A few weeks after the revelation that White House documents turned over to the panel probing the attack on the U.S. Capitol contains a seven-hour-and-37-minute gap in call logs, a pair of U.S. groups on Monday called for an investigation into whether former President Donald Trump "willfully mutilated and destroyed critical records of his presidency before leaving office."
Building on a February 8 letter—sent before the call logs were shared last month with the U.S. House select committee investigating the January 6, 2021—Citizens for Responsibility and Ethics in Washington (CREW) and National Security Archive again wrote to Attorney General Merrick Garland and Federal Bureau of Investigation Director Christopher Wray.
Demanding an investigation by the U.S. Department of Justice (DOJ), the groups' letter emphasizes that the "significant gap" in Trump records corresponds to "a critical period when the Capitol was under attack by insurrectionists, raising the possibility that portions of the call logs were willfully destroyed to cover up evidence of criminal misconduct."
"As our previous letter outlines," the document reiterates, "former President Trump engaged in a pattern of conduct throughout his tenure in office that violated his record-keeping obligations under the Presidential Records Act in multiple ways."
"The time period during which there is a gap in the phone logs includes at least five calls from or to President Trump whose occurrence has been documented in the public record," the letter notes, pointing to his reported correspondence with then-Vice President Mike Pence, House Minority Leader Kevin McCarthy (R-Calif.), Rep. Jim Jordan (R-Ohio), then-Sen. Kelly Loeffler (R-Ga.), and Sen. Mike Lee (R-Utah)—who supposedly passed his phone to Sen. Tommy Tuberville (R-Ala.).
The letter also lays out key events between 11:06 am—when Trump finished a call with then-Sen. David Perdue (R-Ga.)—and 6:54 pm, when he had the White House operator contact an adviser who earlier this month was referred to the DOJ for not cooperating with the January 6 panel, Dan Scavino:
President Trump spoke to a gathering of his supporters near the White House beginning at noon that day, less than an hour after his call with Senator Perdue. One hour later an initial wave of protestors began storming the Capitol, and by 1:30 pm they had overcome the police. Nearly one hour later at 2:24 pm. President Trump tweeted his criticism of Vice President Pence for lacking "the courage to do what should have been done to protect our Country and our Constitution." At 3:36 pm White House Press Secretary Kayleigh McEnany tweeted that President Trump had ordered the National Guard to the Capitol. At 4:17 pm President Trump tweeted a video directed to his supporters inside the Capitol urging them to go home but also telling them "We love you. You're very special." Shortly after 6:00 pm police were able to clear the Capitol.
Trump's actions that day—including his furtherance of the "Big Lie" that the 2020 election was stolen from him—led to his historic second impeachment just days before President Joe Biden took office, though the U.S. Senate, then controlled by Republicans, declined to convict the GOP leader.
The new call for a DOJ probe into the call logs gap comes as members of the January 6 panel are reportedly weighing whether to refer Trump to the department for prosecution.

A federal judge on Monday struck down the Covid-19 mask mandate for public transportation imposed by the US Centers for Disease Control and Prevention (CDC).
US District Judge Kathryn Kimball Mizelle of the Middle District of Florida said the mask mandate exceeds the statutory authority of the CDC.
The mandate requiring face masks on airplanes, the subway, trains, buses and other forms of public transportation was recently extended by the CDC until May 3 amid a rise in coronavirus cases.
US airlines and a number of Republican lawmakers have called for an end to the mask mandate, which was issued by the CDC on February 3, 2021.
Mizelle, an appointee of former Republican president Donald Trump, issued her ruling in a lawsuit filed in July 2021 by a conservative non-profit organization called the Health Freedom Defense Fund.
The judge said the mask mandate "exceeded the CDC's statutory authority," and the health organization had "failed to adequately explain its decisions."
"Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the Court declares unlawful and vacates the Mask Mandate," she said.

But Greene knew the unsubtle insinuation of using violence against a political opponent would demand attention.

The 35-year-old Donald Trump appointee, previously rated “Not Qualified” by the American Bar Association, found that the PHSA does not allow for enforcement of the mask mandate because, after subjecting the the term to a textual analysis, masks are not instruments of sanitation.
“Put simply, sanitation as used in the PHSA could have referred to active measures to cleanse something or to preserve the cleanliness of something,” the opinion says–emphasis in original. “While the latter definition would appear to cover the Mask Mandate, the former definition would preclude it.”
Mizelle uses non-textual tools, which she identifies as “the statute’s context, including the surrounding words, the statute’s structure and history, and common usage at the time,” to move her textual analysis forward. In the process, she determines that “active cleaning” is what the federal law actually refers to when it references “sanitation.”
“Wearing a mask cleans nothing,” the judge says. “At most, it traps virus droplets. But it neither ‘sanitizes’ the person wearing the mask nor ‘sanitizes’ the conveyance. Because the CDC required mask wearing as a measure to keep something clean–explaining that it limits the spread of COVID-19 through prevention, but never contending that it actively destroys or removes–the Mask Mandate falls outside of [the PHSA].”
Mizelle goes on to conclude that sanitation is about what the CDC can do to objects while the agency’s authority over persons “is more closely related to a power discussed” in a section about “conditional release.” This power, the judge notes, is closely related to the agency’s authority to subject individuals “to detention and quarantine.”
“The Mandate requires a traveler to do something to have the privilege of passing a checkpoint and continuing on his journey,” she writes. “In other words, a person may travel ‘[s]ubject to or dependent on a condition–namely, that he wear a mask.”
“As a result, the Mask Mandate is best understood not as sanitation, but as an exercise of the CDC’s power to conditionally release individuals to travel despite concerns that they may spread a communicable disease (and to detain or partially quarantine those who refuse),” Mizelle says. “But the power to conditionally release and detain is ordinarily limited to individuals entering the United States from a foreign country.”
But here’s the rub in the opinion: the power to subject an individual to isolation, quarantine, or conditional release is in a different subsection than the one cited by the CDC in their mandate order. And, in any event, the judge says, the mandate is too broad because it extends to all people instead of just those “reasonably believed to be infected.”
Mizelle, a former clerk for Justice Clarence Thomas, also says the Biden administration violated the APA by improperly invoking the so-called “good cause” exception by instituting the mandate without the typical 30-day notice-and-comment period.
The CDC, the opinion notes, relied on a single, conclusory sentence about the need to make haste due to the “public health emergency caused by COVID-19” in order to dispense with that public input period. And, such a statement, Mizelle writes, “without more, is insufficient to establish good cause.”
Finally, the opinion determines that the rule also violated the APA by being arbitrary and capricious–a term of art in administrative law that relies on a complicated and often-changing Supreme Court test. In sum, the court found that, similar to the good cause determination, the CDC did not use enough “particularity” for a reviewing court to determine that the CDC did not abuse its discretion in issuing the mandate.
“Beyond the primary decision to impose a mask requirement, the Mask Mandate provides little or no explanation for the CDC’s choice,” Mizelle reasons. “Specifically, the CDC omits explanation for rejecting alternatives and for its system of exceptions. And there are many, such that the overall efficiency of masking on airplanes or other conveyances could reasonably be questioned.”
In response to the ruling, White House press secretary Jen Psaki said the decision was “obviously a disappointing” one.
Later on Monday, the Transportation Security Administration said the mandate would no longer be enforced, multiple media outlets reported.
“Today’s court decision means CDC’s public transportation masking order is not in effect at this time,” a TSA official said. “Therefore, TSA will not enforce its Security Directives and Emergency Amendment requiring mask use on public transportation and transportation hubs at this time.”

A federal judge cleared the way on Monday for a group of Georgia voters to move forward with legal efforts seeking to disqualify Representative Marjorie Taylor Greene from running for re-election to Congress, citing her role in the Jan. 6, 2021, attack on the Capitol.
The disqualification effort is based on a constitutional provision adopted after the Civil War that barred members of the Confederacy from holding office. It mirrors several other cases involving Republican members of Congress, whose roles leading up to and during the deadly riot have drawn intense criticism.
The judge, Amy Totenberg, who was appointed to the U.S. District Court for the Northern District of Georgia by President Barack Obama, denied Ms. Greene’s request for a preliminary injunction and temporary restraining order in the high-profile legal feud.
Ms. Greene, 47, who is known for her unflinching loyalty to former President Donald J. Trump and for her clashes with Democrats, has steadfastly denied that she aided and engaged in the attack on the Capitol.

Joe Biden was kept on a tight leash during Easter festivities at the White House over the weekend, with Jill Biden and even the Easter Bunny seen keeping him in line.
After Joe delivered remarks to the crowd from the White House on Sunday, Jill was heard telling Joe to wave to the crowd.

Biden was also restricted from reading to children during the kid-friendly Easter event, and instead tasked by Jill to hold up the book for her to read.

Elsewhere during the event, Joe was seen wandering off to talk to children in the crowd, prompting somebody in an Easter Bunny costume to intervene and direct Joe away from them to meander in a different direction.

A Trump-appointed Federal judge in Florida has voided a national mask mandate for airplanes and other transportation. “Wearing a mask cleans nothing,” U.S. District Judge Kathryn Kimball Mizelle wrote in her decision on Monday. “At most, it traps virus droplets. But it neither ‘sanitizes’ the person wearing the mask nor ‘sanitizes’ the conveyance.”
Mizelle, 35, was only eight years out of law school at University of Florida when Trump appointed her to the lifetime position in 2020. The Daily Beast noted at the time that her only trial experience was as an intern, and that she held four clerkships, including one for Supreme Court Justice Clarence Thomas. Mizelle was rated “not qualified” by the American Bar Association prior to her appointment, citing her lack of experience.

The conspiracy website Infowars has filed for bankruptcy protection as founder Alex Jones faces multiple defamation lawsuits tied to his false claims that the deadly shooting at Sandy Hook Elementary School was a “giant hoax.”
According to documents filed Sunday in U.S. Bankruptcy Court for the Southern District of Texas, three companies owned by Jones are seeking Chapter 11 protection, which would put civil litigation on hold while they restructure their finances.
Jones is being sued by the families of several victims of the 2012 attack that left 26 people dead, including 20 young children, in Newtown, in western Connecticut. It remains the deadliest elementary school shooting in U.S. history. The 20-year-old gunman died by suicide.
But Jones falsely claimed the massacre was fabricated by gun control advocates and the mainstream media, who he said pursued a “false flag” operation staged by “crisis actors.”

Given the state of our grocery shelves, southern border, gas prices, job openings, foreign policy, public schools, inflation, and health care, it would be awfully nice to know who’s really running the greatest country on earth.
The White House celebrated Easter on Sunday with its traditional egg roll, but the Resurrection Day festivities turned into a national embarrassment thanks to the president. His handlers, including his wife, did their best to walk him around like a pet, telling him when to sit, speak, and stay.
This all raises the obvious and alarming question: Who is in charge of the greatest country on Earth right now? Because it sure as heck isn’t Joe Biden.
If you haven’t seen any of the footage, you might think this is an exaggeration, but it isn’t. Here’s Jill Biden monopolizing a children’s book reading, with her husband announcing, “And they’re not going to let me read at all.”

A Federal Judge Refuses to Block Effort to Disqualify Marjorie Taylor Greene from Office Under 14th Amendment ‘Insurrection’ Prohibition

Donald Trump loyalist Rep. Marjorie Taylor Greene (R-Ga.) cannot block efforts to disqualify her from running for re-election on the grounds that she allegedly engaged in insurrection, a federal judge ruled.
The ruling does not itself stop Greene’s re-election campaign, but it means a federal court will not grant Greene’s lawyers request to end-run a challenge submitted to Georgia Secretary of State Brad Raffensperger (R) assessing that question. A challenge, brought by five Georgia voters, will now go before an administrative law judge in Atlanta on Friday.
“This case involves a whirlpool of colliding constitutional interests of public import,” U.S. District Judge Amy Totenberg, a Barack Obama appointee who is the sister of NPR legal correspondent Nina Totenberg, wrote in a 73-page opinion. “The novelty of the factual and historical posture of this case – especially when assessed in the context of a preliminary injunction motion reviewed on a fast track – has made resolution of the complex legal issues at stake here.”
Reaching a sharply different conclusion than a Trump-appointed judge did in early March, Totenberg found that the 1872 Amnesty Act passed by Congress during Reconstruction was never meant to protect future insurrectionists from being disqualified from public office. It only applied to the then-recent insurrection that was the Confederacy, she ruled.
That’s just “common sense,” the judge found.

DETROIT (AP) — An independent autopsy confirms that Patrick Lyoya was shot in the back of the head by a Michigan police officer while facedown on the ground, lawyers for the Black man’s family said Tuesday.
The finding by a former Detroit-area medical examiner matches what was seen last week on video released by the Grand Rapids police chief. The official autopsy report hasn’t been released to the public.
“There’s no question what killed this young man. ... It was a powerful bullet,” said Dr. Werner Spitz, holding a skull at a news conference to show where the bullet entered the head.
Spitz said he believes the gun was pressed against Lyoya’s head when the officer fired.
Lyoya was killed after a traffic stop in western Michigan on April 4. He and the white officer physically struggled on the ground before the 26-year-old refugee from Congo was shot.
Lyoya wasn’t armed. The officer was on top of him and can be heard on video demanding that he take his hand off a police Taser.
“We can confirm that Patrick Lyoya was shot in the back of his head,” attorney Ben Crump said. “That is now scientific evidence of this tragic killing and what his family believes was an execution.”
