Not that the law matter to liberals, but...

According to USSC and other precedents, the concept of "incitement" holds a high bar... a bar well above what the President is accused of doing. 

Speech with only violent imagery would be protected by the First Amendment. Even the mere tendency of speech to encourage unlawful acts is not enough to punish it, according to the Supreme Court.
Punishable incitement must "specifically advocate" for listeners to take unlawful action, give the crowd detailed instructions on how to break the law, or enlist the crowd to carry out a criminal act, the high court has said.
Some, including senators in Trump's trial, will point out that the rioters stormed the Capitol after hearing Trump's speech. To them, the evidence that the speech incited violence is apparent: there was violence after it.
But defining the speech by the audience's reaction, however, may be an unconstitutional "heckler’s veto," as a legal doctrine is known.
The heckler's veto doctrine provides that the hostile reaction of a crowd does not transform protected speech into incitement. A speaker is not automatically liable for the acts of anyone who was at an intended peaceful demonstration. Rather, the speaker must have the intent to engage in the criminal conduct.
There's also the issue of "imminence" required for incitement. There was no reported violence at Trump's speech, which was at the Ellipse. The Capitol is more than a mile away. The invasion of the Capitol clearly happened after the rally, but not seconds after the rally, and not in the same place as the rally.
Even if there is proof Trump "intended" to cause violence with his speech, and even if there is proof that the violence he intended to cause was storming the Capitol, there is potentially an issue of whether the violence was "imminent" enough to be criminal.

The fact of the matter is that the only instructions that the President provided the crowd was to march "peacefully" and "patriotically" to the Capital. As of right now, the only thing people who support this impeachment can fall back on is that "others" (on both sides of the aisle) are equally stupid when it comes to the law. At this point nobody can provide any actual statement Trump provided that supports the idea that he legally "incited" anything. 

There is no such thing as a valid legal argument that Trump gave a speech and then a few minutes later some people rioted at a different location and therefor he is guilty of incitement. That law doesn't exist and the concept of it has been invalidated by the courts.

Moreover, anyone (from either Party) who feels that they are smarter about the law than the USSC should not be listened to. If we no longer recognize the rule of law as we work to administer it to our elected officials, then what sort of banana republic have we become?

The final section of Article II, which generally describes the executive branch, specifies that the “President, Vice President and all civil Officers of the United States” shall be removed from office if convicted in an impeachment trial of “Treason, Bribery, or other high Crimes and Misdemeanors.” 

The decision will never go to the courts.

The President's specific statements incited a high crime and misdemeanor assault on the Capitol building, with the intent to stop counting ballots that would declare Biden and Kamala Harris.

The hypocrisy is a death sentence to the Republican party.

President-elect Joe Biden on Thursday unveiled the details of a $1.9 trillion coronavirus rescue package designed to support households and businesses through the pandemic.

The proposal, called the American Rescue Plan, includes several familiar stimulus measures in the hopes the additional fiscal support will sustain U.S. families and firms until the Covid-19 vaccine is widely available.

The plan is the first of two major spending initiatives Biden will seek in the first few months of his presidency, according to senior Biden officials.

The second bill, expected in February, will tackle the president-elect’s longer-term goals of creating jobs, reforming infrastructure, combatting climate change and advancing racial equity.

Senior Biden officials, who have been working on the stimulus plan for weeks, also confirmed that the president-elect still supports $10,000 in student debt forgiveness. The president-elect will formally introduce the plan during a speech at 7:15 p.m. ET from Wilmington, Delaware.

Still, the nearly $2 trillion price tag will likely draw disdain from Republicans, such as Sen. Rand Paul of Kentucky, who may be wary of spending even more after December’s $900 billion bill.

Still, Biden officials said Thursday they are optimistic that the current rescue package had enough in it to make it palatable to lawmakers across the political spectrum and that the president-elect has been consulting congressional allies in recent weeks on the best path toward approval.

Others, such as Sen. Marco Rubio, R-Fla., have offered early bipartisan support for Biden’s spending plans. Earlier this week, the Florida Republican implored the president-elect to make direct payments of $2,000 a top priority.

“All across our nation, people are looking for answers and demanding accountability, but they are also desperate for hope: hope that political leaders in Washington can begin taking steps to heal our deeply divided nation,” Rubio wrote in a letter to Biden dated Tuesday.

“It would send a powerful message to the American people if, on the first day of your presidency, you called on the House and Senate to send you legislation to increase the direct economic impact payments to Americans struggling due to the pandemic from $600 to $2,000,” he added.

Most economists, including Federal Reserve Chairman Jerome Powell, warn that additional Covid-19 relief funding and economic stimulus may be needed to help businesses stay afloat until the broader population has access to vaccines.

As of Thursday morning, the virus had killed more than 384,000 Americans, according to data from Johns Hopkins University.

McCarthy apparently grew exasperated after the president continued to complain about election fraud.

An anonymous White House official told Axios that the California congressman interrupted: "Stop it. It's over. The election is over."

McCarthy is also said to have taken the president to task during the 30-minute call for blaming last Wednesday's insurrection at the US Capitol on leftists in disguise.

Scott earlier challenged me to provide evidence that Trump said things that led to crowd violence at the Capitol. So here goes, and these are my own arguments, not copied from anywhere:

REGARDING THE VALIDITY OF IMPEACHING TRUMP BECAUSE OF WHAT THE TOLD THE CROWD DURING HIS EIGHTY MINUTE SPEECH:

Brandenburg v. Ohio (1969) states:
The government can punish speech that is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action."

Did Trump do that in his speech? Did he encourage the crowd to engage in imminent lawless action? Did he say things that were "likely to incite or produce imminent lawless action"?

Earlier, on December 19, Trump had tweeted,
"Be There. Will be wild!"

In saying that, Trump was encouraging people to be present BECAUSE it would be wild.

On the morning of January 6, Trump gave a speech on the White House Ellipse that stretched more than an hour and ended like this:

TRUMP:
"Our brightest days are before us, our greatest achievements still wait.
I think one of our great achievements will be election security because nobody until I came along, had any idea how corrupt our elections were. And again, most people would stand there at 9:00 in the evening and say,'I want to thank you very much,' and they go off to some other life, but I said, 'Something's wrong here. Something's really wrong. Can't have happened.' And we fight. We fight like Hell and if you don't fight like Hell, you're not going to have a country anymore. Our exciting adventures and boldest endeavors have not yet begun. My fellow Americans for our movement, for our children and for our beloved country and I say this, despite all that's happened, the best is yet to come. So we're going to, we're going to walk down Pennsylvania Avenue, I love Pennsylvania Avenue, and we're going to the Capitol and we're going to try and give… The Democrats are hopeless. They're never voting for anything, not even one vote. But we're going to try and give our Republicans, the weak ones, because the strong ones don't need any of our help, we're going to try and give them the kind of pride and boldness that they need to take back our country. So let's walk down Pennsylvania Avenue. I want to thank you all. God bless you and God bless America. Thank you all for being here, this is incredible. Thank you very much. Thank you."

Earlier in the speech, Trump had said,

"...we're going to walk down and I'll be there with you."

[Later he was not with them.]

"We're going to walk down. We're going to walk down any one you want, but I think right here.

[Apparently he meant they could walk down any street they preferred, but he was recommending Pennsylvania Avenue which was right there.]

"We're going walk down to the Capitol, and we're going to cheer on our brave senators, and congressmen and women. We're probably not going to be cheering so much for some of them because you'll never take back our country with weakness. You have to show strength, and you have to be strong."

I know people will quibble over whether Trump was inciting violence, but apparently the crowd understood him that way.

Later, when violence started up at the capitol, he watched it on TV both delightedly and approvingly until his advisers began to puzzle him by their lack of enthusiasm and their anguished concern because of what was happening.

Now go back to earlier in the speech where he said,

"And we fight. We fight like Hell and if you don't fight like Hell, you're not going to have a country anymore."

Some in the crowd left as soon as Trump
said that, for he had not yet finished talking when some of them began arriving at the outer fenced perimeter in front of the Capitol building and began pushing and eventually breaking through it, violently shoving and injuring the few Capitol police who resisted them there.

Thus, if the government can punish speech that is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action," Trump can surely be punished for speech that was "likely to incite or produce such action" for it DID.

I agree with those Republicans who are appalled by what Trump said and did.
Also by what he did not do, for when soon thereafter in the White House he saw on the television violence taking place at the Capitol, he did not immediately issue a call for it to stop.

So again, if the government can punish speech that is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action" -- only a dunce would say that Trump's words were not "likely to incite of produce such action" for they were not only LIKELY to produce it, THEY ACTUALLY DID.

They DID, and at first Trump was DELIGHTED that they did.

Nothing that Obama said about fighting ever set off riots. All politicians, including Hillary claim that they are going to "fight" for the right causes.

BUT HERE IS WHY YOU CANNOT DEFEND TRUMP:

When he got back to the White House after his speech, and the scenes of a violent invasion of the Capitol building began to appear on television, he did not cry out in anguish, "Oh my God! How can they be doing that? Didn't they hear that portion of my speech where I told them to protest PEACEFULLY?"

No, he didn't say that.

Nor did immediately he call for the violent actions to cease. Instead, his advisers were disturbed to see how DELIGHTED he was by what was happening!

He thought it was a GOOD THING that the Capitol was being broken into in that way.

And he had considerable difficulty understanding why his advisers were so upset by it. It was only later, after intense pressure began to mount and mount on him to call for peace, that he finally did.

Even then, he told the insurrectionists that "We love you," even as he told them to "go home." And he again repeated the lie that the election had been stolen from them.

There is no way you can deny that Trump was at first GLADDENED, not saddened, by the violent way his supporters responded to his speech. And that is just one more reason he fully deserves impeachment AND CONVICTION.

There are many Republicans who see that clearly, and less and less of them are remaining afraid to say so.

They are realizing that if the GOP does not cut itself off from Trump and much that Trump has come to represent, it will be doomed.

Scott, why was Trump delighted when after his speech he in his White House retreat at first saw tv reports of the invasion of the building? He couldn't understand why his advisers were NOT as elated as he was, and were reacting negatively.

What explanation do you have for that?

Again I state this:
he was DELIGHTED by the initial news coverage of the invasion of the Capitol and the violence being done there, and resisted calling for a cessation of violence until later.

How do you explain that away?
