No, the fact that the courts were never going to overturn the election results is not proof that there were no statistical anomalies....

I deal with a lot of stupid comments and questions on this site, but this repeated one continues to rank right up there towards the top!

If there are real statistical anomalies, then why hasn't any judges ruled in favor of Trump regarding these election challenges.

This is a classic example of someone who is both ill-informed about how both math/statistics and our legal system works. Obviously, not everyone who reads a blog or Twitter has a math or law degree. But much of this only requires a simple amount of common sense and a basic general understanding of how our country works.

Unfortunately, many people seem to lack these remedial skills.

There are very, very simple manners to answer this question (or questions similar). Even though I doubt that those who ask them are doing so because they actually want an answer, I will try (in vain) to explain this again.

  • Statistical anomalies on their own are not legally a reason to "challenge" or "protest" an election. In fact, nobody I know of has even suggested that they would attempt to "go to court" with statistical anomalies in order to have a Judge overthrow an election. Difficult for a Judge to rule on statistical anomalies, when there are no cases being brought. Moreover, if you really want to know whether or not a statistical anomaly exists or not, why would you ask a judge to rule? It is a mathematical question, not a legal question.
  • Given the time between an election, safe harbor dates, and the electoral college vote... there simply isn't enough time to provide for full blown civil lawsuits. People much smarter (about the law) than anyone here have suggested that under normal circumstances that these suits being brought do have more than enough evidence (including statistical) to have generally gotten to the point of discovery. But given the fact that most civil suits take months if not years to complete, means that "normal" civil suit avenues are not really available for election lawsuits.
So the bottom line is that I have not offered statistical anomalies as any sort of legal means to overturn an election. To attempt to discount the idea that anomalies exist based on the fact that no judge has ruled on them is basically an idiotic argument being made by an idiot with no understanding or math, statistics, or the law. That being said, some people just lack education, common sense, and basic intelligence. Can't fix stupid.

The spectacle of so many House Republicans endorsing the Texas suit is depressing, and they aren’t profiles in courage. But their critics would have more credibility if they hadn’t promoted the Russia “collusion” lies for four years and indulged Hillary Clinton’s claims to this day that the Russians elected Mr. Trump in 2016. This is one reason that tens of millions of Americans are inclined to believe Mr. Trump’s election claims despite the losses in court.

They have seen that Democrats and the press never accepted the legitimacy of Mr. Trump’s victory in 2016. Recall that in January 2017 no less a Democratic authority than the celebrated Rep. John Lewis, since deceased, said “I don’t see this President-elect as a legitimate President” because the Russians elected him. He and other Democrats made a show of skipping the inauguration in protest. Was that an attack on democracy?

None of this and Scott's excuses Mr. Trump’s attempts to delegitimize Mr. Biden’s victory on Nov. 3. There is no doubt that mass mail-in balloting led to more election problems, such as varying rules for signature verification in different Pennsylvania counties. Improving ballot integrity for mailed ballots should be a legislative priority in the states in the next two years.

But these irregularities do not add up to a stolen election in multiple states.
Even if Mr. Biden’s narrow victory was overturned in one of the closely contested states, he would have more than 270 electoral votes. John Kerry and Al Gore both would have won had they not narrrowly lost Ohio and Florida, respectively, but they both conceded (Mr. Gore after a long legal fight). Richard Nixon conceded in 1960 despite evidence that he was cheated out of Illinois. All did so at least in part to avoid tipping the U.S. into irreparable political division.

Coldheartedtruth Teller said...

There’s no predicting how Mr. Trump will behave. He rarely takes our advice—we said in January 2017 that he should fire James Comey upon taking office—and perhaps he will continue his “stolen” election claims past Jan. 20. Perhaps he can’t admit to himself that he lost. Perhaps he hopes to nurture resentment to run again in 2024.

But bitterness as a political strategy rarely wears well. If Republicans lose the Georgia Senate runoffs on Jan. 5, Mr. Trump will deserve much of the blame. If election protests turn to violence in the streets, as they did on the weekend in Washington, he will be blamed whether he deserves it or not. Mrs. Clinton’s example of still claiming she was cheated, four years later, hasn’t enhanced her reputation.

There’s a time to fight, and a time to concede. Mr. Trump has had his innumerable days in court and lost. He would do far better now to tout his accomplishments in office, which are many, and accept his not so horrible fate as one of 45 former American Presidents.

The fact that anomalies exist, is no evidence of fraud, that discredits the election.

The attempt to discredit our basic rights is totally irresponsible.

When you lose the argument you create false allegations.

Scott, no one is arguing that this or any election is absolutely perfect with absolutely no anomalies whether "statistical" or otherwise.

But the courts have firmly rejected the charge that any such anomalies, "statistical" or not, are significant enough to overthrow the votes of a single state, much less the election.

Read that over fifty times. Maybe it will sink in.

Sorry Reverend...

Do you have any Judge who has actually ruled anything about statistical anomalies? Or are you just really confused... again... as you seem to always be?

Barr hasn't said a word about statistical anomalies, as that would hardly be part of his job.

You, like the Reverend... simply don't appear to understand the difference between a statistical anomaly and voter fraud. Which technically and by definition are two completely separate issues.

But then again... neither of you obviously have any real math or statistical understanding and appear to understand even less about the law. So it shouldn't surprise me that you don't know the difference.

Now the local nursing home resident doesn't understand the difference between late night vote counting and "fraud".

I wonder out loud if Roger understands "anything" about any of this.

We conclude that the Dominion Voting System is intentionally and purposefully designed with inherent errors to create systemic fraud and influence election results. The system intentionally generates an enormously high number of ballot errors. The electronic ballots are then transferred for adjudication. The intentional errors lead to bulk adjudication of ballots with no oversight, no transparency, and no audit trail. This leads to voter or election fraud. Based on our study, we conclude that The Dominion Voting System should not be used in Michigan. We further conclude that the results of Antrim County should not have been certified.

Former president Bill Clinton and Hillary Clinton, former secretary of state and 2016 Democratic presidential nominee, were among the 29 electors casting ballots at the state capital in New York, as members of the electoral college gathered at statehouses across the country to formally vote for president and vice president.

The chamber broke out in applause after it was announced that the 29 electors had cast their ballots for Biden for president and Sen. Kamala D. Harris (D-Calif.) for vice president.

New York Gov. Andrew M. Cuomo (D) was also among the state’s electors and presided over New York’s electoral college vote.

Wisconsin Supreme Court Rules Against Trump
12:39 pm
The Wisconsin Supreme Court upheld Joe Biden’s win in the presidential race, handing Donald Trump a defeat less than an hour before the Electoral College was to meet, the Milwaukee Journal Sentinel reports.

“The 4-3 ruling was the latest in a string of dozens of losses for the president across the country as Republicans pursue last-gasp efforts to give Trump a second term.”

Rick Hasen:
“The three separate dissents from the three dissenters reach the merits to say that some of the challenges brought by the Trump campaign were meritorious, but they do not say what the remedy should be, and do not weigh in on whether to throw out the votes and award the results to Trump.

Very odd to not say what the remedy should be.”

“I can’t fathom risking our norms, traditions and institutions to pass a resolution retroactively changing the electors for Trump, simply because some think there may have been enough widespread fraud to give him the win… I fear we’d lose our country forever.”

What’s Next for Those Who Think Election Was Stolen?
2:00 pm
New York Times:
“Nearly all of the people interviewed said they believed at least some fraud had been perpetrated, but whether that added up to Mr. Trump’s being the true winner was much harder to know. The reasons for doubting the outcome were many. Misinformation played a role. So did signaling by Republican leaders, first among them Mr. Trump…

“What happens next is a critical question for American democracy. What will become of the belief that the 2020 presidential election was in some way illegitimate? Will it melt away along with Mr. Trump’s prospects for winning, and vanish completely when Mr. Biden is inaugurated? Or will it fester, nursed by Republicans in power, and metastasize into something that could be a rallying cry for nationalists for years to come?”

Fake Electors Try to Deliver Arizona’s 11 Votes for Trump
2:37 pm
“In another sign of the lingering unrest over President Trump’s election loss, an Arizona group sent the National Archives in Washington, D.C., notarized documents last week intended to deliver, wrongly, the state’s 11 electoral votes for him,” the Arizona Republic reports.

“The 11 electors actually chosen by Arizona voters last month — meeting in an unpublicized location because of security concerns over their task — cast their votes Monday for President-elect Joe Biden and Vice President-elect Kamala Harris, formalizing the Democrats’ victory nationally and in the state.”

“Nearly a dozen centrist senators will present their much-anticipated product on Monday afternoon in two pieces: a $748 billion package boosting funds for education, vaccine distribution, transportation and other areas, and a $160 billion add-on of state and local aid coupled with a short-term liability shield for employers.”

Sen. Bernie Sanders (I-VT) is urging Democrats to reject the bill, Politico reports.

Homeland Security Hacked by the Russians
2:26 pm
“The Department of Homeland Security is the third federal agency to have fallen victim to a major cyberespionage campaign by the Russian government, joining the Treasury and Commerce departments as targets that have been compromised,” the Washington Post reports.

“The fact that the department charged with safeguarding the country from physical and cyber attack was victimized underscores the campaign’s significance and calls into question the adequacy of federal cybersecurity efforts.”

How Barr Kept Hunter Biden Probes Secret
3:00 pm
Wall Street Journal:
“Mr. Barr took more steps than previously reported to insulate the investigations, despite calls from President Trump and Republican allies to announce a probe involving President-elect Joe Biden’s son Hunter.”

“Mr. Barr and senior department officials relayed the instructions in conversations with prosecutors, questioning whether their staff members could be trusted and warning against issuing subpoenas or taking other steps that might become public… In siding with department practice, colleagues and legal observers said Mr. Barr bucked critics on the left and right who have accused him of being too accommodating to Mr. Trump.”
