Edward Foley of the Moritz College of Law at Ohio State University. He points out that Article II, Section 4, says that Congress can choose the day the electors meet to vote but that it also says the day "shall be the same throughout the United States." This year, it's Dec. 14, five days from now.

The second hurdle is that Texas has no legal right to claim that officials elsewhere didn't follow the rules set by their own legislatures. The United States doesn't have a national election for president. It has a series of state elections, and one state has no legal standing to challenge how another state conducts its elections any more than Texas could challenge how Georgia elects its senators, legal experts said.

the issue is the fact that election laws were changed by the judicial and/or executive branches in each of the states in direct contravention of the Constitution and violation of state laws; only the states' legislative branches have the authority to do so.

PA being the most flagrant example imho. their supreme court (5 D's, 2 R's) arbitrarily took it upon themselves to ease voting rules, granting 3 days of additional time AFTER election day, coupled with NO signature and NO postmark requirement.

flatly in violation of PA law. and since the outcome of one state DOES impact the others, the 18 states (and counting) who are challenging this are will with their rights to do so.

Obviously you didn't read any of these decisions. Roberts specifically admitted in his own rulings that addressing Covid as an "emergency" was more important than whatever "constitutional issues" arose.

This was a very big back and forth in the most recent 5-4 ruling regarding the religious liberty issues. Gorsuch and Alito both took shots at Roberts and his argument that the "constitution is put on hold" during medical emergencies. Robert's response was weak and "feckless" in his defense of why he decided to not limit executive power in these situations.

In fact, Roberts actually at one point referred to the whole "listening to the experts" argument and not putting constitutional restrictions on leaders attempting to fight the virus.


You can choose to agree or disagree with Roberts (and the three liberals). But you cannot argue that their overriding concern was "the constitution". It wasn't and they admitted such.

I state flat out that the lawsuit is wrong and won't succeed and provide reasons why for both.
