Here is a murky philosophical question...

Doctors make mistake, sometimes horrible mistakes, and sometimes people die because of those mistakes. A doctor might break protocol, might not follow guidelines, or may even do things that are borderline unethical, and end up losing a life in the process.  In those cases, the hospital is generally sued, the doctor is many times fired, and may even lose their medical license because of their negligence. 

Yet, we don't charge doctors for murder and put them on trial for their lives. 

At least we do not, unless it can be proven that they intended for that patient to die.

But under similar circumstances, we seem to want to put police officers on trial. 

Whether or not they intended someone to die seems irrelevant. Why is that?


While I think can all agree that when excessive force is used with the intent to hurt someone, that a police officer should be held to the same standards as anyone else who has that same intent to hurt someone. After all, being a cop does not give you the license to go around beating people up.

But if the police officer is at the very least following some semblance of protocol, not going out of his or her way to actually hurt someone, why do we believe that they should be held criminally liable for things that happen to suspects that they are dealing with? 

Because it's not just Chauvin. It's the criminalization of police work in general. 

Let's be clear at this point. There is no real argument anymore that Officer Chauvin placed his knee across the neck of Floyd with any intent to choke him. The prosecutions own witnesses have already established that he didn't. Even if you believe the one doctor who claimed that the pressure from the prone position somehow blocked the hypopharynx (which is dubious and discounted by Baker), there is no way you can prove that Chauvin intended to do so. I doubt the guy has ever heard of the hypopharynx. Moreover, the prone position is something Officers are trained to do. Even if it was misused (and that is still an unresolved question), misuse of a trained procedure, absent any proof of malice, is a mistake, not murder.

But now hearing the prosecution argue about whether or not Chauvin was responsible for CPR is pushing the envelope to crazy limits. It's one thing to train a police officer, a fire fighter, or even a life guard CPR, it's quite another to charge them with murder if they failed to recognize that they needed to administer it and someone died. Why would anyone learn CPR if we started holding them criminally liable if they somehow failed to recognize and administer that CPR? 

Where we seem to be right now in this trial is an argument, not about intent, but about following protocol. They are arguing about whether or not the lowest level of force can be seen to be "excessive", and now apparently whether Chauvin could have done more to save Floyd from dying. But that's no different than reviewing a patient who died in the Hospital. Did the doctors follow protocol, did they do anything out of the ordinary, could they have done more to save that life. Only difference is that those questions are never argued in front of a jury while looking at murder charges. Nor should they or nobody would ever become a doctor.

More bodycam footage of Chauvin and Floyd shown to court

Policing consultant Barry Brodd is shown another section of the police bodycam footage during George Floyd's restraint on 25 May 2020.

Mr Floyd is heard saying "I can't breathe" and gasping for air in one clip.

Another clip shows Derek Chauvin's appearing to put pressure on Mr Floyd's neck.

Mr Brodd says it is "possible" that more pressure was put on Mr Floyd's neck at this time. 

He says he saw Chauvin reach out to his squad car to regain balance, or "respond to Mr Floyd's moves" during the restraining period. 

He says he does not know if the pressure was increased on Mr Floyd's neck. 

Mr Brodd agrees he heard Mr Floyd saying he could not breathe in the clip around six times - and also agrees the situation could have lead to asphyxia. 

He acknowledges Mr Floyd was "struggling" at the time of his restraint. 

Mr Brodd agrees drug influence could be a factor in positional asphyxia.

Use of control that can produce pain is not justified

Prosecutor Steve Schleicher discusses "situational awareness" with policing consultant Barry Brodd - a former police officer who taught defensive tactics to other officers in a training academy. 

Mr Brodd agrees that a "reasonable officer" should take into consideration the suspect's condition such as their pulse and breathing when they are in custody. 

He tells the court that police officers can respond to violent suspects with a Taser or a "potential deadly force". 

He does not agree with prosecutor Mr Schleicher's statement that someone who is being compliant cannot have any force at all.

But he agrees that if someone is not resisting, and they are compliant, the use of control that can produce pain is not justified.

Mr Brodd says he did notice differences in how Mr Floyd was acting when he was under the control of officers for over nine minutes. But he says he was "actively resisting" for a "couple of minutes".

The court then shows a clip of George Floyd being thrown to the ground in handcuffs by officers - pictured below.

Mr Brodd says Chauvin's knee is on Mr Floyd's "shoulder blade area" or "upper back", and confirms Mr Floyd did not get up after he was restrained.

VILLA RICA, Ga. – Three Georgia police officers were shot and wounded as they pursued two cousins from Alabama in a high-speed chase that ended early Monday with one cousin shot and killed and the other in custody, authorities said.

A Georgia State Patrol trooper clocked a Nissan Sentra going 111 mph (179 kph) on Interstate 20 and initiated a traffic stop around 3:30 a.m., Georgia State Patrol Capt. Brandon Dawson said. The driver initially stopped but took off again as the trooper approached the back of the car.

The trooper pursued the car and bumped it to try to stop it but the driver of the car regained control, Dawson said. When the trooper tried to bump the Sentra again, a passenger used a rifle to fire at the patrol car and hit it, taking it out of action, according to a Georgia Bureau of Investigation news release.

The driver of the Sentra continued to flee, going through the city of Carrollton, where local police officers joined the chase. At some point, a passenger leaned out and fired a shot into a police vehicle, hitting Carrollton Police Sgt. Rob Holloway, Carrollton Police Chief Joel Richards said. The officer lost control of his vehicle and hit a utility pole. Other officers stopped to help him.
