A Long Beach woman who was charged with attempted murder for driving through a crowd during a Yorba Linda Black Lives Matter protest in September is facing more charges in connection with another attack at an earlier protest in Seal Beach, prosecutors said Wednesday, Jan. 20.
And after reviewing videos from the events of that day in Yorba Linda, five more demonstrators have been charged, the Orange County District Attorney’s Office also announced.
Tatiana Rita Turner, 40, was charged in September after the protest with one felony count of attempted murder with premeditation and deliberation, six felony counts of assault with a deadly weapon, including one causing great bodily injury, one felony count of mayhem, and two felony counts of the use of pepper spray by a felon in connection with the Yorba Linda protest.
On Sept. 26, Turner and the Urban Organizers Coalition organized a rally, called “March 4 Equality,” against police brutality and systemic racism near the Yorba Linda Library. Some counterprotesters confronted Turner’s smaller group, and fights broke out, the Associated Press reported.
Turner is accused of running over counter-protesters with her car at the Yorba Linda rally. Prosecutors said she deliberately drove into a crowd of Donald Trump’s supporters with the intent of killing a woman and also seriously injuring a man who broke his leg.
But Turner pleaded not guilty in that case. She saw people with guns and feared for her life when Trump supporters blocked her car, according to her lawyer. She was trying to get away and didn’t intend to hit anyone, her lawyer said.

The law firm that handled the tax affairs of Donald Trump and his company during his presidency said it would stop representing him and his business.

TPM House Democrat is asking that the FBI open an investigation into the role of Parler in stoking the Capitol insurrection.
Rep. Carolyn Maloney (D-NY), chair of the House Oversight Committee, made the request in a Thursday letter to FBI Director Chris Wray.
In the letter, Maloney described Parler as “a potential facilitator of planning and incitement related to the violence, as a repository of key evidence posted by users on its site, and as a potential conduit for foreign governments who may be financing civil unrest in the United States.”
The network, which was boosted by GOP politicians as a safe haven for the right, was knocked offline after the Jan. 6 insurrection attempt when Amazon Web Services stopped hosting the website.
Maloney said in the letter that she would conduct her own investigation, through the House Oversight Committee, into Parler’s role in the attack. She also requested that the FBI open its own probe into the matter and brief her on the status of the investigation.

Yahoo News Republican congresswoman Marjorie Taylor Greene has filed articles of impeachment against Joe Biden the day after he was inaugurated as president.
The lawmaker, who has ties to the baseless QAnon conspiracy theory, took to Twitter to announce the filing against the new president.

Put another way, an executive order can be used to execute a power the commander in chief already has. It can’t be used to give the presidency new powers.

Former President Donald Trump can be convicted in an impeachment trial for his role in inciting the Capitol insurrection on Jan. 6 even though he is no longer in office, a bipartisan group of constitutional law scholars wrote in a letter Thursday.
“We differ from one another in our politics, and we also differ from one another on issues of constitutional interpretation,” wrote the signatories, which include the co-founder and other members of the conservative Federalist Society legal group. “But despite our differences, our carefully considered views of the law lead all of us to agree that the Constitution permits the impeachment, conviction, and disqualification of former officers, including presidents.”
More than 150 legal scholars signed on to the letter, which was obtained by POLITICO. They include Steven Calabresi, the co-founder of the Federalist Society; Charles Fried, who served as solicitor general under Ronald Reagan and is now an adviser to the Harvard chapter of the Federalist Society; Ilya Somin, a law professor at George Mason University and adjunct scholar at the libertarian Cato Institute; and Brian Kalt, a law professor at Michigan State University and leading scholar on the specific question of whether former officials can be impeached.
The House impeached Trump last week, for the second time, in a 232-197 vote for "incitement of insurrection” following the attack on the Capitol by a pro-Trump mob that left five people dead. As the impeachment process moves into its next phase in the Senate, the signatories of the letter are seeking to counter an argument that has been gaining steam among some Republican senators: that it would be unconstitutional for the Senate to hold an impeachment trial for Trump now that he is a private citizen.
“The Senate lacks constitutional authority to conduct impeachment proceedings against a former president,” Sen. Tom Cotton (R-Ark.) said in a statement last week. “The Founders designed the impeachment process as a way to remove officeholders from public office—not an inquest against private citizens.”

The constitutional scholars who signed on to the letter disagree with that assessment, arguing that because the Constitution’s impeachment power has two aspects — removal from office and disqualification from holding office again in the future — it must also be extended to former officials who could try to run for reelection.
“Impeachment is the exclusive constitutional means for removing a president (or other officer) before his or her term expires,” they wrote. “But nothing in the provision authorizing impeachment-for-removal limits impeachment to situations where it accomplishes removal from office. Indeed, such a reading would thwart and potentially nullify a vital aspect of the impeachment power: the power of the Senate to impose disqualification from future office as a penalty for conviction.”
Trump had signaled before leaving office that he might try to run for president again in 2024, and has reportedly mulled forming his own political party. But if the Senate were to hold an impeachment trial and convict him, he would be barred from holding public office ever again. That provision of the impeachment power, the legal scholars wrote, “is an important deterrent against future misconduct.”
"If an official could only be disqualified while he or she still held office, then an official who betrayed the public trust and was impeached could avoid accountability simply by resigning one minute before the Senate’s final conviction vote,” they noted. “The Framers did not design the Constitution’s checks and balances to be so easily undermined.”

The coroner's report stated that George Floyd had approximately three times the lethal amount of Fentanyl in his system. He also reported that the liquid found in his lungs was also consistent with a Fentanyl overdose.
Lastly, the coroner suggested that under normal circumstances, had he just been presented a body without any pretense that he would have listed it as a Fentanyl overdose.
Now a jury will have to determine whether there is enough evidence to convict a Police officer (who is assumed innocent) of murder. They will have to do so beyond reasonable doubt.

House Democrat is asking that the FBI open an investigation into the role of Parler in stoking the Capitol insurrection.
Rep. Carolyn Maloney (D-NY), chair of the House Oversight Committee, made the request in a Thursday letter to FBI Director Chris Wray.
In the letter, Maloney described Parler as “a potential facilitator
of planning and incitement related to the violence, as a repository of key evidence posted by users on its site, and as a potential conduit for foreign governments who may be financing civil unrest in the United States.”
The network, which was boosted by GOP politicians as a safe haven for the right, was knocked offline after the Jan. 6 insurrection attempt when Amazon Web Services stopped hosting the website.

House Speaker Nancy Pelosi (D-Calif.) on Thursday resoundingly rejected the idea that moving forward with a Senate impeachment trial for former President Donald Trump could undercut President Joe Biden’s message of unity in America.
“I don’t see that at all,” Pelosi said in her weekly press briefing when asked the question. “I think that would be harmful to unity.”
The fact is, she said, that Trump incited an insurrection on Jan. 6, when a violent mob of his supporters stormed the U.S. Capitol and roamed the halls looking for lawmakers to stop them from certifying Biden’s electoral win. Five people died.
“Just because he’s gone now ― thank God ― you don’t say to a president, ‘Do whatever you want in the last months of your administration’ … because people think we should make nice-nice and forget that people died here, that [Trump attempted] to undermine our election, to undermine our democracy, to dishonor our Constitution,” said Pelosi.
“Joe Biden said it beautifully:
‘If you’re going to unite, you must remember,’” she added, referencing part of Biden’s inauguration speech.
“That’s our responsibility, to uphold the integrity of the Congress of the United States. That’s our responsibility, to protect and defend the Constitution of the United States. And that is what we will do.”
The House voted to impeach Trump a week after the Capitol riot, making him the first president to be impeached twice. A record 10 Republicans voted yes on the single article of impeachment: incitement of insurrection.
It’s up to Pelosi to decide when to send the article of impeachment to the Senate, which would then trigger a trial in that chamber. She said only that it would be happening soon.

The lawmaker, who has ties to the baseless QAnon conspiracy theory, took to Twitter to announce the filing against the new president.

Ms Greene also alleged that there was voter fraud in her home state that resulted in Mr Biden’s close win in Georgia, but that her win was totally legitimate and that her vote count was accurate.
Republican officials who oversaw the election in Georgia have repeatedly debunked her false claims of voter fraud and Mr Biden’s win was confirmed after a string of checks and hand recounts.
Greene won her house seat in November and represents Georgia's 14th Congressional District, which includes almost all of the northwestern part of the state.

“Senate Minority Leader Mitch McConnell is proposing to Majority Leader Chuck Schumer to delay the start of the impeachment trial of former President Trump until February,” CBS News reports.
“This would give impeachment managers and Mr. Trump’s defense at least a week to prepare. McConnell floated the proposal to GOP senators on a caucus conference call Thursday. McConnell, now in the minority, does not have final say on when a trial would be. Schumer would have to agree to the proposal.”

Under our system of government, the president’s authority to issue such orders (or to engage in any other form of unilateral executive action) must come from the Constitution or federal law. Put another way, an executive order can be used to execute a power the commander in chief already has. It can’t be used to give the presidency new powers.
In particular, Article II of the Constitution assigns the president the roles of commander in chief, head of state, chief law enforcement officer, and head of the executive branch. The president has the sole constitutional obligation to “take care that the laws be faithfully executed,” and is granted broad discretion over federal law enforcement decisions.
“He has not only the power, but also the responsibility to see that the Constitution and laws are interpreted correctly,” Heritage Foundation scholar Todd Gaziano wrote in 2001.
When the president lawfully exercises one of these responsibilities, scholars generally agree, the scope of his authority to issue executive orders and other directives is especially broad. As such, Congress has little ability to regulate or limit that authority.
When a president’s authority comes from power granted by statute, Congress is free to negate or modify that authority, or pass legislation to nullify the order itself, because the Constitution empowers Congress to make the laws that govern us. Still, the president has to sign the law enacting that change, unless Congress is able to override his veto.
Federal courts also may strike down executive orders that exceed the scope of the president’s authority,

Senate Minority Leader Mitch McConnell is proposing to give former President Donald Trump two weeks to prepare his legal case for his impeachment trial, arguing that the Senate cannot "short-circuit the due process" that Trump deserves.
McConnell told Republican senators that he would propose to Senate Majority Leader Chuck Schumer that the former president have until early-February to prepare his case, according to three people briefed on a conference call Thursday. The trial would start in mid-February under the timeline, though Schumer has not yet accepted the deal.
I look at it two ways.
Putting it off allows the Senate majority can pass the $1.3 trillion bill.
It also gives the Republicans to build their rebuttals on impeachment.

Former President Donald Trump can be convicted in an impeachment trial for his role in inciting the Capitol insurrection on Jan. 6 even though he is no longer in office, a bipartisan group of constitutional law scholars wrote in a letter Thursday.
“We differ from one another in our politics, and we also differ from one another on issues of constitutional interpretation,” wrote the signatories, which include the co-founder and other members of the conservative Federalist Society legal group. “But despite our differences, our carefully considered views of the law lead all of us to agree that the Constitution permits the impeachment, conviction, and disqualification of former officers, including presidents.”
More than 150 legal scholars signed on to the letter, which was obtained by POLITICO. They include Steven Calabresi, the co-founder of the Federalist Society; Charles Fried, who served as solicitor general under Ronald Reagan and is now an adviser to the Harvard chapter of the Federalist Society;
Ilya Somin, a law professor at George Mason University and adjunct scholar at the libertarian Cato Institute;
and Brian Kalt, a law professor at Michigan State University and leading scholar on the specific question of whether former officials can be impeached.
The House impeached Trump last week, for the second time, in a 232-197 vote for "incitement of insurrection” following the attack on the Capitol by a pro-Trump mob that left five people dead. As the impeachment process moves into its next phase in the Senate, the signatories of the letter are seeking to counter an argument that has been gaining steam among some Republican senators: that it would be unconstitutional for the Senate to hold an impeachment trial for Trump now that he is a private citizen.
“The Senate lacks constitutional authority to conduct impeachment proceedings against a former president,” Sen. Tom Cotton (R-Ark.) said in a statement last week. “The Founders designed the impeachment process as a way to remove officeholders from public office—not an inquest against private citizens.”
Many Republicans have taken a cue from the conservative former federal appeals Judge J. Michael Luttig, who argued in the Washington Post earlier this month that “once Trump’s term ends on Jan. 20, Congress loses its constitutional authority to continue impeachment proceedings against him — even if the House has already approved articles of impeachment.”
The constitutional scholars who signed on to the letter disagree with that assessment, arguing that because the Constitution’s impeachment power has two aspects — removal from office and disqualification from holding office again in the future — it must also be extended to former officials who could try to run for reelection.
“Impeachment is the exclusive constitutional means for removing a president (or other officer) before his or her term expires,” they wrote. “But nothing in the provision authorizing impeachment-for-removal limits impeachment to situations where it accomplishes removal from office. Indeed, such a reading would thwart and potentially nullify a vital aspect of the impeachment power: the power of the Senate to impose disqualification from future office as a penalty for conviction.”
Trump had signaled before leaving office that he might try to run for president again in 2024, and has reportedly mulled forming his own political party. But if the Senate were to hold an impeachment trial and convict him, he would be barred from holding public office ever again. That provision of the impeachment power, the legal scholars wrote, “is an important deterrent against future misconduct.”
"If an official could only be disqualified while he or she still held office, then an official who betrayed the public trust and was impeached could avoid accountability simply by resigning one minute before the Senate’s final conviction vote,” they noted. “The Framers did not design the Constitution’s checks and balances to be so easily undermined.”
