Manchin - Absolutely not!

He won't vote for the Democrat's new voting law or vote to end the filibuster

Unfortunately, we now are witnessing that the fundamental right to vote has itself become overtly politicized. Today’s debate about how to best protect our right to vote and to hold elections, however, is not about finding common ground, but seeking partisan advantage. Whether it is state laws that seek to needlessly restrict voting or politicians who ignore the need to secure our elections, partisan policymaking won’t instill confidence in our democracy — it will destroy it.
How long till Democrats drive him to switch Parties?
As such, congressional action on federal voting rights legislation must be the result of both Democrats and Republicans coming together to find a pathway forward or we risk further dividing and destroying the republic we swore to protect and defend as elected officials.
With that in mind, some Democrats have again proposed eliminating the Senate filibuster rule in order to pass the For the People Act with only Democratic support. They’ve attempted to demonize the filibuster and conveniently ignore how it has been critical to protecting the rights of Democrats in the past.
As a reminder, just four short years ago, in 2017 when Republicans held control of the White House and Congress, President Donald Trump was publicly urging Senate Republicans to eliminate the filibuster. Then, it was Senate Democrats who were proudly defending the filibuster. Thirty-three Senate Democrats penned a letter to Sens. Chuck Schumer, D-N.Y. and Mitch McConnell, R-Ky., warning of the perils of eliminating the filibuster.

You can only push this so far. Manchin has always been a luke warm Democrat in a pretty red state. He would not have any issues back home if he chose to switch Parties.  I don't believe that any politician wants to switch Parties, but when they do it is generally more because they get demonized and driven out by their own Party. 

Democrats are desperate to remake America in to a new image of wokeness and liberalism. They somehow feel that the 50-50 split in the Senate and the razor thin margin in the House provides them with an excuse to do so. The more rational reason for this desperation is the fact that they do not likely feel that they will hold both chambers of Congress after 2020.

For this reason, we no longer have revenue to invest in our D- infrastructure, and that is the only thing PROVEN to create good jobs as the Republicans' owe Congressional study proved tax cuts for the wealthy have NEVER helped the economy or created jobs.

Critical race theory: My Texas public school sanitized history, facilitated injustice

My suburban Houston middle school held an annual Civil War Day. White eighth-grade-girls lolled about the cafeteria in dresses with hoop skirts and a principal, a self-professed Civil War buff, gave an animated presentation casting Confederate soldiers as misunderstood underdogs.

Perhaps because my parents were transplants to Texas, my mother had the wherewithal to recognize Civil War Day for the inappropriate celebration of plantation culture that it was. She let my sisters and me know how warped she found it all, and that the Civil War was foremost about slavery — a fact that was routinely whitewashed in Texas schools right up to 2019.

I can only imagine what the few Black families at the school thought of the event, but lately I’ve been trying. Because over the past few weeks, as numerous states and Republican lawmakers have taken steps to block schools from teaching the enduring legacy of slavery in the U.S., it has become clear that my school's sanitized approach to the Civil War was not the quirky brainchild of one principal gone rogue.

Rather, it falls neatly in line with a larger philosophy that educating kids about the outsized role racism holds in American history and policy is unpatriotic, “divisive nonsense," as Sen. Mitch McConnell called it.

AN INVENTED INSURRECTION.
How the left is trying to criminalize conservatism.


The Biden Administration is abusing state power to create the appearance of a conspiracy to commit an insurrection on January 6th, 2021 at the U.S. Capitol. The problem is the indictment they just filed with the Circuit Court of the District of Columbia—it proves there was no conspiracy.

The malfeasance of the FBI, the Department of Justice, and the judges involved with the arrest and incarceration without bail of many of those who participated in the riot at the Capitol have been covered brilliantly in a series of pieces by Julie Kelly. These events are abhorrent to anyone who believes in the rule of law and better suited to a totalitarian police state removing political enemies. America is not supposed to have indefinite detention based on political beliefs, and yet here we are.

This treatment is all the more heinous when compared with the near-total lack of interest in prosecuting the year plus-long violence and destruction perpetrated by Black Lives Matter (BLM) and Antifa, some of which involved the seizure and continued occupation for weeks of government buildings. This is a far step from equal treatment under the law and should bring a concerted response from all those on the right who oppose tyranny.

Many of the acts described in the indictment are Constitutionally protected, but it seems that fades away when the left doesn’t like the reason they are being exercised. They attached the term “Big Lie,” a Nazi reference, to any disputes over the 2020 elections. Now they act empowered to treat any related activities as outside the law by that fictional connection.

The government had to present their case to prove there was an insurrection planned for January 6th. Once this indictment saw the light of day, however, it was immediately apparent there was no insurrection and no conspiracy to commit illegal acts of any kind. In fact, the indictment has numerous instances of the so-called conspirators, members of a group known and the Oath Keepers and their associates, discussing the legality of certain actions, then specifically choosing to avoid violating the laws.
The only conspiracy here is by the left to deprive their political opponents of their Constitutional rights.

Essentially, the government case uncovers a conspiracy to petition the government for redress of grievances where citizens who believed an investigation into the election was needed gathered to say so. Perfectly legal and specifically outlined in the First Amendment

. This remained the entirety of the government’s case against the January 6th protesters until, in the heat of the moment, some of those involved got swept up in a mob mentality and forced their way into the Capitol.

As one who grew up with an education McConnell would probably deem patriotic, I am here to point out the ridiculousness of such thinking.

What divides us is not teaching the truth, but leaving kids to fill in the blanks for the vast inequalities they see around them.

What divides us is allowing those kids to grow up into ignorant leaders.

Missing history
At the public Texas schools I attended in the ’80s, we learned that freed slaves were allotted 40 acres of land and a mule.

What we did not learn was that the federal government quickly overturned that agreement, returning those acres to their previous white owners.

We were told that America is a land of opportunity for anyone willing to work long and hard enough. We were not told that for decades many unions excluded Black Americans, thwarting them from the opportunities, pay and work protections offered their white counterparts.

And of course we never studied how banks and government made purchasing homes and property an impossibility for many Black families, foiling them from accruing wealth that would have appreciated over years and generations.


But is rehashing these hard truths really useful, some ask? Can’t we just vow to do better moving forward? The field of cognitive science provides a ready answer:

Studies suggest that when people aren’t provided the reasons for differences in their worlds – such as why the net worth of a typical white family is nearly 10 times that of a Black family – we routinely default to what Andrei Cimpian, a psychology professor at New York University, calls “shortcut” explanations attributing “inherent” qualities to groups of people.

Bad teaching: Bans on critical race theory in schools narrow reality and sell out kids

In 1982, the year I entered middle school, for instance, a jaw-dropping 57% of Houstonians in a Kinder Institute survey said that the main reason Black Americans had, on average, worse jobs, income and housing than white Americans, was because most Black people don’t have the motivation or willpower to pull themselves out of poverty.

Research suggests that kids are especially prone to favoring these kinds of stereotyping explanations, which make it more likely for kids to regard inequities as natural rather than offenses to fix. For targeted children, shortcut explanations may become self-fulfilling, limiting what children believe they can accomplish.

The antidote to all this? Education. Provide kids with the full, historical context for the differences they see.

Children fill in the blanks
Cimpian points to a published study he co-authored in which children learned about a fictional planet which has two groups of residents, with one group being far wealthier than the other. When researchers asked kids why that was, most guessed it had to do with something about the residents, like the wealthier ones were smarter.

Kids who explained things in these terms generally considered the disparities fair.

When researchers told children what they claimed was the true explanation for why life was so different for the two groups, a remarkable divergence occurred.

Kids who received explanations regarding qualities of the residents mostly continued to accept the status quo as inevitable and acceptable.

But children given historical explanations – like that gold had been discovered by one group long ago – were more likely to say the disparities were unjust and needed to be fixed.

This past year, the Black Lives Matter movement has provided many white Americans with a crash course in the longstanding injustices inflicted on Black Americans. An annual survey conducted by Rice University’s Kinder Institute for Urban Research suggests that in the town where I grew up, that's having an impact.

Between 2019 and 2021, the share of white Houstonians who agreed that “Black people in the U.S. are still a long way from having the same chance in life that white people have,” increased by more than 20%, the biggest increase seen since the Institute began asking the question in 2013.

More Houston residents than ever before believe that poor people are "poor because of circumstances they can’t control” (80%) and that “government has a responsibility to help reduce the inequalities,” the researchers wrote.

Thankfully, my old middle school no longer does Civil War Day.

Since my days there, we’ve accumulated ample evidence that the kind of biased history education I received, and that others are fighting to preserve, is actually a recipe for preserving inequities.

We now know that a clear-eyed understanding of how things became unequal is a key first step to creating a more just world.

The question for parents, schools and policymakers, then, is no longer how to level the playing field.

If Texas is going to turn blue by 3035, the Democratic Party might want to consider persuading Hispanic voters it cares more about them than using them as pawns in an open borders electioneering racket. On Saturday night, the donkey party got a taste of a Hispanic revolt in the Texas border town of McAllen, Texas.

“Javier Villalobos defeated Veronica Whitacre in the June 5 runoff election to win the position as McAllen mayor,” NBC 23 reported.

“Villalobos won the election with 4,744 votes to Whitacre’s 4,538 votes,” the report added. “Villalobos won with 51.11 percent of the election total.”

The election race had many conservative political observers optimistic about the odds of making more incursions into blue Hispanic electoral territory.






The Republicans are starting to accrue a larger share of the Latino vote, according to nationwide trends collected by the AS/COA. In 2020, Donald Trump gained ground in state elections even compared to his performance in 2016. Trump gained 14 points with Latinos in Georgia, 12 points in Florida, 8 points in Nevada, 7 points in Colorado, and 6 points in Texas.



The Republicans have gained in presidential elections over the past three cycles: The party has increased its share from 27 percent to 32 percent in 2020.

In another interview, Mr. Sowell told C-Span’s Brian Lamb that black strangers regularly stop him in public and compliment his views: “When I checked out of my hotel this morning, the black security guard came over and said, ‘Are you Sowell?’ And I said, ‘Yes,’ and he shook my hand warmly and we walked—he walked me the length of the corridor and talked about this and about that. . . . So, it’s not Sowell versus blacks. It’s the black intellectuals.”

There is a long history of conflating the interests of black Americans with those of black organizations, black journalists, black academics and other elites. The media lazily continues to turn to these groups, from the NAACP to Black Lives Matter, as if they speak for all black people.

In December 1980, Mr. Sowell headlined the “Black Alternatives” conference in San Francisco. Its goal was to showcase the variety of perspectives among black politicians, intellectuals and civil-rights activists. “The people who were invited,” he began his keynote address, “are people who are seeking alternatives, people who have challenged the conventional wisdom on one or more issues, people who have thought for themselves instead of marching in step and chanting familiar refrains. . . . We have come through a historic phase of struggle for basic civil rights—a very necessary struggle, but not sufficient. The very success of that struggle has created new priorities and new urgencies. There are economic realities to confront and self-development to achieve, in the schools, at work, in our communities.”

Voting groups greeted Biden’s decision to place Vice President Kamala Harris in charge of voting rights legislation this week as a welcome sign that the administration is pushing democracy protection to the top of its agenda. The Senate’s confirmation of Kristen Clarke to head the Justice Department’s Civil Rights Division has also increased hopes that the nation’s top law enforcement body will soon help bolster the current legal challenges to restrictive voting laws to defend Black and brown voters who are being disenfranchised. 

“We’ve been playing whack-a-mole filing lawsuits or being party to lawsuits across the landscape,” said Derrick Johnson, the president of the NAACP. “There is no way, considering the rapid pace in which legislative bodies are seeking to suppress the Black vote, that we will be able to keep up all our efforts without support from this administration and the federal government stepping in and pushing back on these efforts.”

Johnson is meeting with Manchin next week, and other groups may soon ramp up public pressure on the ground in Arizona and West Virginia to sway the two most obvious Democratic holdouts. They also want Biden and Harris to push Manchin and Sinema, and the White House is also planning to pressure more corporations to join the fight as well.  

But anxiety over the fate of the For The People Act is intensifying, even as voting rights groups publicly insist they’re still optimistic about its chances to pass this year. For months, activists have reminded Democrats that federal action is needed, but those calls have reached a fever pitch: Even as they celebrated the victory in Texas this week, voting rights groups pleaded for help from Washington.

“We can’t just fight this in Georgia and then hop over to Florida, and hop over to Texas,” Cliff Albright, a co-founder of the Black Voters Matter Fund, said on a press call this week. “We shouldn’t be in a state-by-state battle. We have got to have federal legislation. We need the full force of the White House and the full force of Congress to stand on the side of people, to stand on the side of democracy, to not underestimate those that are trying to turn the clock back on us

Democrats defeated President Donald Trump and captured the Senate last year with a racially diverse coalition that delivered victories by tiny margins in key states like Georgia, Arizona and Wisconsin.

In the next election, they cannot count on repeating that feat, a new report warns.

A review of the 2020 election, conducted by several prominent Democratic advocacy groups, has concluded that the party is at risk of losing ground with Black, Hispanic and Asian American voters unless it does a better job presenting an economic agenda and countering Republican efforts to spread misinformation and tie all Democratic candidates to the far-left.

The document is all the more striking because it is addressed to a victorious party: Despite their successes, Democrats had hoped to achieve more robust control of both chambers of Congress, rather than the precarious margins they now hold.

In part, the study found, Democrats fell short of their aspirations because many House and Senate candidates failed to match Joe Biden’s support with voters of color who loathed Trump but distrusted the Democratic Party as a whole. Those constituencies included Hispanic voters in Florida and Texas, Vietnamese American and Filipino American voters in California, and Black voters in North Carolina.

Overall, the report warns, Democrats in 2020 lacked a core argument about the economy and recovering from the coronavirus pandemic — one that might have helped candidates repel Republican claims that they wanted to “keep the economy shut down” or worse. The party “leaned too heavily on ‘anti-Trump’ rhetoric,” the report concludes.

Georgia Republican Party on Saturday approved a resolution to censure Brad Raffensberger.

The Georgia Secretary of State “failed to perform his duties in accordance with the laws and Constitution of the State of Georgia, and Republican Party values," according to a version of the resolution posted on Twitter by Atlanta Journal-Constitution reporter Greg Bluestein.

The resolution cited Raffensperger for "Entering into the Compromise Settlement Agreement and Release which changed Georgia's absentee voting procedures outside the Constitutionally prescribed format set forth in Georgia law." There is special worry over the “overperformance” of Trump and Republicans with hispanics and blacks, which isn’t supposed to happen according to Democratic “emerging demographic majority” dogma that says if “we label you BIPOC, you have to vote for us.”

This comes on top of the news from out of McAllen, Texas, a city that is 85 percent hispanic and which Biden and Hillary Clinton carried easily, but which yesterday elected a Republican mayor by a wide margin. Maybe ignoring the crisis at the border is starting to boomerang on Democrats?

Unlike H.R. 1, the 1990 copyright law was the subject of a congressional report, which the court still found inadequate to sustain the law because it cited “just two examples of patent infringement suits against the States.”

“Congruence and proportionality” mean a law cannot be indiscriminately broad unless there is evidence such sweeping coverage is necessary. Congress may not displace a large area of local legislation, but must selectively address specific ills shown through legislative hearings and committee findings.

This “congruence and proportionality” standard was also the basis for a ruling in 2000 upholding state immunity from lawsuits under the Americans with Disabilities Act in Board of Trustees of the University of Alabama v. Garrett. The justices who dissented in the Garrett case agreed “congruence and proportionality” were essential, but they would have upheld the law because of a “vast legislative record” in 13 congressional hearings that found discriminatory treatment “throughout society in general.”

The most compelling precedent showing the unconstitutionality of H.R. 1 is the Supreme Court’s invalidation of provisions of the Religious Freedom Restoration Act (RFRA). RFRA authorized lawsuits against state and local governments for imposing burdens on religious rights. The Court ruled in City of Boerne v. Flores in 1997 that RFRA – passed by an almost-unanimous bipartisan Congress – “reflect[ed] a lack of proportionality or congruence between the means adopted and the legitimate end to be achieved.”

Congress then held hearings “spanning three years” on religious discrimination in local prisons and in the application of local zoning laws. They resulted in the Religious Land Use and Institutionalized Persons Act (“RLUIPA”) which was upheld in 2005 with a unanimous opinion by Justice Ruth Bader Ginsburg in Cutter v. Wilkinson.

The City of Boerne decision addressed whether RFRA qualified under Section 5 of the Fourteenth Amendment, which authorizes the amendment’s enforcement by “appropriate legislation.” H.R. 1 invokes not only Section 5 of the Fourteenth Amendment but also the Constitution’s “Elections Clause” in Article I, Section 4, Clause 2.

This general congressional authorization to “make or alter regulations” enacted by state legislatures is, however, no broader than Congress’ power under the Intellectual Property Clause (Section 8, Clause 8) to grant copyrights and patents. And in her 2020 Allen v. Cooper opinion, Justice Kagan ruled the Intellectual Property Clause did not abrogate states’ sovereign immunity.

The limited “make or alter” power granted Congress in a subsidiary clause does not entitle it to enact a sweeping law that is neither “congruent” nor “proportional.” H.R. 1 would replace the authority explicitly assigned by the same constitutional section to “each State by the Legislature thereof.” If H.R. 1 is now enacted, it is a dead man walking to certain execution under binding Supreme Court precedent.

To confirm the accuracy of the vote, auditors in the state hand-counted random precincts.

And in his request that the Justice Department investigate the Italy conspiracy theory, Mr. Meadows sent Mr. Rosen a YouTube link to a video of Brad Johnson, a former C.I.A. employee who had been pushing the theory in videos and statements that he posted online. After receiving the video, Mr. Rosen said in an email to another Justice Department official that he had been asked to set up a meeting between Mr. Johnson and the F.B.I., had refused, and had then been asked to reconsider.

The Senate Judiciary Committee is one of three entities looking into aspects of the White House’s efforts to overturn the election in the waning days of the Trump administration. The House Oversight Committee and the Justice Department’s inspector general are doing so as well.

Mr. Rosen is in talks with the oversight panel about speaking with investigators about any pressure the Justice Department faced to investigate election fraud, as well as the department’s response to the Jan. 6 attack, according to people familiar with the investigation.

He is also negotiating with the Justice Department about what he can disclose to Congress and to the inspector general given his obligation to protect the department’s interests and not interfere with current investigations, according to a person familiar with the discussions. Mr. Rosen said last month during a hearing before the oversight committee that he could not answer several questions because the department did not permit him to discuss issues covered by executive privilege.

Mr. Durbin opened his inquiry in response to a Times article documenting how Jeffrey Clark, a top Justice Department official who had found favor with Mr. Trump, had pushed the Justice Department to investigate unfounded election fraud claims. The effort almost ended in Mr. Rosen’s ouster.

The claim: Emails show Dr. Anthony Fauci 'lied' about the effectiveness of hydroxychloroquine in treating COVID-19

The release of hundreds of Dr. Anthony Fauci's emails from the early days of the coronavirus pandemic has become fodder for online misinformation.

Social media users have claimed Fauci's emails contain the origins of the coronavirus (false) and show that he knew face masks were ineffective at preventing the virus's spread (missing context). Others have falsely claimed the emails, which The Washington Post and BuzzFeed News obtained through a Freedom of Information Act request, were leaked.

Now, the Gateway Pundit, a conservative website that has repeatedly published false claims about COVID-19, says the emails show Fauci "lied" about a coronavirus treatment that could have saved hundreds of thousands of lives.

"Fauci Was Informed of Hydroxychloroquine Success in Early 2020 But Lied to Public Instead Despite the Science," reads the headline on a June 3 article, which has more than 8,200 shares on Facebook.

Similar claims have circulated widely among pro-Donald Trump and alternative health pages and groups on Facebook. According to CrowdTangle, a social media insights tool, posts mentioning Fauci and hydroxychloroquine have racked up tens of thousands of interactions in the days after the emails were made public.

Fauci, director of the National Institute of Allergy and Infectious Diseases and President Joe Biden's chief medical adviser, did send and receive emails about hydroxychloroquine in spring 2020. But he didn't "lie" about its effectiveness in treating COVID-19.

Hydroxychloroquine, a drug used to treat rheumatoid arthritis and lupus, is not a proven treatment for COVID-19, public health officials say. Fauci's emailed comments on hydroxychloroquine line up with what he said in public and the scientific consensus about the drug.

Said Broomhead:

“As is its usual practice, the court didn’t say why it wouldn’t take the case. The Beginning of the End of Democracy as We Know it?

This morning, West Virginia Senator Joe Manchin announced in the Charleston Gazette-Mail that he’s a “no” on the For the People Act – and a no for ending the filibuster. 

This is a direct in-your-eye response to President Biden’s thinly-veiled criticism of Manchin last Tuesday in Tulsa. 

If it means the end of the For the People Act, it would open the way for Republican-dominated states to continue their shameless campaign to suppress the votes of likely Democratic voters – using Trump’s baseless claims of voter fraud as pretext. That’s the beginning of the end of American democracy as we know it. 

Manchin’s support for extending the John Lewis Voting Rights Act to all fifty states is better than nothing, but it would depend on an activist Justice Department willing to block state changes in voting laws that suppress votes, and an activist Supreme Court willing to uphold such Justice Department decisions. 

Don’t bet on either. We know what happened to the Justice Department under Trump, and we know what’s happened to the Supreme Court.

So without Manchin, is the For the People Act dead? Probably, unless Biden can convince one Republican senator to join him in supporting it. 

Would Mitt Romney or Lisa Murkowski or Susan Collins be willing to do so and buck the voter-suppressing, Trump-dominated GOP? Or will history record that Republican senators were more united in their opposition to democracy than Democratic senators are in their support for it? 

The optimist in me says Romney will do it because he’s an institutionalist who’s appalled the authoritarianism that Trump has unleashed in the GOP. The cynical realist in me says no way. 

Unfortunately I agree with him.


Unless the Republicans gain sanity, the American Dream will die.

A minority party will burn The Constitution of the United States of America and for which it stands, for one and all.

The U.S. district judge began his 94-page ruling sanctioning the AR-15 assault rifle for home and militia use by equating it with a Swiss Army knife.

Yes, you read that correctly.

And it’s all you need to know about the quality of the judge’s tortured opinion — even if it is ultimately upheld, heaven forbid, by the conservative U.S. Supreme Court.

But come on, that couldn’t actually happen. Right?

We’ll probably find out.

This is how San Diego-based federal Judge Roger Benitez — the gun lobby’s best friend in recent years — began his opinion:

“Like the Swiss Army Knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense equipment. Good for home and battle….

“Yet, the State of California makes it a crime to have an AR-15 type rifle. Therefore, this court declares the Californian statues to be unconstitutional.”

And just like that, the judge threw out California’s 3-decade-old ban on assault weapons. He granted a 30-day stay while the state appeals.

Gov. Gavin Newsom, who has successfully championed gun controls that Benitez has previously blocked, hit the bulls-eye with his response to Friday’s ruling:

“Today’s decision is a direct threat to public safety and the lives of innocent Californians, period.

“As the son of a judge, I grew up with deep respect for the judicial process and the importance of a judge’s ability to make impartial fact-based rulings. But the fact that this judge compared the AR-15 — a weapon of war that’s used on the battlefield — to a Swiss Army knife completely undermines the credibility of the decision.”

Look, I never went to law school. But I know the difference between a Swiss Army knife and an AR-15.
