Trump fills 54th appeals court opening...

While You Were Focused On The Electoral College Vote, The Senate Filled The 7th Circuit Coney Barrett Seat


Regardless of anything else, President Trump has made his mark on the courts with three USSC Justices (so far go good) and 54 Appeals Court Judges. He added much needed balance to the once fabled and mocked 9th Circuit Court and provided a more conservative slant to many other Circuit Courts. 

Depending on the Georgia runoffs, a President Biden will have a tough time getting the same sort of liberal Judges that Obama was able to get confirmed. There is little chance of a significant Supreme Court opening during a Biden administration, with the most likely retirement come from Justice Breyer, who is the oldest member (82 years young) by a decade (Justice Thomas is 72).

The three Supreme Court Justices nominated and confirmed under Trump are all younger than I am - Gorsuch (53), Kavanaugh (55) and Coney Barrett (48). Alito is 70 and Roberts is 65. Both Kagan and Sotomayer are in their sixties. A Breyer retirement would only keep the court at the same ideological make up with the tradeoff of a replacement being probably someone "less" liberal but "much" younger.

I understand that we are a federal democracy. We give states of lower population get 2 Senator seats. In the popular vote for President, each vote in Wyoming is equal to 9 votes in California.

courts are not there to "rule" but to "judge" consistent with the US Constitution.

you're become so accustomed, err, addicted to liberal judges legislating from the bench delivering new "rights" with no constitutional basis, losing that advantage terrifies you.

abortion is not a "right", gay marriage is not a "right", and healthcare for all is not a "right", yet liberal justices have contorted their role, and our constitution to create those "rights" out of thin air.

hopefully those days are over for at least a generation, and your wants, wishes and desires must pass legislative muster with the voters at the ballot box as it should be.

I understand that we are a federal democracy.

Actually we are a Federal Republic or more accurately a constitutional republic, although some might refer to us as a Representative Democratic Republic or even a Representative Democracy.

We are not a Democracy in the purest sense of the word as that would require pretty much all decisions to be voted on. We become a Republic because we elect leaders to represent us. We are a version of Federalism because of our mix of Federal, State, and Local Governments.

But at the end of the day, we are driven by a Constitution that provided limited power to the Federal Government and more power to the State and Local Governments.

Our founding fathers understood that a strong Federal Government has the best (or worse) chance of becoming a corrupt totalitarian type Government that attempts to overrun individual freedoms with the least amount of accountability.

The fact that Idaho has the same amount of Senators as California is simply a check on the power and potential tyranny of a corrupt National Federal Government.


The reality is that you live in California. California is responsible for California and only responsible for California. The fact that more people live in California than Idaho, does not give Californians the right to tell Idaho what to do or how to run their Government... or to use the Federal Government to push your misguided California policies on the rest of the States through the Federal Goverment.

The number of electors in each state is equal to the sum of the state’s membership in the Senate and the House. This gives an advantage to smaller population states. Again North Dakota has about one electoral vote per 224,000 people, while California gets about one vote per 677,000 people.

So, the “winner-takes-all” (except Maine and Nebraska) Electoral College model dramatically enables minority rule. No other established democracy has an Electoral College.

Remedy? Elimination of the Electoral College. The House voted in favor of such a constitutional amendment in 1969, but the proposal died in the Senate, by old segregationist interests.

As Senator James Allen of Alabama put it: “The Electoral College is one of the South’s few remaining political safeguards. Let’s keep it.”

The GOP has benefited greatly by this minority rule, but it goes against Republican’s core principles of supporting free markets.

Dr. Ziblatt, explains: “The Republican party is [like] a protected firm in a marketplace, artificially benefiting from the political system in a way that allows it to win even when it doesn’t win a majority. If we had free democratic competition, it would have to change its strategy. When Republicans cannot win a majority of votes nationally and still retain power, the free market of ideas is diminished.”

If we continue down this path, this leads us from minority rule to one party rule. (See Kentucky). That is not what the founders intended.

When there is no competition of ideas in local, state, and federal elections, intelligent progress becomes impossible. Research and compromise disappear, and decisions are made on ideology only.

Autocratic principles creep into the system from the likes of Donald Trump, Mitch McConnell, and the  Republican party.

Texas correctly pointed out that other states need to make changes to their election laws "constitutionally." not by judicial fiat as PA did with no time limit, no postmark and no signature.

it's a domino effect, genius. if 4 or more states can simply make their electoral laws whatever the fuck they want on a whim, their corruption creates that domino effect, disenfranchising other states and their voters.

We have passed the peak of the current wave of the epidemic in Minnesota, North Dakota, South Dakota, Wisconsin, and Iowa. All the numbers have moved in the right direction. There is no evidence of a Thanksgiving surge. Yet Governor Walz continues to insist on micromanaging our lives. While the current shutdown regime expires Friday, the subjects of Governor Walz have looked longingly to him for a restoration of responsibility for the management of our own lives.

It is not to be. Per Blois Olson’s Morning Take email update, Walz will announce at a 1:15 p.m. press conference this afternoon:

• Indoor drinking and dining will remain closed at least through January 11. Restaurants may resume outdoor dining limited to 50 percent of capacity, or 100 customers.

• Fitness studios and gyms will be allowed to reopen at a quarter of their capacity subject to a 100 person limit. Patrons must wear masks and maintain 12 feet of social distancing. Fitness classes can resume January 4.

• Family gatherings will be allowed with one other household, up to 10 people, and up to two other households outside.

• Outdoor entertainment venues can open subject to a 25 percent capacity limit with a 100 person maximum.

• Youth sports teams can resume practices on January 4.

Walz’s spokesman lets on that Walz will “prioritize[] in-person learning for elementary students[.]” It has taken a back seat so far, to the detriment of al the minority communities to which he professes devotion in the current politically correct terms.

Biden himself didn’t seem too familiar with the guy or with the department. Biden slurred his speech and struggled to approximate Becerra’s name in the big announcement for what should have been a nomination to the Department of That’s Easy for You to Say.
