A new subject! Packing the Supreme Court!

By now everyone has heard that Democrats are putting into place a possible bill to add four Supreme Court Justices

The first thing to consider is that it is unlikely that the Democrats will have the votes necessary to pass this sort of legislation. They are down to a two vote margin of error in the House and a no vote margin of error in the Senate. Moreover, that would be assuming that they can somehow get around the filibuster in the Senate that is sure to take place. Democrats will only be allowed to go to the reconciliation bucket so many time before they wear out that welcome. Oh, and there is no chance that this can be considered purely a budgetary issue, so the use of reconciliation would be preposterous. So by all reasonable standards, before they do this, the filibuster would have to be eliminated. No real chance of that happening.

Secondly, the idea of court packing is wildly unpopular with the American public and just talking about it will probably motivate Republicans to come out in force in the 2022 midterms. Moreover, this would just lead to one-upmanship and eventually we would have a USSC that is larger than some of the Circuit courts. Even Democrats and liberals are speaking out against this. Harry Reid (who should know) is openly and publicly warning Democrats not to go there.

The reality is that there is nothing wrong with the Supreme Court. It does not need to be fixed. It's exactly the same as it has always been. Just that for the first time since anyone can remember there is a solid conservative majority. While there have been previous courts with a solid liberal majorities, the best the conservatives have had was a Kennedy or Robert "swing vote" that tilted in their favor more often than not.

But I think the main thing we need to consider here is the motivation for this move. Why are Democrats so desperate to pack the courts? The main issue here is the fact that they know that many of the policies on their wish list quite literally run afoul from the Constitution. While ultimately we know that the Democrats would love to simply dismantle the Constitution (especially those first two amendments - so pesky) they cannot realistically do that. There is no support to amend the Constitution.  But if they could get back to having a majority of Justices willing to ignore the constitution in favor of political partisanship, it works basically the same. They already have a slew of District and circuit court Justices willing to dismantle free speech, a right to bear arms, equal protection, etc. All they need is for those crazy rulings to hold up under appeal, and they can get around that pesky Constitution all together.

The last election did not resolve the legitimation crisis. Apart from removing Trump, it resolved almost nothing.

Take the key question of whether one of our major political parties is prepared to accept the legitimacy of elections it loses. This is not a minor problem in a democracy. It is arguably the most critical foundation of all. And since the election, the GOP has deepened its attachment to the Big Lie of 2020, and doubled down on it. No serious figure with any hope for the future in the GOP — let alone a critical mass — has directly challenged the notion that the 2020 election was rigged and stolen.

And this is more than posturing, or sour grapes, as sometimes happens. We know this because the sole focus of the GOP since last November has been voter fraud. State after state has been tightening restrictions to trim the electorate. Not all of this is malign — as you can see in the Georgia case, which is more complex and less outrageous than the MSM/Democrats want you to believe. But it would be terribly naive not to see this as a clear attempt to minimize the clout of minority voters, whom the GOP (despite the trend of 2020) assumes will always vote Democrat. Meanwhile, the cult of Trump remains — and no one rivals him.

Biden's approval used to be almost 56 on average and he has had multiple polls in the 60's. I suspect that once Slow joe falls under 50%, he will be there to stay. Once he has to actually "do something" other than hide to "recover" from falling polling... I suspect that is when the fun will begin.

Can't help it if liberals were so upset with Trump that they hated him right off the bat. Most people give Presidents a short honeymoon period. But hate (as you well know) is a very very strong emotion.

A significant majority of Americans - 59 percent - approve of President Biden's handling of his job as he approaches 100 days in office, according to a Pew Research Center poll released Friday.

The poll found Biden's job approval is up 5 percentage points from 54 percent in March, while 39 percent of those surveyed said they disapprove of his work thus far.

Biden's 59 percent approval rating is 20 percentage points higher than that of former President Trump's in a Pew poll from April 2017 and is similar to the approval ratings of former Presidents Obama and George W. Bush in April of their first terms.

Biden has been buoyed by support for his tone and rhetoric, as well as his handling of the coronavirus pandemic.

The Pew poll found 72 percent of Americans believe the Biden administration has done an excellent or good job managing vaccine production and distribution.

I guess this is in opposition to the last administration appointments whose only job qualifications seemed to be being pathological liars with fraud charges, convictions, and or allegations against them?

Psaki did the thing one does when someone says something outrageous to you in the form of a question: asking that person to re-say what they said again and think about it. “Is POTUS going to remove an African American woman with decades of experience in the foreign service who's widely respected around the world from her position as ambassador to the UN? He's not. He is proud to have her in that position. She is qualified. She is exactly the right person in that role at this moment in time." Adding, “I have not seen her comments, I will say that there is no question that there has been a history of institutional racism in this country, and that doesn’t require the UN Ambassador to confirm.”

The angle the reporter was trying to parrot is the one the right-wing propaganda sphere has latched onto because they lack any and all policy ideas, and the last time they ran a government they blew out the deficit, gave away unpopular tax cuts to the rich, and we ended up living through a pandemic. To contextualize reporter Emerald Robinson’s 75 IQ, this is what she tweeted out about eight minutes before the White House briefing began: “We are witnessing the Democrat Party's merging of the federal administrative state (which it largely controls) with its crony capitalist corporations and its media allies together into a kind of proto-state apparatus.” Proto-state apparatus?

Now if that isn’t the pot calling the kettle a Republican Party.

Unlike all other Presidents since polling began with Eisenhower, Trump NEVER got ANY honeymoon. He was well below 50% starting out and never, never, never, not even ONCE got to or above 50% on the RealClearPolitics aggregate polls.

GENEVA (Reuters) -The number of new COVID-19 cases per week has nearly doubled globally over the past two months, approaching the highest rate seen so far during the pandemic, the head of the World Health Organization (WHO) said on Friday.

"Cases and deaths are continuing to increase at worrying rates," Tedros Adhanom Ghebreyesus said in a briefing focused on Papua New Guinea (PNG) and the western Pacific region.

He said he was very worried about the potential for a much larger epidemic in PNG, and it was vital the country received more COVID-19 vaccines as soon as possible.

PNG has now reported more than 9,300 COVID-19 cases and 82 deaths. "While these numbers are still smaller than other countries, the increase is sharp and WHO is very concerned about the potential for a much larger epidemic," Tedros said.

PNG health minister Jelta Wong said there was on ongoing challenge in the country to get people wearing masks and disbelief about the disease itself, which would complicate efforts to role out vaccines.

WHO officials said three emergency medical teams had arrived in PNG this week from Australia, the United States and Germany.

"The situation is extremely challenging right now," Takeshi Kasai, WHO regional director for the western Pacific, said of PNG.

Have you had COVID? Think you’re immune from it in the future? Think again, according to the results of a new study of Marine Corps recruits.

Ten percent of the recruits whose blood tested positive for COVID-19 antibodies before training were re-infected with COVID while in basic training at Marine Corps Recruit Depot Parris Island, South Carolina.

The findings make a strong argument for healthy young Americans to get vaccinated, according to researchers.

“For our particular population, this is very strong data about why individuals previously infected, regardless of whether they had symptoms or not, should get the vaccine in accordance with DoD policy,” said Navy Cmdr. Andrew Letizia, deputy director of the infectious disease directorate at the Naval Medical Research Center. The doctor is one of the researchers and authors of the study, published in the Lancet Respiratory Medicine Journal Thursday.

Antibodies are proteins made by the immune system to fight infections; it’s uncertain whether young adults who get COVID are at risk of getting it again. NMRC conducted the study along with the Icahn School of Medicine at Mount Sinai to examine how effective antibodies are in preventing future COVID infections.

Recruits with these COVID-19 antibodies had about one-fifth the risk of getting COVID again, compared with those who didn’t have antibodies. While antibodies from previous COVID-19 infection do provide some protection to young adults, it’s no guarantee, the authors stated.

This is the largest study of COVID-19 looking over the long-term, where researchers have followed active-duty members before they got infected, Letizia said. They used data from blood samples and nasal swabs collected from the recruits when they arrived at Parris Island, and over six weeks of observation after they left their two weeks of restriction of movement.

The findings have implications for readiness, Letizia said. “Young, healthy Americans, regardless of whether they’ve been previously infected or not, should pursue getting a vaccine. That’s going to be the best thing they can do when it comes to long-term medical readiness for themselves and for their units.

“That’s the key crux of all of this when it comes to readiness.”


During the study, which was conducted between May and November, 10 percent of the 189 recruits who had COVID-19 antibodies were re-infected. And 48 percent — 1,079 — of the 2,247 Marine recruits in the study who had not been previously infected with COVID-19 got COVID while they were in basic training.

Those who got COVID “had universally good outcomes,” Letizia said, and the majority didn’t even know they were infected, or re-infected, until they were told about the test results.

“The Marines were certainly doing a fantastic job of observing these public health mitigation strategies,” Letizia said. But the high infection rate of 48 percent “shows us how incredibly infectious this virus can be in this particular setting,” he said. Researchers noted that COVID infections might have been introduced by permanent staff members who interacted with the recruits.

“It’s a very unique environment, but certainly shows the potential of how infectious SARS-CoV-2 can be,” Letizia said.

“This is not an aspect of our study that’s very generalizable to the civilian population at all, because basic training is a very different setting than our normal day-to-day lives,” Letizia said, noting that he suspects that there are lot of other young healthy Americans who have gotten infected and don’t know it.

Study of Marine recruits finds fever, symptom screening misses many coronavirus cases
A study of Marine recruits found that despite these measures and strict quarantines before they started training, the recruits spread the virus to others even though hardly any of them had symptoms.

Before they proceeded to basic training, every recruit in this portion of the study had three negative COVID tests, Letizia said. “We can very confidently say that any infections the recruits got during the six weeks of intense observation were in basic training, as opposed to ROM, and was due to a new infection and not a residual infection.”

Researchers looked at the level of antibodies, and how well the antibodies could neutralize the virus and protect the body. In the Marine recruits who had COVID antibodies but were re-infected, researchers found there were lower levels of those neutralizing antibodies, Letizia said.

Marine recruits were given the opportunity to volunteer for the study, which is part of ongoing research beginning in May 2020 with the Navy and Marine Corps working to make sure military training could safely continue during the pandemic. The next phase of the research is following up with the newly minted Marines at their current duty locations around the world, to look at the duration and effectiveness of the immune response, whether it’s from the natural immunity or by way of the vaccination. They’re also looking at long-term medical effects of those in this young, healthy population who have been infected by COVID-19, Letizia said.

It is not fear. It is being caring. States that opened up too quickly or that have citizens who flaunt not wearing masks are having the greater problems.

I wear a mask to be a good example and because here in Illinois all grocery stores and most businesses and restaurants etc. require you to wear one to enter.

I performed a graveside funeral today for a man who died at 69 from cancer (nothing to do with Covid) and almost everyone was wearing masks.

Afterward, many of us went to a restaurant where masks were required, where the waiters and waitresses wore masks, though of course everyone removed them to eat.

These people are not sheep.
They are good, caring, decent neighbors.

Meanwhile, defense attorney Eric Nelson will try to persuade jurors that elements of testimony he elicited from prosecution witnesses and his own witnesses add up to reasonable doubt over what caused Floyd’s death, whether Chauvin is responsible, or whether Floyd deserves a substantial amount of the blame.

“If I was Nelson, I’d do a lot of things, because a lot of things need to be done,” Joe Friedberg, a local defense attorney not involved in the case, said. “He’s in desperate trouble here.”

The Prosecution will have an African American lawyer give the closing arguments. That will have an effect on the jurors.

The police killing of Adam Toledo in Chicago is unquestionably a tragedy. But was it unjustified? That's a lot harder to say. It all started when police heard gunfire and gave chase. One of the cops went after Toledo, who is shown here at the end of the pursuit as the officer is yelling at him to "drop it":

There appears to be a gun in his right hand. Now here's a still from the moment the police officer fires, eight-tenths of a second later:

Toledo's hands are empty. He has tossed his gun behind him, where the officer can't see it.

Is eight-tenths of a second, on a dark night with a shaky light, enough time for a trained police officer to realize that the gun he saw a moment earlier—which he didn't see being tossed away—is no longer there? I don't know.

I just don't know. But that's the question before us.

But in hundreds of counties around the country, vaccination rates are low, with some even languishing in the teens.

The disparity in vaccination rates has so far mainly broken down along political lines. The New York Times examined survey and vaccine administration data for nearly every U.S. county and found that both willingness to receive a vaccine and actual vaccination rates to date were lower, on average, in counties where a majority of residents voted to re-elect former President Donald J. Trump in 2020. The phenomenon has left some places with a shortage of supply and others with a glut.

The U.S. intelligence community has developed new information about Konstantin Kilimnik, whom they call a Russian spy, that leads them to believe the associate of ex-Trump campaign chair Paul Manafort passed internal Trump campaign polling and strategy information to Russian intelligence services, two U.S. officials say.

On Thursday the U.S. Treasury sanctioned Kilimnik and for the first time said he passed along the data to Russian intelligence services.

That new detail, part of a factsheet released by Treasury, was not included in the 2019 report by special counsel Robert Mueller, who was tasked with investigating Russian interference in the 2016 presidential election.

The team said in its report that Kilimnik was believed to “have ties to Russian intelligence,” and that Kilimnik had received the Trump campaign information from Manafort, but did not say what he did with it after receiving it.

A bipartisan report by the Senate Intelligence Committee in 2020 said coordination between the Trump campaign and a Russian operation to hack and leak Democratic emails may have existed through Kilimnik but could not be established with certainty. The report drew no conclusions about what the Russians ultimately did with the data.

The officials did not disclose when or how the U.S. came into possession of the new intelligence about Kilimnik, including whether or not the information was developed during the Trump or Biden administrations. The officials did not identify the source or type of intelligence that had been developed.

A spokesperson for the U.S. Treasury declined to comment.

In 2019, Mueller’s team authored a report that detailed the connection between Kilimnik and his former employer in Ukraine, Paul Manafort. Manafort was the Trump campaign chairman from the spring of 2016 until August 2016, when multiple press reports about his work in Ukraine and money he received there led to him stepping down. Manafort was working for the Trump campaign without pay.

Manafort was indicted by Mueller’s team and pleaded guilty in federal court to obstruction of justice and conspiracy. A judge found he had broken his plea agreement by lying to investigators on several issues, including his contacts with Kilimnik. He was convicted of additional charges in a separate case. He later received a presidential pardon from Trump.

According to Mueller, Manafort met with Kilimnik in New York on Aug. 2, 2016 and “months before that meeting, Manafort had caused internal polling data to be shared with Kilimnik, and the sharing continued for some period of time after their August meeting.”

What is dark money?

Dark money is election-related spending where the source is secret. Citizens United contributed to a major jump in this type of spending, which often comes from nonprofits that are not required to disclose their donors.

In its decision, the Supreme Court reasoned that unlimited spending by wealthy donors and corporations would not distort the political process, because the public would be able to see who was paying for ads and “give proper weight to different speakers and messages.” But in reality, the voters often cannot know who is actually behind campaign spending.

That’s because leading up to Citizens United, transparency in U.S. elections had started to erode, thanks to a disclosure loophole opened by the Supreme Court’s 2007 ruling in FEC v. Wisconsin Right to Life, along with inaction by the IRS and controversial rulemaking by the FEC.

Citizens United allowed big political spenders to exploit the growing lack of transparency in political spending. This has contributed to a surge in secret spending from outside groups in federal elections. Dark money expenditures increased from less than $5 million in 2006 to more than $300 million in the 2012 election cycle and more than $174 million in the 2014 midterms. In the top 10 most competitive 2014 Senate races, more than 71 percent of the outside spending on the winning candidates was dark money. These numbers actually underestimate the impact of dark money on recent elections, because they do not include super PAC spending that may have originated with dark money sources, or spending that happens outside the “electioneering communications window” 30 days before a primary or 60 days before a general election.

Finally, because they can hide the identities of their donors, dark money groups also provide a way for foreign countries to hide their activity from U.S. voters and law enforcement agencies. This increases the vulnerability of U.S. elections to international interference.
