NY-22 Update - You can't make this shit up folks?

Chenango county found another 55 uncounted ballots?

Update:


One day after the "final numbers" are due, one county apparently found 55 in person "early vote" ballots that were "set aside" for some reason that cannot be explained and apparently not counted. They say that 44 of the 55 are "valid" ballots while 11 of them involve people not registered to vote. 

While mail in ballots went heavy to the Democrat and election day ballots went to the Republican, early votes were more evenly split, going roughly 55-45 percent to Brindisi (out of approximately 3500 early ballots across NY-22). However, Chenango county went approximately 55-43 for Tenney, so those two percentages might even themselves out. Either way, unless there is some sort of "statistical anomaly" with these particular ballots, 44 new ballots would not make up a 12-13 difference by themselves. That would require 44 votes expected to be split fairly evenly 22-22 to come back at 28-16 or 29-15 to wipe out that lead or even put Brindisi in the lead.

There seems to be more questions about the 11 that were not registered. Some are suggesting that they might be provisional ballots (which might lean more towards Democrats). But that is just speculation as the County themselves has suggested that they were invalid ballots. 

All 55 have been passed to the Judge and he will count them and make a final determination on those along with the rest.

Trump says there is abundant evidence all over the place of widespread fraud in the election.

Giuliani et al. say that the FBI has done no investigating.

Ch says that he inclines toward believing Trump (when really he doesn't) and that Barr didn't really say what Barr said.

Unlike you, my position is clear and simple:

There is no evidence of widespread fraud in this election and what little fraud can be found on either side does not alter the outcome.

I find no logical fallacy there, and no dancing around the issue.

LARRY O’CONNOR: If You Wanted to Rig An Election, You’d Do Exactly What Dems Did in 2020.

First, they’d make sure that the voter rolls were full of ineligible voters. Deceased people, non-citizens, and people who have moved out of state would not be purged from the rolls, and there would be no mechanism in place to purge those ineligible voters.

Further, they wouldn’t have any preemptive check to ensure that only eligible voters registered in the first place. For instance, you can’t get a job in this country without showing a passport, birth certificate, or green card for a standard I-9 form. This ensures that only people eligible to legally work here get a job. There is no such citizen check when you register to vote. It’s on the “honor system” that you are a legal citizen when you fill out your registration form. And, let’s face it, why would someone who breaks our immigration laws by entering, staying, and working in our country illegally ever break our election laws, too? That’s a solid policy there.

Next, they’d modify existing election laws so that voters could mail-in ballots on a whim and not for a specific “absentee voting” reason. This way, in-person voting (the most secure kind of voting) would diminish, and mail-in voting (the least secure) would increase.

Next, they’d send a ballot to every voter on the voter rolls regardless of whether they asked for an absentee ballot or not. This way, millions of live ballots are floating in the system and are outside the tight custodian controls of the election apparatus in your state.

Now that they’ve hypothetically flooded the zone with millions of ballots that have been sent out to everyone, regardless of their eligibility to vote, they would need the policy to count every vote that came in, even votes that shouldn’t be counted.

Well Reverend...

Do you admit that fraud exists and that when it involves numbers into the hundreds or even the thousands (134 illegally filled out mail in ballots or requests for 8000 illegal mail in ballots) - that this is a problem and that the people who commit them (Democrat or Republican) should be prosecuted to the full extent of the law... regardless of whether that fraud does or does not "change the outcome" of an election?

Do you agree that the when the number of arrests and convictions start to get into the dozens or even hundreds - and these are just a sampling of the obvious that can be found - that this is a problem and that we should be working to make sure that fraud is prosecuted when found and that we should work to have it eliminated in future elections.


If you agree with me on this point... then I see no other disagreement.


It's not "dancing around" an issue to state facts and to make relevant points to the jurisdiction of what the Attorney General does and what he does not do. Something Barr himself stated in the same interview.

It's not "dancing around" to state that statistical anomalies do exist, but that those are not something that an Attorney General of the United States can do anything with because by themselves they are only suspicious and don't actually "prove" anything.


Again... nothing I have said has been untrue. Statistical anomalies can exist and the fact that statistical anomalies are not considered probable cause to open a criminal investigation does not change the fact that statistical anomalies exist.



It would almost appear that you are stupid enough to believe that because William Barr is not addressing the large county discrepancies or the large vote drops that somehow that proves that these discrepancies or large vote drops are irrelevant or that they just go away?

Sorry... If you are already arguing that voter fraud is a myth and that it doesn't happen... while we are currently watching people be arrested and convicted for fraud that involves hundreds or even thousands of ballots.

Then you are even stupider than I thought.

Again... I figured it would take you at least six months to forget about social workers going into dementia units of nursing homes and coming out with 134 filled out ballots and people attempting to request over 8000 fraudulent mail in ballots... before you would start saying that fraud is a myth and that it never happens.


By the way, how many races at congressional or even local levels would have switched hands had 134 or 8000 fraudulent ballots been allowed to be cast in that particular county or precinct. 134 would have flipped at least two Congressional seats, and 8000 would have flipped numerous.

Ch, neither William Barr nor the FBI find any discrepancies in the handling of this election significant enough to change its outcome. Do you actually think this means that any allegations that counter this cannot be brought into court for prosecution?

No, let them be brought into court and argued there.

But so far even Trump-appointed judges have ruled that the evidence for these alleged discrepancies does not exist sufficiently and convincingly enough to warrant court action.

But do continue to take your allegations of "discrepancies or large vote drops" to the courts. Trump and you have that right.

Yet no matter how many courts how many times say the evidence is not there, you seem to think the allegations should still be made and be taken seriously.

This would be an amazing thing to explain to a prosecutor (that they cannot prosecute someone for fraud unless the fraud is in the tens of thousands of votes).

As many as 280,000 pre-marked ballots were transported from Bethpage, New York, to Lancaster, Pennsylvania, in late October and then “disappeared,” the director of a public interest law firm said Tuesday quoting a postal service subcontractor.

Phill Kline, the director of the legal group Thomas More Society’s Amistad Project, said at a press conference in Arlington, Virginia, that a witness has testified to the fact the ballots that went missing, which was verified by other witness statements.

“This evidence demonstrates, and it’s through eyewitness testimony that’s been corroborated by others through their eyewitness statements, that 130,000 to 280,000 completed ballots for the 2020 general election were shipped from Bethpage, New York, to Lancaster, Pennsylvania, where the ballots and the trailer in which they were shipped disappeared,” said Kline, a former attorney general for the state of Kansas.

Kline claimed in a news release that postal service workers engaged in “widespread illegal efforts” to influence the election, according The Epoch Times.

Three individuals spoke at Tuesday’s event to provide first-hand accounts of what Kline outlined, including truck driver subcontractor Jesse Morgan, who said he drove the truck filled with potentially upward of 288,000 ballots on Oct. 21. The ballots were addressed to Harrisburg but Morgan was instructed to deliver them to a Lancaster location.

The truck — and ballots — vanished after he parked at a USPS depot in Lancaster, he said.

Kline said the numbers come from estimates his group discerned.

The news conference also heard from a witness who claims to have seen a Dominion Voting Systems vendor inserting thumb drives into voting aggregation machines in Delaware County, Pennsylvania, and a third man – another USPS subcontractor — who said he was told the postal service was planning to backdate tens of thousands of ballots in the days after the Nov. 3 election in order to circumvent the ballot submission deadline, Justthenews.com reported.

“This evidence joins with unlawful conduct by state and local election officials, including accepting millions of dollars of private funds, to undermine the integrity of this election,” Kline said. 

In a press release, the Amistad Project says it has sworn expert affidavits claiming “over 300,000 ballots are at issue in Arizona, 548,000 in Michigan, 204,000 in Georgia, and over 121,000 in Pennsylvania.”

Kline said the information will be shared with the FBI, federal and local prosecutors “who are aware of our evidence.”

The Epoch Times said neither the FBI nor postal service has responded to a request for comment.

The claims come on the same day that U.S. Attorney General William Barr told The Associated Press that his office has no evidence of fraud that would change the election results.

What is the point of repeating that same story over and over?

Is there even a point to it?


Because for every story alleging voter fraud in 2020, I can find probably 100 stories demanding that Trump colluded with Russia to steal the 2016 election. More to the point, I can find these fake stories with zero evidence behind them in every major news outlet from ABC, NBC, CNN, MSNBC, FOX and everywhere else.

The fact that the media likes to push theories of stolen elections isn't really in question here... other than we had five investigations lasting over three years into the 2016 election...

While the same people who demanded that are telling everyone to quiet down in 2020 about any allegations of fraud in the name of national unity and to preserve our democracy?


So maybe you just relax a little. You seem uptight. A good romp in the bedroom of your million dollar ocean front home with your glamorous wife, followed by a long drive in your Audi A8 will probably cool your jets a little bit.

Last night, fresh off his pardon for past crimes, retired General Mike Flynn endorsed a call for President Trump to suspend the constitution and declare martial law. It came in a tweet in which Flynn tweeted and endorsed a manifesto calling on President “to immediately declare a limited form of Martial Law and temporarily suspend the Constitution and civilian control of these federal elections for the sole purpose of having the military oversee a national re-vote.”


There’s a lot more awful stuff in the declaration. But that quote, I think, includes all we ever need to hear: declare martial law, throw out the results of an election you lost. In a democracy, this is essentially sedition, a call to overthrow the state.

Former national security adviser Michael Flynn—controversially pardoned by President Donald Trump last week—on Tuesday retweeted a call for the White House to declare martial law and re-run last month’s presidential election.

The appeal—made by the Ohio non-profit We The People Convention in a Washington Times advert Tuesday—urged the president to declare “limited martial law” in order to hold a new election.

The advert cited President Abraham Lincoln’s suspension of Habeas Corpus during the Civil War as precedent, adding: “Then, as now, a President with courage and determination was needed to preserve the Union.”

WTPC claimed the “threat to our United States by the international and domestic socialist/communist left is much more serious than anything Lincoln or our nation has faced in its history—including the civil war.”

The organization’s President Tom Zawistowski released a statement claiming “massive, planned, illegal election fraud conducted by corrupt Democrat/Socialist Party operatives across our nation to steal our vote.”

But WTPC provided no evidence to support its claims, which have been debunked by bipartisan election officials and Trump’s own Justice Department.

The retired general Flynn tweeted a link to the appeal, writing alongside it: “Freedom never kneels except for God.”

When I asked if you agreed with me that fraud was real and it should be prosecuted, rather than answer with a "yes" you went on a tirade about Bill Barr and how statistical irregularities only exist if they can be proven in court to be examples of fraud.

Meanwhile I have been on record over and over and over as saying that I never thought the election would be overturned, that I thought Trump should not have allowed Giuliani to be part of this, that Powell was more a glorified conspiracy theorist than a lawyer (even expressed a little bit of surprise that a Judge ruled in her favor on preserving Georgia voting machines).

I have never demanded that "evidence" of massive fraud actually existed, much less that Bill Barr would find this, or was even looking for it. I only demanded that we should NOT just turn a blind eye to the fraud that does happen (under the guise that it only matters if it changes the results).

I have not repeated the reports of missing USPS trucks as if they are real, or that voting machines systematically switched votes from Trump to Biden. I do not follow Newmax or repeat every conspiracy being reported on Twitter or certain blogs.


What I have discussed are things that are not factually in question. The math is the math is the math is the math. It doesn't change regardless of what other nonsense goes on around it. There ARE large statistical irregularities that are not common to elections that appear to have taken place in a handful of counties in various battleground states. There WERE large vote drops that make almost no statistical sense. That doesn't mean that there might not be a reasonable explanation for all of this. But at this point there doesn't seem to be either "reasonable" explanations or explanations that can be verified by alleged fraud. There just seems to be no explanation. I continue to question why so many people are so vigilantly uncurious about it.

There ARE large statistical irregularities that are not common to elections that appear to have taken place in a handful of counties in various battleground states. There WERE large vote drops that make almost no statistical sense. 

There are two ways to interpret this.

1; This is an unusual situation because a lot of people who are Republicans who just didn't want another four year of the Twitter tirade President. They voted for him in 2016,but not this horror story President.

2: So they split voted .

3: The college educated women voted for Biden in a much higher percentage than in 2016.

I have to give you a little credit for not following Newmax or repeat every conspiracy being reported on Twitter or certain blogs.

Statistical analysis can be slated by bias. Selecting data that suggests your agenda can is included Data that doesn't fit your opinion.

I know how Excel spreadsheets work.

That's not admissible evidence in most cases.

1; This is an unusual situation because a lot of people who are Republicans who just didn't want another four year of the Twitter tirade President. They voted for him in 2016,but not this horror story President.

2: So they split voted .

3: The college educated women voted for Biden in a much higher percentage than in 2016.

The sort of statistical anomaly I refer to Roger is not about expectations or standards... it's about graphing out or plotting a whole bunch of data and finding that 99.99% of it groups into a consistent and standard pattern.

Of course, you will always have certain deviations and those data points will plot outside of the norm... but generally those are just outside the main pattern and would not cause any alarm.


It's like when the teacher used to plot scores of a test on the board. If out of a possible 1000 points, 98 out of 100 students ended up with a score between 800-850... but two students ended up with scores of 995 and 998. That would represent a statistical anomaly.

Now it could be that those two particular students are genius level straight A students who are already accepted to MIT and always bust up the curve.

But if those two students happened to be average students who didn't appear to study or otherwise have any reasonable explanation for why they scored so high.

Then a teacher might have questions.


He certainly wouldn't attribute those scores great teaching of some other explanation that doesn't lend itself to isolation for those two students.


This is not hard, Roger... I just think you don't want to understand it.

ALBANY, N.Y. (AP) — Nearly a month after Election Day, a county in New York on Tuesday said it had discovered a small batch of uncounted ballots with the potential to sway the outcome of one of the nation’s closest battles for a seat in Congress.

Chenango County informed a state judge it had discovered 55 ballots cast during the state’s early voting period in the ultra-tight race between U.S. Rep. Anthony Brindisi, a Democrat, and his Republican challenger, former U.S. Rep. Claudia Tenney.

“Those ballots were apparently mislaid and never counted,” Chenango County Attorney Alan Gordon wrote to Supreme Court Justice Scott DelConte.

The discovery of the uncounted ballots in the rural county of around 47,000 people came a day after local elections officials in the 22nd Congressional District reported what were supposed to have been their final vote totals to the judge. Those totals — which didn’t include the newly discovered ballots — had showed Tenney with a 12-vote lead.

“I have advised our Board of Elections to not open any of those ballots and to secure them in their offices,” Gordon said, adding that he was awaiting the court’s instructions on what to do next.

He said that of the 55 ballots, 11 appeared to have been cast by unregistered voters.

The final result in the race won’t be known until DelConte rules on challenges to more than 2,000 disputed absentee and affidavit ballots cast in the contest.

The discovery of the uncounted ballots is the latest twist in a roller coaster of a race. Tenney led by several thousand votes on Election Day, but her lead evaporated as absentee ballots were counted.

Brindisi appeared to take a lead of a few votes last week, only to see his advantage disappear last weekend after two counties said they had made tabulation errors.

County boards of election had faced a Nov. 28 deadline to send official results to the state, but DelConte has blocked certification while the vote counting disputes are resolved.

Boards of election in other parts of New York have also been slow to finalize their vote counts.

New York City didn’t release information on its absentee ballot count until Tuesday.

The city’s official tabulation confirmed that Republican Nicole Malliotakis had toppled first-term U.S. Rep. Max Rose, a Democrat representing a congressional district that includes Staten Island and part of Brooklyn.

Rose conceded the race Nov. 12, but The Associated Press did not declare Malliotakis the winner until Tuesday because of the previous lack of information about a large number of absentee ballots.

If Tenney ultimately prevails, she and Malliotakis would be two Republican women ousting incumbent first-term Democrats, both men, in parts of the state where President Donald Trump remains popular with a majority of voters.

If the Republicans candidates win it will not be an anomaly.
