While we do not know what exactly is going on in the jury room, in the courtroom we literally have the state emailing themselves the file in an attempt to prove that the file name and metadata can change through a simple email correspondence. As someone who receives documents daily as part of my job, there is absolutely zero evidence that these files "change" in any transmission.
It appears now that the State is arguing that they either made a mistake or that there was a technical glitch, because they deny that they made any attempts to change the video before sending it. However, what the prosecution received is not just a lower definition, but it was in black and white (the video the State has is in color). More to the point, the time stamps and metadata do not appear to be the same.
This is a situation where the Judge in question is probably not technical enough to know for sure what is going on. I might suggest he call up any number of about 10 million computer techs to see if emailing a 1920 color HD video can mysteriously change on it's own to a 480 black and white low resolution video. I doubt he will find anyone who suggests that is possible.
Moreover, the defense might be willing to stipulate to an actual mistrial (without prejudice) rather than with prejudice as requested. But withholding of evidence (which this certainly appears to be) is grounds or a mistrial with prejudice and sanctioning and investigating of the prosecution team.
