Instead of coming up with a plan, Biden administration attempts to convince Americans that they are doing better than they feel...

Really, Biden is doing great! It's just that nobody is noticing? 


This is where politicians can get themselves into trouble. Nothing gets under the skin of your average everyday run of the mill working class American than for some politician tell them that their complaints are not valid. It's called being out of touch. Out of touch politicians generally are unpopular and lose elections.

The reality is that people are not looking at obscure annual financial reports to judge the economy, they are judging it by how much cash they have at the end of the day and whether or not they can find or afford the goods that they want. They are not looking for comparisons between Covid a year ago vs Covid today, and they do not want finger pointing. They simply want to move forward with their lives and enjoy things without Covid hanging over them. 

So when the average American is spending $75 to fill up their vehicle (as it cost us the other day with our Fred Myer discount) rather than $40, that is a problem. When someone has to go to several stores to find staple items that should have been at all of them (as I did the other day looking for a basic cleaning product), that is a problem. When the cost of groceries is consistently higher than we used to pay, then that is a problem. 

When Biden promised Americans during his campaign that he had a foolproof plan to stop Covid in its tracks and then declared "independence" from Covid on July 4th... but we had 1800 people die yesterday alone, then that is a problem. When you are pushing the exact same solutions you were pushing back when it was your foolproof plan, and it still is not working, people only see a fool, not a foolproof plan. 

Inflation is out of control. Wages are not keeping up. Covid is raging and a fourth covid shot is starting to enter the conversation. Some are telling us to cancel Christmas for the second year in a row. But the Administration just seems upset that they are not getting credit for all the wonderful things that they believe they are doing. Perhaps they should worry about what Americans worry about, rather than tell Americans they are worrying about the wrong things.

KANSAS CITY, Mo. — The man whose mother sued Olathe Medical Center to compel the hospital to treat him with ivermectin died from COVID-19 complications last week.

Deke Belden, 41, died on Dec. 13 after being hospitalized for two weeks. He was under sedation for treatment of pneumonia related to a COVID-19 infection.

Belden’s physician had approved treatment of COVID-19 with ivermectin after he was diagnosed in November. He used a private supply that belonged to his mother, Sherri Belden.

But Olathe Medical Center stopped treatment with ivermectin — an anti-parasitic most often used to treat heartworm in livestock — after he was admitted Nov. 27 through the emergency room.


The U.S. Food and Drug Administration has not approved or recommended treating COVID-19 with ivermectin, though its use as a treatment has gained traction primarily among anti-vaxxers.

The U.S. Center for Disease Control and Prevention issued a health advisory in August 2021, warning of an increase in cases of ivermectin overdoses.

Sherri Belden, acting under power of attorney with her son sedated, sued Olathe Medical Center in Johnson County District Court on Dec. 6, seeking a court order to allow her son to be treated with ivermectin as “the last, best chance of survival from this dread disease.”

She had previously brought in some of her ivermectin and tried to administer it to Deke Belden in the hospital, but Olathe Medical Center staff intervened.

"The physicians and caregivers at Olathe Medical Center take an evidence-based approach to COVID-19 treatment, just as with any other illness or condition," the hospital said in a statement to KSHB 41 News last week. "The patient’s best interest is always the top priority with consideration of all appropriate treatment options as guided by certifying medical boards."

A judge rejected a temporary emergency injunction on Dec. 8.

According to his obituary, originally from St. Elmo, Illinois, Deke Belden “worked for the family oil business for several years before moving to Kansas,” where he met and married his wife.

A celebration of Deke Belden’s life is planned. In his honor, memorial contributions may be made to the Kansas City Dream Center.

Now, some researchers say omicron could actually hasten the virus' transition from pandemic to endemic, albeit with large numbers of illnesses and potential deaths along the way.

The theory: Due to omicron's high rate of transmission and danger to unvaccinated and non-boosted people, hospitalizations and deaths could rise significantly in the coming weeks and months — but survivors could emerge with a degree of so-called "natural immunity" that could help protect against Covid's next variant of concern.

"As all the public health folks have been saying, it's going to rip right through the population," says Dr. David Ho, a world-renowned virologist and Columbia University professor. "Sometimes a rapid-fire could burn through very quickly but then put itself out."

Notably, natural immunity isn't nearly as reliable as vaccine-enabled immunity. Roughly 62% of the U.S. population is fully vaccinated as of Wednesday, according to the Centers for Disease Control and Prevention. Only 30% of those people have received a booster dose, crucial for bolstering protection against omicron.

It's a "speculative" theory, Ho says, based on how most viruses typically act — and Covid has certainly taken some unpredictable turns over the past two years. But the possibility has been discussed among infectious disease experts for some time.



Dr. Bruce Farber, chief of infectious diseases at New Hyde Park, New York-based hospital network Northwell Health, says the "best-case scenario" would be a highly contagious Covid variant that doesn't make most people particularly sick, and creates some level of temporarily baseline immunity in the U.S.

"It could certainly help end large spikes of deadly Covid with high hospitalizations," Farber says.

Omicron is highly contagious, but its influence on hospitalizations and deaths is yet unconfirmed by researchers. In South Africa, where the variant was first detected last month, hospitalizations and deaths have remained relatively low despite a sharp rise in new Covid cases — but experts warn that the country's vaccination demographics and hot December weather could be influencing that trend.

Still, as long as large portions of the world remain unvaccinated, Covid will keep spreading and mutating, Farber says. That means the pandemic's future timeline is highly uncertain, even as experts broadly agree that Covid will eventually become an endemic and potentially seasonal disease.

Dr. Timothy Brewer, a professor of medicine in the division of infectious diseases at the David Geffen School of Medicine at UCLA, is one of those experts: Covid isn't ever going to disappear completely, he says.

Rather, people will have to learn to live with it. Regular vaccinations and antiviral pill treatments could combine with infection-born immunity to make Covid outbreaks significantly less severe in the coming years — not unlike how doctors manage the flu, an endemic seasonal disease that has caused multiple pandemics over the past century.

"This virus is so well adapted for human-to-human transmission that it's never going to away," Brewer says. "There will be periods when there will be more cases and [fewer] cases, just like it occurs with influenza every year."

Today that form of government in crisis in America, as that core right to vote that defines republicanism is under attack by Republican legislators in red states across our nation.

It’s never been used or adopted as law by the courts so it’s essentially “potential power,” a powerful but tightly coiled force quietly waiting for a real emergency, buried deep in our Constitution for 232 years.

July 18, 1787

It was a brutally hot summer in Philadelphia that year, and a week and a day after a mob chased down Mrs. Korbmacher on the streets outside Independence Hall (then the seat of the Pennsylvania legislature) and beat her to death for witchcraft.

Inside the Hall, the delegates were writing the Constitution for a new nation, and the question had come up whether the new US government should have the power — or the obligation — to “guarantee” that no state could so change its laws as to deprive its citizens of a “Republican Form of Government.”


In fact, those notes taken during the Convention wouldn’t see publication for another roughly 50 years, after all the men in the Hall were dead, a concession to numerous delegates who’d essentially sold out their wealthy acquaintances by ensuring a republican democracy or allowing slavery to continue (there were compromises on both sides, some of which, like the electoral college and setup of the 2-votes-only-regardless-of-population Senate, cripple us to this day).

Before them for debate that day was proposed constitutional language: “That a republican constitution and its existing laws ought to be guarantied to each state by the United States.”

An immediate objection came up from both New York’s Gouverneur Morris and New Jersey’s William Houston, because that language would allow the new states to keep laws that some delegates thought weren’t “republican” in nature.


The judgment of history weighed on Morris. Madison later recounted that, “He came here as a representative of America; he flattered himself he came here in some degree as a Representative of the whole human race; for the whole human race will be affected by the proceedings of this Convention.”

Thus it was no surprise when Morris rose to object that the proposed language could keep terrible state laws in place.

“Mr. GOUVERNEUR MORRIS thought the resolution very objectionable,” Madison wrote. “He should be very unwilling that such laws as exist in Rhode Island should be guarantied.”

New Jersey’s William Houston, a mathematics professor and abolitionist who served as a Captain in Washington’s army, concurred — although he was more concerned with not wanting to encourage laws that maintained slavery and debt peonage.

At which point several men rose to point out they were debating the power of the federal government to “guarantee a Republican Form of Government” to all the states — but what if power-hungry people in a particular state were to rise up in rebellion and seize control of that state’s government, thus ending statewide republicanism and creating a minor dictatorship or cult?

And then, what if that state then threatened other states’ ability to have a government reflecting the will of the people?


“Mr. GORHAM thought it strange that a rebellion should be known to exist in the empire,” Madison wrote, “and the general government should be restrained from interposing to subdue it. At this rate, an enterprising citizen might erect the standard of monarchy in a particular state; might gather together partisans from all quarters; might extend his views from state to state, and threaten to establish a tyranny over the whole,—and the general government be compelled to remain an inactive witness of its own destruction.” [emphasis added]

“[T]hat a republican form of government shall be guarantied to each state; and that each state shall be protected against foreign and domestic violence.”

That did the trick.

That day’s debate is what gave us Section 4 of Article IV of the Constitution:

“The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.”

It’s an amazing sentence, that could be as sweeping in its power as the Commerce Clause (which JFK and LBJ used to force integration of the South), but has never really been used in any meaningful way since it was written on that hot summer day in 1787.

The first time this “Guarantee Clause” came before the Supreme Court, slavery was the law of the land and Chief Justice Roger Taney, a former slaveholder, was determined to keep it that way by bottling up that Clause’s power.

Seven years before he tried to cement slavery into the law of every state in the union with his Dred Scott decision, Taney ruled in Luther v Borden (1849) that his Supreme Court would never be allowed to interfere with state’s rights on the basis of the Guarantee Clause.

“Under this article of the Constitution,” Taney wrote, “it rests with Congress to decide what government is the established one in a state.”

In other words, Taney said: The definition of what a ‘Republican Form of Government’ actually means isn’t yet laid out in the law or previous interpretations of the Constitution: therefore, it’s politics. And politics is the province of Congress, not the Supreme Court, which must limit itself to law.

On that foundation, later Supreme Courts repeated Taney’s assertion that the question was political and not one to be decided by the courts: instead it was up to the politicians in Congress if they were going to “guarantee a Republican Form of Government” to — or within — any particular state at any point in the future.

Taney was quoted “lucidly and cogently” in Pacific States Telephone & Telegraph v Oregon (1912) and Chief Justice John Roberts noted in 2019 that, “This Court has several times concluded that the Guarantee Clause does not provide the basis for a justiciable claim.”

Thus, to this day, it’s up to Congress, not the Court, to decide what a “Republican Form of Government” is and how Congress will guarantee it to and/or within every state.

Which brings us to today, and how Congress can end partisan gerrymanders, dial back the power of money in politics, and guarantee the right of every American citizen to vote without undue difficulty.

The opening of the Freedom To Vote Act lays it out clearly:

“Congress also finds that it has both the authority and responsibility, as the legislative body for the United States, to fulfill the promise of article IV, section 4, of the Constitution, which states: ‘The United States shall guarantee to every State in this Union a “Republican Form of Government.”’” [emphasis added]

The proposed law even notes as justification for its existence how the Supreme Court has dropped — or laid down — the ball and therefore Congress must pick it up:

“Congress finds that its authority and responsibility to enforce the Guarantee Clause is clear given that Federal courts have not enforced this clause because they understood that its enforcement is committed to Congress by the Constitution.”

The Freedom To Vote Act is more urgently needed with every passing day, as multiple Republican-controlled states openly (and ironically) tear down actual “republican principles” of representative government by continuing to pass laws that pre-rig election outcomes.

Some have even gone so far as to introduce laws that authorize their legislatures to ignore or reject votes they don’t like, in anticipation of the 2024 election.

Passing this law must now be the Senate’s first priority because, “It’s a republic, ma’am, if you can keep it.”

Regrets, I have a few: Rep. Tom Rice says he regrets his vote against certifying two states' electoral votes for President Joe Biden in the hours after the Jan. 6 Capitol attack.

It may not be for the reason you expect. The South Carolinian says he still believes there were “real issues with the election.” However, among the 10 House Republicans who voted to impeach then-President Donald Trump over the insurrection, Rice is the only one who voted for certification challenges to Biden's win — and he now says he regrets casting those votes. Rice's contrition comes from Trump's failure to intervene when a mob of his own supporters stormed the Capitol in order to try to stop the certification.

“In retrospect I should have voted to certify,” Rice told POLITICO. “Because President Trump was responsible for the attack on the Capitol.”

“In the wee hours of that disgraceful night, while waiting for the Capitol of our great country to be secured, I knew I should vote to certify. But because I had made a public announcement of my intent to object, I did not want to go back on my word. So yeah, I regret my vote to object.”

He explained: Rice argued the outgoing president watched “with pride” from the safety of the White House and “did nothing to stop it” —despite pleas from Trump's friends and family — as Capitol Police were beaten for hours, the House was “sacked and defaced" and Vice President Mike Pence and his family fled for their lives. The result, Rice noted, was five dead and hundreds injured.

“There was a coward in that equation," Rice said. "But it wasn’t Mike Pence."

Putting it in context: The majority of Rice’s House Republican colleagues voted not to certify Biden’s win after the bloody Capitol siege. And while Rice is the first to say he regrets this vote, it's unlikely that a wave of other GOP lawmakers will follow Rice in acknowledging their regret. Rather, many are still trumpeting Trump's baseless claims of a stolen election.

Also: While Rice's impeachment vote has led him to be cast as a centrist, his record and persona tells otherwise. He touts how he voted with Trump 94 percent of the time. He argues that supporting impeachment was the conservative thing to do. And that is the message he is trying to impress upon voters as he seeks reelection in a red state where Trump still holds a lot of influence.
