Day one of the Chauvin trial

Motions and jury selection is the all important part of the trial

They say that many of these trials are won or lost before opening statements. Make the right arguments and get the right rulings on evidence, pick the best jury possible, and it could very well make all the difference in the world.

One of the most heated discussions was whether or not to admit as evidence a prior arrest that George Floyd had where he had admitted to ingesting a large amount of drugs when confronted by cops to hide the drugs from being found. He ended up being admitted to a local Hospital and almost died from a similar amount of Fentanyl that was found in his body. This happened pretty close to one year prior to his death.

The defense wants this admitted as evidence of support of their theory that George Floyd did the same thing on the day of his death. That he ingested the large amount of Fentanyl to avoid being arrested for drug charges. The prosecution on the other hand is arguing that it is more prejudicial than probative. From what legal analysts are describing the Judge is leaning towards not allowing it. 

While this obviously seems like good news for the prosecution and somewhat puzzling news for the defense (who could show some modus operandi in Floyd's behavior), it does actually show that everyone is basically stipulating to the idea that George Floyd had purposely ingested a lethal dose of Fentanyl. The judges ruling would most certainly be reversed if the prosecution "opens the door" by making any suggestions that Floyd had not intentionally ingested the lethal dose of Fentanyl.  

So, at this point, the jury will be hearing about the Fentanyl that was found in the toxicology reports as well as expert testimony that will suggest that this is why George Floyd died and that it wasn't because he was choked or otherwise physically killed. Moreover, it will be argued (and not challenged) that Floyd ingested the Fentanyl of his own free will. This is quite obviously the most solid portion of the defense's case and will be the most difficult for the prosecution to overcome.

She spends a good portion of each day, around four to five hours, with Biden and their team behind closed doors, according to White House sources. Harris was in the Situation Room during his recent decision to order an airstrike in Syria, for example. The two carve out one-on-one time for lunch together once a week, and he has dropped by her office down the hall from time to time.

“The chemistry between the two of them is great,” said Rep. Jim Clyburn, a South Carolina Democrat who’s a key supporter of the Sleepy President. “There seems to be the right chemistry, and he expresses the fact that he has faith and confidence in her.”

Learning on the job is no small thing for the second-in-command to this particular President, until she implements the 25th amendment.

The Democrats sneaked a tax increase into the recovery bill.

Tucked a trio of little-noticed tax hikes on the wealthy and big corporations into their coronavirus relief package that together are worth $60 billion.

One takes away deductions for publicly traded companies that pay top employees more than $1 million. Another provision cracks down on how multinational corporations do their taxes. A third targets how owners of unincorporated businesses account for their losses.

It’s surprising because Democrats were widely expected to put off their tax-increase plans until later. Many lawmakers are wary of hiking them now, when the economy is still struggling with the coronavirus pandemic. If anything, when it came to their stimulus plan, Democrats were focused on cutting taxes, not increasing them.

The Republicans spent 8 hours reading the bill in the Senate floor, but didn't know what it contained.

That's one of the reasons why the progressive Senators happy.

Department employees have said that Mr. Garland’s performance at his confirmation hearing, a largely amicable affair, made them hopeful that he would restore honor to the agency and lift up its 115,000-person work force demoralized by the Trump-era rancor.

Restoring trust inside and outside the Justice Department will be key, as Judge Garland will immediately oversee politically charged investigations, including a federal tax fraud inquiry into President Biden’s son Hunter and a special counsel inquiry into the Russia investigation.

The department will also be involved in civil and criminal cases related to issues that have bitterly divided the country, including systemic racism, policing, regulation of big technology companies, L.G.B.T.Q. rights and other civil liberties matters.

Judge Garland will also confront the rise of domestic extremism as law enforcement officials continue investigating the Jan. 6 assault on the Capitol. His first briefings this week were expected to be with the F.B.I. director, Christopher A. Wray, to discuss the threat and with Michael R. Sherwin, the outgoing top prosecutor in Washington who has led the Justice Department inquiry.

The Capitol riot investigation has grown closer to Roger J. Stone Jr., one of Mr. Trump’s allies, and the F.B.I. has found evidence of communications between right-wing extremists and White House associates, underscoring how closely Mr. Trump had aligned himself with such groups during his presidency.

During his confirmation hearing, Judge Garland said that he would rely on his experience leading the department’s investigation into the Oklahoma City bombing to help again combat domestic extremism.

“I supervised the prosecution of the perpetrators of the bombing of the Oklahoma City Federal Building, who sought to spark a revolution that would topple the federal government,” he said. “I will supervise the prosecution of white supremacists and others who stormed the Capitol on January 6, a heinous attack that sought to disrupt a cornerstone of our democracy, the peaceful transfer of power to a newly elected government.”

During the Clinton administration, Judge Garland was chosen by Jamie Gorelick, the deputy attorney general, to serve as her top deputy. He led the investigation into the 1995 Oklahoma City bombing, which led to the conviction and execution of Timothy McVeigh, and went on to supervise other high-profile cases that included the Unabomber, Theodore J. Kaczynski, and the bombing at the Atlanta Olympics in 1996.

The investigations helped cement Judge Garland’s reputation as a fair-minded centrist. After his appeals court confirmation, he did not make major headlines again until 2016, when Mr. Obama nominated him to serve on the Supreme Court, a choice that won bipartisan support, including from conservative stalwarts like the former Whitewater prosecutor Ken Starr.

For weeks now, an overwhelming percentage of Americans – Democrats, Independents, and Republicans – have made it clear they support the American Rescue Plan. Today, with final passage in the House of Representatives, their voice has been heard.

Now we move forward with the resources needed to vaccinate the nation. To get $1,400 in direct payments to 85% of American households. To expand coverage and help with lowering health care premiums. To give small businesses what they need to stay open. To expand unemployment insurance, provide food and nutrition assistance. To help keep a roof over people’s heads. To cut child poverty in half.

This legislation is about giving the backbone of this nation – the essential workers, the working people who built this country, the people who keep this country going – a fighting chance.

I want to thank all the members who voted for it, especially Speaker Pelosi, the finest and most capable speaker in the history of our nation. Once again, she has led into law an historic piece of legislation that addresses a major crisis and lifts up millions of Americans.

On Friday, I look forward to signing the American Rescue Plan into law at the White House – a people’s law at the people’s house.

The bonus was almost as mysterious as her own original appointment to Fannie Mae as an outgoing Clinton official, given that Gorelick had no banking expertise whatsoever to help manage one of the nation’s most important lending institutions.

The researchers put it mildly by saying, “links they found between Republican governorship and greater COVID-19 impact, are consistent with the idea that the political polarization of the COVID-19 response has contributed to less effective COVID-19 policies and worse case-related statistics in some states.”

Putting that more bluntly, Republican governors—and the tone set by Donald Trump—are directly responsible for hundreds of thousands of deaths, and millions of Americans suffering long-term effects of COVID-19. Unlike those states hit by the disease in the opening weeks, they were not short of tests, they were not ignorant of social distancing rules, they were not unaware of what could happen if they ignored the advice of experts.

They just put their political careers ahead of human lives. By choice.

ATLANTA—Then-President Donald Trump urged the chief investigator of the Georgia Secretary of State’s office to look for fraud during an audit of mail-in ballots in a suburban Atlanta county, on a phone call he made to her in late December.

During the six-minute call, which was reviewed by The Wall Street Journal, Mr. Trump repeatedly said that he won Georgia. “Something bad happened,” he said.

“When the right answer comes out, you’ll be praised,” Mr. Trump told the chief investigator, Frances Watson.

She responded: “I can assure you that our team and the [Georgia Bureau of Investigation], that we are only interested in the truth and finding the information that is based on the facts.”

The Washington Post reported on the call in January, but this is the first time the recording has been released.

Fulton County District Attorney Fani Willis has launched a criminal investigation into alleged efforts to have officials in Georgia overturn the state’s results of November’s presidential election. In a February letter to officials, Ms. Willis said a grand jury would convene this month.

In early January, media outlets, including the Journal, published news of a recording of a telephone conversation between Mr. Trump and several supporters and Mr. Raffensperger and his staff. During that Jan. 2 call, Mr. Trump urged Mr. Raffensperger to “find” votes to change the election outcome. He berated Mr. Raffensperger for not doing more to overturn the election.

Representatives of the former president didn’t immediately respond to requests for comment.

As we all know, the two centerpieces of the $1.9 billion rescue bill are checks for everyone and bonus payments for those collecting unemployment benefits. However, the bill has lots of other things in it, all of them aimed at specific groups. For example:

People with kids ($120 billion in child tax credits)People using Obamacare ($34 billion in increased subsidies)Airline employees ($58 billion bailout means that furloughs were avoided)Food service workers ($25 billion in grants to restaurants)Organized labor ($86 billion bailout of failing union pension funds)Teachers ($130 billion to help schools reopen)Veterans ($20 billion for veterans' healthcare)

If your goal is to stimulate the economy, it doesn't matter all that much where the money goes. You just want to get money into the economy quickly. This leaves plenty of room to make sure that you spread the benefits around so that you have lots of grateful registered voters when the next election rolls around.

That's how this bill works. It accomplishes three things. First, it spends lots of money so that the economy will be humming when the 2022 elections are held. Second, it provides lots of money for programs specific to COVID-19 recovery. This will ensure that the pandemic is long past by next November. Third, it provides big, targeted benefits to specific groups who can be reminded of them during campaign season.

Will it work? Who knows. But its goal is very clearly to do well by doing good—and in this case, "well" means increasing the Democratic majority in the next Congress. From my perch it sure looks like it's primed to succeed.

It will get the working class back, like FDR When he authorized union rights.

He is the most pro union in decades.

The Senate confirmed attorney general nominee Merrick Garland Wednesday in a strong bi-partisan 70-30 vote, sending the federal appeals court judge to the Justice Department where he has pledged to shield the agency from politics and make the sprawling investigation into the deadly U.S. Capitol assault his “first priority.”

The margin of confirmation was the largest for an attorney general since Eric Holder, who secured 75 votes when he was confirmed as the nation's chief law enforcement officer in the Obama administration.
