Trials, tribulation, and court rulings regarding missing Texas Democrats

 So yesterday we had this:

Activist Judge Throws the Fugitive Texas Democrats a Lifeline

Gov. Greg Abbott has officially called another special session, forcing the Texas Democrats who fled to block a voter integrity bill to continue their foolhardy charade. But now, an activist judge has stepped in to throw them a lifeline. The Democrat (Judge) has signed an order to block enforcement of the arrest warrants put out for the Texas Democrats. Those arrests are allowed under the Texas Constitution as a way to force the appearance of lawmakers who refuse to show up to do their jobs.

Basically a judge provided a two week window where Democrats could conceivably return  home, not have to go to session and also not be arrested. The concept is that this same Judge could conceivably extend that two weeks indefinitely  The reason why Democrats have fled Texas repeatedly is that not attending legislative sessions is actually against the law and staying in the state makes them a wanted criminal who could be arrested. The order would appear to make it okay for these Democrats to come home and still not go to work.

But today we have this:

Texas Supreme Court: Gov. Abbott Can Defund Legislature Branch
The Texas Supreme Court rejected the Texas state Democrats’ request to overturn Gov. Greg Abbott’s veto on funding the legislature branch. he Democrats argued Abbott violated the constitution and separation of powers. Abbott cut the funding after the Democrats fled to D.C. to avoid doing their job. They disagreed with voting legislation making it harder to cheat.

However, according to the Texas Supreme Court, if Democrats do not come back into session then the entire Texas legislative branch will be defunded at the end of September. So it looks like the shit is about to hit the fan either way. Abbot and the Republicans will not address the bill that would replace the funding until the voting legislation is voted on.

Secondly, the district judge who "threw the Democrats a lifeline" will likely be overturned even before getting to the Texas Supreme Court. The law is the law is the law, and a Judge ultimately has no real authority to change legislative laws. This one is pretty clear. So that victory will ultimately be short lived. 

Ultimately the Texas Democrats will be required to leave the state for good (or be arrested upon return) or they can simply not get paid or not have real jobs as legislators if they refuse to come back and actually do those jobs. This will not end well for them. The longer they hold out, the more humiliating their return and eventual cave will be.

In the last few months I have come to believe that you are an authoritarian person. It's not race related.

But I know enough about history and I feel that if the Republicans succeed, the minority will have total control over the institutions.

The hard right wing, wants to get rid of the FBI and turn the DOJ back into the lawyer for the President.

Even though Bill Barr refused Trump's demands to arrest Joe Biden and Hunter Biden, and the news that has come out, Trump almost staged a coup.

"It’s been a long and winding road, but we have persisted and now we have arrived," Senate Majority Leader Chuck Schumer, D-N.Y., said on the Senate floor before the vote. "There were many logs in our path, detours along the way, but the American people will now see the most robust injection of funds into infrastructure in decades."

"It's been a long time coming," he added.

All told, the bill will provide:

$110 billion for roads, bridges and other major projects

$11 billion for road safety

$39 billion to modernize public transit

$66 billion for passenger and freight rail

$15 billion for electric vehicles, buses and charging infrastructure

$25 billion for airports

$17 billion for ports

$50 billion for water infrastructure

$55 billion for clean water efforts, like replacing lead pipes

$65 billion for high-speed internet and broadband infrastructure

$21 billion to aid environmental clean-up

$73 billion for power infrastructure

resigned after the state attorney general said he violated sexual harassment laws, the New York Times reports.

Cuomo called for a “seamless” transition as Lt. Gov. Kathy Hochul (D) takes over.

It’s a remarkable turn of events for a governor who was hailed a national leader just a year ago during the coronavirus pandemic.

The "Infrastructure"(LOL) bill is a fucking inflation bomb, and folks are waking up to that fact.:



Fifty-nine percent (59%) of voters nationwide believe increased government spending leads to inflation. A Scott Rasmussen survey found that only 14% disagree and 27% are not sure.

Seventy-eight percent (78%) of Republicans see a connection between spending and inflation. Democrats, by a 45% to 21% margin, tend to agree. Among Independent voters, 45% believe more government spending leads to inflation while 11% do not.

These numbers help explain why just 22% of voters want Congress and the President to increase federal spending next year. Thirty-nine percent (39%) want spending to be cut and 21% would like it to remain about the same. That finding reflects a marked change from a year ago when just 14% of voters wanted the government to stop spending more money.

1/ Funny story about @TaylorLorenz, @nytimes reporter and champion of transparency (best-known for eavesdropping on Clubhouse because THE PUBLIC HAS A RIGHT TO KNOW!)

Oops! Seems @TaylorLorenz decided she wanted the Tweet to go bye-bye forever and so took advantage of the fact she technically owns the rights to it to make it so.

I think the same arguments exist for both Trump and Biden. Whatever allegations of sexual harassment was tossed around, they existed prior to either of them becoming President. As far as I know, there were no allegations that Trump or Biden committed sexual harassment while on the job.

That means that in both cases the voter chose those men to be President in spite of allegations of sexual harassment and other things. Those were vetted, known, and people could make an informed decision as to whether or not it disqualified them from being President.

I sort of agree with Psaki on this one (go figure).


Cuomo, on the other hand, is being accused (apparently credibly) by women who claim to have been harassed while Cuomo was on the job. In pretty much all of these cases, these claims were not vetted and known when Cuomo was elected.

Now if Cuomo wants to resign today and run again for the next election. Then New Yorkers could choose to reenlist him as Governor in spite of these allegations. But at this point, these things are coming up as new claims.

There are enough of them and they seem credible enough for Cuomo to resign.

I'd agree with you if I thought we had an impartial press, big tech and justice department.

We don't, so many people voted unaware. How many voters knew Hunter's laptop was real ? Joe lied about that during a debate. He alluded to 50 former intelligence officers saying it was Russian disinformation. They lied. And Biden had to know they were wrong. Hasn't admitted he is the "bif guy" of course if he did he would be admitting to tax fraud.

Not really sure about the Reade accusation, just that it was not fully vetted...

Gov. Ron DeSantis on Wednesday addressed the rising number of coronavirus infections in the state and said the key to stopping a surge in COVID-19-related hospitalizations and deaths is to increase the statewide vaccination rate.

“These vaccines are saving lives. They are reducing mortality,” DeSantis said during a news conference in St. Petersburg. “I can tell you that we’re going to end up having over 95% of folks that end up seriously ill from this point on are going to be people who are not vaccinated. And so, that’s the single most important thing that people can understand.”

DeSantis addressed vaccine hesitancy, saying that the benefits of the vaccine outweigh the small risk of side effects.

“There are occasionally some side effects, but if you’re 70 years old, man, the benefit is so much better than worrying about some of that. It’s not even close,” he added.

In a new letter to congressional leadership today, the Congressional Progressive Caucus underscores that there is significant support for Pelosi staying the course.

As part of this shared commitment, the Congressional Progressive Caucus has recently concluded an internal survey of its 96 members regarding the urgency of ensuring that a narrower bipartisan infrastructure agreement is enacted on the condition that a robust package of social, human, and climate infrastructure—reflecting all Democrats’ longstanding priorities—is simultaneously passed by simple majorities in Congress through the budget reconciliation process.

We specifically asked whether members would commit to withholding a yes vote on the bipartisan infrastructure deal — Senate Amendment 2137 to H.R. 3684 — until the Senate has passed budget reconciliation legislation deemed acceptable by the Congressional Progressive Caucus. A majority of our respondents affirmed that they would withhold their votes in support of the bipartisan legislation in the House of Representatives until the Senate adopted a robust reconciliation package.
