Why liberals are wrong about the filibuster and a federal voting law

Joe Manchin’s Incoherent Case for Letting Republicans Destroy Democracy
In an op-ed yesterday, Manchin laid out a series of propositions that purport to explain his position, but upon close inspection make it difficult to understand what he believes or wants.
The internal contradiction of Manchin’s position is summarized in the first two sentences. The first one establishes that the right to vote is fundamental: “The right to vote is fundamental to our American democracy and protecting that right should not be about party or politics.” But in the next line, he qualifies that this right can “never” be protected in a partisan fashion: “Least of all, protecting this right, which is a value I share, should never be done in a partisan manner.”
Maybe Manchin thinks it’s fine for states to pass Republican-only voting restrictions. Or maybe he thinks it’s bad, but less bad than overriding it with a national-level bill to protect voting rights that requires curtailing the filibuster.
Why is he choosing this? Because, Manchin argues, “Voting and election reform that is done in a partisan manner will all but ensure partisan divisions continue to deepen.” And that is probably correct: Partisan divisions are likely to continue deepening if the Senate enacts protections for Americans’ right to vote. They will also probably continue deepening if it doesn’t. Partisan divisions have been deepening for a long time.

Let's be clear... the Constitution holds that States get to determine how they run their own elections. There are questions abound as to whether this sort of Federal law specifically designed to hand-cuff how States are running their elections would pass USSC muster to begin with. So we could start with that. 

But there is also no "bi-partisan" consensus on how to best hold elections. If there was then they would pass a bi-partisan bill. The general public is overwhelmingly in favor of things like Voter ID and other measures that would prevent fraud. They are also overwhelmingly in favor of more early voting and easier access. It certainly seems like something could be done to address the concerns of the public, but what the public wants really does not play a part in this particular argument. This is all about power and what laws will help which party.

So in the meantime you will see states offering differing manners in which they will hold their elections (as the constitution allows).  Conservative states will enact laws that concentrate on eliminating fraud, while liberal states will concentrate their efforts on laws that make voting easier.  Interestingly, both the Georgia and Texas laws do a little bit of both. Both increase security, while also expanding early voting opportunities and hours. 

While that might seem to be a fair compromise, liberals want everything to fall down on the side of "more access" and "less security". Moreover, liberals clearly doesn't care if there is a "bi-partisan" bill. Rather they somehow prefer one giant "federal" partisan bill that takes away State's rights to enact their own laws (as the constitution allows). Of course, that "federal bill" will ONLY address voter access and likely work to make security a secondary concern.

Oh, and let us not forget.  These laws in Texas and Georgia and elsewhere are very popular in the states that they are being passed in. These are also states that have enough votes to pass these without changing long standing traditions or breaking the system to get it done. The fact that liberals from New York and California want to tell Texas, Georgia, Florida and other conservative states how to hold election is proof positive that these people have a way larger impression of their own importance than they actually should.

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Place of Chusing Senators.

Election regulations are proscribe by the states. However, the Constitution seems to give Congress some power to alter and make new regulations.

In practice however this power is very limited as the most important and fundament changes to voter regulation required constitutional amendments,

One federal law the change voting practices was to ensure that the day for choosing electors was the same in all states. (The first Tuesday after the first Monday in November)

It would have been interesting to see how much leeway the Supreme Court would allow Congress. The betting here is that it would not be very far.

The last thing the founding fathers wanted was running a National election feeling it would concentrate too much power in the federal government.

That was the danger of HR1 and hopefully it will be put back in the cracker box where it belongs.

As part of an ongoing effort by some Republicans and Trump supporters to cast doubt on the legitimacy of the 2020 presidential election, you might have heard something about efforts to conduct a forensic audit on the ballots to prove fraud did — or did not — occur.

In Arizona, the state Senate successfully sued to get access to Maricopa County's 2.1 million ballots, even after two post-election audits were conducted by a Republican-controlled board that confirmed Biden's victory. A partisan third-party group has been "auditing" the votes in recent weeks. 

Former Department of Homeland Security official Matt Masterson told NPR that Arizona's review is "performance art," a "clown show," and definitely "a waste of taxpayer money" that threatens confidence in democracy and is not an actual audit. A conservative radio host in Phoenix and ardent Trump supporter has begun making similar remarks, backing away from his previous support of the audit and now summing it up as "the sideshow at the state fair." 


The filibuster, used by either side gives the minority to deny the right to vote to minority voters.

The Republicans are scared of the people.

The Constitution was written to keep a day to day political actions.

That's why we have elections years apart, unlike most parliamentary systems.

I know I'm repeating myself but, this Republican party of today is the most dangerous in history.

If the Republicans succeed in 2022 and 2024, the minority of the population will have power over everything.

Power is all they want.

Destroying democracy sounds pretty bad. Indeed, that description would seem to be the worst possible outcome. The only way to prevent that outcome would be either to weaken or abolish the filibuster to pass voting protections, or to threaten to do so as leverage to get Republican support. But Manchin flatly rules out either, asserting, “I will not vote to weaken or eliminate the filibuster.”

Four points stand out. First, though Ukraine has been badly treated by Moscow, the issue matters not much for American and European security. Ukraine long was part of the Russian Empire (in both old and new variants). Washington never worried about Kyiv’s status since Moscow was the key player.

Ukraine is closer to Europe, which therefore should have a greater interest in that nation’s stability. The Europeans, however, recognize that Russia’s mistreatment of Ukraine — seizing Crimea and backing separatism in the Donbass in the east — is sui generis. Putin has done nothing to indicate he wants to try to swallow Ukraine, an impossible task, and if he won’t do that he isn’t likely to launch a blitzkrieg to overrun Europe (with three times Russia’s population).

The main impact of Moscow’s Ukrainian misadventure is making Kyiv’s membership in NATO unlikely, since present rules bar admitting a country with active border disputes with a neighbor. But that fits with European opposition to Ukraine’s inclusion. Since the conflict started in 2014, the more distant U.S., pushed by a curious coalition of pro-war Republicans and anti-Trump Democrats, has been most determined to confront Moscow.

Second, Putin’s government doesn’t threaten the United States. A direct attack on America is inconceivable. As for the Europeans, even they, at least those not on Russia’s border, dismiss the likelihood of war: if they were worried, they would be spending more than 1 percent plus change on their militaries. There is a lot of sparring between America and the Russian Federation in peripheral areas — Syria, Cuba, Venezuela, Libya — but these are of marginal importance. And if Washington did not treat Moscow as an enemy through sanctions and more, the latter would be less likely to reciprocate by routinely challenging U.S. interests. Russia’s human rights situation is atrocious, but murder, kidnapping, torture, mass imprisonment, and foreign aggression don’t bother American officials when conducted by Egypt, Bahrain, Saudi Arabia, Turkey, and more.

The COVID-19 pandemic, by increasing social expenditures and depressing taxes, will end up adding as much as $16 trillion to the national debt. The Biden administration is pushing a tsunami of spending unconnected to personal and national need. As a result, America will soon break its previous record of debt at 107 percent of GDP, set in the aftermath of World War II. Alas, the impact of an aging population will only intensify. By 2050 the Congressional Budget Office figures that number will be an astounding 200 percent.

It’s time for America to make a deal. President Donald Trump had an opportunity to do so, but he didn’t. But his room to maneuver was constrained by false claims of election collusion in 2016, supplemented by a bipartisan smear campaign. Republicans didn’t want to give up their traditional Cold War enemy, Moscow, which Democrats suddenly found politically convenient to denounce. The president’s appointees joined the permanent bureaucracy to consistently undercut his approach, continuing Washington’s previous anti-Russia policy, increasing sanctions and further alienating relations.

In contrast, Biden has been denouncing Russia for years. Indeed, he called Moscow a threat while describing China as a “competitor.” But that gives him an opportunity to play a modern Richard Nixon. Biden can “go to Russia”

I did some research. I got admitted into the South Dakota School of Mines and Technology in 1969 because despite a low GPA my SAT.

For example, at many top ranked schools, students scored within the 90th percentile of test takers. This means a score of 2100 or above for the SATs 

A professor told me that if I studied hard enough I could have been admitted into almost every university in the country.

But I fucked up.

The clearest example of this, Obama said, was the January 6 insurrection and how there are now "large portions of an elected Congress going along with the falsehood that there were problems with the election." The insurrection at the US Capitol by Trump supporters came on the same day that 147 Republican lawmakers voted not to certify Joe Biden's electoral victory in key states. The falsehood that the 2020 presidential election was stolen has been pushed by former President Donald Trump himself, who has since cheered on baseless Republican audits of elections.

Asked by Cooper about Republicans leaders briefly going against Trump following the insurrection, Obama said, "And then poof, suddenly everybody was back in line."

"Now, the reason for that is because the base believed it and the base believed it because this had been told to them not just by the President, but by the media that they watch," Obama said. He later added: "My hope is that the tides will turn. But that does require each of us to understand that this experiment in democracy is not self-executing. It doesn't happen just automatically."

At the heart of some of these divisions, Obama argued, is race -- a through line that defined Obama's rise in politics and his election as the first Black president.

The former President said during the interview that it remains "hard for the majority... of White Americans to recognize you can be proud of this country and its traditions and its history and our forefathers and yet, it is also true that this terrible stuff happened."

Obama's comments on the arrest -- "The Cambridge police acted stupidly in arresting somebody when there was already proof that they were in their own home," he said in 2009 -- set off a firestorm and, according to the former President, tanked his polling with White voters.

"And it gives a sense of the degree to which these things are still... they're deep in us. And, you know, sometimes unconscious," Obama said in the interview. "I also think that there are certain right wing media venues, for example, that monetize and capitalize on stoking the fear and resentment of a White population that is witnessing a change in America."

While Obama jokes during the interview that he is a "little too gray-haired" to get back into community organizing, his daughters -- Sasha and Malia -- participated in Black Lives Matter protests after George Floyd was killed in Minneapolis in 2020, giving their father a "great source of my optimism."

"My daughters are so much wiser and more sophisticated and gifted than I was at their age," Obama said with a laugh during the interview. "When people talk about... how do I think about my legacy, you know, part of it is the kids who were raised during the eight years that I was president. There're a bunch of basic assumptions they make about what the country can and should be that I think are still sticking. They still believe it. And they're willing to work for it."

Obama's interview with CNN largely centered on his participation in a so-called BAM -- or Becoming a Man -- circle.

The program, aimed at mentoring and supporting boys and young men, started in Chicago in 2001, but Obama first joined one of the circles in 2013 and has continued to be a part of the program ever since. The program was a key reference when Obama launched My Brother's Keeper in 2014, as he worked to reverse trends showing young men of color are more likely to drop out of school, get in trouble with the law or be unemployed.

"But I understood what it meant to not have a father in the house. I understood what it meant to be in an environment in which you were an outsider."

He added, "The violence and drugs and some of the issues that the guys were dealing with day to day were different. But the mistakes I made, the struggles I was going through, were similar."

Through the program, which is said to work with 8,000 youth in 140 schools each year, the former President meets for group conversations with young men in Chicago. During that time, Obama tries to convey that even though he went on to become the President of the United States, he struggled with many of the things these young men deal with on a daily basis.

"The first time I sat down with these guys, the most important thing for me to communicate at that time, and I was President of the United States, was in many ways, (you) are ahead of me, of where I was at your age," Obama said. "I just had certain advantages you guys don't. I could make a mistake and land on my feet."

The advice is both broad and practical. During the meeting, one participant noted how he had never learned how to tie a tie or the difference between forks at a dinner.

"I didn't learn that 'til I got the White House," Obama joked in response.

Obama wrote in his memoir that it wasn't until college -- first at Occidental College in California and later at Columbia University in New York -- that he began to develop an academic curiosity. He noted that for three years while living in New York, he "lived like a monk -- reading, writing, filling up journals, rarely bothering with college parties or even eating hot meals."

In the memoir, he wrote that he got lost in his own head about success and failure, something that has become a central question in his work with students in Becoming a Man.

"These kids are just as talented. They're just as smart. They could achieve just as much," Obama said in the interview with Cooper. "The single most important thing I learned... the line between success or failure in this society so often is dictated not by anybody's inherent merits."

He added, "It has to do with the circumstances in which they're in. That doesn't mean they don't have individual responsibility. ... But it also means that we as a society continue to fail them."

Based on public reporting, we’ve all known since 2019 that Rudy Giuliani tried to pressure the leader of Ukraine into announcing a phony investigation into Joe and Hunter Biden, in an attempt at altering the outcome of the 2020 U.S. Presidential election. But it was never clear just how explicit Giuliani was with that pressure, what evidence there was, and whether it would be possible to get criminal charges to stick against him for it – until now.

CNN has obtained and released a 2019 recording of Rudy Giuliani trying to pressure a top aide to Ukrainian President Zelensky. More to the point, Rudy specifically offered U.S. governmental support for Zelensky in exchange for announcing a phony probe into Biden. This means Rudy has incriminated himself on tape. If the Feds didn’t already have this recording, they do now.


So now, in addition to the fact that Rudy Giuliani is already on track for indictment and prison for his international financial crimes, the Feds now have the ability to indict Giuliani for attempting to conspire with a foreign government to tamper with a United States election.


Keep in mind that this isn’t just about convicting Rudy and sending him to prison. It’s about making Rudy realize he’s screwed, so he’ll conclude that he has no choice but to flip on Donald Trump and others. This newly surfaced recording could help force the issue. The president was obsessed with the idea that Democrats would strip the primary win from Joe Biden and nominate Hillary Clinton or Michelle Obama instead, reporter Michael Bender writes in an upcoming book.

In early 2020, a frustrated and furious Donald Trump described Joe Biden as “a mental retard” while struggling to cope with his own placement in early polls, according to a passage from “Frankly, We Did Win This Election”: The Inside Story of How Trump Lost, a forthcoming book by senior Wall Street Journal reporter Michael Bender.

The author notes that Trump vented his anger at the time by interrupting “a policy meeting in the Oval Office to ask, ‘How am I losing in the polls to a mental retard?’”

In another moment Bender writes that Trump held back on focusing his firepower on Biden during the primary stage of the election because he was convinced that the Democratic Party was scheming to switch out now president Biden for a different candidate—such as Hillary Clinton or Michelle Obama—over the summer. According to Bender, Trump also felt that his attack strategy had backfired during the first stage of the Democratic primary. “The president, meanwhile, had often complained that his early attack on [Elizabeth] Warren had damaged her presidential bid, which he regretted because he viewed her as an easier opponent than Biden,” Bender writes. “Now he worried that a heavy blitz of attack ads would hasten the secret plot being hatched by Democrats, and his mind raced with who they might select in Biden’s place.” During a meeting held the month after the coronavirus outbreak hit the U.S., Trump expressed his Biden replacement theory to advisers, saying that Democratic leadership would “realize [Biden is] old, and they’re going to give it to somebody else. They’re going to give it to Hillary, or they’re going to give it to Michelle Obama.”

One person in Trump’s circle did work to put a stop to this absurd belief, which Trump apparently clung to so deeply that he “had cited it as a reason to hold off on heavy spending against Biden earlier in the month.”

Bender writes that Trump campaign pollster Tony Fabrizio “devoted nearly an entire page of [a campaign memo] to debunking a conspiracy theory that had bubbled up inside Trump World, including with the president, that Democrats were going to steal Biden’s nomination at the convention.”

In the memo, Fabrizio reportedly wrote, “I know there is some concern (which I strenuously disagree with) that if we go after Biden too soon, we can collapse him, and the Dems will replace him at their convention.
I know POTUS tends to share this opinion.”

Bender adds: “The pollster aimed to debunk the theory by outlining the remaining Democratic primaries, in which Biden had no significant challenger, and the delegate math to secure the nomination.

Biden would have enough delegates to secure the nomination in just three weeks, Fabrizio explained, and it would be mathematically impossible to steal it in four weeks.”

The book, which is slated for an August 10 release is one of several highly anticipated postmortem accounts of Trump’s 2020 defeat. Bender conducted extensive research for the book, interviewing more than 150 people, including Trump, whom he traveled to Mar-a-Lago on at least two occasions to meet with.

Obama said, “I think we have to worry when one of our major political parties is willing to embrace a way of thinking about our democracy that would be unrecognizable and unacceptable even five years ago or a decade ago. When you look at some of the laws that are being passed at the state legislative level where legislators are basically saying we are going to take away the certification of election process from civil servants, secretary of states, people who are just counting ballots, partisan legislatures who may or may not decide a states electoral votes should go to one person or another. And when that’s all done against the backdrop of large numbers of Republicans having been convinced wrongly that there was something fishy about the last election, we’ve got a problem.”

He continued, “I thought that there were enough guardrails institutionally that even after Trump was elected that you would have the so-called Republican establishment who would say okay, you know, it’s a problem if the White House isn’t — doesn’t seem to be concerned about Russian meddling, or it’s a problem if we have a president who is saying neo-Nazis are marching in Charlottesville, there are good people on both sides.”

Obama added, “The degree to which we did not see that Republican establishment say hold on, time out, that’s not acceptable. That’s not who we are but rather be cowed into accepting and then finally culminating on January 6 where what originally was ‘Oh, don’t worry, this isn’t going in where. We’re just letting Trump and others vent.’, Then suddenly you now have large portions of an elected Congress going along with the falsehood.”

He concluded, “I didn’t expect that there would be so few people who say well, well I don’t mind losing my office because this is too important. America is too important.”

Where are those who rejected the John Birch Society, who stood up to Joe McCarthy in the ‘50s, who worked across the aisle to pass landmark Civil Rights legislation? Where are the Republicans of old who knew how to speak truth to power and who convinced Richard Nixon he had to resign for the good of the country? Where are the courageous Republicans who believed in conservatism, like Liz Cheney, who would say simply and truthfully, Joe Biden is President, Trump is not a patriot and does not represent our Party?

It started way before Trump, like the frog put in tepid water and the fire slowly turned up and the frog doesn’t jump out.

This has been with us since the John Birch Society, but our problem now is that the Republican Party leaders of conscience are too few and far between to sound the alarm. If there ever was a time to show courage and common sense, it is now.

As Republicans became more conservative, they argued more and more strongly for less government, greater defense spending and embraced cultural conservatism. They lost northern Republican moderates while gaining seats held by conservative Democratic southerners, but they didn’t embrace the complete crazies. They may have tolerated them, but Republicans were still a party that elected presidents and members of Congress who supported free and fair elections, an independent judiciary, a free press, bipartisan cooperation — and who rejected violence, overturning elections, undermining democracy. From Eisenhower to Bush, the Republican Party may have left a lot for us Democrats to disagree with, but we would have been hard pressed to describe them as the party with fascist, anti-democratic views and values. 

That has changed.

Actions show it: Republican-controlled legislatures passing bills in state after state gaming the system to stop people from voting on the front end and letting them change the election results on the back end; Congressional Republicans allowing an armed insurrection on Jan. 6 to be swept under the rug by rejecting a bipartisan commission; Arizona Republicans continuing the lie about the election results and engaging a phony and fraudulent “audit”; and too many rank-and-file Republicans falling for — and Republican leaders supporting — the likes of QAnon, which spreads falsehoods deliberately.

Polls show the destruction of the Republican Party: 70 percent of Republicans don’t believe Biden is the legitimate winner of the Presidential election; 23 percent of Republicans believe that “government, media and the financial world in the U.S. are controlled by a group of Satan worshiping pedophiles who run a global child sex trafficking operation”; 28 percent of Republicans believe “things have gotten so far off track, true Patriots may have to resort to violence in order to save the country.”

Here is the even bigger problem: When you examine Republicans who get their news from far- right sources and who are strong Trump supporters, 40 percent buy into those QAnon conspiracy theories and support violence. Their numbers are growing.

Former national security adviser Michael Flynn, speaking recently at a QAnon rally in Dallas, said that we should have an armed coup by the military like what happened in Myanmar.

I did some research. I got admitted into the South Dakota School of Mines and Technology in 1969 because despite a low GPA my SAT.

For example, at many top ranked schools, students scored within the 90th percentile of test takers. This means a score of 2100 or above for the SATs 

A professor told me that if I studied hard enough I could have been admitted into almost every university in the country.

One reason Christian believers in Jerusalem could observe so communal and socialistic a practice was their conviction that the return of Jesus was going to take place within a very short time, bringing the blessings of God’s Kingdom to all the earth. As the years wore on, however, and Jesus’ immediate return failed to materialize, churches founded in Asia Minor, Greece, and Italy relaxed such stringent requirements for membership.

Still, as late as a quarter century after Jesus’ crucifixion, the Apostle Paul, writing to the Christians in Corinth, could assure them that “the present form of the world is passing away” and the return of Jesus was now so very near, he said, that they might want to consider abstaining from sex within marriage and even from marrying itself (!) in order to prepare themselves spiritually for Jesus’ imminent return. (1st Corinthians chapter 7; Paul’s certainty about the extreme nearness of Jesus’ return can probably be attributed to a statement by Jesus that not all his original followers would die before his return: Mark 9:1; compare Matthew 16:28).

Of course, Jesus could be exceedingly demanding and envisioned an imminent godly Kingdom on earth in which there would be neither wealth nor poverty (Luke 6:20-26) and in which no one would attempt to rule over or take advantage of others, but all would strive toward being loving servants, even slaves, of one another, as he himself felt tasked to be, even to the point of dying for the sake of the vast “many” (Mark 10:42-45; see Isaiah 53:11-12).

In the political turmoil of today, it is regrettable that so many who claim allegiance to Jesus adamantly oppose any form of “common-ism,” even when practiced by democratic societies. It is disheartening to have to admit that several nations in our world today are far more responsive to Jesus’ communal teaching than are many American politicians who seem hell-bent on creating a government dedicated to pursuing the selfish greed they want to impose on all the rest of us.

The Senate released today an investigation into the January 6th attacks on the Capitol building. Axios reports.

Among the 20 committee recommendations:A department-wide plan for Capitol Police to create threat assessments for special events.Congress to provide USCP with additional funding for training and protective equipment.Give the USCP police chief unilateral authority to request National Guard support amid an attack.Intelligence agencies should report domestic terrorism data to Congress.DOD clarification of chain-of-command authorization to prevent delays in D.C. National Guard deployment.

The backdrop: The joint report comes shortly after Senate Republicans blocked a bipartisan, bicameral commission to investigate the insurrection.

A key argument from GOP leaders was that a 9/11-style commission would be duplicative of other investigations, including Tuesday's report from the Senate committees.However, the report clearly states its scope was limited, and "further scrutiny of these failures and the preparations and response of federal agencies" is needed.

What's next: House Speaker Nancy Pelosi (D-Calif.) must soon decide how to move forward on a congressional investigation into Jan. 6 now that the commission has failed.

She has several options she can take. We're told she's leaning toward the formation of a select committee, but that could change as leaders continue to negotiate the best path forward.

The proud socialist nation of Denmark passed a law on Thursday that would require the relocation of asylum seekers to third countries, outside of Denmark.

Human rights groups argue the law is “irresponsible” since there’s no plan established for where asylum seekers would actually be processed. Denmark would need to establish an agreement with a third country.

Nonetheless, the “Danish Alien Act” (as it is known in English) was passed 70 to 20 by the Danish Parliament.

Government spokesperson Rasmus Stoklund defended the Danish government to CNN, explaining, CNN writes:

…that the goal “is to stop people ‘applying for asylum in Denmark’ and free up resources, otherwise used on asylum claims, which can be used in refugee camps close to war zones where the government maintains refugees are in greatest need.”

Stoklund also told CNN that more than a half of asylum seekers were rejected by Denmark last year and that, if asylum seekers could be processed outside the nation, then the country may be able to reduce the number of people applying. This, he suggests, could potentially reduce crime rates and cut down on integration issues.

Many in Europe, however, are increasingly concerned about the move. Some fear it may create a climate where other nations will also enact strict measures to prevent asylum seekers from coming to their countries.

In recent years, Europe has struggled with the integration of many refugees relocating from Syria. The challenged of integration has inflamed tensions and created some unexpected challenges.

In the United States, there has been an ongoing political struggle at the U.S.-Mexico border. President Biden has made it clear that no asylum seeker will be turned away as they await their status.

I don’t know, from everything I’ve read, the politics in America during the Civil War seem to have been pretty heated. There was a fair amount of tension here in the late 1960s too. We’re sniping a lot at each other right now, but are we really at an all-time low?

I’m usually a big fan of political battles, especially now that the Democrats have moved to the left of Cuba. It would be nice if we could get along better but it’s just too much work now that common ground has practically disappeared into the ether.

The Senate report cited Donald Trump’s speech on Jan. 6 to a massive crowd of supporters that then marched to the Capitol, in an apparent attempt at balance, but did not conduct any thorough analysis of the former president's involvement.

The report will still likely cause consternation on the Hill. The No. 2 Capitol Police official and overseer of most of its uniformed officers, Chad Thomas, resigned Monday ahead of the review’s release. Senators' findings also put more pressure on Pittman, who led the department’s intelligence division during the attack.

Other findings in the report painted an unfavorable picture of the Capitol Police’s preparation and response to the insurrection.

No officers recalled hearing then-Chief Steven Sund on the radio during the attack, and they heard now-acting Chief Pittman only once, according to interviews with officers. Pittman said that an insufficient number of Capitol Police personnel were authorized to use less-lethal munitions like pepperballs and grenade launchers — officials have conceded those could have made a difference that day, but few officers were trained to use the equipment.

Top federal intelligence agencies failed to adequately warn law enforcement officials before the Jan. 6 riot that pro-Trump extremists were threatening violence, including plans to “storm the Capitol,” infiltrate its tunnel system and “bring guns,” according to a new report by two Senate committees that outlines large-scale failures that contributed to the deadly assault.

An F.B.I. memo on Jan. 5 warning of people traveling to Washington for “war” at the Capitol never made its way to top law enforcement officials. The Capitol Police failed to widely circulate information from its intelligence unit that supporters of President Donald J. Trump were posting online about pressuring lawmakers to overturn his election loss.

“If they don’t show up, we enter the Capitol as the Third Continental Congress and certify the Trump Electors,” one post said.

“Bring guns. It’s now or never,” said another.

The first congressional report on the Capitol riot is the most comprehensive and detailed account to date of the dozens of intelligence failures, miscommunications and security lapses that led to what the bipartisan team of senators that assembled it concluded was an “unprecedented attack” on American democracy and the most significant assault on the Capitol in more than 200 years.

“The failure to adequately assess the threat of violence on that day contributed significantly to the breach of the Capitol,” said Senator Gary Peters, Democrat of Michigan and the chairman of the Homeland Security and Governmental Affairs Committee. “The attack was quite frankly planned in plain sight.”

The 127-page joint report, a product of more than three months of hearings and interviews and reviews of thousands of pages of documents, presents a damning portrait of the preparations and response at multiple levels. Law enforcement officials did not take seriously threats of violence, it found, and a dysfunctional police force at the Capitol lacked the capacity to respond effectively when those threats materialized.

“The failures are obvious,” said Senator Amy Klobuchar, Democrat of Minnesota and the chairwoman of the Rules and Administration Committee. “To me, it was all summed up by one of the officers who was heard on the radio that day asking a tragically simple question: ‘Does anybody have a plan?’ Sadly, no one did.”

In response to the report, the Capitol Police said in a statement that its leaders agreed that the force needed improvement, including changing the way it collects and shares intelligence. But it insisted that law enforcement officials had no way of knowing that a pro-Trump rally would turn into a mass assault.

“Before Jan. 6, the Capitol Police leadership knew Congress and the Capitol grounds were to be the focus of a large demonstration attracting various groups, including some encouraging violence,” the statement said. But, it added, “neither the U.S.C.P., nor the F.B.I., U.S. Secret Service, Metropolitan Police or our other law enforcement partners knew thousands of rioters were planning to attack the U.S. Capitol. The known intelligence simply didn’t support that conclusion.”

The report is the product of a collaboration among Mr. Peters, Ms. Klobuchar and the top Republicans on the two committees they lead: Senator Rob Portman of Ohio on the Homeland Security Committee and Roy Blunt of Missouri on the Rules Committee. The inquiry does not describe the events of Jan. 6 as an “insurrection,” a term many Republicans had joined Democrats in embracing immediately after the attack. Aides involved in its drafting said they had refrained from trying to summarize or contextualize Mr. Trump’s false claims just before the riot took place. They opted instead to include the full text of his speech in an appendix.

Many of the findings in the report were culled from public testimony from committee hearings, though five people sat for detailed interviews with the committee: Christopher C. Miller, who was the acting defense secretary; Ryan D. McCarthy, the Army secretary; Gen. James C. McConville, the Army chief of staff; Yogananda D. Pittman, the acting chief of the Capitol Police; and J​. Brett Blanton, the architect of the Capitol.

The committee staff solicited more than 50 statements from Capitol Police officers that painted a vivid portrayal of the rioters, some of whom gave Nazi salutes and hurled racist slurs at them. One officer described being crushed by the mob. Another told the committee that she still suffered from chemical burns she experienced that day.

About 140 law enforcement officers reported injuries from the riot. The bipartisan report also tied seven fatalities to the assault, including five protesters who died and three police officers who died in its aftermath, two from suicide.

The document lays out profound problems with the special Capitol Police unit that handles civil disturbances, only a fraction of which was adequately trained to respond to a riot, and which was poorly equipped. On Jan. 6, its officers were not authorized to wear protective gear at the beginning of their shifts or to use their most powerful nonlethal weapons — such as grenade launchers and sting ball grenades — to push back crowds, because they lacked the training to do so.

“Let’s be honest: Capitol Police were put in an impossible situation,” Mr. Portman said. “Without adequate intelligence, training and equipment, they did not have the tools to protect the Capitol.”

The committees recommended 20 improvements, like beefing up police training and equipment and forming a single intelligence bureau in the Capitol Police to better share information. Their suggestions followed those from Lt. Gen. Russel L. Honoré, a retired Army officer whom Speaker Nancy Pelosi of California chose to lead a House task force that recommended the hiring of more than 800 Capitol Police officers, the construction of mobile fencing around the complex and changes to Capitol Police Board procedures to allow the agency’s chief to quickly summon the National Guard in an emergency.

Mr. Blunt said that he and Ms. Klobuchar would soon introduce legislation to grant the Capitol Police chief power to unilaterally summon the National Guard in emergencies. He said they were also likely to assemble a spending bill to increase funding for the department and carry out other changes.

There was much information the panel was unable to learn. The senators secured only limited cooperation from key agencies, including the F.B.I., the Department of Homeland Security, the Justice Department and the House sergeant-at-arms. Other agencies failed to meet deadlines to hand over documents.

The findings — and their limitations — are likely to fuel renewed calls for an independent commission like the one created after the Sept. 11, 2001, terrorist attacks, populated by experts and armed with subpoena power to investigate what happened that day and why. Senate Republicans blocked the creation of such a body late last month, arguing in part that it would duplicate the work already underway by the Senate committees and prosecutors at the Justice Department.

“This report is important in that it allows us to make some immediate improvements,” Mr. Peters said. “But it does not answer some of the bigger questions that we need to face, quite frankly, as a country and a democracy.”

It does, however, offer a detailed accounting of more than a dozen intelligence failures.

“Neither the F.B.I. nor D.H.S. deemed online posts calling for violence at the Capitol as credible,” the report states.

It faults the Department of Homeland Security’s Office of Intelligence and Analysis for issuing “no intelligence products specific to Jan. 6” while it issued 15 other documents on unrelated domestic extremism without “any mention of the joint session of Congress or the Capitol.”

The report also describes the “absolutely brutal” abuse of the Capitol Police, which employs more than 1,800 sworn officers and whose $500 million budget exceeds that of the police forces in Detroit, Minneapolis and St. Louis.

“At one point, I was pushed so hard and crushed in between people that I could not breathe,” one officer reported.

“I specifically remember being sprayed with bear spray at least six to eight times while tussling with rioters who were trying to use the bike racks against us as weapons,” another told the committee.

Many questions remain unanswered, ranging from the criminal — such as who was responsible for the pipe bombs that were placed outside the headquarters of the Democratic and Republican National Committees — to the strategic: Is law enforcement doing enough to combat right-wing extremism?

The senators said they planned to press on with their investigation.

“The American people certainly do deserve to get all the facts about this attack,” Mr. Peters said.

The Biden Administration is abusing state power to create the appearance of a conspiracy to commit an insurrection on January 6th, 2021 at the U.S. Capitol. The problem is the indictment they just filed with the Circuit Court of the District of Columbia—it proves there was no conspiracy.

The malfeasance of the FBI, the Department of Justice, and the judges involved with the arrest and incarceration without bail of many of those who participated in the riot at the Capitol have been covered brilliantly in a series of pieces by Julie Kelly. These events are abhorrent to anyone who believes in the rule of law and better suited to a totalitarian police state removing political enemies. America is not supposed to have indefinite detention based on political beliefs, and yet here we are.

This treatment is all the more heinous when compared with the near-total lack of interest in prosecuting the year plus-long violence and destruction perpetrated by Black Lives Matter (BLM) and Antifa, some of which involved the seizure and continued occupation for weeks of government buildings. This is a far step from equal treatment under the law and should bring a concerted response from all those on the right who oppose tyranny.

Many of the acts described in the indictment are Constitutionally protected, but it seems that fades away when the left doesn’t like the reason they are being exercised. They attached the term “Big Lie,” a Nazi reference, to any disputes over the 2020 elections. Now they act empowered to treat any related activities as outside the law by that fictional connection.
