Court: Clinton Campaign Lawyer Michael Sussman Must Stand Trial Over Alleged Lies To FBI In Russia Probe
Mr. Sussmann has moved for pretrial dismissal of the Indictment under Federal Rule of Criminal Procedure 12(b)(3)(B) for failure to state an offense. For a statement to be criminal under 18 U.S.C. § 1001, it must be both “false, fictitious, or fraudulent” and “material.” Sussmann’s sole argument for dismissal is that, even taking the allegations in the Indictment as true, his purported misrepresentation to Baker was immaterial as a matter of law and therefore cannot support a conviction under § 1001. The Court will deny the motion.
The standard for materiality under § 1001 in this circuit is whether the statement has “a natural tendency to influence, or is capable of influencing, either a discrete decision or any other function of the [government] agency to which it was addressed.” United States v. Moore, 612 F.3d 698, 701 (D.C. Cir. 2010). Focusing on the first part of the standard, Sussmann argues that his alleged statement to Baker—that he was not at the meeting on behalf of a client—could not possibly have influenced what was, in his view, the only “discrete decision” before the Bureau at the time: whether to initiate an investigation into the Trump campaign’s asserted communications with the Russian bank.
At the outset, Sussmann’s argument that the materiality of his statement must be assessed only in relation to the FBI’s decision to commence an investigation is based on an overly narrow conception of the applicable standard. He largely ignores the second part of the test: whether the statement could influence “any other function” of the agency. Applying that prong of the materiality standard, the D.C. Circuit has stated that “a ‘lie distorting an investigation already in progress’ also would run afoul of § 1001.”

So basically the concept here is that Sussman is pretty much admitting that he lied to the FBI when he said that he was just there as a concerned citizen with information for the FBI and was not representing anyone.  But he argues that whether he was there as a concerned citizen or as a representative of Trump's political opponent was not material to... well anything? 

The Judge points out that even if there had already "been" a decision by the FBI to investigate Trump, that him providing evidence under false pretenses would also qualify him under the statute in question. The argument can certainly be made that the FBI would have (or at least should have) treated this differently had they known that it was at smear attempt from the Clinton campaign, rather than real intelligence from a concerned citizen.

The irony here is that everyone probably knows that the FBI would have used this as an excuse to investigate Donald Trump either way. There is little question that this was more of a "partnership" between the Clinton team and the FBI than it was the Clinton team fooling the FBI into an investigation. I have no doubt that when the FBI asked Sussman if he was working on behalf of anyone that it was more of a nudge nudge wink wink question were the expectation was that Sussman would lie. I would go so far as to say that the FBI (unless they are complete dolts) had to know that the information being presented was indeed dubious and probably not worthy of the two full years and millions of dollars spend investigating it. 

But either way, under the letter of the law Sussman is a criminal. He lied to the FBI knowingly and with every intention of malice. This wasn't a Papadapoulos sort of "misleading statement" where they wanted to confuse his final interview and start date with the Trump campaign, or a supposed General Flynn lie that the FBI interviewers said was not a lie. This was a blatant attempt to mislead, either with or without the FBI playing along. You would need to have some very tortured logic to dismiss this as legal.

Now the fun begins. Let's see if Sussman goes quietly into the night chancing probation, losing his license to practice law, and some hefty fines if found guilty. Or perhaps he cuts a deal and throws someone else under the bus to save his own ass? Of course, Mr Sussman should probably already be on "suicide watch" and would have to go into hiding if he decides to turn on the Clinton syndicate.

Chatter about Trump's mental state has, in fact, been an ongoing component of his time at the top of the Republican Party.


"Peril," Bob Woodward and Robert Costa's book about the final months of the Trump presidency, is larded with questions about Trump's mental state.

This is in reference to Joint Chiefs of Staff Chairman Mark Milley, who was the highest ranking general in the administration, about the January 6, 2021, riot at the US Capitol:

"[He] was certain that Trump had gone into a serious mental decline in the aftermath of the election, with Trump now all but manic, screaming at officials and constructing his own alternate reality about endless election conspiracies," Woodward and Costa write.

The book also cites this from House Minority Leader Kevin McCarthy, in a call to Trump on the eve of Joe Biden's inauguration: "I don't know what's happened to you in the last two months. ... You're not the same as you were for the last four years."

If anything, the intervening months have seen Trump go deeper into his election fraud fantasies -- growing more and more disconnected from actual facts. Just last week, Trump urged Russian President Vladimir Putin to release negative information he may have about Hunter Biden, the son of the current President.

This is not an academic discussion. Trump is, without question, the frontrunner to be the Republican presidential nominee in 2024. He is giving every indication that he is going to run again. And polling suggests that if the election were held today, Trump would at least be competitive with Biden.

In short: While Sununu was, ostensibly, joking, it's not really a laughing matter. There are lots and lots of Republicans -- including many who are publicly supportive of Trump -- who privately wonder about his mental state and what it means for the party going forward. We should all be worried about what it means for the country going forward.

Federal Judge Refuses to Dismiss Durham Probe Case Against Michael Sussmann, Says He ‘Cannot Resolve This Standoff Prior to Trial’

A federal judge on Wednesday agreed to keep a criminal case alive against a former Perkins Coie attorney who worked on Hillary Clinton matters in the lead-up to the 2016 presidential election. The attorney claimed that he was acting as a private citizen when giving data about Donald Trump to then-FBI General Counsel James A. Baker on Sept. 19, 2016.

That indicted lawyer, Michael A. Sussmann, is charged with a single count of making a false statement to the FBI in connection with his assertion that he was not acting on behalf of any Democratic Party-tied client. Prosecutors do not allege that the internet data he he disclosed purportedly show a connection between then-presidential candidate Donald Trump and Russia’s Alfa Bank was inaccurate.

Sussmann was indicted at the behest of Special Prosecutor John H. Durham, who was appointed by then-Attorney General William Barr to suss out the roots of “whether any federal official, employee, or any other person or entity violated the law in connection with . . . law-enforcement activities directed at the 2016 presidential campaigns.”

U.S. District Judge Christopher R. Cooper, via a six-page opinion and order, ruled against Sussmann’s attempt to dismiss the matter in the weeks prior to trial.

“The Indictment claims that Sussmann concealed from Baker that he was providing the information to the FBI in a political capacity,” Judge Cooper wrote while recapping the core case.  “Specifically, Sussmann allegedly told Baker that he was not attending the meeting on behalf of any client when, in fact, he had assembled and was conveying the information on behalf of two specific clients: (1) a technology-industry executive named Rodney Joffe and (2) the Hillary Clinton presidential campaign. The FBI opened an investigation based on the information Sussmann provided, but ultimately determined that there was insufficient evidence to support the existence of a communication channel between the Trump campaign and the Russian bank.”

Sussmann has long argued that (1) he did not lie to the FBI, and (2) that, even if he lied, his alleged lie was not “material” to whether or not the FBI opened a probe regarding Trump based on the information provided.

Despite those arguments, Judge Cooper said that the case must stay alive because “Supreme Court unanimously held that because materiality is an element of a § 1001 offense” and, therefore, “it is a question that generally must be answered by a jury.”

Judge Cooper ruled that he thus could not dismiss the matter before it even goes before a jury:  “[t]he battle lines thus are drawn, but the Court cannot resolve this standoff prior to trial.”

As noted, the case turns on whether or not Sussmann’s alleged lie was “material” to the FBI’s decision-making process regarding the tip received.

Though he decided to keep the case on track for trial, Judge Cooper did suggest that Sussmann’s theories are not wholly unsupported.

“[W]hile Sussmann is correct that certain statements might be so peripheral or unimportant to a relevant agency decision or function to be immaterial under § 1001 as matter of law, the Court is unable to make that determination as to this alleged statement before hearing the government’s evidence,” Cooper wrote.  “Any such decision must therefore wait until trial.”

Sussmann’s trial is scheduled to begin on May 16, 2022.

Here are the latest developments in the war in Ukraine.

The United States is weighing whether to send a high-level official to Ukraine, and is planning to deliver more military equipment, in a show of support to President Volodymyr Zelensky ahead of an anticipated new stage of the war.

Mr. Zelensky has switched between chiding and praising world leaders for their aid, or lack of it, during the seven weeks of fighting. On Tuesday night, in his nightly address, he said that he had “sincere gratitude” for the $800 million in military aid that President Biden had agreed to send.

The additional aid follows growing evidence of atrocities committed by Russian troops in the suburbs of Kyiv, the capital. Mr. Zelensky has repeatedly held allies to task, insisting they provide weapons that could be used to attack Russian forces, not just defend against them.

Mr. Biden said in a statement that the package would include “new capabilities tailored to the wider assault we expect Russia to launch in eastern Ukraine.” The Pentagon said the equipment would be sent as soon as possible.

The supplies include weapons, ammunition, artillery systems, armored personnel carriers, helicopters, counter-artillery radars and air surveillance radars, and unmanned coastal defense vessels. It will also have protective equipment for chemical, biological, radiological and nuclear attacks.

“We’re aware of the clock,” said John F. Kirby, the chief Pentagon spokesman, said at a news conference on Wednesday. “And we know time is not our friend.”

Here are other major developments:

A Russian warship in the Black Sea was “seriously damaged,” according to both a Ukrainian military official and Russian state news agencies. The head of Odesa’s military forces, Maxim Marchenko, said on Telegram that Ukrainian forces had struck the ship with missiles. Hours later, Russia’s Defense Ministry said a fire had caused ammunition to explode on the ship, the Moskva, according to the Russian state news agency Tass.

Ukrainian officials say that departing Russian soldiers have laced large swaths of the country with buried land mines and jury-rigged bombs — some hidden as booby traps inside homes.

House Minority Leader Kevin McCarthy (R-Calif.) drew right-wing ire after he stated that House Republicans, if they win the House majority in this year’s midterm elections, will not impeach President Joe Biden for “political purposes.” 

He is not alone in not wanting to embrace impeachment. With the midterm election season starting, McCarthy has kept focus on issues like the Biden administration’s struggles with inflation and a migration surge at the border.

Republican strategist Doug Heye said that McCarthy “knows that if we’re talking about impeaching the president, we’re not talking about inflation and anything that distracts from what is causing 60 percent of the American public to say that we’re on the wrong track.”

But many of the more than a dozen House Republicans who have signed on to Biden impeachment resolutions are not letting up on their calls to impeach the president.

“President Biden is willfully and intentionally endangering the safety and security of the American people by facilitating the invasion at our Southern Border,” said Rep. Bob Good (R-Va.), who has cosponsored impeachment resolutions led by Reps. Marjorie Taylor Greene (R-Ga.) and Lauren Boebert (R-Colo.). 

“A Republican majority should do everything in its power to hold the president accountable for effectively surrendering operational control of the U.S. border to the Mexican crime cartels. How can we not impeach this president for his purposeful violation of his Article 4, Section 4 constitutional responsibility to protect the states from invasion?” Good said.

In his comments to Fox Business host Maria Bartiromo on Sunday, McCarthy did not completely shut down the idea of impeachment, and vowed to hold the Biden administration accountable. Republicans have promised a wave of investigative and oversight actions if they take back the House majority.

“We believe in the rule of law,” McCarthy said. “We’re not going to pick and choose just because somebody has power. We’re going to uphold the law. At any time, if someone breaks the law and the ramification becomes impeachment, we would move towards that. But we’re not going to use it for political purposes.”

His comment, though, set off a wave of criticism from right-wing commentators. Some, like Jesse Kelly, argued that Democrats’ moves to impeach former President Donald Trump and potentially future Republican president warrants an equal response.

“Who are you? You want to be Speaker of the House of Representatives and you’re afraid to take on Biden and the regime?” far-right personality Mike Cernovich said on Steve Bannon’s “War Room” podcast.

Seventeen House Republicans have introduced or co-sponsored resolutions to impeach Biden, four of which are led by Greene. Several others have publicly called for impeachment, with Rep. Madison Cawthorn (R-N.C.) doing so at a Trump rally over the weekend.

Two Florida men charged with filing ballots in two states in the 2020 presidential election confessed to voter fraud, according to court records.
Charles F. Barnes and Jay Ketcik, residents of The Villages in Sumter County, Fla., pleaded guilty to casting more than one ballot in the election. Voter fraud is a third-degree felony that can result in a maximum five-year prison sentence.
Barnes, 64, and Ketcik, 63, will be able to defer prosecution if they abide by the court-ordered requirements that State Attorney Bill Gladson set, according to pretrial intervention documents. The men will avoid further punishment if they complete 50 hours of community service, attend a 12-week adult civics class and meet regularly with a supervising officer, among a handful of other requirements.
“If you comply with these conditions during the period of deferred prosecution, no criminal prosecution concerning this charge will be instituted in this county,” Gladson wrote. “If the defendant violates the terms of this agreement, and this case is returned to the court’s docket, this document shall be admissible as an admission of guilt.”

Ketcik, a registered Republican, was among three Central Florida residents who had expressed support for former president Donald Trump before being arrested in December following reports that they cast more than one vote during the 2020 election, according to various Florida news media outlets. Barnes, who has no party affiliation, was arrested in January and faced similar charges. Both men were released from jail after paying a $2,000 bond. Neither man responded to efforts to reach them for comment.
Ketcik voted by mail in Florida along with casting an absentee ballot in Michigan, prosecutors say. An arrest report shows that Barnes previously had an address in Connecticut.
According to the Florida Secretary of State’s office, Florida election officials referred 75 individuals to law enforcement agencies due to potential voter fraud in the 2020 election.

NEW YORK (AP) — Retail sales rose modestly in March as higher prices for food, gasoline and other basics dampened consumer spending.

Retail sales increased 0.5% after registering a revised 0.8% jump from January to February. Spending has been fueled by wage gains, solid hiring and more money in banking accounts. Patrick Lyoya, 26, a Congolese refugee, was killed outside a house in Grand Rapids,

Video footage shows Lyoya running from the white officer who stopped him for driving with a license plate that didn’t belong to the vehicle. They struggled in front of several houses while Lyoya’s passenger got out and started filming. Shortly afterward, the officer shot Lyoya, who was face down on the ground, in the back of the head.

After protests in the city calling for justice, the police chief, Eric Winstrom, released four videos, including critical footage of the shooting recorded by the passenger in Lyoya’s car. “I view it as a tragedy,” said Winstrom, a former high-ranking Chicago police commander who became Grand Rapids police chief last month.

Grand Rapids is a small city of roughly 200,000 people, about 150 miles (240 km) north-west of Detroit.

The officer, a seven-year veteran, will not be identified publicly unless there are criminal charges, said Winstrom. He has been placed on paid leave with his police powers suspended, the chief said. Michigan state police are conducting a criminal investigation.

LONDON — Russian officials said their flagship Black Sea vessel was “seriously damaged” in what Ukrainian officials claimed was a missile strike against the warship Moskva.

Defense Ministry officials in Moscow said on Thursday that the explosion on the Moskva, a warship leading the country’s naval assault against Ukraine, was “due to a fire” and said that “ammunition exploded on board.” They added that the crew, believed to include around 500 sailors, were all safely evacuated from the burning ship. The ministry said the fire is now under investigation.

However, the governor of Odesa claimed the damage was a result of a Ukrainian missile strike.
