Some day three analysis

Second, while being questioned by Prosecutor Eldridge, McMillian was asked how Floyd appeared to him while being restrained, with Chauvin’s knee on Floyd’s neck. I expect Eldridge was hoping for a reply along the lines of “he looked like he was being killed.”
Instead, what Eldridge got was McMillian stating that Floyd had foam running out of his mouth. A perhaps stunned Eldridge responded with, “Foam in his mouth?” and McMillian immediately affirmed, “Yes, foam in and out of his mouth.”
Foaming in the lungs, and by extension out the mouth, is, of course, a notable indication of pathological fentanyl overdose. This would obviously reinforce the likely defense narrative that Floyd was killed not by Chauvin’s knee but by the three-fold fatal dose of meth/fentanyl speedball drug cocktail he rapidly ingested to avoid its discovery by the police.
That was about all the substantive value contained in McMillians’ testimony on direct.

With a trial that will likely last as long as this one, you look for one or two tidbits per day that might stand out. The prosecution continued it's case by interviewing more of the people on the scene. Probably the two most notable was the clerk who assisted Floyd when he passed the counterfeit $20.00 bill and the elderly McMillian who told the court that he had stopped to "snoop" at what was going on.

The clerk suggested multiple times (and even ended his testimony) making a point of saying that Floyd was high. Not so high that he couldn't communicate that he wanted to buy cigarettes, but high enough that he it drove the cashier to eventually call the police. 

The older man broke down crying on the stand. Not sure that this helps either side, other than it makes him appear overly emotional. But as noted in the text I pasted, McMillian seemed to surprise the prosecutors by making a point of saying Floyd had foam coming in and out of his mouth. This is a point that will likely be hammered by the Defense when their time comes. Foaming of the mouth is a very strong indicator of drug overdoses, seizures, or rabies. Of the three, quite obviously the opioid overdose seems most likely given the evidence on hand. 

The other officers on the scene are also seen and heard on video referring to the fact Floyd was foaming, even before he was place in the knee to the neck restraint. So it's likely that Floyd's reaction to the three times the lethal dosage of Fentanyl was happening prior to any actions by Officer Chauvin.

Code’s case was one of six arrests as far back as 2015 that the Minnesota attorney general’s office sought to introduce, arguing that they showed how Chauvin was using excessive force when he restrained people by their necks or by kneeling on top of them — just as he did in arresting Floyd. Police records show that Chauvin was never formally reprimanded for any of these incidents, even though at least two of those arrested said they had filed formal complaints.

Of the six people arrested, two were Black, one was Latino and one was Native American. The race of two others was not included in the arrest reports that reporters examined.

Discussing the encounters publicly for the first time in interviews with The Marshall Project, three people who were arrested by Chauvin and a witness in a fourth incident described him as an unusually rough officer who was quick to use force and callous about their pain.

The interviews provide new insight into the history of a police officer whose handling of Floyd’s arrest, captured on video, was seen around the world and sparked months of protests in dozens of cities.

Chauvin, who was fired, has said through his attorney that his handling of Floyd’s arrest was a reasonable use of authorized force. But he was the subject of at least 22 complaints or internal investigations during his more than 19 years at the department, only one of which resulted in discipline. These new interviews show not only that he may have used excessive force in the past, but that he had used startlingly similar techniques.

The CEO of Delta Airlines is now calling Georgia’s new voting law “unacceptable”. This is a 360-degree reversal of a statement released last Friday by the company, headquartered in Atlanta. That was then, this is now.



There is no other way to look at a statement released today by Delta Airlines CEO Ed Bastian but to see it as a massive cave to angry Democrats looking to drive a wedge between Georgia voters. The bill, SB 202, was signed into law last Thursday. The next day, Bastian was taking credit for working with other Atlanta-based corporations to make sure that “some of the most egregious measures” were taken out of the bill before Governor Kemp signed it.

He said in a statement last Friday saying that it “improved considerably during the legislative process, and expands weekend voting, codifies Sunday voting and protects a voter’s ability to cast an absentee ballot without providing a reason.”

Today, just five days later, Bastian issued another statement and this one is noticeably different in its tone. Today he is expressing indignant outrage.

“We had some success in eliminating the most suppressive tactics that some had proposed,” Bastian said. “However, I need to make it crystal clear that the final bill is unacceptable and does not match Delta’s values.”

Bastian further said, “It’s evident that the bill includes provisions that will make it harder for many underrepresented voters, particularly Black voters, to exercise their constitutional right to elect their representatives.”

“I know this result in Georgia has caused frustration, anger and pain for many members of our Delta family,” Bastian wrote. “I commit to you that as we move forward, Delta will continue to do everything in our power to hear and protect your voice and your rights, both in Georgia and nationwide.”

Gosh, I wonder what could have happened. You know what happened – the angry mob became predictably outraged over the new legislation and had a hissy fit when the governor signed it. The worst part of this orchestrated outrage is that it is all based on lies. The way they represent the bill is divorced from reality. But the chief medical examiner’s report establishes that, however else Floyd died, it wasn’t from Chauvin’s knee. Oopsie! I guess it wasn’t absolutely essential that our country go through eight months of looting, riots and mostly peaceful arsons.

In lieu of citing some B.S. media “fact check,” I shall quote directly from the autopsy report by the Hennepin County Chief Medical Examiner, Andrew Baker:

“No life-threatening injuries identified —

“A. No facial, oral mucosal, or conjunctival petechiae

“B. No injuries of anterior muscles of neck or laryngeal structures

“C. No scalp soft tissue, skull, or brain injuries

“D. No chest wall soft tissue injuries, rib fractures (other than a single rib fracture from CPR), vertebral column injuries, or visceral injuries

“E. Incision and subcutaneous dissection of posterior and lateral neck, shoulders, back, flanks, and buttocks negative for occult trauma”

In short: No bloodshot eyes and no trauma to any part of Floyd’s neck.

And yet, day after day, prosecutors, witnesses and the media tell us that Chauvin “squeezed the life out of” Floyd. The medical evidence establishes that whatever else caused his death, it was NOT asphyxiation.

That’s the entire case against Officer Chauvin! But the howling mob isn’t giving up its holy religious observance because of one dork in a lab coat. The sun might not rise! The city of Minneapolis could be wiped out! Wait — that might actually happen.

The medical examiner also found that Floyd had enough fentanyl in his system — I don’t want to say “to kill a horse,” because that would be a cliche. But it would be enough to bump off an entire team of Budweiser Clydesdales. In technical medical jargon:

“A. Blood drug and novel psychoactive substances screens:

“1. Fentanyl 11 ng/mL”

That’s just the first few words of the “Toxicology” section. Also listed are norfentanyl, 4-ANPP, methamphetamine, cannabinoids, amphetamines, morphine and so on.

Altogether, the videos from within Cup Foods and officers’ body cameras provided a fuller picture of Mr. Floyd in his final hours. In the store, he chatted and laughed with other customers. After he bought cigarettes — with what the cashier thought was a fake $20 bill — he left without incident.

The prosecution has so far focused on the shared suffering of witnesses, reinforced by graphic videos from many angles. During the testimony of the store clerk who accepted Mr. Floyd’s $20 bill, one of the jurors fell ill. The proceedings were halted for 20 minutes, with the judge calling her illness a “stress-related reaction.”

The juror, a white woman in her 50s, said of Mr. Floyd during the jury selection, “He didn’t deserve to die.”

Calling George Floyd a "good black man" is either a horrible April Fools day joke, or a pretty damned low bar for being a "good black man".

If this guy and his rap sheet makes in a "good black man" I wonder what it takes to be a "bad black man".


This is simple. George Floyd cooperates and he possibly gets medical treatment in time to save his life from his drug overdose. Possibly, although based on medical opinions I have seen, that amount of Fentanyl might still kill him even if he had gotten treatment.

As for the trial itself, read Power Line’s Scott Johnson and National Review’s Andrew C. McCarthy for expert analysis. They are following it most closely and are capturing the nuances and flow of the trial as it progresses. Scott appears very skeptical of the defense’s strategy and tactics thus far, and raises important questions about its lack of robust cross-examination of the first few witnesses. Red-line the ghettos, patrol the perimeters and respond to NO calls from within.

These folks have requested, insisted, and demanded no police, so I think we should respect their wishes.

Will innocents get hurt or die? Sure. But they need to understand that's the price they get to pay to rid themselves of their precious "systemic racism" and oppressive policing.
