Senator Ben Sasse on Thursday said he expects the Supreme Court to throw out a Texas lawsuit seeking to invalidate President-elect Joe Biden’s election victory.
“I’m no lawyer but I suspect the Supreme Court swats this away,” Sasse said in a statement.
“From the brief, it looks like a fella begging for a pardon filed a PR stunt rather than a lawsuit – as all of its assertions have already been rejected by federal courts and Texas’s own solicitor general isn’t signing on,” the Nebraska Republican said.
Eighteen states joined the lawsuit, filed Monday in the Supreme Court by Texas Attorney General Ken Paxton, which seeks to block presidential electors in four battleground states from casting their votes for Biden.
The lawsuit argues that the electoral vote should be delayed in Michigan, Georgia, Wisconsin, and Pennsylvania as investigations into voting irregularities continue. Texas and the other states are requesting an emergency order to invalidate millions of ballots in the four swing states.
The legal claims in the Texas lawsuit have largely been heard already in lower courts over the course of various cases filed by the Trump team and its allies since the election. All 50 states have already certified their election results.
On Wednesday, the attorneys general of seventeen states Trump won last month filed an amicus brief in the case. The red states that joined that brief are Missouri, Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, and West Virginia.
Arizona’s Republican attorney general Mark Brnovich filed his own brief expressing his support for the lawsuit despite Biden’s victory in Arizona.
The lawsuit comes on the heels of the Supreme Court’s rejection on Tuesday of a similar lawsuit from Pennsylvania Republicans seeking to invalidate the state’s presidential vote results.

On Tuesday, the Supreme Court unanimously rejected President Donald Trump's effort to overturn the presidential election in Pennsylvania. Hours later, the defeated President was back to spreading lies and conspiracy theories about being robbed of victory in an election that he lost to Joe Biden by more than seven million votes.
The madness of Trump's they-stole-it-from-me crusade grows more obvious every day. And it raises a question that has been asked about him for years: Does he really believe what he says?
When Trump was just a businessman and TV celebrity, the answer didn't matter. But now it does.
The man who occupies the highest office in the land is traveling the country in Air Force One, bringing along his Secret Service protectors and his presidential seal, and spreading his nutty claims.
At a rally last week in Valdosta, Ga., he tells his followers, "We're winning!" even as one court after another, in state after state, tosses out his frantic attempts to upend the election by lawsuit. Ranting endlessly on Twitter and Facebook, he insists that victory was stolen from him. But the "evidence of fraud" that he says "is overwhelming" is actually NONEXISTENT.
It's all very crazy. It is also dangerous.
The danger became obvious when, on the night when Trump spoke in Georgia, armed protesters gathered outside a Michigan state official's home to chant and shout obscenities. Their cries of "Stop the steal!" were obviously inspired by the President's delusions. .On Saturday Trump put it this way: "We're all deeply disturbed and upset by the lying, cheating, robbing, stealing that's gone on with our elections."
Michigan was also the place where, authorities said, the governor was the target of a kidnapping plot foiled by the Federal Bureau of Investigation. Fourteen men were arrested.
Authorities allege that they talked about executing the governor and burning down the state Capitol. Part of what motivated them, according to court records, was (Trump's other favorite obsession) state restrictions to limit the spread of the coronavirus.
Even as cases, hospitalizations and deaths have climbed to new heights across the country, the President has persisted in attacking state and local officials who are fighting the pandemic with scientifically sound methods -- mask requirements and limits on public gatherings. In Georgia, Trump said cities and state "should open up" to business as usual.
That view has put tens of thousands of people -- like the supporters who stand should-to-shoulder without face coverings at his rallies -- at risk of debilitating illness and death. One study by Stanford University estimated that Trump rallies were responsible for about 30,000 extra infections and 700 deaths as of Oct. 30.
Nevertheless, people seem to take pride in putting their lives on the line for Trump, to show they agree with him when he says things like, "Don't be afraid of Covid."
Why would Trump downplay the coronavirus risk and put his supporters in danger? Well, it seems he believed that the business shutdowns many experts recommended to fight the pandemic would hurt him politically. The Washington Post reported Trump felt this way back in July when America had recorded three million cases and 130,000 deaths.
As the US death count more than doubled and cases rose nearly five-fold, other nations fared better with stringent shutdowns and mask requirements. One could only conclude that Trump's continued public call to loosen public health measures was not sincere.
In a similar way, the President's claims about the outcome of the 2020 election seem more an act intended to inspire the faithful to cheer and donate money than a matter of genuine belief.
With his court losses piling up and his lawyers reduced to presenting oddball witnesses at legislative hearings, Donald Trump knows he lost the election. CNN reported weeks ago that he has said so himself. However, by furiously insisting he was cheated and filing lawsuits across the country, he has been able to freeze fellow Republicans, who would otherwise congratulate Biden, and raise scads of money with appeals for a so-called Election Defense Fund.
Of the more than $200 million raised by Trump during the time he has bellowed about being cheated, only a reported $8.8 million has been spent on the lawsuits, according to figures released by the campaign last week and reported in the Washington Post. The rest may be put into a so-called leadership political action committee, which can fund all sorts of activities Trump might enjoy after leaving the White House.
Trump's public denials about the election results will also help him escape the blow to his ego that might come with having to admit he lost fair and square.
Having long established that he thinks that there's little worse in life than losing, Trump's image requires that he refuse to acknowledge a genuine defeat. Instead he will proclaim the American election system to be corrupt, and rally his followers to believe him, even though he knows this is not true.
So where does this leave us, as we consider whether Donald Trump believes the outrageous stuff he says? The only answer is that he doesn't believe it, but he doesn't care what damage he does to his country. Even if it makes people suffer and die, or leads them to take up arms against make believe enemies, he will keep it up for as long as the cash flows in and the faithful tell him he's a winner.

But should he still elect to veto the bill, he could complicate lawmakers’ efforts to complete the legislation, which has been signed into law for each of the last 59 years, before it expires at the end of the congressional session on Jan. 3.

Ms Susca has appeared on propaganda network Russia Today to criticise President Trump and has tweeted that it would be a “dereliction of duty” to broadcast his speeches.
In 2019 Ms Susca posted a happy snap with failed presidential candidate Hillary Clinton where she admitted “I’ve been on Team Hillary since 08 tbh” and said she was disappointed her likability did not resonate with the public in 2016.

I’ve done this before, but I want to remind you of Vaclav Havel’s “Power of the Powerless,” which is based around the parable of the greengrocer. The set up is that the greengrocer in a Communist country puts up a sign in his window that reads “Workers of the world, unite!”
Why does he do it? What is he trying to communicate to the world? Is he genuinely enthusiastic about the idea of unity among the workers of the world? Is his enthusiasm so great that he feels an irrepressible impulse to acquaint the public with his ideals? Has he really given more than a moment's thought to how such a unification might occur and what it would mean?
I think it can safely be assumed that the overwhelming majority of shopkeepers never think about the slogans they put in their windows, nor do they use them to express their real opinions. That poster was delivered to our greengrocer from the enterprise headquarters along with the onions and carrots. He put them all into the window simply because it has been done that way for years, because everyone does it, and because that is the way it has to be. If he were to refuse, there could be trouble. He could be reproached for not having the proper decoration in his window; someone might even accuse him of disloyalty. He does it because these things must be done if one is to get along in life. It is one of the thousands of details that guarantee him a relatively tranquil life "in harmony with society," as they say. . . .
The slogan is really a sign, and as such it contains a subliminal but very definite message. Verbally, it might be expressed this way: "I, the greengrocer XY, live here and I know what I must do. I behave in the manner expected of me. I can be depended upon and am beyond reproach. I am obedient and therefore I have the right to be left in peace." This message, of course, has an addressee: it is directed above, to the greengrocer's superior, and at the same time it is a shield that protects the greengrocer from potential informers. The slogan's real meaning, therefore, is rooted firmly in the greengrocer's existence. It reflects his vital interests.
This is exactly how we should view the various lawsuits being filed on behalf of President Trump, especially the suit filed by the Texas attorney general.
Why did the Texas AG file his preposterous claim? Is it because he expected it to be successful? Or because he thought it had even a miniscule chance of succeeding?
No.
He filed it for the same reason as the greengrocer. The Texas AG wanted to signal that he was in harmony with his society (which in Texas is synonymous with the Republican party). That he knows what he must do. That he can be depended upon and has the right to be left in place.
And this is why 17 other state attorneys general joined the Texas suit. They were simply putting up signs in their windows, too.
If the Texas AG served elsewhere, in some other capacity—if he was a United States senator, for instance—he would have found some other mode of expression. But he is only a humble state attorney general. So filing this suit was his sign. Workers of the world, unite!
Ted Cruz needed his own sign. Which is why he volunteered to argue the Texas suit before the Supreme Court.
Did anyone ask Cruz to take the case? No. Did Cruz believe there was any chance, whatsoever, that the case would be accepted by the Court? No. But Ted Cruz has eyes to see and ears to hear. He saw everyone else in the party putting up their signs signaling obedience and reliability. And so volunteering to argue the case became his sign.

Havel explains that the greengrocer putting the sign in his window is both the subject of oppression and an instrument of the oppressive system. He puts the sign up in his window because he has to in order to avoid trouble.
But by putting up their sign, he also contributes to the creation of a panorama of control, which forces the next person to put up her sign, too.
And that’s pretty much what’s going on in the GOP right now.
The actions of the state attorney generals contribute to the panorama which forces congressional Republicans to either stay silent or put up signs of their own.
But maybe the best example of the totalitarianism we’re seeing in the party is how Republicans who say the obvious—that Joe Biden won a free and fair election—are treated. They are not merely seen as having divergent opinions. They are viewed as dissidents. Dangerous people who must be hunted and shunned, opposed and defeated.
And this is because their refusal to conform threatens the foundation of the autocratic power structure. Here’s Havel explaining what happens when the greengrocer takes down his sign:
Let us now imagine that one day something in our greengrocer snaps and he stops putting up the slogans merely to ingratiate himself. . . .
The bill is not long in coming. He will be relieved of his post as manager of the shop and transferred to the warehouse. His pay will be reduced. His hopes for a holiday in Bulgaria will evaporate. His children's access to higher education will be threatened. His superiors will harass him and his fellow workers will wonder about him. Most of those who apply these sanctions, however, will not do so from any authentic inner conviction but simply under pressure from conditions, the same conditions that once pressured the greengrocer to display the official slogans. They will persecute the greengrocer either because it is expected of them, or to demonstrate their loyalty, or simply as part of the general panorama, to which belongs an awareness that this is how situations of this sort are dealt with, that this, in fact, is how things are always done, particularly if one is not to become suspect oneself. . . .
Thus the power structure, through the agency of those who carry out the sanctions, those anonymous components of the system, will spew the greengrocer from its mouth. The system, through its alienating presence in people, will punish him for his rebellion. It must do so because the logic of its automatism and self-defense dictate it. The greengrocer has not committed a simple, individual offense, isolated in its own uniqueness, but something incomparably more serious. By breaking the rules of the game, he has disrupted the game as such. He has exposed it as a mere game. He has shattered the world of appearances, the fundamental pillar of the system. He has upset the power structure by tearing apart what holds it together. He has demonstrated that living a lie is living a lie. He has broken through the exalted facade of the system and exposed the real, base foundations of power. He has said that the emperor is naked. And because the emperor is in fact naked, something extremely dangerous has happened: by his action, the greengrocer has addressed the world. He has enabled everyone to peer behind the curtain. He has shown everyone that it is possible to live within the truth. Living within the lie can constitute the system only if it is universal. The principle must embrace and permeate everything. There are no terms whatsoever on which it can co-exist with living within the truth, and therefore everyone who steps out of line denies it in principle and threatens it in its entirety.
Not much of a reach, is it?
It’s important to understand that this is all new to American politics. We have not been down this road before. And so we should not assume that we know with certainty where it leads.
Maybe the optimistic view is correct: All things are passing. We’ll revert to the Old Republican party soon, just with more constructive populism. These are just the actions of one clownish, cartoonish figure. He didn’t actually succeed, right? Everything is fine.
Or maybe not. Maybe the panorama and the new power structure will outlast Donald Trump and this mode of existence within the Republican party will endure.
And if it does, the consequences will be felt not only by the Republican party.

The interviews with people who work for the lender, Deutsche Bank, and the insurance brokerage, Aon, are the latest indication that once Mr. Trump leaves office, he still faces the potential threat of criminal charges that would be beyond the reach of federal pardons.

The prosecutors have been fighting in court for more than a year to obtain Mr. Trump’s personal and corporate tax returns, which they have called central to their investigation. I often viewed the ’60s and ’70s through the frightened eyes of my parents, both helplessly dazed and endlessly shocked by the sight of assassinated leaders, burned cities, lost wars, desecrated American flags, martyred students and democratic institutions brought low by a frenzied, radical age.
A year before my grandmother sat in stunned silence inside our family’s suburban Atlanta home, Joan Didion had found herself vexed by the “hemorrhaging” that was beginning in San Francisco. The legendary essayist wrote of America’s atomization and the painful realization that “things fall apart.” Reporting on the lost souls of Haight-Ashbury, Didion mourned that “at some point we had aborted ourselves and butchered the job.”
The dystopian scenes painted in her book “Slouching Toward Bethlehem” would take different forms across the United States in the coming years. Millions of Americans responded to the riotous upheaval playing out nightly on network news by flocking to a conservative movement that would soon identify itself by what it was not, define itself by the enemies it kept and occupy itself with an endless search for a lost America that proved irretrievable — because it was a land that had never existed.
The Republican Party projected itself as the bulwark against left-wing radicalism, the moral arbiter of all that was evil, and the righteous judge of what was constitutionally permissible and what was an abomination against God. The movement chained itself to rigid ideology and primal fear, despite Russell Kirk’s warning that “the conservative abhors all forms of ideology” and is guided instead by principles “arrived at by convention and compromise.”
But a party that elevated Donald Trump from Manhattan’s class clown to the U.S. presidency no longer has any use for the likes of Kirk, Edmund Burke or William F. Buckley.
For four years, Republicans averted their eyes as Trump broke the law, defied constitutional norms, trashed governing traditions, dehumanized political opponents and further radicalized a party that had long ago become unmoored from conservative tradition — and yet that proved to be but a preview of worse things to come. Now, Republican leaders are either actively engaged in sedition against the United States or offering their silent support to a president furiously working to overturn an election.
The leveling wind against liberalism has instead become a gale-force wind beating away at the foundations of American democracy.
So what does one do when the cure becomes more toxic than the disease? When the fever proves more deadly than the infection it was meant to kill? Where do voters turn when those who promised to protect American institutions against political extremism pose a greater threat to democracy than the progressive elites they long demonized?
Last weekend, I asked those questions while watching with horror as fellow Americans in Valdosta, Ga., cheered on a politician’s efforts to stage a coup against his democratically elected successor. What a devolution it has been for a party whose members proudly pack pocket-size Constitutions in their jackets while perversely claiming fealty to the Framers’ original intent. How ironic that the very people who convinced my parents they would be the cure for political extremism have metamorphosized into a band of radicals who present the greatest risk to American democracy since the Civil War.
Now it is Jewel Clark’s grandson gazing at images on his television and wondering how a country could so badly lose its way on a tortuous journey from Haight-Ashbury to Valdosta, Ga.

President Trump has expressed interest in pursuing the appointment of a special counsel to investigate allegations of fraud in the November elections and issues related to Hunter Biden, according to people familiar with the matter.
In recent days, the president has directed advisers to look for people who could serve in such a position, one of the people said, as lawsuits and other efforts by Mr. Trump and his campaign to reverse the election results founder. White House officials and allies of the president on Capitol Hill and elsewhere have also pushed for the appointment of a special counsel, another person familiar with the discussions said.
White House chief of staff Mark Meadows has told people that the president is interested in pursuing a special counsel to investigate election fraud and wants to act quickly, one of the people said.

TIME FOR TRUMP TO STOP.
President Trump's defenders have pointed out many times, correctly, that he has every right to pursue legal challenges to election results in states he lost narrowly. Going to court is not staging a coup or plotting to destroy democracy, as some of Trump's adversaries have charged. It is the way people, even the president of the United States, pursue claims in the system. So, even though many of the cases brought by Trump and his allies have been far-fetched, and he has lost nearly all of them, there was no great harm in bringing them.
But the time has come to end it. Monday is the day electors meet in the states to cast Electoral College votes for president. The states have already certified the results of their elections; the total is 306 electoral votes for Joe Biden and 232 for Trump. None of the president's challenges has resulted in a change in any of those state totals, and he would need that to happen in not one, not two, but three states — say, Arizona, Georgia, and Pennsylvania — in order to win. Instead, Biden will win the presidency with 306 votes, unless a "faithless elector" or two makes his winning total slightly smaller. (Remember in 2016, when some desperate Democrats hoped droves of electors committed to Trump would abandon that commitment? It didn't work.)
On Friday evening, the Supreme Court rejected the president's last big challenge, the lawsuit filed by the state of Texas against Georgia, Pennsylvania, Michigan, and Wisconsin. There was no way in the world the court, at the behest of one state, would throw out election results in four other states. There was no basis on which to do it, it was not called for by the Constitution, and it would have set a terrible precedent that would surely plague our politics in years to come. In the end, the justices decided not to take the case at all. Only two, Samuel Alito and Clarence Thomas, said the court should have taken the case, but even they said they "would not grant other relief" and expressed "no view on any other issue." With that, Trump's hope of the nation's highest court stopping certification of the election died.

The Georgia Republican Party, National Republican Senatorial Committee and the two Republican candidates for the runoff elections, Sen. David Perdue and Sen. Kelly Loeffler, filed a lawsuit this week in federal court, asking the judge to declare the state’s absentee ballot verification process unconstitutional.

It is customary this time of year for opinion columnists to review their performance and offer a mea culpa where appropriate. My list is long enough that I thought I’d get an early start.
My biggest mistake is actually four years old, which can be explained but not, as it turns out, justified. On the eve of Election 2016, I wrote that we’d survive as a nation no matter who won, Donald Trump or Hillary Clinton. I did not say we’d be fine. Mere survival seemed a fairly safe bet and, so, I gambled all my chips on our system of checks and balances.
Writers often say they write the books — or columns — they need to read. Though I had been consistently critical of candidate Trump since the first rumor surfaced that he might run for president, I had become convinced six weeks before Election Day in 2016 that he was going to win. This insight was based upon my familiarity with his base — the folks Clinton fatefully called “deplorables.” But I thought we’d get through it okay. That proved to be a mistake.
Every time President Trump did something objectionable, which was more or less daily, Twitter would remind me of my earlier error. The checks and balances conceived by the creators of our republic, and in which I had placed my faith, weren’t nearly as strong as I had believed. They’ve only eroded further under Trump, leaving us at the end of his term, literally, not surviving.
No one could have predicted the coronavirus pandemic, which has taken nearly 295,000 American lives so far. In retrospect, it’s not surprising that Trump mishandled matters during the early stages of the virus when swift, decisive actions might have made a difference. We now know that he is that bad a human being and that lousy a leader. We’ve come not to expect just worse from him but the worst. If once I thought that he’d be at least rational — or I viewed his rallies as harmless sideshows — I’ve been thoroughly disabused of such notions.
