DETROIT (AP) — A Michigan police officer charged with murder after shooting Patrick Lyoya in the back of the head has been fired, officials said Wednesday.
Christopher Schurr, a Grand Rapids officer for seven years, waived his right to a hearing and was dismissed, effective last Friday, said City Manager Mark Washington.
Schurr's dismissal was recommended by police Chief Eric Winstrom after a second-degree murder charge was filed Thursday.
Washington declined further comment, noting the criminal case and a likely lawsuit over Lyoya's death.
Lyoya, a Black man, was killed at the end of a traffic stop on April 4. He ran and physically resisted Schurr after failing to produce a driver's license.

Prominent conservative attorney George Conway was perplexed by why Republican Rep. Barry Loudermilk of Georgia won't clear his name after allegations from the House Select Committee Investigating the Jan. 6 Attack on the U.S. Capitol.
"The Jan. 6 Committee on Wednesday released new footage of a man who on Jan. 6 outside the Capitol made violent verbal threats against top Democratic lawmakers and who the day before had been taken on a tour of House office buildings by Rep. Barry Loudermilk," NBC News reported. "The man is heard in a video outside the Capitol threatening Democrats Speaker Nancy Pelosi, Senate Majority Leader Chuck Schumer, Judiciary Committee Chairman Jerrold Nadler and Rep. Alexandria Ocasio-Cortez."
CNN's Jake Tapper asked Conway for analysis.
"If there's nothing there, what's the problem? Why not talk to the January 6th committee?" Conway asked.

The relationship between former President Trump and former Vice President Mike Pence will take center stage at the Jan. 6 committee’s third hearing as it examines the “pressure campaign on Vice President Pence driven by the former president.”
“Tomorrow’s hearing is going to focus on former President Trump’s attempts to pressure former Vice President Pence to unilaterally change the results of the election in the joint session of Congress on Jan. 6,” a select committee aide told reporters.
“Even as advice was swirling around the White House saying that this scheme was illegal, it was totally baseless, the president nevertheless continued publicly to apply pressure on Mike Pence,” the aide added, something that “directly contributed to the attack on the Capitol. And it put the vice president’s life in danger.”
The committee has already shown video of a noose brought to the Capitol that day, and relayed that when Trump was informed about chants to ‘hang Mike Pence,” he reportedly responded, “maybe our supporters have the right idea.”
The committee has pledged to highlight not just the way Trump both privately and publicly put pressure on Pence to reject the election results, but also the fallout that occurred afterwards, something that has resulted in a fractured relationship as both have eyed runs in 2024.
In Thursday’s public hearing, the third by the Jan. 6 panel, viewers will hear from Greg Jacob, then senior counsel to Pence, as well as Michael Luttig, a former judge on the 4th Circuit Court of Appeals and conservative legal figure who was an informal adviser to Pence.
Clips of the committee’s deposition with Pence chief of staff Marc Short are also likely to be played.
Luttig wrote ahead of the attack that the vice president’s role in certifying the election is only “to faithfully count the electoral college votes as they have been cast.”
Both men will be questioned by Luttig’s former clerk, John Wood, a former U.S. attorney appointed by former President George W. Bush who now serves as senior investigative counsel for the committee. Rep. Pete Aguilar (D-Calif.) will also play an elevated role in the hearing.
Jacobs and Eastman would also go on to have a heated email exchange amid the riot at the Capitol, with Jacobs criticizing him for forwarding legal advice that “functioned as a serpent in the ear of the President of the United States.”
“Thanks to your bullshit we are now under siege,” Jacobs said at one point in the exchange.
Much of the hearing is likely to focus on Trump campaign attorney John Eastman, a conservative law professor who wrote two memos for the Trump campaign, including one that encouraged Pence to buck his ceremonial duty to certify the election results.
The committee’s battle with Eastman has already provided a win for the panel. The federal judge in the case denied Eastman’s attempt to shield some of his emails due to attorney-client privilege — a protection that can be invalidated by criminal activity.
The judge called Eastman’s advice “a coup in search of a legal theory.”
Through that battle, the committee has already detailed the extent that Eastman’s plans upset lawyers both for Pence specifically and White House counsel in general.
“He came in and said, ‘I’m here asking you to reject the electors.’ That’s how he opened at the meeting” on Jan. 5, Jacob said of Eastman, according to his deposition before investigators for the House select committee shared in court filings released in March.
Jacob recounts two meetings with Eastman, one on Jan. 4 and another on Jan. 5, where the Trump attorney outlined a number of scenarios, including having Pence declare Trump the winner or reject state electors as a way to kick the matter back to the states.
“I was surprised that we instead had a stark ask to just reject electors,” Jacobs said.
After the riot, White House staff were furious at Eastman.
“I said to him, ‘Are you out of your effing mind? Because I only want to hear two words coming out of your mouth from now on: ‘orderly transition,’” White House counsel Eric Herschmann said he told Eastman when he called Jan. 7.
Herschmann pushed the phrase until Eastman himself repeated it and then told him: “Now I’m going to give you the best free legal advice you’re ever getting in your life. Get a great effing criminal defense lawyer. You’re going to need it.”

The committee combined the man’s recordings with surveillance camera footage of him apparently taking pictures during the tour with Loudermilk in a YouTube video:

Jan. 6 victim Michael Fanone had harsh words on Wednesday for the Capitol Police Department.
Before Fanone spent two decades serving the DC Metropolitan Police Department, he worked for the Capitol Police Department.
CNN's Anderson Cooper asked Fanone about a letter sent by Capitol Police Chief Tom Manger that claims the department did not find anything suspicious about a pre-Jan.6 tour of the Capitol Complex led by GOP Rep. Barry Loudermilk of Georgia.
"Anderson, I read the letter that was signed by Chief Manger, and I found it incredibly irresponsible," Fanone said.
"To me, the letter reeked of outside pressure," he explained. "First of all, the U.S.Capitol Police is not the lead investigative agency with regards to the Capitol breach and the insurrection on Jan. 6th. The lead investigative agency is the FBI and Department of Justice, so at the very least the expectation would have been that they would defer any questions to the FBI and the Department of Justice. But they didn't do that, they chose to answer."
"When I went through it line by line, it looks to me like Chief Manger was engaging in a game of semantics," he said. "I mean, that absolutely is suspicious activity."

The House committee investigating the Jan. 6, 2021, attack on the Capitol has obtained email correspondence between Virginia “Ginni” Thomas, the wife of Supreme Court Justice Clarence Thomas, and lawyer John Eastman, who played a key role in efforts to pressure Vice President Mike Pence to block the certification of Joe Biden’s victory, according to three people involved in the committee’s investigation.
The emails show that Thomas’s efforts to overturn the election were more extensive than previously known, two of the people said. The three declined to provide details and spoke on the condition of anonymity to discuss sensitive matters.
The committee’s members and staffers are now discussing whether to spend time during their public hearings exploring Ginni Thomas’s role in the attempt to overturn the outcome of the 2020 election, the three people said. The Washington Post previously reported that the committee had not sought an interview with Thomas and was leaning against pursuing her cooperation with its investigation.
In the weeks after the 2020 election, Ginni Thomas repeatedly pressed Meadows to overturn the outcome, according to text messages obtained by The Post and CBS News. After Jan. 6, she told Meadows in a text that she was “disgusted” with Pence, who had refused to help block the certification of Biden’s electoral college victory. She wrote, “We are living through what feels like the end of America.”

The emails showed Eastman knew the plan rested on states certifying Trump slates. But when he presented a memo to Pence in January 2021 attesting to the existence of Trump slates - that did not actually exist - he revealed corrupt intent to obstruct proceedings on 6 January 2021, the panel believes.
No state legislatures ultimately certified an alternate slate of electors for Trump. The Trump White House appears to have participated in a related scheme to send fake Trump slates to Congress, though those were not introduced at the certification on the day of the attack.
But the select committee intends to reveal at the hearing that Pence’s counsel, Jacob, and others including Luttig, all informed the then-vice-president that even if the states had transmitted alternate slates of electors, the plan was unlawful from the start.
The Trump White House counsel separately told Trump that Eastman’s plan violated the law, Cassidy Hutchinson, a top former aide to White House chief of staff Mark Meadows, has also testified to the panel.
Yet Trump and Eastman proceeded with the plan anyway. At the Save America rally on 6 January 2021, Trump told his supporters that he hoped Pence would do the “right thing” and just refuse to certify Biden’s election win, knowing full well by then that it was unlawful.
The select committee is likely to show, finally, that Eastman himself knew the strategy was unlawful. In an email he sent to Jacob as the Trump mob stormed the Capitol, he admitted the scheme violated the law, but then he said Pence could surely violate the law a little more.
Eastman said in the email that because Biden’s certification had been temporarily interrupted by the Capitol attack, Congress had violated the law governing the process. So Pence should have no problem committing “one more minor violation and adjourn for 10 days”, he said.

'Tantamount to a revolution': Retired federal judge hammers Trump in statement before House testimony .
In a statement released to CNN hours before he is expected to testify before the House Select Committee investigating the Jan 6th insurrection, retired conservative federal judge Michael Luttig made clear he feels Donald Trump put the country at great risk by attempting to overturn the 2020 presidential election results.
Luttig advised former vice president Mike Pence to ignore the former president's entreaties to throw out votes and ask states to reconsider their own election results which, in turn, infuriated supporters of Trump who chanted "Hang Mike Pence" as they stormed the Capitol building.

In his statement, obtained by CNN, Luttig wrote, “It is breathtaking that these arguments even were conceived, let alone entertained by the President of the United States at that perilous moment in history. Had the Vice President of the United States obeyed the President of the United States, America would immediately have been plunged into what would have been tantamount to a revolution within a paralyzing constitutional crisis.”
He added, "This false and reckless insistence that the former president won the 2020 presidential election has laid waste to Americans’ confidence in their national elections. More alarming still is that the former president pledges that his reelection will not be ‘stolen’ from him next time around, and his Republican Party allies and supporters obeisantly pledge the same.”
According to CNN he also defended the work being done by the bi-partisan select committee, writing, "No American ought to turn away from January 6, 2021 until all of America comes to grips with what befell our country that day, and we decide what we want for our democracy from this day, forward.”
