CBS poll is bad news for Biden and Democrats...

Reality: Nobody cares about "woke politics" and it's a sure loser





Maybe the most important one of them all!


Notice how climate change, LGBTQ rights, gun control, BLM, police reform, the new green deal, arresting Donald Trump, and every other staple liberal talking point is not on the list of important issues? This list looks so dramatically different than it did two years ago we might as well be living in a different country? 

Moreover, who does the general public trust more to fix the economy, to fix crime, to stand up to Russia, to stop illegal immigration? Well certainly not Biden and the Democrats. Biden's best approval on these subjects is 39% and those are likely people who believe in "more" crime and think he is delivering. I doubt the public views his Democratic cohorts any better.

So what are Democrats planning on campaigning on exactly? Their Jan 6th commission? Election laws? Don't say gay? They need an issue that is not about Trump, race, or gender. Can they find anything?

Trump Is Clearly Guilty of Sedition


Here’s how the U.S. Code defines “seditious conspiracy”:

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

Is there any doubt — based on what we already know — that Donald Trump is guilty of seditious conspiracy?

However, the New York Times reported over the weekend there’s a dispute among the members of the House Select Committee investigating the January 6 insurrection about whether to file a formal criminal referral against Trump to the Justice Department.

Rep. Liz Cheney (R-WY) is in favor, based on what she told CNN over the weekend: “It’s definitely clear what President Trump was doing. What a number of people around him were doing. That they knew it was unlawful. They did it anyway.”

She added: “I think what we have seen is a massive and well organized and well-planned effort that used multiple tools to try and overturn an election.”

But there are supposedly Democrats on the committee who feel a criminal referral is “largely symbolic” and could “backfire” by “tainting” the Justice Department’s separate investigation.

I agree with Dan Pfieffer who thinks this is “head-in-ass” thinking:

Do these Democrats really believe Republicans and the Right Wing media machine are not going to politicize the charges brought forth by the Attorney General? After all, he was appointed by the man whose election the insurrection was trying to overturn.

It’s true there’s still a lot we don’t know about Trump’s role in the insurrection — particularly during the 7-hour gap of phone records that seemed to have disappeared.

But what we do know actually happened in broad daylight.

Let’s start with the words as they appear in 18 U.S. Code § 2384, defining the phrase “seditious conspiracy”:

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

The law dates to 1948. The maximum penalty originally was six years, but in 1956 they increased it to 20—probably motivated by Cold War fever. Undoubtedly, the expectations of the authors of this law and its amendments were that the seditionists in question would be Communists or other enemies of the system. I’m pretty sure they didn’t imagine the category would one day include a sitting president of the United States.

But can there be any serious doubt, reading that definition, that Donald Trump is guilty of seditious conspiracy? He certainly conspired with at least one other person—indeed he conspired with the hundreds of people he urged to come to Washington because it was going to be “wild!” and then egged them on to march; he was in a place under U.S. jurisdiction; and the rest of the language—“overthrow,” “put down,” “oppose by force,” “prevent,” “hinder,” and so on—sounds like a literal description of January 6, 2021.


There’s a dispute among the members of the House January 6 committee, according to a New York Times report, about whether to file a formal criminal referral about Trump to the Justice Department. Republican Liz Cheney is in favor; she seems to want to nail Trump (while at the same time, she clearly wants to limit broader damage to her party by keeping the focus on one man). Cheney told CNN Sunday: “It’s definitely clear what President Trump was doing. What a number of people around him were doing. That they knew it was unlawful. They did it anyway.”

Do Republicans worry about things backfiring? Hardly ever that I can see. They just do them. Eighty jillion Benghazi hearings. Voting, as nearly 150 of them did, to deny Joe Biden the presidency. Pushing these blatantly undemocratic voter-suppression laws. They never worry about backfiring. The irony is that sometimes their zealotry does backfire on Republicans. The impeachment of Bill Clinton backfired on Newt Gingrich such that he lost his job over it. But they just keep on doing outrageous things, and their winning percentage, tragically, is pretty good.

In other words: The backfiring worry is very overstated in a hyper-polarized age. Of course a formal referral will infuriate Trumpists. And it will give Trump a little fodder to complain about a partisan “witch hunt.” But Democrats can counter that the committee has two Republicans. Liberals will nod, conservatives will be enraged, and most voters in the middle will shrug. It’s a relatively minor thing, this referral. There’s no harm in doing it.

What’s more interesting is how the committee is going to wind this down in the coming months. Members have been hearing hours and hours of testimony. Investigative staff have been poring through electronic communications. The leaks so far have been close to masterful, conveying a sense of momentum and making careful readers wonder, “Gee, how much more do they have?”

I bet a lot. They’re still deciding who their big witnesses are going to be in May and June. But if those hearings have a few bombshell moments (perhaps relating to exactly what Trump did and said during those seven hours), to be followed by a full and thorough report, and then a formal referral on Trump because by that time the evidence will be so overwhelming as to make a referral seem like a foregone conclusion, that will be powerful.

Those seven hours notwithstanding, we know what Trump did. He did it right before our eyes. He urged a rowdy crowd to march to the Capitol to force the vice president to break the law. He called a state election official in Georgia and instructed him to break the law. He belongs in a house, all right. But it isn’t white.

This remains absolutely fascinating to me. I mean, here we have all of these TDS-afflicted GIANTS of the American legal community. Towering intellects like Harvard's Tribe et. al., with Trump seemingly surrounded by a myriad of obviously blatant violations of the law - sedition, insurrection, treason, jaywalking, sending mean tweets, etc., yet nothing has been done. No charges have been filed.

It begs the question - WHY?

Biden Must Invoke the Defense Production Act

Both the American and the Ukrainian arsenals should be full—and Russia should know it.

​​The political objective of the Biden administration is to keep Ukraine free and whole. To that end, the administration has sent large quantities of arms—especially Javelin anti-tank missiles, Stinger anti-aircraft missiles, and small-arms ammunition—to Ukraine.

But it has not been enough. Ukraine needs more arms. As Volodymyr Zelensky told 60 Minutes last week, the United States and other countries supportive of Ukraine have to supply weapons to Ukraine as if they were defending themselves and their own people. They need to understand this: If they don’t speed up, it will be very hard for us to hold on against this pressure. . . . We think this will be a new wave of this war. We don’t know how much [Russian weaponry] there will be. But we understand that there will be many times more than there is now. . . . [All] depends on [how fast] we will be helped by the United States. To be honest, whether we will be able to [survive] depends on this. I have 100 percent confidence in our people and in our armed forces. But unfortunately, I don’t have the confidence that we will be receiving everything we need.

The Pentagon’s own stockpiles of certain weapons systems are running low, due in part to a decade of budgetary dysfunction and shortsightedness; this may be a factor in why the administration has not sent more military aid to Ukraine. If so, this is exactly the kind of contingency for which the Defense Production Act exists.


The law gives the president emergency authority to direct the private sector to produce goods the government needs at a time of crisis; its primary purpose is to enable the emergency production of military goods at a time of war. President Donald Trump activated it (or, at least sort of activated it) in 2020 to enhance America’s COVID response, which was not what the law was originally designed for—it is, after all, the Defense Production Act. And President Joe Biden recently invoked the law “to secure American supply chains for the critical materials that go into batteries for electric vehicles and the storage of renewable energy,” which also extends beyond the law’s purpose. (Biden did not, however, go nearly as far as a large coalition of environmental groups urged last month; they wanted him to use the law to take much more significant action to combat climate change.)

It is critically important that what goes out of the U.S. inventory in support of Ukraine is replenished immediately. This will ensure that Ukraine has what it needs as long as the war continues, and will send a signal to Russia that, as long as the Ukrainians are willing to fight, the United States will make sure that they have the weapons to fight with. War is a contest of wills, and a full American inventory ready to be shipped to Ukraine simultaneously encourages the will of the Ukrainians and dampens the will of the Russians.

Trump didn't FORCE anyone to do anything that day alky. Those who visited the Capitol did so of their own free will. A review of the transcript of Trump's speech that day reveals that he emphasized peace, and a peaceful demonstration.

One need not be a professor emeritus of law at Harvard to arrive at this most basic and fundamental conclusion.

While E15 is only 10 cents cheaper on average and is less "energy dense," meaning drivers would need to buy more fuel, it should still help lower fuel expenses, they told reporters on a call previewing the announcement.

"Those savings can add up, especially during the summer months, when fuel is elevated and as the supply emergency caused by [Russian President Vladimir] Putin's aggression continues," a senior administration official said.

The move comes after Russia's invasion of Ukraine and the sanctions and boycotts that followed launched retail gasoline prices to record highs. His policies didn't cause the increase of fuel costs but the President always gets blamed for it.

The gas you use now is often 10 percent ethanol, but some industry groups believe the higher concentration of E15 will cause problems. All cars 2007 and newer should be compatible with E15 because automakers have changed the formulation of the affected components

Consumer prices for March increased 1.2% month-to-month and 8.5% annually, the Labor Department said on Tuesday. But traders were focusing on the core reading, which excludes food and energy prices. Core CPI in March increased 0.3%, below the consensus economist estimate from Dow Jones of 0.5%. Core prices on an annual basis were up 6.5%.

The 10-year Treasury yield retreated from a three-year high following the report as traders were betting the core reading could mean inflation is showing signs of peaking.

“The big news in the March report was that core price pressures finally appear to be moderating,” wrote Andrew Hunter, senior U.S. economist at Capital Economics. The economist believes the increase in March will “mark the peak” for inflation.

The Nasdaq rebounded in March with a 3.4% gain after falling into correction territory earlier this year. However, investors dropped growth and tech names in April as the Nasdaq fell by more than 5% so far this month. The index is down 17% from its all-time high.

Some of the biggest contributors to the latest increase in inflation were food, shelter and gasoline, according to the BLS. In fact, the index tracking gas prices surged to rise 18.3% month-on-month in March, comprising more than half of the total monthly increase in CPI. In February, gasoline had posted a 6.6% monthly increase.

But even excluding more volatile food and energy prices, the CPI also posted a marked move higher in March. The core CPI jumped 6.5% in March over last year, accelerating from a 6.4% increase in February and representing the fastest increase since August 1982.

The monthly Consumer Price Index report from the Bureau of Labor Statistics was released Tuesday morning, and while inflation continues to rise some economists appear pleased, with one stating the report is "slightly better than anticipated."

Overall, the annual rate of inflation is 8.5 percent, but removing food and energy, prices are up 6.5 percent annually.

Gas prices are a big part of the inflation rate. CNN's cable reporting calls the current report a "rearview mirror" look, given that gas prices are coming down. They add some economists are hoping the peak of the inflation has been reached. They also note that the U.S. does not rely much on oil from Russia, so in other countries, inflation is worse.

"Food prices are up 8.8% over the past year. Energy prices are up 32%, including 11% in March alone -- reflecting the spike in energy prices associated with Russia's invasion of Ukraine," The New York Times' Ben Casselman notes.

Casselman points to Putin's illegal war in Ukraine for food price increases:

And he sees some good news: "Headline inflation accelerated in March, but we all knew that would happen given gas prices. The bigger surprise is the slowdown in 'core' inflation."

There's still plenty to be concerned about. Casselman says this is "the fastest year-over-year inflation since 1981."

Meanwhile, oil companies – not the President – set the price of gas at the pump and other energy products, and are under no obligation to price gouge, which is illegal in most states during a declared state of emergency, such as war, natural disasters, or COVID-19.

PIERRE, S.D. (AP) — The South Dakota House is set to decide Tuesday whether Attorney General Jason Ravnsborg should be impeached for his conduct before and after he struck and killed a pedestrian on the shoulder of a highway.

Troopers have said Ravnsborg was distracted before the September 2020 crash that killed 55-year-old Joseph Boever. Ravnsborg initially told authorities he thought he had struck a deer or other large animal. He went back the next day and found Boever’s body.

Opponents of impeachment say Ravnsborg need not be held accountable by the House because he wasn’t on the job when the crash happened. He had been driving back from a Republican fundraiser.

Ravnsborg has cast Boever’s death as a tragic accident. He pleaded no contest last year to a pair of traffic misdemeanors, including making an illegal lane change.

An investigation committee from the Republican-controlled House voted against recommending impeachment after arguments that Ravnsborg’s actions were not part of his official duties. Republican Gov. Kristi Noem has pushed for impeachment, saying Ravnsborg lied to investigators.

The Highway Patrol concluded that Ravnsborg’s car crossed completely onto the highway shoulder before hitting Boever, and criminal investigators said later that they didn’t believe some of Ravnsborg’s statements.
