- That the actions of Officer Chauvin was what provided the substantial contribution to the death of George Floyd
- That Officer Chauvin had a reasonable understanding that his actions could lead to the death of George Floyd.
If a juror has a reasonable doubt that George Floyd died of positional asphyxia and instead believes that it was an arrest of the heart from underlying health conditions, the drugs in his system, or even a combination of both, then that should be enough for reasonable doubt. The fact that Chauvin may have contributed in some way is not enough under the law to say he committed murder or manslaughter.
Likewise if a juror has a reasonable doubt that Officer Chauvin understood that the prone position restraint would likely cause enough physical harm to actually kill someone, then even if that juror believes that Floyd did die of asphyxia that would also be enough to provide reasonable doubt.
There are a few key factors from a logical objective standpoint to consider when making a determination. For the first point. Cause of death.
- George Floyd did not officially die of asphyxia. His death certificate states cardiopulmonary arrest, based on a combination of factors (none of which were proportioned within the official autopsy). The official medical examiner (the only objective doctor testifying) rejected the notion (under oath) that Floyd was asphyxiated.
- George Floyd underlying artery blockage is considered coronary artery disease. This is generally labeled under the broader category of coronary heart disease. Coronary heart disease is listed on over 300,000 death certificates a year.
- George Floyd had enough Fentanyl in his system to justify overdose as a cause of death. Doctor Baker, Doctor Thomas, and Doctor Fowler all testified under oath that if the examination of George Floyd focused just on what they found in the autopsy and toxicology reports, that they would have labeled this an overdose. Opioid overdoses account for the cause of death on 80,000 death certificates a year.
- There is almost no documented cases of positional asphyxia in healthy adults. It's been reported that about 100 people official died from a restraint asphyxia over the past decade and only 5 of those cases involved someone who was not obese, had not been tasered in a police stop, or did not have drugs in their system. Five people out of the thousands of suspects that have been placed in a prone position without issue over the past ten years or so.
So would it be "reasonable" to believe that the official autopsy and official cause of death was correct and that the coronary artery disease, the 11 ng/ml of Fentanyl, or a combination of both was the underlying reason that Floyd died. Would it be "unreasonable" to suggest that causes responsible for 400,000 deaths per year might be a better explanation than restraint or positional asphyxia which has only killed five healthy people in ten years?
For the second point. Intent.
- There was no real motive provided for why Chauvin would have had intent to harm Floyd. While there was much quibbling over excessive force, excessive police force cases are generally a civil, rather than a criminal issue. It becomes a murky grounds to argue that intent to commit third degree assault can just be assumed from contested excessive force.
- The criticism regarding turning to the side was made quite clear by many trainers and people who held that particular opinion. The prosecution failed, however, to prove that Chauvin had ever attended a class or had training where this technique was taught. The defense, however, provided a police trainer who suggested that while this was now part of new cadet training, that it was unlikely that veteran cops would have been exposed to it.
Bottom line is that you do not have to like Officer Chauvin or even think he is without fault here. But this is neither a popularity contest or an internal personnel disciplinary investigation to determine if Officer Chauvin followed his job description. The state could have handled this in any number of ways, but they choose to charge Chauvin with murder and manslaughter. They sought out to prove beyond a reasonable doubt that the official cause of death was incorrect and instead it was murder by assault or manslaughter with grave indifference. They have to prove "murder" or "manslaughter" to warrant a conviction. They cannot just prove that Chauvin is an unlikable and arrogant cop who might have missed some steps in the official training reference manual.

Well from what I can find... if Derek Chauvin is convicted, it will be only the second time where police were convicted (or even charged) for a death that did not include a police shooting.
The only other time included 14 shots with a taser along with pepper spray and other possible physical assault.
Obviously when a police pulls out a gun and shoots there is always a known chance that someone can die. Pepper spray and 14 taser shots is excessive in anyone's books.
This will be the first time that a police officer will be found guilty of killing someone using a trained restraint.

When I was younger, the news came from the television networks, only two or three networks. Now websites such as ultra right wing news, not objective. The same thing happens on the left side, but, they don't have nearly as many viewers.
And again, most people are more emotional than objective on politics and religions than objective.

Effective border management starts well beyond the border, so we must work with our neighbors to help them build freedom and opportunity so their citizens can thrive at home. We cannot rely on enforcement alone to prevent the untenable and so often heartbreaking scenes that come with large-scale migration.
We also need a modernized asylum system that provides humanitarian support and appropriate legal channels for refugees to pursue their cases in a timely manner. The rules for asylum should be reformed by Congress to guard against unmerited entry and reserve that vital status for its intended recipients.
Increased legal immigration, focused on employment and skills, is also a choice that both parties should be able to get behind. The United States is better off when talented people bring their ideas and aspirations here. We could also improve our temporary entry program, so that seasonal and other short-term jobs can more readily be filled by guest workers who help our economy, support their families and then return home.

As for the millions of undocumented men and women currently living in the United States, a grant of amnesty would be fundamentally unfair to those who came legally or are still waiting their turn to become citizens. But undocumented immigrants should be brought out of the shadows through a gradual process in which legal residency and citizenship must be earned, as for anyone else applying for the privilege. Requirements should include proof of work history, payment of a fine and back taxes, English proficiency and knowledge of U.S. history and civics, and a clean background check. We should never forget that the desire to live in the United States — a worldwide and as powerful an aspiration as ever — is an affirmation of our country and what we stand for. Over the years, our instincts have always tended toward fairness and generosity. The reward has been generations of grateful, hard-working, self-reliant, patriotic Americans who came here by choice.

Instead, a DuckDuckGo search reveals it was picked up by ZERO mainstream media outlets and Big Tech tyrants will suspend people who post it, as political strategist Steve Cortes learned the hard way when he posted a Tweet that went against the face mask narrative. Of course, this is precisely the view of “justice” that led to the infamous lynching of Emmitt Till in 1955 Mississippi, a black 14-year-old, for the purported crime of offending a white woman in a grocery store.
And this is precisely the mob justice that the militant factions of Black Lives Matter and Antifa want to bring to 2021 America.
Give us guilty, on all counts, even on counts not actually being argued in this trial, or we burn it all down generally, and target defense witnesses and, by implication, the trial jurors specifically.

Frankly, at this point it’s absolutely apparent that Derek Chauvin can receive nothing like a fair trial in this case. When I write that, by the way, I’m defining “fair trial” as one involving a process we’d want for ourselves or a loved one, or even a friend or neighbor.
No one would want to be on trial, or have anyone they cared about on trial, in a courthouse surrounded by a violent, raging mob, being exhorted to further violence by government officials, with militant factions of political groups terrorizing the witness for the defense, and by extension the jury itself.
Yet that is what’s been offered to Derek Chauvin as “justice.”
Regardless of what anyone may think of Derek Chauvin, it is absolute truth that the criminal due process we offer to the worst of us is precisely what any of the rest of us should expect to also receive should we find ourselves having to account in a criminal court. And not one bit more.
If you would not want to be tried under these circumstances, then you ought not want anyone tried under these circumstances, including Derek Chauvin, or worse.
One reason that Judge Cahill has denied every defense motion for a continuance or a change of venue in this case has been, in effect, what could would it do? How long would you delay? Where would you go? This chaos, in effect, will follow this defendant everywhere, so he’s no more likely to get a fair trial elsewhere in Minnesota than he is here.
I think Judge Cahill is right about that—but I think his reasoning has led him to the wrong conclusion.
If it cannot be expected that Chauvin can get any fairer a trial elsewhere in Minnesota than he can in the rage-mob surrounded Hennepin County Courthouse, the solution consistent with the “justice” any of us would want for ourselves or anyone we care about is not to compel him to endure an unfair trial where he is.
Rather, the solution consistent with “justice” is to dismiss these charges, with prejudice.
And if the rationale for not doing so is anticipated rioting, looting, and arson—and I expect that will be the rationale—then all we’re doing is admitting that we’ve already handed over “justice” in America to the mob, and adopted the “Emmett Till lynching model” of “justice” for anyone targeted by the mob.
If that’s the case, enjoy the ride.

The study found that none of the 445 individuals was infected with SARS-CoV-2 confirmed by real-time reverse transcription polymerase [27].
