Arbery Trial - Guilty Verdicts Handed Down

Travis McMichael - Guilty across the board

Greg McMichael - Not guilty of Malice Murder, guilty of everything else

William R Bryan - Not guilty of Malice Murder, mostly guilty of the rest

This is not surprising based on everything we have seen and what most legal analyst I follow were expecting. Branca seemed to be the only one who really believed that they might get off, while McCarthy and most other legal analysts I follow sort of expected the result that we saw. Travis McMichael guilty of everything and the other two not guilty of Malice Murder. The only real question was whether or not Greg McMichael and William Bryan would be found guilty of the lower forms of Murder (non-Malice). In this case they were.

I didn't watch the trial and only caught some of the glimpses of what happened. I still believe that calling Arbery a "jogger" was a blatant misrepresentation of the truth. I still don't trust the media to report on this accurately. This wasn't as cut and dried as it was made out to be. I also don't know what was actually presented to the jury and what was only presented to the public. Many times we question why something was not considered by a jury, only to find out that the information was not every presented or was not allowed to be presented. 

All that being said, a jury of 12 have found the three to be all guilty of some form or murder here. So you have to accept that what they witnessed over the course of this trial led to these convictions. Was politics in play? Probably. But that is sort of the reality of what is happening today.

The big lesson to be learned here. If you are going to establish a neighborhood watch to police your neighborhood. Probably not a good idea to arm yourself with rifles and handguns and go chasing people down. Had it not been for the guns and the fact that they tried to detain him (rather than just follow him), then the police might have been able to get involved to whatever degree that they could. Perhaps this guy (one way or the other) decides to stop lurking around your neighborhood and nobody has to die.

A Georgia jury has convicted three white men of murder in the death of Ahmaud Arbery.

Travis McMichael, who shot fatally shot Arbery in February 2020, was convicted on all nine charges, including malice murder and four counts of felony murder.

McMichael's father, Gregory McMichael, 65, was found not guilty of malice murder, but was convicted on the remaining charges, including the felony murder counts.

Travis McMichael was found guilty on all counts, including one count of malice murder and four counts of felony murder. Gregory McMichael was found guilty of four counts of felony murder and acquitted on a charge of malice murder. Mr. Bryan was convicted on three counts of felony murder and acquitted on malice murder and an additional felony murder charge.

Mr. Arbery, a 25-year-old Black man, was unarmed when he was confronted by the McMichaels in Satilla Shores, a predominantly white residential area outside Brunswick. Prosecutors argued that Mr. Arbery was out for a run that day and that the defendants hunted him down based on unfounded suspicions that he was a neighborhood thief.

Attorneys for the three men, who are white, argued that they had good reasons to suspect Mr. Arbery was responsible for burglaries and thefts in their neighborhood and that they sought to detain him for police


Mr. Arbery’s death drew national attention after a video showing the fatal shooting circulated, with many Black civil-rights groups and leaders calling it an example of racist vigilantism. The Rev. Jesse Jackson and the Rev. Al Sharpton both attended the trial in support of the Arbery family. The case put laws authorizing citizen’s arrests under scrutiny and led to the passage of a hate-crime law in Georgia.

The men could face life in prison when they are sentenced.

Federal prosecutors have charged the three men with federal hate crimes in connection with the killing.

Prosecutors said the defendants had "assumed the worst" about a Black man out on a Sunday afternoon jog. He was chased by the defendants for about five minutes around the looping streets.

Arbery's mother, Wanda Cooper-Jones, looked up appearing to mouth silent prayer in the courtroom as the judge prepared to read out the verdict. As the first guilty verdict was read aloud, she sobbed aloud: "Oh!"

Her head sunk into her chest as she wept, with civil rights activist the Rev. Al Sharpton gripping her hand. Arbery's father Marcus Arbery leapt up and cheered.

Sheriff's deputies came over and told him he had to leave.

"It's been a long time coming," Marcus Arbery said, and left.

Outside the courthouse, a crowd of more than 100 people gathered and cheered yelling "justice" and "yes" as the verdicts were read, some waving flags including one for the Black Lives Matter movement.

Travis McMichael, looking red-faced, turned as he stood to leave the courtroom and mouthed "love you" to his mother, Leigh.

"I'm floored, floored with a capital 'F,'" Laura Hogue, one of Gregory McMichael's lawyers, said in the courtroom.

Some Black Americans used a despairing phrase to describe a case seen as another example of Black people falling under suspicion while innocently doing an everyday activity: "running while Black." Arbery's name was added to those invoked in nationwide anti-racism protests in 2020 that erupted after the police killings of George Floyd and Breonna Taylor, both of whom were Black.

The prosecution was widely seen as another test case in how the U.S. justice system handles instances of unarmed Black people killed by white people. During the trial, there was almost no evidence presented or discussion of race as a motive.

The issue of race hung over the trial. A nearly all-white jury was selected, and one of the defense lawyers repeatedly, but unsuccessfully, sought the removal of Black pastors and civil rights leaders including the Rev. Jesse Jackson from the courtroom.

Superior Court Judge Timothy Walmsley said he was required to accept the "race-neutral" reasons defense lawyers gave for the removal of all but one potential Black juror. Black activists said it showed again how the justice system was skewed against Black Americans.

CITIZEN'S ARREST

Defense lawyers cited a Georgia law codified during the 19th century U.S. Civil War that allowed anyone to make a citizen's arrest of someone they have reasonable suspicion is fleeing a serious crime they committed. The law was repealed in the wake of Arbery's killing.

Today, the jury rendered its verdicts and the three defendants were found guilty of murdering Ahmaud Arbery. Still, we feel the weight of grief. Ahmaud Arbery should be alive, and nothing can take away the pain that his mother Wanda Cooper-Jones, his father Marcus Arbery, and the entire Arbery family and community feel today. I share in that pain.

These verdicts send an important message, but the fact remains that we still have work to do. The defense counsel chose to set a tone that cast the attendance of ministers at the trial as intimidation and dehumanized a young Black man with racist tropes. The jury arrived at its verdicts despite these tactics. 

Ahmaud Arbery was a son. He was a brother. He was a friend. His life had meaning. We will not forget him. We honor him best by continuing the fight for justice.

I'm old enough to understand how important it is. In the 60s the white men would not have been charged for crimes.

The killing of Ahmaud Arbery, a young Black man who had the gall to jog through a mostly White neighborhood, was nothing but a classic lynching of the kind that could have happened a century ago.

We can say that in plain English now, with no hemming and hawing, following Wednesday’s jury verdict finding Arbery’s killers guilty of murder, aggravated assault and false imprisonment — the same crimes that White lynch mobs once regularly committed against Black Americans with impunity.

Lawyers for the three defendants — Travis McMichael; his father, Greg McMichael; and their friend William “Roddie” Bryan — played the race card repeatedly throughout the trial, perhaps seeing it as the only card they had. In Brunswick, Ga., a town where almost 60 percent of the population is Black, they managed to seat a jury with only one Black member. They resorted to just about every racist trope used to denigrate and demonize Black men over the years, suggesting that the armed killers had reason to fear the slight Arbery’s allegedly inhuman strength and malice. One defense lawyer, Laura Hogue, even went so far as to tell the jury that Arbery had “long, dirty toenails.”


Those defense attorneys utterly failed. It took just 11 hours of deliberation for the almost all-White jury to find the three White defendants guilty of lynching a Black man. Maybe there’s a glimmer of hope for justice in these United States after all.
