It's now forty five days past the election and there is still no final word on the Congressional makeup. New York 22 is still in litigation and will most assuredly make it into next week unresolved.
But the big news is a massive shift in the ongoing tally. After some of the the re-re-recanvassing has been reported, the 12 vote Tenney lead was slashed down to 11 votes. Either way, the judge calling for another canvassing doesn't appear to be changing much of anything (so far), with only a handful of new votes being found in only two of the counties (with two counties not providing results yet). At what point do we accept something less than election perfection for the expedience of actually declaring a winner?
What appears puzzling is that the Judge appears to be waiting (if not stalling) to deliver his rulings on the challenged ballots in question. He has now had those challenged ballots in his possession for at least two weeks, and there is little reason why he shouldn't already know what his rulings will be? Why wait for another recanvassing of the ballots (which took another week to change the vote total by one) before making his decisions?
My best guess is that he wants to make sure that there are no more "ballots" to be found "after" he has provided his ruling, thus robbing the counties of being able to "know" how many ballots are needed to alter the final count. By making sure that "all counts" are final, that means that his rulings will be the last word... one way or the other. No last minute "found" ballots that just happen to have enough ballots to flip things around.
