Regarding Trump's tax returns...

Guess who else has always had his tax returns? The IRS
Guess who is tasked with determining if tax laws were broken? The IRS


To be clear, out of about 250 million tax returns filed every year, approximately 5000 people end up being charged with some sort of tax fraud. That is incredibly low number. Like most criminal acts, you must prove that a technical crime was committed, that there was specific intent to commit the criminal activity, and generally that there is an unwillingness to cooperate with audits and IRS auditors. Even after all of that, a lion's share of those charged are simply fined.

The amount of people who are audited, cooperate with audits, provide their information to the IRS, and are actually paying taxes, and are not actually hiding income, not defrauding someone, not destroying documents, not hiding money offshore, and then charged with tax fraud is almost zero. By common sense and the assumption of innocence in our legal system, the IRS will generally only bring egregious cases to court. Cases that do not rely on shades of grey or two different opinions about what something is worth.

The Manhattan District Attorney is doing exactly the opposite of what our system of Justice stands for. Rather than follow criminal actions, investigate who committed then, and then charge those responsible,  this D.A. is openly choosing a "target" and then openly admitting that he will go looking for a crime to charge his "target" with. The sad part about this is that there is so much open hatred of Donald Trump that there are plenty of angry, hateful, spiteful individuals (inflicted with TDS) who are literally applauding the move.

The fact is that Donald Trump files his taxes every year and most years he has been audited by the IRS. The IRS (who are the experts in tax laws) have not found any reason to charge Donald Trump with any criminal activity. I find the concept that a local New York District Attorney sees himself to be smarter about tax laws than the IRS to be silly. We all know why he is doing this, and it has nothing to do with any sort of justice.

The DA was always going to get the tax returns. It was just a race to see if he could get them "prior" to the election so that damaging information could be found and leaked. Trump's sole intention was to delay the release till after the election.


Are you one of those who believes that the IRS is simply not smart enough regarding tax laws to catch Donald Trump? That it will take some NYDA to figure out what the IRS couldn't?

It just appears that many people seem to conveniently forget that the agency in charge of determining whether or not someone has broken tax laws is actually the IRS and that the IRS has had all of Trump's tax returns and financial information.

Whether or not the New York District Attorney does or does not have access to them literally has "NOTHING" to do with whether or not Trump's tax returns have been vetted by authorities. The actual real tax authorities (the IRS) has vetted his taxes and audited them pretty much every year. If there were crimes to be found, they didn't find them.

The idea that he is "hiding" them is sort of the big lie, huh?

I think the concept is that Cy Vance will be willing to concoct something to charge him with, because his standards will be lower than what the IRS uses. Think about the Manafort/Gates charges brought by the Mueller team. Those tax and bank fraud cases had been looked at multiple times, never charged, and were pushing the statute of limitations. As far as I understand, the Mueller team brought nobody in from either the IRS or the SEC to testify that either Manafort or Gates actually committed a crime.

It becomes a situation where a prosecutor asks a group of citizens (making up the jury) to suddenly become tax experts who can determine whether or not the tax laws have been broken. Or to some degree, they use the assumptive argument to make everyone "assume" that the actions are illegal (without ever proving it). Then they just prove that those actions took place and they get a conviction.

I personally find it troubling that there are prosecutors out there who want to take over the job of the IRS and push criminal charges when the IRS has not made that determination. Why bother having a criminal portion of the IRS if we do not defer to them.

Yes... they are called non-disclosure agreements and are perfectly legal. They were also reported as legal expenses (which is also legally correct).

At one point, there were Democrats demanding that it was a campaign violation because the NDA were not reported as a campaign expense. But the Federal Election Commissions had ruled on NDAs prior and flat out stated that they generally could NOT be written off as a campaign expense because they benefitted the candidate personally as well.


There is no "tax" crime having to do with writing of a NDA as a legal expense.

There was a an open investigation predicated on the fact that Michael Cohen pled guilty to that particular crime as part of his plea bargain. Possibly the first person on the planet to get a lower sentence to plead to more crimes. The idea (of course) being that Cohen could testify against Trump.

The prosecutor who had that case stalled for a long time and there were rumors of a "sealed indictment"... and then the Judge eventually closed the case and demanded that all information be "unsealed" and lo and behold there was no indictment.

So the whole Stormy Daniels ship has already sailed. They are needing to find something else that the IRS didn't catch.

Trump has refused to release his tax returns for two very simple reasons -

1) He's under no legal obligation to do so. and for the sake of accuracy he said he "might" not "would" release them at the conclusion of the audit.

2) He's smart enough to know that the disingenuous and intellectually dishonest hacks on MSDNC would view his taxes through the over-simplified prism of personal income tax and insinuate that he paid little or no taxes without acknowledging his full compliance with tax law.

Your actual argument to suggest tax criminality is that the IRS said that they were "not" auditing Trump's tax returns (which would mean that they saw nothing worthy of a second look)?

That seems very odd, Reverend?

Please explain why the IRS would not be auditing a potential Tax Criminal, or if they did audit him, why they didn't charge him if he is, in fact, a tax criminal? After all, most of these supposed criminal actions took place either before or while he was running for President.

The IRS has has four years to check for criminal behavior. One would think that they would have found it by now... wouldn't you agree, Reverend?



Perhaps you should accept that the quest to see Trump's tax returns was for the reason to find political (not criminal) fodder and that the push was always to get them released "prior" to the election. Perhaps a little honestly would be good.

Or otherwise explain why an ex-President's tax returns seems to make you so excited? Is your TDS that strong, that you cannot just let go of your hatred, spite, and anger even when Trump is no longer President?

I would say the same reason why Obama didn't release his college transcripts. Because both Presidents are entitled to some privacy regarding things that probably would lead to their political opponents making political fodder over these things. Obviously Obama had reasons to be embarrassed with his transcripts and there were probably things that Trump would have thought to be embarrassing in his tax returns.

Again. I don't think you understand how tax laws work. When Donald Trump submits his taxes to the IRS, they are allowed to audit, investigate, or do what they need to do to look into potentially problematic behavior.

999 out of a 1000 times, the IRS is the one who will determine if someone has committed a tax crime. Not local District Attorneys.


So he has not delayed anyone from looking at his taxes. It's just that a DA is attempting to get a hold of them so he can then to look for a crime. If this was anyone but Trump and most places (other than New York) there wouldn't be a judge who would have provided a DA to get tax returns without actual probable cause (which he seems not to have).
