And this is why Chauvin and the other cops cannot get a fair trial...

This is what happens when emotions take over and judgement falls to the wayside!

Were the Court TV legal analysts bigger hacks than me for
 thinking the prosecution was trying to lose on purpose?

Keep in mind that this particular person has made numerous attempts to demand that he was impartial and listening to both sides. Yet after the first day of a trial where the analysts on Court TV actually had a discussion on whether or not the prosecution was "throwing the case on purpose" and where almost every legal observer suggested a very bad day for the State... Roger loses his cool and demands all of the cops will be "convicted felons". 

So was this "convicted felons" argument based on any reasonable evidence presented? 

Was it the dispatcher who stated on the witness stand that she never saw any actual excessive force, but did see signs of a mighty struggle? Was it the witness who claimed that she didn't remember when she moved to Minnesota, much less what happened on that day? Was it the angry bouncer with a low grade MMA background who suggested (without any police training) that Officer Chauvin was using trained techniques to tighten the choke hold with his knee, or was it when the angry bouncer suggested that blaming Floyd and drugs was what "America does"? 

Because other than that, the prosecution offered nothing that we already didn't know. Opening statements are not proof of fact and are not a determination of guilt or innocence. None of the witness held any real compelling testimony (unless you take Donald "Dwill" Williams at face value that as a bouncer he has a medical understanding of how the esophagus or trachea work). 

Perhaps the prosecution has better witnesses to come. But perhaps it doesn't matter if enough Rogers sit on the jury and are willing to take out their own anger on four police officers who put their lives on the line for our safety, and throw them under the pass to make themselves feel better. Either way, nobody will trust Roger to be providing us with any "objective" feedback on this case. His mind was made up a long time ago.

During the discussion about the hearing yesterday, I made it clear that, I had not made up my mind his innocence or guilt.

The defendant has the Constitutional right of being innocent until proven guilty by a jury of his peers.

Based upon the laws and evidence presented by both sides, I don't know if he is guilty or innocent.

I can separate my feelings from my objective perspective.

Burden of proof.

All of the charges against Chauvin require the prosecution to prove the former police officer’s culpability beyond a reasonable doubt.

The number of charges helps the prosecutors, as it raises the chances of getting a conviction.

Chauvin’s third-degree murder charge is somewhat unique, as Minnesota is one of a few states in the country to have such a charge.

The standard of proof for third-degree murder is less than it is for second-degree murder, but it still carries a hefty maximum sentence of 25 years.

For Chauvin to be convicted by the jury of murder in the third degree, the prosecution would need to prove that Chauvin acted without the intent to kill Floyd but in a “eminently dangerous” way “evincing a depraved mind, without regard for human life.”

Securing a second-degree murder conviction is a more strenuous task.

Second-degree murder in Minnesota can be classified as either intentional or unintentional; Chauvin’s second-degree charge is the latter.

Prosecutors would need to prove without a reasonable doubt that Chauvin killed Floyd unintentionally while kneeling on his neck. As part of this, they would need to show that Chauvin had intent to commit aggravated assault and battery against Floyd.

For the manslaughter charge to stick, the prosecution will need to prove that Chauvin “consciously” acted in a manner that had the chance of causing “death or great bodily harm” to Floyd.


"consciously" is not a difficult point to make to the jurors. He has 19 years of experience in law enforcement.

A "depraved mind" is a high task to prove.

It is the sign of a sickness deeper than covid-19 that the defiance of public health guidance has become a political selling point in the Republican Party.
Consider the case of South Dakota Gov. Kristi L. Noem. Speaking last month to the 2021 Conservative Political Action Conference, she stirred some presidential buzz for her proud resistance to basic virus control measures even at the height of the pandemic. “Now let me be clear, covid didn’t crush the economy, government crushed the economy,” Noem told the conference. “South Dakota is the only state in America that never ordered a single business or church to close. We never instituted a shelter in place order. We never mandated that people wear masks.”
Noem continued: “We have to show people how arbitrary these restrictions are, and the coercion, the force and the anti-liberty steps that government takes to enforce them.”

Now let me be clear. South Dakota has the second-highest case rate and the eighth-highest covid death rate in the country. In that sparsely populated state, the disease has taken the lives of nearly 2,000 people. And Noem’s defiant inaction has made that number higher than it should have been. What level of hubris, extremism or insanity does it take to crow about one of the worst covid records in the nation? Noem might as well be campaigning for higher office in a hearse.

But to help you out they show no benefit, and none has ever been proven. It makes sense to stay home if you are sick. Wear a mask if you are sick and have to venture out. But don't shutdown society and cause the harm that Fraudci and his non-scientific positions have caused. Being a scientist doesn't give you the authority to dictate what is "science", when it is not.

Chauvin’s knee remained even after Floyd became unresponsive. Floyd was ultimately pronounced dead at an area hospital at the age of 46.

The good news is that once a respected publication like Scientific American decides to "get woke" they've beclowned themselves and openly admitted that they no longer wish to be taken seriously.

I see roger has basically conceded he was wrong when he stated "The defense might have proved lack of intent." He was wrong.

Now he states "the failure to take this virus seriously is precisely what got us into this mess in the first place." Actually what got us into this mess is a bit more complicated. It starts with China. And includes a heavy dose of Democrats playing politics with science. The only fact roger has is that 500,000 Americans have died. But nothing else he speculates has been scientifically tied to cause, except perhaps the criminal behavior of governors in dealing with nursing homes.

I sure wouldn't want him on any jury.

I understand why African Americans are disturbed by the actions of police officers. I have several friends who have been stopped for driving while black in white neighborhoods.

It's not as common any more. But it will probably never go away.
