Chauvin trial - Day two trial recap

This will start to get a little mind-numbing, considering the prosecution witness list is in the hundreds and their case will take several weeks if not months. But if yesterday is any indication, we are going to be hearing many many people saying largely the same thing over and over. Observations from several legal analysts are suggesting that the witnesses all appear well coached.

There is still a bit of division between those who feel that these emotional appeals are largely effective and that the defense is not doing a very good job in mitigating that and those who feel that the prosecution's case so far feels too contrived and is not really attempting (so far) to prove a cause of death. There seems to be no witnesses that have come across as either completely effective or completely ineffective.

The last witness (a firefighter who was also a bystander to the events) was definitely something to see. She was contrived to the point where she literally refused to acknowledge that any amount of citizen interference would ever effect her ability to do her job. It was if she was testifying that she was a robot with no emotions. At one point she claimed she didn't recall something asked of her (that she obviously did). She then refused to look at a document to refresh her memory. After being ordered to look at the document, which she already knew what is was, she made a somewhat belligerent argument as to why she claimed she didn't know. Shortly after that, the Judge cleared the Jury from the court and chastised the witness. She will be back on the stand this morning.

At the end of the day the prosecution would like the jury to make a raw emotional decision based on how the events made people feel. There is a sentiment by certain Americans that this trial is not about Officer Chauvin, but rather a statement about race in America (yada yada). They feel that anything other than a guilty verdict would be akin to a slap at all minorities. Obviously the defense wants people to draw a legal and logical conclusion not based on raw emotion.

Roger says he was strangulated to death (or something). No witnesses so far have testified to that. The bouncer witness with the 5-6 MMA record did say that Officer Chauvin applied the dreaded "side blood choke hold" to Floyd - but based on his testimony of that mysterious MMA hold, it was not strangulation. It was something that cuts off blood circulation.

But still... Roger believes that it's strangulation because the prosecutor used the term. The fact that the defense determined differently or that no testimony has suggested it... is moot, because some people have already made up their mind.

Cutting off blood flow to the brain can severely damage one half of your brain.

I am curious if Roger understands that when you stop the flow of the blood by compressing on the carotid arteries - that by nature you are not actually restricting the air to the lungs.

Therefore, someone saying that they cannot breath would not be any indication that they are in a "blood choke hold" - which is where the intention is to cut off blood.

But as 99% of martial artists will tell you, you do have to shut off both carotid arteries to successfully get this to work and that person will not complain about breathing, but rather they will quite literally start to lose consciousness within a matter of seconds.


In other words, there is no real evidence of a blood choke hold that takes several minutes to work. Nor would cutting off the blood flow ever cause someone an inability to breath.



So the prosecution is attempting to make muddy the waters between the two holds. They are attempting to put forward (with the testimony of the MMA bystander dude) that Chauvin's knee to the neck was a type "blood choke" meaning cutting off the supply of blood to the brain, while simultaneously arguing (or at least implying) that the fact he complained he couldn't breath came from the same restraining move.


It's like a person complaining that their leg hurt and blaming it on the fact that someone else had applied an arm bar to them.

Well one of the major issues if you lose blood flow from the carotid arteries would be a reduction of mobility in the face, mouth, tongue, oral cavity which would make talking extremely slurred if not impossible.

Either way it doesn't prevent breathing.


So that appears to be a problem with the logic, Roger.

Medically (if suffering from a lack of blood to the brain) George Floyd should have had no problems breathing, but would have had trouble talking.

This makes it impossible that the lack of breathing came from a "blood choke hold" and extremely unlikely (had the choke been working) that he could have talked to complain about his breathing issues.


We need another explanation... if we are being objective and logical.

In fact the last witness tells the court that he saw foam coming out of Floyd's mouth "prior" to him being put in the knee restraint. That he was already claiming he was being killed before that even happened. That his "body was shutting down".

Clearly, saying “I did not review my statement” wasn’t going to do the trick. So, in her frustration, she started arguing with Nelson and defensively adding details that were not responsive to his questions — such as the explosive conclusion that she was angry at the time of the events in question because she had just watched the police murder Floyd. That, of course, is the central issue in the case, and one on which she is not competent to render an opinion, lacking both medical training and non-hearsay knowledge of what happened before she arrived on the scene just four minutes before the ambulance took Floyd away.

Hansen also has a service-rivalry chip on her shoulder. As a trained first responder, she perceives that the Floyd situation was botched. She has convinced herself that if 9-1-1 had been called, her fire department would have had responders on the scene within three minutes, the paramedics would have been close behind, and Floyd would have been saved. She therefore blames the police department and its dispatcher for mishandling the situation, with the result that the medics arrived too late. Hansen is emotionally invested, and self-restraint is not her strong suit, so she leaps to the conclusion that the police killed Floyd, and she wants the world to know that’s what she thinks — regardless of whether it’s admissible testimony.

The technology giant announced it will occupy 19 stories, or 500,000 square feet, of 1105 West Peachtree after initially suggesting it would take up five floors of the 31-story Midtown tower.

Downtown Minneapolis loses first large employer in years


Portico Benefit Services is leaving downtown Minneapolis and relocating to Edina.

Why it matters: Downtown Minneapolis and its restaurants and retailers need all the workers they can keep as companies move to hybrid work models that will reduce the daily headcount in the city.

The details: Sources tell Axios that Portico, a benefits provider for employees of the Evangelical Lutheran Church of America, is leaving 60,000 square feet in RSM Plaza on Nicollet Mall.

Portico is leasing 25,000 square feet in the 7700 France building, which recently underwent a major renovation. The size difference in the two leases is further proof that companies need less space in a post-pandemic world.

"We found an alternative location that will allow for additional flexibility as we move to a more agile, hybrid work environment for the future," Portico CFO/COO Stacy Kruse said in an emailed statement.

Context: Portico is the first sizable company to leave downtown for the suburbs since TCF Financial departed in 2015 for Plymouth.

It's not clear exactly how many employees Portico has downtown, but the number is likely in the hundreds based on the space.

What we don't know: Exactly why Portico made the decision, other than that its lease was up.

The intrigue: The Minneapolis Downtown Council last summer warned that downtown could lose as many as 10,000 jobs due to public safety concerns and the City Council's talk of defunding police.

"I think we will hear of more," Downtown Council President Steve Cramer told Axios. "But it will be a lot less than we were fearful of."

He sobs and screams in terror throughout much of the footage, and at no point does he appear to pose any threat to the officers.

At the beginning of the footage, while Mr. Floyd is still in the driver’s seat, one officer curses at him while ordering him to keep his hands in sight — showing the immediate aggressiveness with which the police acted. As the officers order him to get out of the car, he appears to be scared that they will kill him if he moves; it is at this point that he starts saying, “Don’t shoot me.”

He also says tearfully, “I didn’t know, man,” possibly referring to the accusation that the $20 bill he had used was counterfeit.

As the officers try to push Mr. Floyd into the back seat of a police vehicle, the footage shows him screaming and saying repeatedly that he is claustrophobic and scared.

It also underscores the nonchalance with which Mr. Chauvin responded to Mr. Floyd’s obvious distress. As Mr. Floyd begs for his life and says he can’t breathe, the officer says, “Takes a heck of a lot of oxygen to say that.” When another officer says he can’t find Mr. Floyd’s pulse, Mr. Chauvin says simply, “Uh-huh.”

The videos — introduced during testimony by Lt. Jeff Rugel, a body camera expert, who explained how the Minneapolis Police Department’s body cameras worked and verified the legitimacy of the footage — provide additional, horrifying perspectives on events that the public has previously seen from one or two angles.

In all of them, one of the things that stands out most is the depth of Mr. Floyd’s terror as he begs for his life, again and again, for minute after agonizing minute.

“Please! Please! Please!” he screams between sobs. “Mama! Mama! Mama!”

“Mom, I love you,” he says at one point, and then: “Please. I can’t breathe.”

His voice becomes quieter and quieter as he loses consciousness.

Federal authorities have arrested Daniel Joseph Rodriguez, the 38-year-old Donald Trump fanatic who was identified as the man caught on camera assaulting a police officer during the U.S. Capitol insurrection on Jan. 6. Rodriguez was indicted on eight counts and arrested Wednesday, according to court records.

Rodriguez was part of the mob that swarmed D.C. Metropolitan Police Officer Mike Fanone, who pleaded for his life and suffered a mild heart attack. Rodriguez can be seen on video jabbing a small black device into Fanone’s neck — causing the officer to drop to the ground — before breaching the Capitol building and trying to smash out a window.

Fanone’s story went viral in the weeks following the insurrection. In media interviews, the father of four described being shocked with a stun gun and surrounded by rioters chanting, “Kill him with his own gun!” The identity of Fanone’s assailant remained unknown until a HuffPost investigation published Feb. 26 revealed that it was Rodriguez.

The government has created, by their own overheated hyperbole, a nearly insurmountable obstacle to proving their initial accusations in court.

And that’s when the case against Munchel and Eisenhart began to fall apart. In fact, several cases now face an uphill battle as the Justice Department’s abusive overreach related to January 6 is exposed in federal court.

In a major blow to both prosecutors and judges who’ve signed off on dozens of orders to deny bail to Capitol breach defendants—including nonviolent offenders such as Munchel and Eisenhart—the D.C. Court of Appeals on March 26 asked a lower court to “consider anew the government’s motion for detention” for the pair.

The three judges carefully deconstructed the charges against mother and son, noting neither has been accused of violence such as assault or destruction of property. One judge argued the detention order should be reversed, not revisited. In his partial dissent, Judge Gregory Katsas took aim at the Justice Department’s exaggerated case.

“While there, they attempted neither violence nor vandalism,” Katsas wrote. “They searched for no Members of Congress, and they harassed no police officers. They found plastic handcuffs by chance, but never threatened to use them. Munchel’s threat to ‘break’ anyone who vandalized the Capitol was intended to prevent destruction and was addressed to no one in particular.”

Katsas detailed how both defendants fully cooperated with authorities, both were employed at the time of surrender—Eisenhart has been a nurse for 30 years—and neither has a criminal record with the exception of Munchel’s two marijuana possession charges from several years ago.

The only felony the government could come up with to charge Munchel and Eisenhart—who are being charged together—is “obstruction of an official proceeding,” which is an enhancement count filed against defendants charged with misdemeanors.

The appellate court order had a quick impact on other cases. That same day, another federal judge, citing the court’s opinion, challenged the Justice Department’s pre-trial detention motions for two members of the Oath Keepers, a group facing conspiracy charges for its role in the Capitol breach.

U.S. District Court Judge Amit Mehta ordered the release of Donovan Crowl and Connie Meggs. (On March 24, Mehta released Laura Steele, a defendant in the Oath Keepers case, and on March 12, Mehta released an ailing 66-year-old veteran prosecutors accused, without evidence, of helping Oath Keepers plan to storm the building.) The government then withdrew its detention request for another Oath Keeper, Graydon Young, on March 29.

No Sedition Charges So Far
Despite heavy-handed threats and braggadocio about pending “sedition” cases, nearly three months later, the Justice Department has nothing even close to this boast—and their mouthpieces in the media are getting nervous.

But any conviction would codify its use against anyone who disrupts a government meeting or ceremony. “While violent assaults in the Capitol are rare, protests and acts of civil disobedience—such as disrupting congressional hearings or even House and Senate floor sessions, are more common,” Politico admitted. “That means prosecutors and judges will have to weigh how much more punishment a Trump supporter who invaded the Capitol during the Electoral College count deserves than, say, an anti-war protester chanting at a CIA confirmation hearing or a gun-control advocate shouting in the middle of the State of the Union address.”

The standard way to look at spending like this is to add up how much it costs over a decade and how much of that cost is paid for over the same 10-year window. The proposed tax hikes generate only about $1.5 trillion over a decade, meaning this plan would add close to $1 trillion to the U.S. debt.
“Put another way, roughly half of the spending will be paid for,” said Shai Akabas, director of economic policy at the Bipartisan Policy Center.

The proposal calls for about $2.3 trillion in spending over eight years, yet it would take 15 years for the proposed tax increases to generate that amount of money. That’s not how budgeting normally works.

The White House is already getting criticized for portraying this as a plan that is “paid for” by tax increases, when the numbers don’t actually add up.
