The Maricopa County Board of Supervisors voted 4-1 to authorize the lawsuit in Superior Court in Phoenix, arguing the Legislature's demands are overly broad, could pierce voter privacy and constitute "a draconian abuse of power."
The lawsuit contests a subpoena from the state Senate Judiciary Committee, arguing the request for evidence was unlawful, could violate ballot secrecy and did not give the county enough time to comply.
In a state that was won by Joe Biden by approximately 10,000 vote, Maricopa county was the county that made pretty much the entire difference and then some.
This was one of those counties that had giant swings from 2016 (when Trump carried the county) to 2020 (when Biden carried the county). In Maricopa county, Joe Biden literally pick up 334K more votes than Hillary Clinton did in 2016. Not 334K more for the state, or 334K within the county. But he managed to garner same vote Clinton did in this one county PLUS an additional third of a million new votes. IN ONE COUNTY!
Granted, this is a large county that grew about a quarter million in population since 2016, but pushing a quarter million potential new voters into a third of a million new Democratic voters seems to be a pretty remarkable feat.
Now this doesn't necessarily mean there was fraud, tampering, or anything illegal. It just makes it pretty clear that there was a serious Joe Biden surge in this one particular county that was not just unusual, but game changing unusual.
But how does it help the cause if the Board of Supervisors refuse to cooperate with investigations? If there was truly "nothing to hide" then why not provide the information in question? Nobody is being accused of any crimes and there is no fifth amendment rights to decline such a request. This is simply an informational investigation in an election where nearly 40% of the country believes that there was fraud, tampering, or that the election was outright stolen.
Hiding your information from investigators is not going to help convince that 40% that everything was on the up and up. There is no "good" reason to not cooperate.

Are you familiar with what a "subpoena" is and how it is used during an investigation? Are you familiar with the idea that when you are issued a subpoena that you are generally considered legally obligated to comply??
Or do you believe that in our world that anyone who suggests that there is no reason for them to be investigated can just offer up that "opinion" and that subpoenas just go away?
Boy wasn't that a bone of contention during the Mueller investigation? Every time the President attempted to use privilege or other legal means to fight a request for information, you suggested (every time) that it was evidence of guilt and that only a guilty person would fight subpoenas and try to keep information under wrap.
In this case, there is no privilege, fifth amendment rights, or anything else. The people with the subpoenas have as much right to the information as the election officials did. If the election officials can open up and look at a mail in ballot without it being an infringement on the "secret ballot" concept, then there is no reason why an investigator cannot as well. If the person in question wanted a "secret ballot" then they can go into polling station, fill out an anonymous ballot, and drop it in a box. But they knew that when that ballot was filled out and sent in that people would open it up and compare addresses, signatures, etc... that information is not private and in fact is required public information to be able to use the mail in concept.

In a statement issued by the campaign, Trump lawyer Rudy Giuliani said the campaign had filed a petition asking the high court to reverse three rulings by a Pennsylvania state court interpreting the state's rules for mail-in ballots.
“The Campaign’s petition seeks to reverse three decisions which eviscerated the Pennsylvania Legislature’s protections against mail ballot fraud," Giuliani said in a statement.

When the words "martial" and "law" are put together they conjure up pictures of suspended liberties, curfews and people being taken off the streets for questioning. So, if you read yesterday's report about the explosive White House meeting where Michael Flynn proposed that Trump use martial law to force a new election, you may have been filled with anxiety. Let's set the record straight, Trump cannot declare martial law and hold a new election, as Flynn has suggested. Here's why:
First you have to understand what martial law is. Under martial law the military takes over for all civilian authority, even the courts. Such an event has not taken place since 1941 in Hawaii after the Japanese attack on Pearl Harbor. No such attack has taken place today and while we see a few protestors get out of hand, there isn't wide-spread lawlessness occurring across the nation. There is simply no justification for declaring marital law.
Another issue that makes declaring martial law a tall order is that the president himself does not have the authority to do so without the consent of Congress. Of course there are a handful of crazy Congressman who might go along, but not nearly enough. Yet another important issue that must be on the minds of White House staffers yesterday, is if Trump tries to declare martial law on his own without the consent of Congress it would be a crime, a coup d’etat. The idea of committing a crime of this magnitude would be deal breaker for almost anyone. Many times people who tried and failed to take over a government ended up dead.
It seems Trump, who is being led by the evilest of men like Michael Flynn, believes an executive order he signed two years ago gives him the authority to do as he pleases as it pertains to elections, but it does not and it appears he doesn't even understand the order he himself signed. That order only gives the president authority to impose sanctions upon foreign countries or individuals who attempt to disrupt an election. The only person or persons attempting to disrupt an election are Trump, Flynn, Giuliani and his gang of bumbling thieves.
Chris Edelson, an assistant professor of government at American University says the theory they are working involves from an inaccurate reading of the executive order Trump signed.
"Basically, what (the executive order) does is allow people in the executive branch to impose economic sanctions on foreign actors interfering in the election," said Edelson. "How you get from there to imposing martial law, I don’t know. It doesn’t make any sense."
Other constitutional lawyers have also chipped in.
"The president has no ability to unilaterally authorize himself to impose martial law, just as he could not issue an executive order allowing himself to decide judicial cases or controversies," said Daniel Kobil, a law professor at Capital University Law School.
Noah Feldman, a professor at Harvard Law School said the president has no inherent authority to impose martial law. According to Article II of the Constitution, the president can only declare martial law under the extreme circumstances of a rebellion or foreign invasion. (Even then, only with the approval of Congress).
"Losing an election doesn’t count as a basis for invoking this power," Feldman said.

Several media outlets, including The Daily Beast, reported over the weekend that Trump held an Oval Office meeting with his former campaign lawyer Sidney Powell and her client Michael Flynn, Trump’s ex-national security adviser who the president recently pardoned. Both Powell and Flynn have been front-and-center in peddling unhinged, baseless conspiracies that Trump lost the election due to a nefarious international plot featuring dead dictator Hugo Chavez and corrupt voting software.
During the bonkers meeting, which apparently left several advisers “spooked,” the president reportedly considered Flynn’s recent proposal that Trump should invoke martial law in order to allow the military to redo the election in several states. Trump also suggested making Powell, whose “Kraken” election lawsuits have been laughed out of court, a special counsel investigating voter fraud.
Interviewing Romney on Sunday’s State of the Union, CNN anchor Jake Tapper brought up the latest reports—which also included Trump pushing to issue an executive order to seize voting machines—before asking Romney to weigh in.
“This is, needless to say, quite alarming and scary to a lot of people. What will the Senate do to make sure this doesn’t happen?” Tapper wondered aloud.

“He could be championing this story but instead he’s leaving Washington with conspiracy theories and things so nutty and loopy that people are shaking their heads, wondering what in the world has gotten into this man,” the Utah senator stated. “I think that is unfortunate because he has more accomplishments than this last chapter suggests he is going to be known for.”
The president, meanwhile, has leaned back on his favorite retort over the multiple reports on the meeting and his discussions about a coup, calling it “Fake news” and “more knowingly bad reporting” in a late Saturday night tweet.

Ex-Justice Department Lawyer Apologizes

Erica Newland writes in the New York Times that she’s “haunted by what I did” as a lawyer in President Trump’s Justice Department.
“No matter our intentions, we were complicit. We collectively perpetuated an anti-democratic leader by conforming to his assault on reality. We may have been victims of the system, but we were also its instruments. No matter how much any one of us pushed back from within, we did so as members of a professional class of government lawyers who enabled an assault on our democracy — an assault that nearly ended it.
“We owe the country our honesty about that and about what we saw. We owe apologies. I offer mine here.”
Trump Files Another Supreme Court Appeal

President Trump’s campaign team on Sunday filed an appeal to the U.S. Supreme Court asking it to reverse several cases by the Pennsylvania Supreme Court to change the state’s mail ballot law before and after the 2020 presidential election,” Fox News reports.

Agreement on COVID-19 Relief
I applaud the bipartisan Congressional economic relief package that will deliver critical resources to fight COVID-19, including funding for vaccine distribution, and much needed temporary relief for workers, families, and small businesses. In November, the American people spoke clearly that now is a time for action and compromise. I am heartened to see members of Congress heed that message, reach across the aisle, and work together. This is a model for the challenging work ahead for our nation.
This bill provides critical temporary support for millions of Americans who have lost their jobs through no fault of their own, support to help keep families in their homes, and food on their table; and direct payments to help Americans make it through a dark winter. It gives a lifeline to small businesses struggling to stay afloat, having previously found themselves at the back of the line for relief. And, it provides an important downpayment on the investment we need in vaccine procurement and distribution, helping deliver these incredible vaccines around the country and offer the American people protection and peace of mind that there will be light at the end of the tunnel.
But this action in the lame duck session is just the beginning. Our work is far from over.
On day one, my administration will be ready to undertake additional steps to get the virus under control and build our economy back better than it was before this crisis. In our first 100 days, we’ll be asking all Americans to mask up for 100 days; we’ll have a plan to administer 100 million vaccine shots in 100 days and to get most schools open in the first 100 days. These are bold, but doable steps to contain the virus and get back to our lives. But we will need to act quickly. We need to scale up vaccine production and distribution and acquire tens of millions more doses. We need to undertake an ambitious plan to educate the American people in the efficacy and safety of these vaccines so that we can all reap the benefits of their protection. We need to do more to protect the most vulnerable among us who even now, in the midst of this holiday season, are desperate for real cause for hope.
This sums up what happens when otherwise rational people fall for.
