It would be one thing if there was "overwhelming support" for a Jan 6th commisssion

Poll: Americans split on Jan. 6 commission - 52-48
Voters are split on whether Congress should launch its own investigation into the Jan. 6 riot at the U.S. Capitol, according to a new Harvard CAPS/Harris poll released exclusively to The Hill.
The current divide among voters over whether a congressional investigation is needed to get to the bottom of the attack largely falls along party lines. Sixty-nine percent of Democrats say they support such a commission compared with 38 percent of Republicans.
Conversely, 62 percent of Republicans believe that the FBI and Justice Department investigations are sufficient, a view shared by only 31 percent of Democrats. Independent voters, meanwhile, were split 50-50 on the matter.
"The commission is simply seen as a partisan political football as the country is simply split on partisan lines in their view of the commission," said Mark Penn, director of the Harvard CAPS/Harris poll.

The reality is that this separate political commission to politically investigate and politically draw conclusions so that a political report can be written for political reasons is only supported by people of one political affiliation.

Of course the political people supporting this political investigation are not interested in the answers that they have been given in the criminal complaints. The professional investigators are actually tied to the law and can provide legal answers.  The political people supporting this political investigation want answers that satisfy them politically. 

Democrats and liberals want to demand that the 400 or so people out of 30,000 at the rally were a violent threat to the sanctity of our democracy and they want to demand without any evidence what-so-ever that this was some sort of coup. The problem is that the charges against the bulk of these 400 people are akin to misdemeanor trespassing charges and under normal legal circumstances the majority of these might not even stick. 

A real investigation by the FBI and others within law enforcement has already disproven much of the rhetoric.
  • A cop was not murdered
  • This was not an armed attack on the capital (only three gun charges were filed. None of them were in the building)
  • There was no coordinated conspiracy to be found
The reality is that this was a rally that was 98.6% peaceful (as in 98.6% of those at the Trump rally were not involved trespassing in the Capital building or charged with any crimes).  It's not a "mostly peaceful" situation where the claim is made because some people where "mostly peaceful" but then were violent for a short period of time. This was a situation where 98.6% of those in attendance did nothing violent, and the 1.4% who were less than peaceful were largely only trespassing. 

The problem is that any actual real investigation (like the one that the FBI is engaged in) has no choice but to reach these conclusions. Try as they may to charge people with multiple misdemeanors and even charging them with picketing on Federal grounds (as if that is the crime we need prosecuted), they can still only charge the people they can charge and only charge them for what they did which was mostly walk into the Capital building (in many cases being let in by Capital police) and then walking back out when told to. 

The politically motivated "commission" that the political people want is something with the preconceived and predetermined belief that this was a violent coup somehow directed and incited by Donald Trump. Of course, if there was evidence of Donald Trump directing or inciting the violence, then the FBI would have already arrested him. 

But a politically motivated "commission" would not be bound by the law, facts, rights of the accused or anything else. They would be free to come to the foregone conclusions that the politically partisan people are convinced need to be expressed in some sort of "official capacity". Because as time moves on, they are losing the argument about how Jan 6th was the second coming of Sept 11th.

*considerable damage (vandalism) was done to the building and objects in the building in addition to the damage incurred by breaking and entering,
*people ran through the building shouting "stop the voting," an act of sedition,
*Mitch McConnell himself described it as a "failed insurrection,"
*people ran through the chambers shouting "Hang Mike Pence!"
*while others shouted "Where's Nancy Pelosi" (a few of whom have said they would have killed her if they could have found her)

Yesterday’s violent storming of the Capitol building raises questions about President Trump’s fitness to see out the remaining two weeks of his term;
about whether large parts of the Republican Party remain committed to even basic norms of democratic government;
and about how the country should move on from this brazen attack on the peaceful transition of power.

But it also raises a host of criminal law enforcement issues.

Hundreds of people participated in what Senate Majority Leader Mitch McConnell condemned as a “failed insurrection[.]” And, as Bobby Chesney described on the National Security Law Podcast, the events included a “cartoonish avalanche of crimes.” For reasons that remain unclear, relatively few people were actually arrested yesterday, but the FBI has begun trying to figure out the identities of those who stormed the Capitol. And a growing number of U.S. attorneys have written on Twitter that “Federal crimes were committed today at our Nation’s Capitol building,” and that rioters who traveled to D.C. would be prosecuted by U.S. attorneys in their home districts.

The extensive video evidence and crowds of people involved in yesterday’s mayhem give rise to a plethora of potential criminal charges against a large number of criminal suspects. Here, we spell out some of the potential federal criminal statutes that could apply to yesterday’s conduct. It's not intended to be an all-encompassing list and will likely grow as more reporting emerges about what exactly happened on Capitol Hill. Nor do we directly address President Trump’s potential legal exposure, a subject that raises complicated questions of presidential liability to criminal prosecution.

Criminal law is highly fact-specific, and there are still many unanswered questions about what precisely occurred yesterday in any given incident and who had what level of involvement in planning or executing the acts that made up the mob violence. But here is a rough list of plausible factual predicates for any follow-on prosecution under federal law:

*Hundreds of individuals, some armed, forcibly intruded into the Capitol in order to stop the certification of Electoral College votes. They managed to achieve this goal at least temporarily.
*The counting of electoral votes in both chambers, in fact, stopped from around 2:15 p.m. until about 8 p.m., when law enforcement retook control of the facility.
*The intrusion resulted in violence threatened or committed
against Capitol security,
against members of Congress and the Senate,
and against congressional staff.
One of the rioters was shot and subsequently died. Capitol Police described the incident: “As protestors were forcing their way toward the House Chamber ... a sworn USCP employee discharged their service weapon” and shot the woman.
Three other people died as a result of “separate medical emergencies.”
The rioters stole and vandalized government property.
Federal criminal law is, to put it mildly, expansive on the subjects relevant to such conduct.
*There’s a whole collection of more narrowly applicable statutes that some participants in the mob appear to have violated.
*There are reports, for example, of rioters perusing Pelosi’s emails—which, if true, could likely constitute a violation of the Computer Fraud and Abuse Act’s prohibition against “knowingly access[ing] a computer without authorization.”
As more becomes public about what happened, there will likely be other examples of these more idiosyncratic violations. For now, we’re going to focus on more broadly applicable statutes.

For purposes of federal criminal law, it is useful to group the potential offenses into three categories, starting with the most straightforward and progressing to the most serious, legally consequential and difficult to prove.
First, there are property offenses.
Second, there are offenses related to disorder.
And third, there are anti-government offenses, most notably seditious conspiracy.
If nothing else, the mob clearly violated laws against trespassing on federal facilities and destroying and stealing federal property. Federal law prohibits “depredation against any property of the United States” as well as robbing or attempting to rob “another of any kind or description of personal property belonging to the United States.”
It also prohibits possessing a firearm in a federal facility “with intent that a firearm or other dangerous weapon be used in the commission of a crime.”

Another federal statute makes it a crime to “knowingly enter or remain in any restricted building or grounds without lawful authority to do so” including “with intent to impede or disrupt the orderly conduct of Government business or official functions.”
That section also includes offenses in which one “obstructs or impedes ingress or egress from any restricted building or grounds” and “knowingly engages in any act of physical violence against any person or property in any restricted buildings or grounds.” The statute’s definition of “restricted buildings or grounds” includes places “where the President or other person protected by the Secret Service is or will be temporarily visiting” or places that are “restricted in conjunction with an event designated as a special event of national significance.”

Vice President Mike Pence was presiding over the Senate during the vote, and Vice President-elect Kamala Harris was also present, so the building likely satisfied the requirement that it contain a “person protected by the Secret Service.”
In addition, federal law explicitly prohibits bringing weapons into the Capitol or engaging in “violent entry and disorderly conduct.”


A second category of offenses relates to disorder. For example, federal law prohibits both transportation of firearms and obstruction of law enforcement as part of civil disorder, an activity defined broadly as “any public disturbance involving acts of violence by assemblages of three or more persons, which causes an immediate danger of or results in damage or injury to the property or person of any other individual.”

Federal law also criminalizes riots, which are defined along similar lines.

Finally, there is a special prohibition on forcibly obstructing a congressional inquiry, although it’s unclear whether the electoral-count certification counts as an “inquiry.”

And then there are the political offenses. These come with increased criminal penalties and would also send the strongest message about the severity of the behavior on display.

The offenses can be found in Title 18, Chapter 115, which criminalizes “treason, sedition, and subversive activity.”
Treason, narrowly defined as “lev[ying] war against” the United States or giving “aid and comfort” to its enemies, doesn’t fit with the fact pattern here.
And although federal law also prohibits “rebellion or insurrection against the authority of the United States or the laws thereof,” that statute is very rarely used by prosecutors. It is notable, though, that a conviction for rebellion or insurrection would make someone “incapable of holding any office under the United States,” a fact that may be of interest to those concerned about Trump’s future political ambitions.

So the most relevant prohibition is Section 2384, which outlaws “seditious conspiracy,” defined as when “two or more persons ... conspire to overthrow, put down, or to destroy by force the Government of the United States ... or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof.”

Sedition is a serious charge, but a number of analysts (including Lawfare’s Benjamin Wittes) have raised the possibility that certain conduct related to yesterday’s debacle might meet the terms of the statute.

Military veterans running on their record of service is nothing new. And criticism of an opponent’s military background — or lack thereof — isn’t unusual either, as the Bill Clinton and John Kerry campaigns can attest. But by highlighting Trump’s record, they’re also turning a spotlight on other candidates who were eligible for service during the Vietnam War, including Biden.

In fact, some Democratic strategists believe that’s their true goal.

“They’re not talking about Donald Trump. They’re talking about Joe Biden,” one long-time Democratic activist told InsideSources.

A whopping one-third of Americans either believe that it was a mistake or remain unsure about the US’s involvement in the so-called “good war,” according to a new poll by the Economist/YouGov.

The study, which was conducted in honor of Memorial Day, asked 1,500 Americans whether it was a mistake for the US to participate in wars from World War I to Iraq. To ensure accurate representation, the sample was weighted according to gender, age, race, education, 2016 presidential vote, registration status, geographic region, and other designations, per the site.

The poll found that a whopping 18% of participants were unsure if Uncle Sam should’ve participated in WWII, in which President Franklin Delano Roosevelt deployed troops to fight the Nazis and the Japanese Empire in 1941.

Meanwhile, 14% thought fighting in the “War Against Hitler” was a mistake while 62% believed that contributing soldiers was the right decision.

On average, 60% of participants ages 18 to 29 said it was the correct choice to join the fight while only 49% of people ages 30 to 44 agreed, the Daily Mail reported. Meanwhile, Republicans were the bigger proponents of US involvement in WWII with 77% backing our decision compared to just 63% of Democrats. Similarly, 74% of men agreed with our injecting US troops into Germany while 62% of women thought it was a good idea.

Last year, The Atlantic published a story alleging that then President Trump referred to soldiers fallen in times of war “losers” and “suckers.” The Atlantic’s story also claimed that, while visiting John Kelly’s son’s grave at Arlington National Cemetery in 2017, Trump asked Kelly “what was in it for them?”

However, one of its own — national security correspondent Jennifer Griffin — said parts of the damning report were verified to her by two people who previously worked for the Trump administration.

No one killed Brian Sicknick. But that isn’t stopping the Biden Justice Department, the media, every Democratic politician, and now Sicknick’s loved ones from perpetuating the lie.


n August 26, 2020, Kevin Phomma was arrested in Portland for assaulting several police officers with bear spray during that city’s nonstop siege by Antifa and Black Lives Matters protesters. Phomma and others surrounded the federal Immigration and Customs Enforcement facility, blocked traffic, and fought with law enforcement.

In a press release announcing his arrest, the Justice Department said, “Phomma doused several officers with pepper spray while they attempted to arrest him. Once in custody, officers discovered the pepper spray was in fact a powerful bear deterrent pepper spray.”

Phomma, 26, also had a three-inch dagger in a sheath strapped to his left hip. He was charged with a dozen counts ranging from civil disorder—a felony—to unlawful use of mace. He appears to contribute little to society except for his skills as a professional protester.

A few days after his arrest, Phomma was released on bail. His trial is still pending; his lawyers claim the civil disorder charge is “a vestige of opposition to civil rights for Black Americans.” (He does not appear to be black.)

While Phomma roams free, acting as the aggrieved party rather than the aggressor, the two men who allegedly sprayed officer Brian Sicknick with a chemical irritant on January 6 are not so lucky.

George Tanios and Julian Khater were arrested in March and accused of “attacking” Sicknick with a chemical spray; the indictment, not coincidentally, was filed just a few weeks after the initial account of Sicknick’s death—the murder-by-fire-extinguisher story—was exposed as a lie.

Desperate to sustain the lie that a police officer was killed by bloodthirsty Trump cultists on January 6, the media and Democrats quickly pivoted to the idea Sicknick died from an allergic reaction to the bear spray. Tanios and Khater, who traveled together to hear Donald Trump’s speech that day, face four charges of using and carrying the “dangerous and deadly weapon” on January 6.

Unlike Kevin Phomma, one charge filed against Tanios and Khater is “assault on a federal officer with a dangerous weapon.” Unlike Phomma and his accomplices, Tanios and Khater also are charged with conspiracy for allegedly pre-planning the assault on a federal officer.

But it is not just Macgregor and Flynn who toy with the idea of martial law and coups. In the run-up to the January 6 attack on the Capitol, Trump surrounded himself with MAGA leaders who openly called for him to invoke the Insurrection Act and deploy troops to overturn the election.

Even Administration officials were rattled, with one telling Axios that when Trump is "retweeting threats of putting politicians in jail, and spends his time talking to conspiracy nuts who openly say declaring martial law is no big deal, it’s impossible not to start getting anxious about how this ends."

Military officials took the notion of martial law and coups seriously enough that they felt they had to say something.

In early January — days before the attack on the Capitol — all 10 living former defense secretaries signed an open letter warning that “Involving the military in election disputes would cross into dangerous territory.”

As senior Defense Department leaders have noted, “there’s no role for the U.S. military in determining the outcome of a U.S. election.” Efforts to involve the U.S. armed forces in resolving election disputes would take us into dangerous, unlawful and unconstitutional territory. Civilian and military officials who direct or carry out such measures would be accountable, including potentially facing criminal penalties, for the grave consequences of their actions on our republic.

"We gather in our churches on Sunday morning, you have morning worship and then after the service you get on the church buses, church vans, get in cars and people go to vote," says Bishop Reginald T. Jackson of the Sixth Episcopal District of the African Methodist Episcopal Church. Jackson is the presiding prelate over more than 500 churches in Georgia.

"It's a very effective way the Black church has of getting out our vote," he tells Steve Inskeep on Morning Edition.

Georgia's Republican-led House passed HB 531 earlier this month. One of its provisions would have largely standardized voting across counties, limiting the ability of counties to offer more days to vote. Backers of the change argued that it would have brought more uniformity and less confusion to the state's elections.

After pushback from Black Georgians, Democrats and some in the business community, modified measures would require early voting to be available on two Saturdays before elections, and give local officials the option to open polls on two Sundays.

Black churches' involvement in politics and voter mobilization goes back to the years after the Civil War. But they became a major force during the civil rights movement.

"Souls to the polls has a direct link back to Jim Crow when we were fighting for the right to vote," says Christy Jackson, the supervisor of the Sixth Episcopal District who is also married to Bishop Jackson. "It became something that gave us comfort, to go in a group with our church group during those times to go and vote."

In modern times, Christy Jackson tells Morning Edition, souls to the polls is for the larger community, not just for members of the church. "They might just be community members who get on the bus knowing that they have sort of a safe transport, if you will, to the polls."

Churches are especially important for mobilizing African Americans in rural counties, Christy Jackson says. "There are some polling locations, voting locations that are 10, 15, 20 miles from where a person lives. And so these central located churches, for example, then become what we call neighborhood hubs."

The bills in Georgia's legislature that would increase barriers to voting are largely backed by Republicans.

The bishop says that if any measures that hinder voting end up becoming law, African Americans will persevere.

Christy Jackson adds that recounting the struggles of the past to young activists is essential. "You have to tell the story so that you can see the throughline to the other side."

Attorney Sidney Powell, who filed baseless 2020 election challenges on behalf of former President Donald Trump, insisted on Saturday that the Republican politician "can simply be reinstated"—continuing to promote conspiracy theories and misinformation about President Joe Biden's victory.

Powell made the remarks during the "For God & Country Patriot Roundup" conference in Dallas this weekend. Also speaking at the event was retired general Michael Flynn, the former Trump national security who has also repeatedly pushed false claims about the 2020 election.

"He can simply be reinstated," Powell said of Trump during the conference. The crowd cheered loudly in response to her groundless claims.

"And Biden is told to move out of the White House," the lawyer continued with a smirk on her face. "And President Trump should be moved back in. I'm sure there's not going to be credit for time lost, unfortunately. Because the Constitution itself sets the date for inauguration. But he should definitely get the remainder of his term and make the best of it. That's for sure," Powell insisted.

The federal agency, which was led by a Trump appointee at the time, said there was "no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised."

But Trump, Powell, Flynn and other allies of the former president continue to promote baseless claims about the 2020 election. These groundless allegations have added fuel to the bizarre QAnon conspiracy theory. Adherents to QAnon believe that the country is largely run and controlled by a group of Satan-worshipping pedophile Democratic politicians and Hollywood elites. They believe that Trump has somehow been working to challenge and destroy their organization.

A poll released last week by the Public Religion Research Institute found that nearly a quarter (23 percent) of Republicans agreed with the statement, "the government, media, and financial worlds in the U.S. are controlled by a group of Satan-worshipping pedophiles who run a global child sex trafficking operation." Furthermore, 28 percent of Republicans said they believe that "true American patriots" may need to resort to violence to save the U.S. because it has gone so off track.

"Our country needs to turn around," Brenda Bintz, a retired nurse from New Jersey who attended the weekend conference featuring Powell and Flynn, told The Dallas Morning News. "We've turned our back on God."

Powell is facing a $1.3 billion defamation lawsuit from Dominion Voting Systems over her false claims about the company's alleged involvement in a plot to rig the election for Biden. In response to the lawsuit, Powell's attorneys said in a March court filing related to the defamation lawsuit "that reasonable people would not accept" Powell's statements about the 2020 election "as fact."

Newsweek reached out to Powell for further comment.

We should all be rooting for these bills to pass nation wide.

Conservatives because we want transparency in the process.

Liberals because they believe they can lie and propagandize the issue to draw up support from minorities.
