Since they did not actually prevent anyone from observing them, the fact that they counted unsupervised is not illegal and as the argument goes... not their fault.
While this seems like an explanation, it really doesn't seem like a "reasonable" or "believable" one.

This is clear VIDEO EVIDENCE of exactly what people claimed happen in multiple states. The states in question called for a suspension of counting for the night. Everyone clears out, and then a group of people come back in (without poll watchers or observers) and start scanning ballots.

Were these really suitcases or actual ballot boxes? Some are saying suitcases while others are saying they were just regular ballots. Why are they being pulled from under a desk? Suspicious? Sure? Does it prove fraud? Well we don't know. But the reason why we have poll workers is to at least make it "appear" to be on the level and to reduce the amount of suspicion.
This should be considered disturbing behavior for anyone (Republican or Democrat). There isn't a soul at this point who would not (for any reasons other than blatant partisanship) want to see this further investigated and the people who committed this act prosecuted if it turns out that anything illegal was going on..

A two-and-a-half-minute video showing an election worker conducting an ordinary part of the recount process in Gwinnett County, Georgia, has been spun into false claims of fraud.
This is just the most recent example in a surge of falsehoods aimed at undermining the results of the 2020 election.
“It has all gone too far. All of it,” Gabriel Sterling, who oversees Georgia’s voting system, said at a press conference on Dec. 1 in which he called on President Donald Trump and other elected officials to condemn violent rhetoric aimed at election workers. “A 20-something tech in Gwinnett County today has death threats and a noose put out today saying he should be hung for treason. … It has to stop,” Sterling said.
Sterling was referring to an employee of Dominion Voting Systems who is seen in the viral video.
The video appears to have been recorded by a recount observer, and it has been circulated by conspiracy theorists, who falsely claim it shows fraud.
It was shared on Nov. 30 by Ron Watkins, who has been peddling election fraud claims related to Dominion to his 328,000 Twitter followers. Watkins is the son of Jim Watkins, owner of 8kun, the website that spawned the QAnon conspiracy theory, which regards Trump as a crusader against an elitist group of pedophiles. Some of Watkins’ election-fraud claims were included in a recent affidavit for a lawsuit brought by Lin Wood, an Atlanta-area lawyer who has also promoted QAnon rhetoric.
When Watkins shared the video, he included this text: “Watch a Dominion Representative at Gwinnett County Election Central, responsible for tabulating ballots and certifying results, download data to a USB from the Election Management Server, plug it into a laptop, manipulate the data, then palm the USB.”
The right-wing website Gateway Pundit published Watkins’ thread on the topic as though it were a news story.
But the video shows no such thing.
First of all, the person in the video wasn’t responsible for certifying election results. “Certification can only be done by the election board,” Joe Sorenson, spokesman for Gwinnett County, told us in a phone interview. The Dominion contractor was there to help with the tabulating process.
As for what the video shows him doing, the worker was conducting a routine check of the number of ballots that had been recounted, Sterling, the voting system implementation manager in Georgia, explained in a phone interview with FactCheck.org. He was using a USB drive to transfer a report about a recently counted batch of ballots to a computer equipped with a program to read it.
“This is just part of the recount process,” Sterling said, estimating that the procedure shown in the video might be done every hour or two.
We don’t know exactly when the video was recorded or by whom, but it appears to have been during the state’s recent recount. The cordoned-off section of the room where the recording was made was open to the public, Sorenson said.
The earliest version of the video we could find was on the QAnon-themed YouTube channel that Watkins cited on Nov. 30. A recount requested by the Trump campaign had started about a week before, on Nov. 24. It was scheduled to end Dec. 2.
That recount was the second review of Georgia’s election outcome. The first review was a full hand-count audit of paper ballots that was conducted under a new state law and was completed on Nov. 19. The audit confirmed President-elect Joe Biden’s win, and Georgia Secretary of State Brad Raffensperger, a Republican, certified the results of the state’s election.
After the results were certified, the Trump campaign was able to request the machine recount.
Raffensperger said at a press conference Dec. 2 that he expected no substantial changes to the final tally following the recount.
There were no substantial changes following the audit, either.
In Gwinnett County, where the video was recorded, Biden won 58% of the vote. That percentage didn’t change after the audit, although Trump did pick up an additional 285 votes out of a total of 415,507 ballots cast.
Also, Sterling noted that the video appears to have been taken during the recount of the votes, not the original tabulation. So, if a worker manipulated the vote count at that point, there would have been a discrepancy in the numbers.

Why they were "pulled out from under tables and a desk" may or may not be at issue. The allegation is that the same person who cleared out the room was the same person who originally placed those particular cases under the table. Others are saying that it is not abnormal to store ballot cases under a table and that it doesn't prove anything.
Some are blaming the poll watchers for being the ones who should not have left... that they misinterpreted that counting was going to stop, when in fact it didn't.
There doesn't appear to be audio, only video... so we are largely relying on what is being said by the people who were there. They seem to claim that the same women who put these particular cases under the table (presumably so they didn't get counted by someone else) - was the same women who cleared the room - was the same women who then grabbed these particular cases to count when others were not there.
It's the classic Scott Adams case of two different movies.
Depending on your perspective, there is nothing fishy and the fact that they were alone was not their fault. Or this is proof of a grand conspiracy and that the thousands of ballots in these cases were likely planted.

She was identified primarily by her shirt and purse, emblazoned with “Lady Ruby” and “LaRuby” respectively. “LaRuby” is the name of her business.
Freeman can be seen at several points in the now-infamous video. She is seen standing over others while they remove the suitcases, then remove the ballots from the suitcases, suggesting she may have been acting in a supervisory role.
National File has identified the vote counter in Georgia, who brought in suitcases full of ballots that were counted after observers were told to leave, as the daughter of Ruby Freeman.
In an October 26 Facebook live stream, Freeman said “Y’all want to know who my new supervisor is? It’s my daughter.” She added that “I just do what she say do and it’s her show baby, it’s her show.”
Freeman identified her daughter on the November 2 edition of The Atlanta Journal-Constitution, writing that she, as “Supervisor of registration,” was “giving that look to the employees.” She added, “Mommie is so proud of you.” Freeman’s daughter can be seen with long, blonde dreadlocks that are dark at the roots in the photo.
I actually modified my own blog post slightly after watching the video more closely than listening to the attorney talk about it. removing a line about them being suitcases that were hidden.
Without the perspective of what is actually "normal" and not knowing if there is a reasonable reason why cases of ballots are under tables (perhaps there was no other place or room for them) - we cannot say that they were suitcases or that they were hidden.
I don't want to just "assume" everything the attorney says is true, and am willing to accept that (other than there was no reason for them to be in that room without observers, much less running any ballots through any machines) there is probably no concrete evidence that the ballots being run through can be proven to be planted.
But in my humble opinion, the video does shows a small number of poll workers obviously counting ballots without anyone observing. This, alone, is troubling enough for me to question the entire 2.5 hours.

The fact that this was suggested in Fulton (and denied) suggests that we cannot simply accept blanket denials that it didn't happen elsewhere. This is proof that not only did poll workers count without supervision, but they WERE IN FACT willing to lie about.
In Georgia, Gwinnett County was the one who sent everyone home after a water pipe break was reported. Nobody is really denying that people were told to go home. Nobody "can" deny that vote totals were altered during the time that poll watchers left and the time they came back the next day. That should be enough "proof" that it happened in that county as well.
Keeping in mind that is was somewhere around that time (after poll watchers went home) that even the NYT needle moved 4 whole points (when it generally only moves a few tenths of percentages after a certain amount of votes are counted). One of those "big drops" in question appears to be the only reasonable explanation that final vote total "expectations" would have been so severely altered.
This, alone, is troubling enough for me to question the entire 2.5 hours.

For the first time in congressional history, the House of Representatives voted to pass a measure that would decriminalize marijuana use at the federal level -- months after pulling the bill amid worries the controversial vote could cause some lawmakers to lose tight races in November.
The vote passed 228-164, mostly down party lines, with just five Republicans voting in favor of the measure. Six Democrats voted to oppose.
While the federal government continues to criminalize cannabis, House Judiciary Chairman Jerry Nadler stressed that 36 states and the District of Columbia have legalized medical cannabis while 15 states and the District of Columbia have legalized cannabis for adult recreational use. Nadler said the legislation "would reverse the failed policy of criminalizing marijuana on the federal level and would take steps to address the heavy toll this policy has taken across the country, particularly on communities of color."
I almost got arrested for possession of marijuana in 1973! It would have been a federal felony then.

A Kansas son's obituary paying tribute to his father who died of Covid-19 is going viral for excoriating mask refusers.
In the death notice, Courtney Farr, the son of the late Dr. Marvin J. Farr, who died December 1 at Park Lane Nursing Home in Scott City, Kansas, wrote that his father was "preceded in death by more than 260,000 Americans infected with Covid-19."
"Hope you're in as much peace now as you are in this picture," Courtney Farr wrote in a Facebook post about his father, Marvin.via Facebook
Describing his late father as a man born into the Great Depression and having survived World War II amidst great sacrifice, Courtney Farr said Marvin "died in a world where many of his fellow Americans refuse to wear a piece of cloth on their face to protect one another."
"He died in a room not his own, being cared for by people dressed in confusing and frightening ways. He died with Covid-19, and his final days were harder, scarier and lonelier than necessary. He was not surrounded by friends and family."
