Gabbard is exactly right. The issue with the prosecution isn't that the prosecutor is bad (although he might be). The issue with the prosecution is that the case is bad. Trial attorneys are known to have a saying. When the facts are on your side, you pound the facts. When the law is on your side, you pound the law. When neither is on your side, you pound the table.
Sometimes that works. Sometimes just creating enough charged up emotion can overcome the tedious concept that the charges being brought are not actually being proven or that an obviously guilty person might get off due to tricky lawyering. But in this case, the prosecution is just downright looking bad with all the table pounding. It's all they have and Kyle Rittenhouse is not coming off as any sort of bad guy, much less a mass murderer.
At the end of the day, the jury will be forced to decide what they probably would have done given those same circumstances. The prosecution is flailing with the concept that Rittenhouse is guilty because he was just there (when he didn't have to be). But the same thing can be said for everyone. Rosenbaum and gang would be alive today if not for going to a riot, and deciding to chase down a 17 years old kid with an assault rifle. If stupidity was a crime, those people paid the ultimate price.

A lack of technical knowledge may have just influenced an important court case. The New York Times reports the defense for shooter Kyle Rittenhouse incorrectly claimed that an iPad's pinch-to-zoom function could modify footage of the incident, "creating what it thinks is there, not what necessarily is there." That sparked a debate between lawyers and Judge Schroeder, who maintained the burden was on the prosecution to show the imagery remained in its "virginal state," not on the defense to prove manipulation.
The judge may have accepted the argument. He denied the prosecution's request for an adjournment and instead called for a 15-minute recess, suggesting the team could find an expert to support their claim in that space of time. They didn't, and The Verge noted that the trial resumed with the jury watching zoom-free video on a Windows PC connected to the courtroom TV.
They did their research. They were going to prosecute because that is what the woke mob demanded.
Rittenhouse was extremely fortunate to draw a judge whose loyalty to the US Constitution outweighed his loyalty to party.
Somebody said yesterday that it appeared the prosecutor wanted to go so far against the defendant's rights so as to force the judge to declare a mistrial.
That would allow the left to claim victory because it was an old white judge who "subverted" justice, even if he was placed there by a Democrat.
And give the state media a narrative (supplied by the DNC)
What I find just as outrageous is that the FBI drone footage existed (including audio) from day 1 which would have shown the truth. When the defense got a hold of leaked grainy video of the original FBI HD drone video they were forced to acknowledge it was real and they had taken it.
But now supposedly lost it.

"The alleged raid comes after the Houthis kidnapped three Yemeni nationals affiliated with the U.S. Embassy from one of the employee's private residences in Sana'a on November 5," according to MEMRI. At least 22 other Yemenis were kidnapped by the Houthis in recent weeks, "most of whom worked on the security staff guarding the embassy grounds," according to MEMRI.
The State Department confirmed to the Free Beacon that the Yemeni staffers are being detained without explanation and that the Iran-backed militants stole property after breaching the American facility in Sana'a, which housed U.S. embassy staff prior to the suspension of operations there in 2015.

The trial this week of Kyle Rittenhouse, charged with homicide for the killing of two unarmed men during the unrest after police shot Jacob Blake in the back, is arguably one of the most polarizing the country has seen in recent times.
Schroeder's behavior has been the subject of a good deal of outrage as he – on live TV – repeatedly berated the prosecutor Wednesday. Some legal experts indicate his anger at the state's attorney might be justified, but at the very least most seem to agree it should not have been done in public.
Wednesday afternoon many were stunned when Judge Schroeder's phone went off in the middle of the trial.
Schroeder quickly grabbed it and angrily turned the ringer off, but as several noted, his ringtone is the same song Donald Trump used as his theme song at his MAGA rallies, known to some as "Proud to be an American," officially "God Bless the U.S.A."
There's nothing wrong with the song itself, but given how Trump himself has repeatedly "endorsed" Rittenhouse, even traveling visiting Kenosha, the scene of the killings, some are expressing concern.
Civil rights attorney Timothy Welbeck, the Director of the Center for Anti-Racism Research, and an Assistant Professor of Instruction at Temple University, called it "outrageous."
"This is outrageous," he tweeted in response to a video of Judge Schroeder's phone ringing. "Aside from the obnoxious disruption it causes (I've seen judges threaten defendants and witnesses with jail time when their cell phones rang during court proceedings), it further reveals Judge Schroeder's potential for bias in this matter and related ones."
Last summer at a White House press briefing Trump told reporters his thoughts about Rittenhouse: “You saw the same tape as I saw, and he was trying to get away from them."
“I guess it looks like and he fell and then they very violently attacked him and it was something we're looking at right now and it's under investigation," Trump said, as CNBC reported August 31, 2020. “I guess he was in very big trouble. He probably would have been killed. But it's under investigation."
One day earlier The New York Times reported "the president even 'liked' a tweet that offered support for Kyle Rittenhouse, a 17-year-old Trump supporter who has been charged with homicide after two demonstrators were shot to death in Kenosha, Wis. 'Kyle Rittenhouse is a good example of why I decided to vote for Trump,' the tweet said."
Former Republican and former federal prosecutor Ron Filipkowski, now a Democrat, was among the first to identify the song:

A report of a gunman on the loose in New Milford -- which triggered a lockdown of all borough schools Thursday morning -- thankfully was proven unfounded, Police Chief Brian Clancy said.
"It was a hunter walking to his car," Clancy said. "He is hunting out of state, not in New Milford. There is absolutely no threat."
Borough schools were placed on lockdown and then sheltered in place as police investigated what turned out to be a rumor that a man carrying an assault rifle -- and possibly two -- was seen on Hoffman Avenue near the Berkeley Street Elementary School.
Another rumor was that he was a suspect in an armed robbery.
All false.
Reinforcements poured into town almost immediately.
The Bergen County prosecutor's and sheriff's offices assisted in the search, along with police from Bergenfield, Cresskill, Dumont, Oradell and River Edge, Clancy said.
The chief thanked them all.
