A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit — including President Joe Biden’s first and only appointee to that court, Ketanji Brown Jackson — will instead hear arguments in the matter on Nov. 30.

The delay is a minor setback for the House Jan. 6 committee, which had prevailed in U.S. District Court against Trump’s legal effort to block access to his records altogether. The National Archives, which house Trump’s records, had been preparing to deliver them to the committee on Friday afternoon.

The committee has repeatedly emphasized the urgency of accessing Trump’s records as it explores the former president’s effort to overturn the 2020 election results, including the Jan. 6 assault on the Capitol that disrupted the electoral vote count and sent lawmakers fleeing in fear. You call this fake news

Despite claims of urgency, the House did not object to Trump’s request for a temporary injunction while the appeals court considers the broader issues. The Justice Department also took no position on the temporary stay.

The composition of the appeals court panel is likely to hearten House investigators. The order issued on Thursday indicates that, in addition to Jackson, the panel includes Judges Patricia Millett and Robert Wilkins, who were appointed by former President Barack Obama to the court.

Despite the slowdown, the case is still moving at breakneck speed through typically slow-moving federal courts. Trump filed suit in mid-October to block the Jan. 6 committee’s access to his records. A District Court judge, Tanya Chutkan, rejected Trump’s effort on Tuesday, dismissing the notion that a former president could overrule the sitting president on matters of executive privilege.

Trump quickly appealed the decision and asked the appeals court to delay the effect of Chutkan’s ruling until fuller arguments could be heard. The appeals court’s decision to set a two-week briefing schedule keeps the case moving on a fast track. Trump is due to file his written brief in the case on Tuesday, with a reply by the National Archives and the House on Nov. 22. Trump will have an additional reply on Nov. 26 before oral arguments the following week.

If Trump loses in the three-judge panel, he has the option to appeal to the full appeals court or the Supreme Court.

Autumn is bringing colder weather, particularly to the more northern states, so people in the north are spending more time indoors. More time indoors means more people are in situations where they are more likely to catch the virus. So we’re going to see the number of infections in the northern states increase and stay high, probably through the winter — or at least until the virus runs out of people to jump into because everyone either has protection from vaccination or protection from past infections.

Considering they are Obama/Biden Judges it's a miracle they didn't summery make a decision in favor of the Democrats.

National Grid emailed upstate New York customers earlier this week warning them that average monthly home heating bills will be $46 higher than last winter — an increase of nearly 50 percent.

The news comes as consumers are facing substantial increases in the cost of everything from groceries, clothing, pet food, car parts and home improvement supplies amid the worst price inflation since 1990.

But it is especially troubling because National Grid had already told customers a month ago that their heating bills would be 31 percent higher than last winter because of a huge spike in wholesale natural gas prices.

The revised forecast will mean that the average National Grid customer - who typically paid $100 a month for their heat last season - will now have to shell out $147 a month to stay just as warm this winter.

That's $15 higher than National Grid had predicted just a month ago.

Those numbers, of course, are just estimates and based on a typical upstate New York winter with cold and sometimes frigid temperatures over the next five months.

Why such a shock on utility bills? The most simple answer is that inflation is having its biggest impact on energy prices, which have increased 30 percent over the past 12 months according to data released Wednesday by the U.S. Department of Labor.

The Biden administration is searching for a job to give Terry McAuliffe following his defeat in the race to be Virginia governor last week, according to a new report.

Punchbowl News reported Thursday that White House officials are looking to place the former Democratic National Committee chair somewhere in the hierarchy. The report cited “multiple high-level sources familiar with the White House’s thinking.”

It is unclear what position McAuliffe would hold, but the report noted that he is not actively seeking work in the administration.

It’s hard to see how we can address these and other social disparities if we can’t have honest conversations about what’s driving them. And the political left’s attempts to silence truth-tellers will only delay those conversations. Earlier this year, a Georgetown University law professor was terminated for musing aloud that year after year, many of her black students tended to have the lowest grades. Not long ago, a University of Pennsylvania law professor expressed a similar sentiment and was reprimanded for her remarks.

In neither case did anyone present evidence showing that what the professors said was untrue or that they harbored any ill will toward black students. They were attacked—as racists, no less—for saying something that is well-known among academics at elite institutions but that you are not permitted to discuss.

But why wouldn’t black students who are admitted to highly selective schools with poorer academic credentials be struggling? College admissions tests, at the undergraduate and graduate levels, do a fairly good job of predicting how a first-year student will fare. “A number of studies have shown that blacks at elite colleges have GPAs that place them somewhere between the 15th and 20th percentile of white students,” write Richard Sander and Stuart Taylor Jr. in their 2012 book about affirmative action, “Mismatch.” Moreover, “only 5 percent of blacks and less than one-tenth of Hispanics end up in the top fifth of the class, and blacks are four or five times as likely as whites to end up in the bottom tenth.”

If schools knowingly admit applicants with lower test scores than the average student at the institution, it’s no great shock that those students are concentrating at the bottom of the class. Racial preferences in college admissions set up smart kids to fail, and school administrators take it out on professors for stating the obvious. The student who would do fine at less-selective Michigan State gets shoehorned into the more-selective University of Michigan because affirmative-action advocates care more about racial and ethnic diversity than they do about graduation rates.

The learning gap in education is no less a concern than the gun violence in our inner cities. There’s a strong case to be made that the two are closely connected, given that our jails and prisons aren’t teeming with college graduates. We ought to be having serious discussions about how best to move forward on both fronts. But that’s less likely to happen if well-intentioned people can’t state simple truths in public without having their character assassinated and their livelihood threatened.

So I asked one of our nation’s preeminent historians, Princeton University professor Allen C. Guelzo, to explain CRT and why it is so dangerous.
Critical race theory, Guelzo says, is a subset of critical theory that began with Immanuel Kant in the 1790s. It was a response to — and rejection of — the principles of the Enlightenment and the Age of Reason on which the American republic was founded. Kant believed that “reason was inadequate to give shape to our lives” and so he set about “developing a theory of being critical of reason,” Guelzo says.
But the critique of reason ended up justifying “ways of appealing to some very unreasonable things as explanations — things like race, nationality, class,” he says. Critical theory thus helped spawn totalitarian ideologies in the 20th century such as Marxism and Nazism, which taught that all human relationships are relationships of power between an oppressor class and an oppressed class. For the Marxists, the bourgeoisie were the oppressors. For the Nazis, the Jews were the oppressors. And today, in 21st century America, critical race theory teaches that Whites are the oppressors.
In CRT, “all White people are instinctively white supremacists,” Guelzo says, adding, “I say ‘instinctively’ because this is not a function of reason.” This is why its advocates talk about “systemic racism” — a CRT term that has crept into our public discourse and has even been embraced by President Biden. “Systemic sounds like systematic, except of course that it isn’t,” Guelzo says. “When you try to find something that is systematic, then you have to go find evidence.” But “systemic implies something so deep and so instinctive that you’re not even conscious of it. … [that] there is an instinctive bias that is built into people of certain colors.”
CRT rejects democracy as a “relic of Enlightenment reason,” Guelzo says, and argues that White people “use tricks like democracy and the search for truth … to exploit and oppress and dominate people of color.” Don’t take his word for it. Richard Delgado and Jean Stefancic, authors of “Critical Race Theory: An Introduction,” state that “critical race theory questions the very foundations of the liberal order, including equality theory, legal reasoning, Enlightenment rationalism, and neutral principles of constitutional law.”

Because critical theory rejects reason, it cannot be questioned. Under this rubric, Guelzo says, the only purpose of questions is to serve the interests of the oppressive class, and “any answer you come up with, which doesn’t speak in terms of some hidden structure of oppression, can simply be dismissed as part of the structure of oppression.” For example, “if you believe, as the Nazis did, that the Jews are responsible for all political and economic events, then my pointing out that the overwhelming majority of political leaders are not Jews merely shows that I am either a dupe of the Jews or that I’m in on the fix.” Similarly, if you question whether all White people are oppressors, “the questioning itself is an example of how you’re in on the oppression.”
For advocates of CRT, the only solution to systemic oppression is the “inversion of color power,” Guelzo explains. So while most Americans oppose racial discrimination, critical race theory embraces it. Ibram X. Kendi, one of CRT’s leading advocates, openly declares: “The only remedy to racist discrimination is antiracist discrimination. The only remedy to past discrimination is present discrimination. The only remedy to present discrimination is future discrimination.”
This is the opposite of what the civil rights movement stood for. The Rev. Martin Luther King Jr. did not argue that America was systemically racist; he argued that racism was un-American. He appealed to the Enlightenment ideals contained in what he called our “magnificent” Declaration of Independence and Constitution, and declared his goal was to take “the whole nation back to those great wells of democracy, which were dug deep by the Founding Fathers.” King argued Bull Connor, head of the Birmingham, Ala., police, and the Southern racists were violating the principles of the American founding. But critical race theory argues the opposite — that Connor was the fulfillment of the American founding, because America was founded to perpetuate white supremacy.
Why is this dangerous? As Richard M. Weaver famously said, “Ideas have consequences.” Critical theory has led to the rise of ideologies that have killed millions. “We have paid severe prices at those moments when people have lost faith in reason and decided to defect to something else,” Guelzo says. “Those are the moments when genocide rears its hideous head.”
By rejecting reason, he argues, critical race theory could provoke a backlash that drives others “into equal, but opposite irrationality” such as “genuine white supremacy. … If your critical race theory is impervious to questioning and evidence, then fine: I will retreat into my critical race theory and it too will be impervious to evidence and the questioning. At which point then the only solution becomes violence.”
This is why CRT is so dangerous — and must never be used to indoctrinate America’s children.

A self-styled “commentator” and “journalist” for Real America’s Voice who traveled from his home in Arizona in August 2020 to document “ANTIFA” and other “rioters” in Kenosha, Wis., testified for the defense in the Kyle Rittenhouse intentional homicide trial on Thursday.  During a cross examination by lead prosecutor Thomas Binger, the judge overseeing the matter declared that the case was “not a political trial” and questioned the prosecutor about why he wished to probe the witness’s possible biases.

On direct examination by Rittenhouse’s attorneys, Drew Hernandez testified that he gathered facts and gave opinions on his own website back in August 2020 but has since been hired by Real America’s Voice. (He didn’t mention it as a witness, but Real America’s Voice disseminates ex-Donald Trump chief strategist Steve Bannon’s podcast “War Room,” a show currently being scrutinized by congressional investigators looking into the Jan. 6 attack on the U.S. Capitol.) Hernandez’s YouTube channel contains rants against critical race theory and the mandatory masking of children. They also contain discussions about “Let’s Go Brandon!” (a euphemism for “Fuck Joe Biden!”). A pinned tweet on Hernandez’s Twitter page purports to “dismantle the stupid little ‘BLM is mostly peaceful’ narrative in 1 minute.” The pinned tweet contains video from an appearance on the RT network — which is owned and paid for by the Russian government

Elsewhere, he posted — apparently gleefully — that “LEFTISTS” were “FREAKING OUT” about Latino voting trends (emphasis in original) and proclaimed that “BIDEN IS WEAK” (again, emphasis in original). He also said a “WOKE MLB” was to blame for pulling this year’s all-star baseball game out of Atlanta, Ga., and bemoaned that teachers were allegedly trying to “deny the existence of Jesus Christ, then turn around and redefine Him” as “bi sexual and non binary” — a move he called “BLASPHEMY.” He further decried what he believed were instances of discrimination against white people and complained about “Black privilege.”

Hernandez has also linked himself to the Jan. 6, 2021 siege on the U.S. Capitol

The trial of Kyle Rittenhouse, the man who killed two people during social justice protests last year in Kenosha, Wisconsin, has sparked plenty of frustration this week. Rittenhouse was 17 when he traveled from his hometown in Illinois to Kenosha with an AR-15 rifle, apparently intent on exacting some vigilante justice on demonstrators.

The proceedings have been marked by some controversial moments. First, there was the judge, himself a target of plenty of scorn, saying the people Rittenhouse killed could not be described as "victims" but could be described as "rioters and looters." This week, there were Rittenhouse's much-maligned tears, as the defendant took the stand and appeared to cry while testifying. There have also been the clues to the judge's apparent bias toward Rittenhouse; then, there was the defense’s request for a mistrial with no opportunity to retry the case.

All together, it's made the whole thing a bit of a farce, because with this is as much of a spectacle,that true justice is impossible.

Build Back Better 2.0 Still Raises Taxes For High Income Households And Reduces Them For Others

In a new analysis, the Tax Policy Center estimates that the major tax changes in the latest version of President Biden’s Build Back Better plan would cut taxes on average for nearly  all income groups in 2022. The exception: Those in the top 1 percent, who will make about $885,000 or more. They’d pay about $55,000 more than under current law. Those in the top 0.1 percent, who make about $4 million and up, would pay an additional $585,000 on average, a 5.9 percent reduction in their after-tax income.

Looking only at direct taxes—individual income taxes and payroll taxes—the plan also would cut 2022 taxes on average for every income group except those in the top 1 percent.  The highest-income households would face roughly the same increase in direct taxes in 2022 as they would with all major provisions.

Changing Picture

Taking into account all major tax provisions, roughly 20 percent to 30 percent of middle-income households would pay more in taxes in 2022. However, their tax increases would be very small. Among those with a tax increase, low- and middle-income households would pay an additional $100 or less on average. Those making $200,000-$500,000 would pay an average of about $230 more.  

Looking at direct taxes only, fewer than 0.1 percent of those making $500,000 or less would pay more in taxes than under current law. A proposed increase in the nicotine tax that TPC did not incude as a direct tax could boost that share slightly.  

The picture would change somewhat in 2023. Among the reasons: The bill would extend the 2021 expansions of the Child Tax Credit (CTC) for 2022 only. In addition, one of the major tax increases in the bill, the corporate minimum tax on book income, isn’t scheduled to take effect until 2023. TPC allocates corporate taxes to households, as investors and workers.

In general, the combined effects of these changes would result in many households paying higher taxes in 2023 than in 2022. They would shrink the average 2023 tax cuts for low-income households, raise taxes slightly for moderate-income households, and increase taxes significantly for the highest-income households.

The story would change again in 2026. All of the individual income tax provisions of the 2017 Tax Cuts and Jobs Act currently are scheduled to expire at the end of 2025. Households also would be affected by the bill’s proposed revisions in the state and local tax (SALT) deduction cap. Finally, there would be significant changes in revenues collected from multinational corporations.

The plan TPC analyzed would boost the annual cap on the SALT deduction to $80,000 from 2021 through 2030 and restore the $10,000 cap for 2031. But because the cap would expire completely after 2025 under current law, very high-income households that pay large amounts of state and local tax would pay more in taxes with a $80,000 cap after 2025 than they would if the SALT cap completely disappeared.

Despite what its promoters say, raising the cap to $80,000 would provide almost no benefit for middle-income households. It would reduce their 2021 taxes by an average of only $20. Even those making between $175,00 and $250,000 would get a tax cut of just over $400 or about 0.2 percent of after-tax income. By contrast, the higher SALT cap would boost after-tax incomes by 1.2 percent for those making between about $370,000 and $870,000 (the 95th to 99th percentile).

Due to these and other issues, when all major tax provisions of the BBB bill are included, every income group except those making about $28,000 or less would pay higher taxes on average in 2026 than under current law. However, the tax increases for middle income households would be very small, only about $70 on average. The top 1 percent would pay about $100,000 more.

Looking at direct taxes only, the story would be quite different. Almost no households making $500,000 or less would pay higher taxes in 2026. However, the top 0.1 percent would pay an average of about $700,000 more than under current law.

Lake County, Ill. State’s Attorney Michael Nerheim’s office said in a statement that an investigation conducted by local police “revealed the gun used in the Kenosha shooting was purchased, stored and used in Wisconsin.”

Prosecutors say Black kept the gun in Wisconsin, and Rittenhouse never possessed it in Illinois, where he lived with his mother and sisters. Black had the gun in his trunk and turned it over to police after Rittenhouse turned himself in to Antioch, Illinois, police just a few hours after the shootings.
