Recount recap NY-22 - back to the drawing board?

The Judge from New York basically punted everything back to the BOE and canvassing boards to redo everything they brought to him to rule on. I think both sides are spinning this as a little bit of a win. 

Brindisi and his team are going to argue that "recanvassing" all of these votes might add some new votes to the count. They are hoping that on top of the newly "found ballots" in certain counties, that some of the previously tossed votes will be seen as valid. 

Whereas the Tenney team can argue that the "recanvassing" will basically fall back to where they were before the dispute started. In other words, the election boards will rule the same way they ruled the first place, and the same ballots would have to be challenged again. 

Only it is unclear whether these challenges will then be ruled on by Judge Scott DelConte or not. You could take his ruling to suggest that he isn't going to decide the race (that this is up to the voters and "valid" votes). You could also take this ruling to suggest that he will rule on the challenged ballots, just that the election boards must follow the law and write the reasons for the challenge with ink on the back of the ballot (rather than with sticky notes). However, it's sort of unclear if the recanvassing he is calling for will allow watchers to challenge (or if there are even still watchers available to challenge). Without the same votes being challenged, the original challenges would never actually get ruled on?

Two of the counties have already come back with their recanvassing results, saying nothing has changed from their original count. The county (Chenango) that found the extra 66 ballots, have also reported that there was nothing new (other than those 66 ballots). They will presumably add however many of those extra ballots that are "valid" to their count. I think the key will be how the counties who have all of the challenged ballots view the ruling and how they choose to proceed. 

The Judge was clear that he wants the race decided by "valid" ballots and by "valid" voters, not the courts. What that suggests is anyone's guess. But the one thing that is not a guess, is that Judge DelConte is at the end of his rope with this thing. Who can blame him.

Oh... of course.... it's probably all for naught as Queen Nancy and her minions in the House will likely just vote to seat Brindisi regardless of the outcome of the election challenge, and the certified winner. I think we need some sort of law or constitutional amendment that takes that whole thing off the table. The states and the voters in those states should determine who represents them, not partisans in congress.

We have three branches of government for a reason.

The courts interpret the constitution as originally intended.

They have not politicians who worry about getting reelected, or pleasing the President.

The courts are keeping the lame duck President from stealing the election.

It applies here too Scott.

The judge makes his or her decision upon the Constitution.

Even the three conservative justices have been denying the lame duck President and on January 20th the Orange Monster can go to Florida and Twitter tirade.

The biggest threat is the huge numbers of people believe the election was stolen by the Democrats and the Republicans who have followed the law are at risk.

But there are very few of them, and in 40 days approximately the President elect Joe Biden is sworn in, I hope that some Republicans will break away from Trump because he's no longer the President, and we will return to normality.

Republican officials need to lead their voters out of this morass. Our democracy is resilient, but increasingly, feverish partisans cannot accept lost elections. When some Democrats embraced accusations that Facebook or Russia stole the election for Trump in 2016, Republicans were rightly outraged. Now, many are swallowing trumped up charges of a vast conspiracy.

Paxton’s lawsuit is a sad attempt by an embattled official facing corruption accusations to change the subject and generate political favor. The attorney general is reportedly under federal investigation after several of his top deputies raised questions about whether he took inappropriate action to help a campaign donor. He’s also awaiting trial on years-old state charges of securities fraud. The attorney general denies doing anything wrong.

It’s time for other Texas Republicans to call him out. Abbott, in particular, has the credibility to do so. After all, he held Paxton’s office before becoming governor, winning national attention for his legal challenges to the Obama administration.

He and others should push Paxton to resign. His attempts to hold on to his office were already harmful enough. Now, the attorney general is discrediting the state, misleading voters and feeding dangerous conspiracies. Enough is enough.
