Because solar panels are definitely a matter of national security?

Biden Invokes Defense Production Act for Solar Panel Production, Waives Tariffs
Legal Insurrection calls it an abuse of power. I would say it is an abuse of brainpower. Even if somehow you could justify that solar panels are any sort of national emergency, you certainly cannot make them part of the defense production act.

Joe Biden might be corrupt and willing to abuse power, but I have a feeling in this case he is just being dumb... which is to say that he is just being himself.

"A strong majority of Americans believe the U.S. economy is experiencing a recession, a poll from the Economist and YouGov showed.

The results indicate that fifty-five percent of respondents say the U.S. economy is in recession now. Just 21 percent say the economy is not in a recession, and 24 percent say they are not sure.."

The solar industry cheered the move.

"The president's action is a much-needed reprieve from this industry-crushing probe," said Abigail Ross Hopper, the president and chief executive officer of the Solar Energy Industries Association.

Last month, Hopper had voiced concerns to NPR that the ongoing tariff investigation was "wiping out a decade of solar job growth."

The White House is framing the import window as a "bridge" to a period where domestic solar manufacturing is much more robust.

The U.S. solar industry has grown exponentially in recent years, but is nowhere near the pace needed to reach Biden's goal of a net carbon-neutral energy sector in the next 13 years.

In an effort to speed up that growth even more, Biden is also invoking the Defense Production Act to help expand American solar panel manufacturing, as well as other clean energy technology like building insulation, efficient heat pumps for buildings, equipment for fuel cells and power grid infrastructure like transformers. The president is also directing the federal government to increase the amount of U.S.-made solar panels and clean technology products it buys, as well.

The Robert T. Stafford Disaster Relief and Emergency Assistance Act (Stafford Act)[1] is a 1988 United States federal law designed to bring an orderly and systematic means of federal natural disaster assistance for state and local governments in carrying out their responsibilities to aid citizens. Congress' intention was to encourage states and localities to develop comprehensive disaster preparedness plans, prepare for better intergovernmental coordination in the face of a disaster, encourage the use of insurance coverage, and provide federal assistance programs for losses due to a disaster.[2]

Biden also has no justification to invoke the Defense Production Act: “The Defense Production Act is the primary source of presidential authorities to expedite and expand the supply of materials and services from the U.S. industrial base needed to promote the national defense .DPA authorities are available to support: emergency preparedness activities conducted pursuant to title VI of the Stafford Act; protection or restoration of critical infrastructure; and efforts to prevent, reduce vulnerability to, minimize damage from, and recover from acts of terrorism within the United States.”

Defense Production Act

The Defense Production Act of 1950 is a United States federal law enacted on September 8, 1950 in response to the start of the Korean War. It was part of a broad civil defense and war mobilization effort in the context of the Cold War. Its implementing regulations, the Defense Priorities and Allocation System. Since 1950, the Act has been reauthorized over 50 times. It has been periodically amended and remains in force.

Why are you babbling on about the Stafford Act??

He is not abusing his executive order authority under the Constitution.

Coldheartedtruth Teller said...

Presidents Donald Trump and Joe Biden both invoked the Defense Production Act (DPA) in response to the COVID-19 pandemic. The Cold War–era law gives the president significant emergency authority to control domestic industries. Trump used the law to crack down on hoarding, limit exports of medical goods, and increase production of critical supplies. Biden has used it to speed up vaccination and testing efforts.

What are the origins of the Defense Production Act?

Passed in September 1950 at the start of the Korean War, the DPA was modeled on the War Powers Acts of 1941 and 1942, which gave President Franklin D. Roosevelt sweeping authority [PDF] to control the domestic economy during World War II. The original DPA gave the president a broad set of powers, including the ability to set wages and prices, as well as ration consumer goods, though not all of these powers have been renewed. The law has been continually reauthorized by Congress, most recently in the John S. McCain National Defense Authorization Act of 2019. It is set to expire in 2025.

What does it do?

The current version of the law still gives the executive branch substantial powers. It allows the president, largely through executive order, to direct private companies to prioritize orders from the federal government. The president is also empowered to “allocate materials, services, and facilities” for national defense purposes, and take actions to restrict hoarding of needed supplies. To bolster domestic production, the president may also offer loans or loan guarantees to companies, subject to an appropriation by Congress; make purchases or purchase commitments; and install equipment in government or private factories. Companies can also be authorized to coordinate with each other, which might otherwise violate antitrust laws.

They didn't say it was an abuse of power when Trump was the President

They said
President Joe Biden invoked the Defense Production Act to boost the production of solar panels in America because out of everything citizens need that is obviously the most in-demand.

But Biden also waived tariffs for two years for four Southwest Asian countries: Cambodia, Malaysia, Thailand, and Vietnam. These countries make up 80% of America’s solar-panel imports.

Oh, how I love it when the government picks winners and losers. It always turns out so well, especially solar panels!

Let’s not forget President Barack Obama’s genius idea with Solyndra.

Yes, Biden does something similar to Obama…again.

Biden also has no justification to invoke the Defense Production Act: “The Defense Production Act is the primary source of presidential authorities to expedite and expand the supply of materials and services from the U.S. industrial base needed to promote the national defense. DPA authorities are available to support: emergency preparedness activities conducted pursuant to title VI of the Stafford Act; protection or restoration of critical infrastructure; and efforts to prevent, reduce vulnerability to, minimize damage from, and recover from acts of terrorism within the United States.”

Biden’s explanation for using the DPA does not match the criteria:

Specifically, the President is authorizing the Department of Energy to use the DPA to rapidly expand American manufacturing of five critical clean energy technologies:

Solar panel parts like photovoltaic modules and module components;Building insulation;Heat pumps, which heat and cool buildings super efficiently;Equipment for making and using clean electricity-generated fuels, including electrolyzers, fuel cells, and related platinum group metals; andCritical power grid infrastructure like transformers.

In deploying the DPA, the Biden-Harris Administration will strongly encourage the use of strong labor standards, including project labor agreements and community benefits agreements that offer wages at or above the prevailing rate and include local hire provisions. The Administration also will strongly encourage projects with environmental justice outcomes that empower the clean energy transition in low-income communities historically overburdened by legacy pollution.

Following this announcement, the White House and the Department of Energy will convene relevant industry, labor, environmental justice, and other key stakeholders as we maximize the impact of the DPA tools made available by President Biden’s actions and strengthen domestic clean energy manufacturing.

Even Press Secretary Karine Jean-Pierre could not explain why Biden invoked the DPA. Could it be because there is no valid reason to invoke it for this matter?

Emails reveal that fake Trump electors in Georgia were told not to tell anyone what they were doing

Sarah K. Burris

June 06, 2022

There were several states that attempted to replace the electors chosen by voters in the 2020 election. It was part of a plot by former President Donald Trump's campaign and legal team to somehow overthrow the election simply by having supporters push their way into the rooms where the electors were.

States like Arizona, Michigan, Wisconsin, New Mexico, Nevada, Pennsylvania and Georgia were all working to beat back against Democratic electors and stop Trump from being thrown out of the White House.

The Washington Post revealed that little-known fake Georgia electors were revealed in a series of emails that have now been made public. A staffer from the Trump campaign told Republicans on Dec. 13, 2020, that if they intend to overthrow the election count they must do so in "complete secrecy."

“I must ask for your complete discretion in this process,” wrote Robert Sinners, (his real name) who served as the Trump campaign’s election operations director in Georgia. The note came the day before the electors were scheduled to meet at the Georgia Capitol to certify the election results

Coldheartedtruth Teller said...

The House select committee investigating the Jan. 6, 2021, attack on the U.S. Capitol, which begins public hearings on Thursday, is likely to highlight the scheme to appoint fake electors and explore whether top Trump campaign officials initiated the strategy as part of a larger effort to overturn the democratic election.

Coldheartedtruth Teller said...

The Trump campaign directed a group of Georgia Republicans to meet in secret and obscure their objectives in an email obtained by federal prosecutors as part of their recent investigation into Donald Trump’s efforts to overturn the election in several swing states,” CNN reports.

“The email is part of the intensifying Justice Department investigation focused on the Trump campaign’s interactions with so-called alternate Republican electors in states Trump lost and whether a scheme to organize them could be charged as a crime.”

“On June 9, the Jan. 6 House Select Committee will hold public hearings as part of their ongoing investigation into the storming of the Capitol last year. In short order, the set of six scheduled televised sessions this month are likely to build momentum towards making the case that the president was directly involved in attempts to undermine the peaceful transition of power.”

“The steady dropping of shocking findings from the committee over the course of the past months suggests the sessions will likely have many viewers on the edge of their seats,” Aftergut added, and then suggested that the Pence associates could set Trump’s defenders back on their heels as they reveal the content of conversations between the former president and their former boss as Trump tried to get him to refuse to oversee the certification of the 2020 presidential election

Coldheartedtruth Teller said...

“June’s hearings follow a series of escalations in Trump’s ongoing legal battles stemming from his attempts to undermine the 2020 election,” he writes. “May’s legal developments and the looming hearings suggest increasing pressures and prospects that Trump will face criminal charges, the committee’s lead-off witnesses will be three courageous Republicans working for Vice President Mike Pence, who supported his resistance to the multi-step conspiracy that Trump appears to have led and aimed at ending the lawful transfer of power: His staff attorney, Greg Jacob, Pence’s outside attorney, Michael Luttig, the eminent former federal Court of Appeals Judge, and Marc Short, Pence’s chief of staff.”

Coldheartedtruth Teller said...

While the final details are still being sorted, the upcoming hearings have two apparent goals. First, committee members intend to address Trump’s election meddling. And second, to elucidate the circumstances around the ‘hours of inaction‘ before Capitol police received backup from the national guard releasing a video telling his followers inside the Capitol to leave,” he wrote adding, “If the details coming out of the investigation are any indication, the committee is hard at work building their case.”

“If May’s news was any indication, this select committee’s hearings will tell an even more chilling story — beginning, middle and end — about how a criminal conspiracy nearly ended our democracy,” he concluded.

Coldheartedtruth Teller said...

Rep. Jamie Raskin (D-Md.) on Monday said the House select committee investigating the Jan. 6, 2021, attack on the Capitol has found evidence on former President Trump that supports “a lot more than incitement.”

The comment from Raskin, a member of the Jan. 6 panel, referenced Trump’s second impeachment in January 2021, when the House voted to impeach the then-president for incitement to insurrection.

The Jan. 6 panel is set to hold its first public hearing on Thursday, where Raskin said the committee will lay out information regarding individuals who played a role in the attack — including Trump.

“The select committee has found evidence about a lot more than incitement here, and we’re gonna be laying out the evidence about all of the actors who were pivotal to what took place on Jan. 6,” Raskin said during an interview with Washington Post Live.

Coldheartedtruth Teller said...

The idea of former President Trump and his allies potentially engaging in a “conspiracy” has come up in legal proceedings related to Jan. 6.

In March, U.S. District Judge David Carter wrote in a decision that Trump and his legal adviser John Eastman “more likely than not” committed multiple federal crimes when carrying out efforts to stop Congress from certifying President Biden’s 2020 election win.

The House select committee investigating the Capitol attack will unveil new evidence at Watergate-style public hearings this week showing Donald Trump and top aides acted with corrupt intent to stop Joe Biden’s certification, according to sources close to the inquiry.

The panel intends to use the hearings as its principal method of revealing potential crimes by Trump as he sought to overturn the 2020 election results, the sources said, in what could be a treacherous legal and political moment for the former president.

Fake Trump electors in Ga. told to shroud plans in ‘secrecy,’ email shows

The message informed those involved in the plan that they were not allowed to disclose their intentions, even to State Capitol security

A staffer for Donald Trump’s presidential campaign instructed Republicans planning to cast electoral college votes for Trump in Georgia despite Joe Biden’s victory to operate in “complete secrecy,” an email obtained by The Washington Post shows.

“I must ask for your complete discretion in this process,” wrote Robert Sinners, the campaign’s election operations director for Georgia, the day before the 16 Republicans gathered at the Georgia Capitol to sign certificates declaring themselves duly elected. “Your duties are imperative to ensure the end result — a win in Georgia for President Trump — but will be hampered unless we have complete secrecy and discretion.”

The Dec. 13, 2020, email went on to instruct the electors to tell security guards at the building that they had an appointment with one of two state senators. “Please, at no point should you mention anything to do with Presidential Electors or speak to the media,” Sinners continued in bold.

The admonishments suggest that those who carried out the fake elector plan were concerned that, had the gathering become public before Republicans could follow through on casting their votes, the effort could have been disrupted. Georgia law requires that electors fulfill their duties at the State Capitol. On Dec. 14, 2020, protesters for and against the two presidential candidates had gathered on the Capitol grounds.

The goal is to provide the public with a more in-depth portrait of what unfolded on Jan. 6 than the images that played out on television that day, and to reveal the extent of what the panel called a “coordinated, multistep effort to overturn the results of the 2020 presidential election and prevent the transfer of power.”

Norman L. Eisen, who was hired by the Judiciary Committee to serve as special counsel during the first Trump impeachment, said Democrats had learned from some of their successes and misfires during those hearings, but still faced challenges.

“They need to have three things: the attention-grabbing power of new evidence, the spontaneous drama created by live witnesses and the oldest trick in the book: telling a good story,” Mr. Eisen said. “The risk is, there’s an enormous amount of anticipation and buildup.”

John Dean has also been called upon by the media and Congress to provide expert analysis during scandals in the Clinton and Trump administrations. Now a grandfather living in Beverly Hills, California, he quips: “My speciality, I guess, is presidents in deep trouble.”

But if something like Watergate happened in the 2020s, he does not believe it would necessarily bring down a president again. “It would be very different today, primarily because of Fox News, which would be mounting a fulsome defence of him. We are far more polarised today than we were. We were polarised during Watergate but not to the degree we are today.”

Dean will be watching this week’s January 6 hearings on Capitol Hill intently but reckons that Republicans, at least, face less accountability than they once did. “Trump is a poster boy for authoritarianism and the authoritarian followers just fell in line. They just absolutely did what authoritarian followers do: click their heels, salute, ‘Yes sir!’”

That leaves him fearing for the future of American democracy. “Not so much Trump but now the whole Republican party has shifted into this authoritarian stance. Not all the Republicans I know are that way but too many of them now think authoritarianism is just dandy because it works, it’s efficient. Well, Mussolini ran the trains on time, didn’t he – but at some expense.”

Rep. Steve Cohen (D-Tenn.) on Tuesday said the House Jan. 6 select committee’s first hearing will show how much former President Trump was involved with the events that led to the Capitol riot.

“We’re going to see how much Trump was involved. Trump ran this show. He ran it from the time he lost the election in November and he did it with his son, or sons, and all of his henchmen up there,” Cohen said during an interview with CNN.

The Tennessee Democrat’s comments come two days before the House select committee investigating the Jan. 6, 2021, attack on the Capitol is scheduled to hold its first public hearing after nearly a year of digging into the events that led to the deadly attack.

The televised hearing, which is scheduled to begin at 8 p.m., has promised to feature previously unseen material documenting the riot, in addition to witness testimony.

The panel has conducted more than 1,000 interviews and obtained upward of 125,000 documents throughout its probe.

Cohen on Tuesday said he is looking for new evidence in the hearing that shows “involvement of Republican legislators that denied that they met with President Trump on Jan. 6 and soon before.”

“But we have proof through Mark Meadows’s emails and other evidence that they did in fact meet and that they worked with them,” he said, referring to messages from Trump’s then-White House chief of staff.

“And there were several legislators who have denied being involved, but they are involved and it went to the highest powers. They were all close to Meadows, they all encouraged Meadows, I think we’re going to see that,” he added.

Trump met with a group of GOP lawmakers prior to the Capitol riot, including Reps. Mo Brooks (R-Ala.), according to Politico. The Jan. 6 committee issued Rep. Andy Biggs (R-Ariz.) a subpoena last month, and the congressman is now requesting “additional information concerning the rationale” for the request.

Cohen argued to CNN that Meadows and Trump’s allies “were willing to have [Vice President] Mike Pence hung and thought that would have been a good thing.”

He pointed to the gallows that were brought near the Capitol on Jan. 6 and chants of “hang Mike Pence.”

“Nobody knows yet who brought that gallows or constructed that gallows on the Capitol grounds, but that was done with the purpose to intimidate, to instill fear and possibly, I think, to be used,” the congressman said

I would put it to all of you that there are more mass shooters, and they are on duty seven days a week, in places like Detroit, Cleveland, Baltimore, Newark, Chicago, Atlanta, Oakland than anywhere else. We just don't hear about them, because the victims -- typically people who look exactly like their killers -- are not interesting enough, and because their bodies don't have the same political impact or uses.
