The poll, taken by TechnoMetrica Institute of Policy and Politics in New Jersey last month, asked 1300 people about what they thought about the Durham probe. What was astonishing was that almost 3/4 of those polled who were following the story wanted prosecutors to investigate her and members of her campaign for manufacturing dirt on President Donald Trump. What was most surprising about those numbers was that included 66 percent of Democrats who were following the story, a jump in 20 points from October. Among Republicans, the number was 91 percent. Among independents, it was 65 percent.
76 percent of Americans want Attorney General Merrick Garland’s counsel Maggie Goodlander to recuse herself from the Durham probe because of a potential personal conflict posed by her husband, White House National Security Adviser Jake Sullivan, who is cited in the Sussmann indictment.
So not only do Americans want Durham to continue to probe this situation, most believe that the DOJ might not be objective and are looking for certain people to recuse themselves. Lot's of recent movement on this Durham probe and things are not looking good for either Hillary or the FBI.
That being said, there are crazy liberals who still support Hillary. Probably the same ones who defended her bathroom server, taking hammers to her blackberrys, but still want to hang Trump in town hall for being a little late in turning in some of his Presidential records.

A court filing from special counsel John Durham claims that Hillary Clinton’s 2016 presidential campaign paid a technology company to "infiltrate" servers belonging to Trump Tower, according to Fox News. WASHINGTON — The National Archives and Records Administration recently recovered 15 boxes of official records from former President Trump’s home at the Mar-a-Lago beach club in Palm Beach, Fla., some of which were reportedly labeled classified or top secret, others of which were reportedly ripped into pieces. What happens next is still unclear.
Trump confirmed the return of the documents in a statement Thursday calling it “routine and “no big deal.” But the National Archives and Records Administration has reportedly asked the Justice Department to investigate and determine whether charges are warranted.
The Justice Department did not return e-mails seeking more information, but the Archives said in a statement that Trump representatives continue to search for additional records that should have been delivered to the national archives more than a year ago ["A LITTLE TIME"?] under the Presidential Records Act. The Archives had worked with the Trump team throughout the year to locate the missing documents, according to the statement.
The House Oversight and Reform Committee also announced Thursday it will investigate the matter in a letter seeking information from U.S. archivist David Ferriero.
Could Trump face charges?
It’s very complicated. Technically, yes, he could.
According to the Congressional Research Service, anyone who engages in the “unlawful removal or destruction of government records” is subject to punishment under Title 18, Section 2071 of the U.S. Code. That punishment is a fine, up to three years’ imprisonment and having to “forfeit his office and be disqualified from holding any office under the United States.” WOW!
But will he be charged... who knows?
Trump’s penchant for ripping up documents and not following the spirit of the record retention law was public knowledge for much of his administration. Prosecutors would have to prove that Trump withheld or destroyed specific documents willfully and intentionally now to keep them from becoming public.
No president has been charged with violating the act, [NO PRESIDENT HAS BEEN THAT STUPIDLY CRIMINAL] and doing so for the first time would potentially open up a whole host of legal issues, including whether if convicted, he would be able to run for the office again.[SEEMS CLEAR: NO!]
The Constitution lists just three qualifications for being president: be at least 35 years of age, a natural born citizen and live in the United States for at least 14 years. So the question becomes can Congress just add an additional requirement of essentially, “don’t destroy government records”? You can bet it would be litigated... thoroughly.
What is a presidential record?
All presidential records belong to the American people under the Presidential Records Act, which Congress passed in 1978 in response to President Nixon’s handling of White House recordings documenting his and others’ actions around the Watergate break-in. Before then, presidential records were considered a president’s personal property. [NO MORE, DONALD.]
Presidential records are defined as historically relevant materials created by or for the president as part of carrying out the duties of the office. That includes computer files, paper, photos, video or audio recordings. So traditionally, letters from foreign leaders, logs of who called the Oval Office, schedules, notes from meetings, draft speeches, etc., are all presidential records. (The Washington Post reports that the boxes contained correspondence with North Korean leader Kim Jong Un as well as a letter left for Trump by President Obama, both of which would normally have been turned over to the Archives.)
Diaries or journals and campaign materials meanwhile are personal records.
But here’s the crux; under the act the president gets a lot of say over what is turned over, and there is pretty much nothing the Archives can do to enforce the law.
To prove a violation under the Presidential Records Act, prosecutors would have to prove the person intentionally mishandled the material or was grossly negligent in doing so, not that it simply was swept up in the rush to get out of the White House. And the Biden Justice Department might not want to take on investigating the prior administration.
But is the bar higher for classified materials?
Some of the documents recovered by the National Archives are reportedly clearly marked classified or top secret, which for any one except the president would potentially be a huge problem. Former national security advisor Sandy Berger, for example, was prosecuted and fined $50,000 for sneaking classified documents out of the National Archives in his clothes in 2003.
While the Justice Department might be leery about going after a president for taking home some letters he shouldn’t have kept, it has been more willing to go after government officials accused of mishandling classified material.

For the sake of argument let's say there were "classified documents" in the 15 boxes. I originally heard that there were notes from discussions with world leaders and such, but the "classified documents" is a fairly "new" thing and there is back and forth on the validity of those claims.
Honestly, it wouldn't surprise me one way or the other, but the one thing that continues to stand out in my brain is that our Government holds almost no secret documents in physical form anymore. They are nearly 100% electronic. So why in this case would there happen to be classified physical documents and why would Trump just "give them back" if there was a law broken there. Wouldn't he have been better off destroying them (after all they would almost have to be just copies).
But I digress. Again... assume there were classified documents.
We have had several recent examples of classified documents being "mishandled". The three most obvious is Hillary Clinton and James Comey and General Petraeus. But there have been a slew of others as well.
of all of those who supposedly mishandled classified documents, the only person charged was General Petraeus. The reason he was "specifically" charged was that he was said to have provided access to these documents to his girlfriend (who was also a reporter).
It was not the mishandling that made the DOJ decide to charge him. It was the apparently intention that he was showing them to someone that prompted the charges.
Others were not charged for similar things because the DOJ decided that they were not doing so with any "intention" to provide them to anyone else. This was the excuse the DOJ used to not charge Hillary, even as people suggested her mishandling rose to the level of negligence (having used a hackable cell phone out of the country, etc, etc, etc...).
So "even" if you were looking to charge Trump with mishandling classified information you would first have to "prove" that the information in question was "marked" classified, that Trump had not "declassified" it as is his prerogative as President...
and based on very recent precedent, you would have to prove that it was his intention to pass this along to someone who could actually use these documents to harm the country.

The New York Times was handed a small victory on Monday, after a New York district judge said he would dismiss a landmark defamation case brought against it by former Alaska Governor Sarah Palin.
Driving the news: In an unusual decision ahead of the jury vote Monday, Judge Jed S. Rakoff said Palin failed to prove the New York Times acted with "actual malice," per NPR's David Folkenflik.
